EXECUTIVE SUMMARY:At its October 19, 2021 Special Meeting, the City Council directed Staff to prepare a resolution amending the Rules for the Conduct of Meetings of the City Council and to update the teleconference section in Chapter 2.12 of the Municipal Code relating to the Planning Commission.The first reading of this Ordinance was held at the November 16, 2021 Regular City Council Meeting.
STAFF RECOMMENDATION:Waive the second reading and adopt the Ordinance Amending Chapter 2.12 (Planning Commission) of the Dublin Municipal Code to Allow Up to Two Commissioners to Participate via Remote Attendance and Allow Video Attendance Remotely.
FINANCIAL IMPACT:None.
DESCRIPTION:At its October 19, 2021 Special Meeting, the City Council discussed the Rules for the Conduct of Meetings of the City Council and directed Staff to update the teleconferencing rules for the City Council and Planning Commission. The draft ordinance will make the following changes to Chapter 2.12 (Planning Commission) of the Dublin Municipal Code:Chapter 2.12 (Planning Commission) of the Dublin Municipal CodeThe current Dublin Municipal Code allows only one member of the Planning Commission to participate via teleconferencing and only audio teleconferencing is allowed. The Ordinance will amend Section 2.12.020 (D) to allow up to two Commissioners to participate remotely and allow

video remote participation. On November 16, 2021, the City Council waived the first reading and introduced the Ordinance. The City Council is being asked to waive the second reading and adopt the Ordinance.

AN ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF DUBLIN
AMENDING CHAPTER 2.12 (PLANNING COMMISSION) OF THE DUBLIN MUNICIPAL
CODE TO ALLOW UP TO TWO COMMISSIONERS TO PARTICIPATE VIA REMOTE
ATTENDANCE AND ALLOW VIDEO ATTENDANCE REMOTELY
The City Council of the City of Dublin does hereby ordain as follows:
Section 1:
Section 2.12.020 (D) of Chapter 2.12 of the Dublin Municipal Code is amended
as follows:
2.12.020 Membership—Appointment—Term—Removal.
D. Remote Attendance. In rare cases and exceptional circumstances, the Planning
Commission permits remote attendance by Planning Commissioners at regular
and special Planning Commission meetings. Only two Planning Commissioners
are permitted to attend remotely per meeting. The first two Planning
Commissioners who notify the City Clerk of his or her intention to do so will be
permitted to attend remotely. Audio and video remote attendance is permitted,
video is preferred.
Section 2.Severability. The provisions of this Ordinance are severable and if any
provision, clause, sentence, word or part thereof is held illegal, invalid, unconstitutional, or
inapplicable to any person or circumstances, such illegality, invalidity, unconstitutionality, or
inapplicability shall not affect or impair any of the remaining provisions, clauses, sentences,
sections, words or parts thereof of the ordinance or their applicability to other persons or
circumstances.
Section 3.Effective Date. This Ordinance shall take effect and be enforced 30
days following its adoption.
Section 4.Posting. The City Clerk of the City of Dublin shall cause this Ordinance
to be posted in at least three public places in the City of Dublin in accordance with Section
36933 of the Government Code of the State of California.
