HomeMy WebLinkAbout03-26-1990 Adopted CC MinutesREGULAR MEETING - March 26, 1990 A regular meeting of the City Council of the City of Dublin was held on Monday, March 26, 1990, in the Council Chambers of the Dublin Civic Center. The meeting was called to order at 7:34. p.m., by Mayor Paul Moffatt. ROLL CALL PRESENT: Councilmembers Hegarty, Jeffery, Snyder, Vonheeder and Mayor Moffatt. PLEDGE OF ALLEGIANCE The Mayor led the Council, Staff and those present in the pledge of allegiance to the flag. PROCLAMATION HONORING ALICE PITCHFORD Mayor Moffatt read and presented a proclamation to Alice Pitchford for her many years of community service. Alice and her husband, Norm, are retiring and will be moving to Olympia, Washington. PRESENTATION OF ORGANIZATION OF THE YEAR AWARD TO SOROPTIMISTS Vice Mayor Vonheeder advised that Soroptimists International of Dublin has been selected as recipient of the Organization of the Year award for 1989. An engraved placque was presented to Kim Woods. PRESENTATION OF CITIZEN OF THE YEAR AWARD TO KAREN SEALS Vice Mayor Vonheeder presented the Citizen of the Year award to Karen Seals, who has been very active on the Dublin Substance Abuse Council and almost single handedly organized past Dublin Red Ribbon Week actiVities. PROCLAMATION REGARDING EARTHQUAKE PREPAREDNESS MONTH Mayor Moffatt advised that April, 1990, has been declared as California Earthquake Preparedness Month and encouraged all citizens to. enhance their knowledge and awareness of proper safety measures to follow before, during, and after an earthquake. @*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@* CM - VOL 9 - 61 Regular Meeting March 26, 1990 CLOSED SESSION At 7:47 p.m., Mayor Moffatt announced that the Council would recess to a closed executive session in accordance with Government Code Section 54956.9(a). The title of the litigation was not stated because to do so would jeopardize the City's ability to conclude exiSting settlement negotiations to its advantage. PUBLIC MEETING RECONVENED At 9:10 p.m., the public meeting was reconvened, with all Council- members present. CONSENT CALENDAR On motion of Cm. Jeffery, seconded by Cm. Vonheeder, and by unanimous vote, the Council took the following actions: Approved Minutes of Regular Meeting of March 12, 1990 Adopted RESOLUTION NO. 26 - 90 DECLARING MARCH 25-31, 1990 AS "CENSUS AWARENESS WEEK" Granted a request to waive fees for use of the Dublin Sports Grounds fields for Challenger Division (handicapped youth) of Dublin Little League Adopted RESOLUTION NO. 27 - 90 APPROVING THE APPLICATION FOR GRANT FUNDS FOR THE LUCKY/A'S YOUTH BASEBALL FIELDS PROGRAM Authorized Staff to enter into a contract agreement with Singer & Hodges, Inc., for Landscape Architectural Services for the Frederiksen School kindergarten tot lot at a cost not to exceed $5,300; authorized an additional appropriation from the unallocated reserves in the amount of $4,400 to cover the cost of design and construction documents; and directed Staff to negotiate a development agreement with the Dublin Unified School District for the project Adopted RESOLUTION NO. 28 - 90 AWARDING CONTRACT 90-03 ANNUAL SIDEWALK REPAIR/HANDICAP RAMP CONSTRUCTION PROGRAM TO B & B CONCRETE CONSTRUCTION ($107,731.85) @*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@* CM - VOL 9 - 62 Regular Meeting March 26, 1990 and authorized the Mayor to execute the agreement; authorized a budget transfer in the amount of $2,200 from the Sidewalk Repair Capital Improvement Project (CIP) to the Dublin Boulevard Sidewalk @ Clark Avenue CIP; and created a new CIP for the previously unbudgeted Civic Center Service Entrance and authorized a budget transfer in the amount of $18,000 from the Annual Overlay Project Adopted RESOLUTION NO. 29 - 90 AWARDING CONTRACT 90-02 ALAMO CREEK PARK PHASE II TO R.M.T. LANDSCAPE ($271,356.91) and authorized the Mayor to execute the agreement; authorized budget transfers of a) $38,000 from the Underground Utilities - Dougherty Road project; b) $10,000 from the Traffic Signal Pre-Emption project; c) $10,000 from the Traffic Signals - Village Parkway/Brighton Drive and Village Parkway/Tamarack Drive project; d) $17,000 from the 1-580/ 1-680 Ramp Widening project; and e) an additional appropriation of $26,285 from Unallocated Reserves Adopted RESOLUTION NO. 30 - 90 ACCEPTANCE OF FINAL MAP FOR TRACT 6258 (PARK WOOD CIRCLE VILLAGE III) RAFANELLI & NAHAS Denied a protest from. Bay cities Paving and rejected bid submitted by Bay Cities Paving and adopted RESOLUTION NO. 31 - 90 AWARDING CONTRACT 90-04 ANNUAL STREET OVERLAY/REPAIR PROGRAM TO GRANITE CONSTRUCTION, INC. ($419,674) and authorized the Mayor to execute the agreement Accepted improvements under Contract 88-7 (San Ramon Road Phase III Street Reconstruction, Widening, Traffic Signals, Bike Path, and Landscaping); authorized release of securities and retention payment to Gallagher and Burk ($48,168.22); and authorized a transfer of $94,497.84 from Unallocated Reserves Approved Warrant Register in the amount of $699,332.11 Adopted RESOLUTION NO. 32 - 90 DECLARING INTENTION TO ISSUE BONDS FOR THE PURPOSE OF PROVIDING FINANCING FOR CERTAIN PUBLIC STREET IMPROVEMENTS @*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@* CM - VOL 9 - 63 Regular Meeting March 26, 1990 FIRST WESTERN DEVELOPMENT PD, PLANNED DEVELOPMENT REZONING PA 89-050 Planning Director Tong advised that in accordance with City Council direction at the public hearing on March 12, 1990, Staff revised the draft general provisions for the Planned Development Rezoning general provision 9-C-4, to allow wall signage on the east building elevation subject to a Conditional Use Permit. The revised provision would read: "4. The east building elevation may be considered a Secondary Building Frontage for City Sign Ordinance purposes if a Conditional Use Permit is granted. In order to grant a CUP for signage on the east building elevation, the decision making body must find, based upon facts in the record, that: a) The color, size, shape, lighting intensity, and other physical design character- istics of the signage will not have any adverse effect on traffic safety conditions and safe traffic operations on 1-680; b) The signage will be proportionate with human scale as visible to traveler on 1-680; and c) The signage meets all other applicable provisions of the City Sign Ordinance with the exception that the projection of the east building elevation need not be in a roadway or public open space area such as a private street, an open plaza or square, or an auto parking area, per Section 8-87.10(s)." Cm. Snyder asked Mr. Hess how many businesses they anticipate will wind up in this building. ~ Mr. Hess responded that there will be Kuppenheimer's, plus the possibility of 2 or 3 other tenants. On motion of Cm. Jeffery, seconded by Cm. Vonheeder, and by unanimous vote, the Council adopted RESOLUTION NO. 33 - 90 ADOPTING A NEGATIVE DECLARATION OF ENVIRONMENTAL SIGNIFICANCE CONCERNING PA 89-050 FIRST WESTERN DEVELOPMENT REZONING APPLICATION and RESOLUTION NO. 34 - 90 ESTABLISHING FINDINGS AND GENERAL PROVISIONS FOR A PD, PLANNED DEVELOPMENT DISTRICT REZONING FOR PA 89-050 FIRST WESTERN DEVELOPMENT and RESOLUTION NO. 35 - 90 IMPOSING A TRAFFIC IMPACT FEE ON PA 89-050 FIRST WESTERN DEVELOPMENT @*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@*@* CM - VOL 9 - 64 Regular Meeting March 26, 1990 and waived the reading and INTRODUCED an Ordinance amending the Zoning Ordinance to permit the rezoning of real property located at the southeast corner of Amador Valley Boulevard and Amador Plaza Road, 7450 Amador Valley Boulevard, and continued the item to the April 9, 1990 Council meeting for a second reading and adoption of the Ordinance. OTHER BUSINESS Goals & Objectives Meetinq, Location Change Mayor Moffatt announced that the City Council would hold its annual Goals & Objectives meeting the following night, March 27, 1990. The meeting location has been changed from the Civic Center to the West Room of Shannon Community Center, and will begin at 6:30 p.m. West Dublin Study Area Meeting Cancelled Mayor Moffatt announced, that the special joint City Council/Planning Commission meeting scheduled for Monday, April 2, 1990 to discuss land use alternatives for the West Dublin Study Area has been cancelled. A new date will be scheduled.
