A full video recording of the meeting with the agenda items indexed and time stamped is available on the City’s website at: https://dublin.ca.gov/ccmeetings A regular meeting of the Dublin City Council Regular Meeting was held on Tuesday, November 16, 2021, in the City Council Chamber. The meeting was called to order at 7:00PM., by Mayor Hernandez. Mayor Hernandez announced that the meeting is being conducted pursuant to California Government Code Section 54953(b) concerning teleconferencing of meetings and Vice Mayor Kumagai was participating via Zoom from the teleconference location at the Sheraton Maui. In accordance with the Ralph M. Brown Act, this location was identified in the notice and agenda for this meeting. All votes during the meeting were conducted by roll call vote. 1) CALL TO ORDER Attendee Name Status Melissa Hernandez, Mayor Present Shawn Kumagai, Vice Mayor Present (via Teleconference) Jean Josey, Councilmember Present Michael McCorriston, Councilmember Present Dr. Sherry Hu, Councilmember Present 2) PLEDGE OF ALLEGIANCE 3) ORAL COMMUNICATIONS 3.1) Employee Introduction The City Council welcomed the new Dublin Staff member, Freshta Pirzada, Plans Examiner with the Community Development Department. 3.2) Presentation from Three Valleys Community Foundation The City Council received a presentation from Three Valleys Community Foundation. Three Valleys Community Foundation is requesting $50,000 in DUBLIN CITY COUNCIL MINUTES REGULAR MEETING NOVEMBER 16, 2021 funding over three years to bring a geographically based community foundation to the Tri-Valley. By consensus, the City Council directed Staff to move forward with preparing a funding agreement to bring back as a Consent item at a future meeting and a program framework to present to the City Council. 3.3) Public Comment Mahathi Vurimi provided public comment. Julia Paulasa provided public comment. 4) CONSENT CALENDAR 4.1) Approved the November 2, 2021 Special City Council Meeting and Regular City Council Meeting Minutes. 4.2) Approved the proclamation and named December as Impaired Driving Prevention Month in the City of Dublin. 4.3) Adopted Resolution No. 126-21 titled, “Approving an Agreement with TireHub for On-Call Vehicle Maintenance and Repair Services.” 4.4) Received the Payment Issuance Report and Electronic Funds Transfers listing of payments issued from October 1, 2021 - October 31, 2021 totaling $6,149,409.45. 4.5) Adopted Resolution No. 127-21 titled, “Approving Amendment No. 2 to the Streetlight License Agreement Between the City of Dublin and Pacific Gas and Electric Company for the SmartMeter Program.” 4.6) Adopted Resolution No. 128-21 titled, “Authorizing the City Manager to Approve Contract Change Orders with Saboo, Inc. for the Information Technology Infrastructure Improvements in Association with the Dublin Heritage Park Cemetery Improvements Project, CIP No. PK0215,” and approved the budget change. 4.7) Received the Fiscal Year 2021-22 1st Quarter Financial Review and Approved the Budget Change. 4.8) Received the City Treasurer's Informational Report of Investments for the Quarter Ending September 30, 2021. DUBLIN CITY COUNCIL MINUTES REGULAR MEETING NOVEMBER 16, 2021 4.9) Adopted Resolution No. 129-21 titled, “Authorizing the Purchase of Four Vehicles from the Ford Store San Leandro and Declaring Replaced Vehicles as Surplus Property.” 4.10) Adopted Resolution No. 130-21 titled, “Amending and Restating the Rules for the Conduct of Meetings of the City Council,” and waived the reading and introduced the Ordinance Amending Chapter 2.12 (Planning Commission) of the Dublin Municipal Code to Allow Up to Two Commissioners to Participate via Remote Attendance and Allow Video Attendance Remotely. On motion by Councilmember Josey, seconded by Councilmember McCorriston, and by unanimous vote the City Council adopted the Consent Calendar items. RESULT: ADOPTED [UNANIMOUS] MOVED BY: Jean Josey, Councilmember SECOND: Michael McCorriston, Councilmember AYES: Hernandez, Kumagai, Josey, McCorriston, Hu 5) WRITTEN COMMUNICATION – None. 6) PUBLIC HEARING 6.1) Ordinance Opting in to the Alameda County Waste Management Authority Organics Reduction and Recycling Ordinance and Amending Municipal Code Chapter 5.32 The City Council received a presentation regarding the Alameda County Waste Management Authority Organics Reduction and Recycling Ordinance (ORRO) and proposed amendments to Municipal Code Chapter 5.32 to conform with the ORRO. Mayor Hernandez opened the public hearing. Upon receiving no public comment, Mayor Hernandez closed the public hearing. On motion by Councilmember Josey, seconded by Councilmember Hu, and by unanimous vote, the City Council waived the reading and INTRODUCED the Ordinance Opting in to the Alameda County Waste Management Authority Organics Reduction and Recycling Ordinance and Amending Chapter 5.32 of the Dublin Municipal Code. DUBLIN CITY COUNCIL MINUTES REGULAR MEETING NOVEMBER 16, 2021 RESULT: APPROVED [UNANIMOUS] MOVED BY: Jean Josey, Councilmember SECOND: Sherry Hu, Councilmember AYES: Hernandez, Kumagai, Josey, McCorriston, Hu 7) UNFINISHED BUSINESS – None. 8) NEW BUSINESS 8.1) Proposal to Acquire Sofi Apartments - California Statewide Communities Development Authority City Attorney John Bakker announced he has recused himself from CSCDA matters and Bryan Wenter, Miller Starr Regalia, sat at the dais as legal counsel on this item. The City Council received a presentation from California Statewide Communities Development Authority (CSCDA) and Opportunity Housing Group regarding a proposal to convert the Sofi Apartments (176 market-rate units at 7100 San Ramon Road) to low-, middle-, and moderate-income rental housing under the CSCDA Workforce Housing Program. Nicole Massache provided public comment. Daniela Massache provided public comment. Edgard Martinez provided public comment. Maribeth Wilson provided public comment. Barbara Dymek provided public comment. Claudia McCormick provided public comment. By consensus, the City Council directed Staff to not proceed at this time with the current transaction or engage in conversations with other entities about affordable housing projects until after the City Council meets on February 5, 2022 to review the affordable housing strategy and provide Staff with a clearer direction. Mayor Hernandez called for a three-minute recess at 10:12 pm. Mayor Hernandez reconvened the meeting at 10:16 p.m. DUBLIN CITY COUNCIL MINUTES REGULAR MEETING NOVEMBER 16, 2021 City Attorney John Bakker returned to the dais. 9) OTHER BUSINESS The City Council and Staff provided brief information-only reports, including committee reports and reports by City Council related to meetings attended at City expense (AB1234). Mayor Hernandez announced that Vice Mayor Kumagai lost internet connection and left the meeting at 10:28 p.m. Mayor Hernandez called for a moment of silence in memory of Supervisor Wilma Chan. 10) ADJOURNMENT Mayor Hernandez adjourned the meeting at 10:33 p.m. Mayor ATTEST: City Clerk
