CALL TO ORDER 2. PLEDGE OF ALLEGIANCE TO THE FLAG 3. ORAL COMMUNICATIONS 3.1 Presentation of Savings Bonds to November Recycling Contest Winners: Mrs. Kenneth Coupe, Anita Lambert, Ronald oto, C. R. Chandler and Mary Kuane 3.2 Recognition of Vice Mayor Burton and Chris Kinzel, TJKM for planting of flowers in Civic Center planters as Dublin Rotary Club auction project. At this time, members of the audience are permitted to address the City Council on any item which is NOT on the City Counci 1 Agenda. Conments should not exceed 5 m;nutes. If any person feels that this is not sufficient time to address their concern, that person should arrange with the City Clerk to have their particular concern placed on the agenda for a future meeting. The City Council CANNOT deliberate or take action on a non-agenda item UNLESS there is factual evidence presented to the Counci 1 indicating that the subject brought up falls into one of the exceptions under Government Code Section 54954.2. 4. CONSENT CALENDAR Consent Calendar items are typically of a non-controversial nature and are considered for approval by the City Council with one single action. Members of the audience who would like an item removed from the Consent Calendar for purpose of publ ic input may request the City Council to remove the item. The request may be made at the time that the Mayor asks the audience members if there is anyone interested in removing an item from the Consent Calendar. 4.1 Minutes: Regular Meeting of November 22, 1993 STAFF RECOMMENDATION: Approve 4.2 Expiration of Term of City's Appointment to Alameda County Mosquito Abatement District Board of Trustees Dr. Harvey Scudder has served on this Board since August of 1983 and the City has been notified that his current term expires on January 2, 1994. STAFF RECOMMENDATION: Adopt Resolution appointing Dr. Scudder to another 2-year term which expires on January 2, 1996. 4.3 City Treasurer's Investment Report as of November 30, 1993 The City'S investment portfolio totals $17,389,417.38 and funds are earning an average yield of 5.067%. STAFF RECOMMENDATION: Receive Report. 4.4 Acceptance of Work - Contract 93-11 NPDES Pilot Project Work on this project to improve storm water quality has been completed in accordance with approved plans and specifications. Grant funds have been extended to cover additional work. STAFF RECOMMENDATION: Accept work and authorize $2,858 retention payment to Harris & Harris and authorize an additional appropriation of $9,265.50 from new revenues. 4.5 Report on 1993 Citizen and Organization of the Year The City Council will review the process to be used in the selection of the 1993 Citizen and Organization of the Year. STAFF RECOMMENDATION: Confirm City Council subcommittee of Howard and Moffatt; confirm that awards will be made in conjunction with the st. Patrick's Day celebration; and direct Staff to coordinate the distribution of nomination forms. 4.6 Eastern Dublin General Plan Amendment, Specific plan and the Dublin Parks & Recreation Master Plan Budget Adjustments The Planning & Recreation Staff will be finalizing the Eastern Dublin General Plan Amendment and Specific Plan and the Dublin Parks and Recreation Master Plan due to the recently approved Eastern Dublin project. Staff is recommending budget adjustments and additional appropriations approval for both projects. STAFF RECOMMENDATION: 1) Authorize the Mayor to execute the Budget Change Form and approve additional appropriations to the Planning Budget in the amount of $75,650 and to the Parks & Recreation Master Plan Project in the amount of $10,000; 2) Authorize the Consultant to complete the Parks & Recreation Master Plan. 4.7 Disaster Care Shelter Site Agreements The American Red Cross is mandated by federal statute to provide emergency services to victims of disaster. It is advantageous for both the City and the American Red Cross to have suitable sites predesignated with a Statement of Agreement. STAFF RECOMMENDATION: Approve Agreements. 4.8 Acceptance of Work - Contract 92-01 Dublin Boulevard Extension This project connects the existing developed portion of Dublin to the Eastern planning area, as well as to the proposed East Dublin BART Station. The construction portion of the project is now complete and it is appropriate to accept the improvements and construction contract. STAFF RECOMMENDATION: 1) Accept improvements and authorize payment of retention in the amount of $59,391.51 to Les McDonald Construction, once existing stop notices have been cleared and less $211.95 for City-provided traffic control; 2) from fund reserves, appropriate $29,425 from Fund 220 and $13,041 from Fund 315 to the 1993-94 Capital Improvement Budget for the Dublin Boulevard Extension. Appropriate $71,945 from new revenues to Fund 221. 4.9 Warrant Register Dated December 13, 1993 STAFF RECOMMENDATION: Approve 5. WRITTEN COMMUNICATION 5.1 Request for Funding from the Children's Theatre Workshop Correspondence has been received from the Children's Theatre Workshop (CTW), requesting that the City of Dublin contribute a one-time donation of $10,000 to assist CTW in securing a permanent home. STAFF RECOMMENDATION: Receive presentation. 5.2 Request for Funding the Resources for Family Development (RFD) Substitute Teacher Registry Program A request for financial support to fund the Resources for Family Development (RFD) Substitute Teacher Registry Program for one year has been received. The program is structured so the City would contribute $3,000 to cover administrative costs associated with the program for one year. The money funds substitute provider training and screening (fingerprinting, TB test, & Child Abuse Index Clearance). STAFF RECOMMENDATION: Receive presentation. 5.3 Tri-Valley Community Television (CTV) Funding The Tri-Valley Community Television Corporation (CTV) received $9,000 for FY 1993-94. This funding level is lower than the original request of $41,000. Through service reductions and compromises among the involved cities, the CTV Board of Directors is requesting an additional $11,279 to meet the short term budget shortfall. STAFF RECOMMENDATION: 1) Receive presentation and 2) approve an additional $11,279 contribution for FY 1993-94 with the understanding that future funding is not guaranteed. 5.4 Request from the Dublin Unified School District (DUSD) to Fund Crossing Guard Services The City Council will consider a request from the Dublin Unified School District to fund the provision of adult crossing guard services. The report also identifies for Council consideration a number of options with regard to providing crossing guard services. STAFF RECOMMENDATION: 1) Receive presentation; 2) Authorize the City to proceed with the services of a temporary service agency commencing 1/1/94; 3) Review the issue of crossing guard services with the DUSD prior to adopting FY 1994-95 Budget. 6. PUBLIC HEARING 6.1 Second Reading of Amendments to the Smoking Pollution Control Ordinance Following a public hearing on November 22, 1993, the City Council introduced an ordinance amending the City's current Smoking Pollution Control Ordinance which would: 1) Require all restaurant dining areas to be totally smoke free within one year; 2) Require businesses to post signs which have letters at least 3" in height; 3) Ban the distribution of tobacco samples; 4) Prohibit cigarette vending machines. Freestanding bars and bars within restaurants would remain unregulated. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and adopt amended ordinance; -OR- reintroduce other amendments to the ordinance. 6.2 Dublin Commercial General Plan Amendment/Planned Development Rezone/Tentative Map PA 93-052 J. Patrick Land Co., representing BJ Dublin Commercial, is requesting initiation of a Planned Development Rezone Ordinance for the existing 7f acre parcel located near the intersection of Dougherty Road and Dublin Boulevard. The public hearing on this project was continued from the November 22, 1993 City Council meeting. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and INTRODUCE Ordinance -OR- give Staff and Applicant direction and continue the matter. 7. UNFINISHED BUSINESS - None 8. NEW BUSINESS 8.1 Joint Powers Agreement - Alameda County Street Light Acquisition This proposed agreement provides for cost-sharing among the member agencies for a study which will determine whether the purchase of existing street lights from PG&E is feasible and cost-effective. Initial indications are positive that street lighting assessments could be reduced to Dublin property owners after the cost of purchasing the street light system is recovered. STAFF RECOMMENDATION: Adopt Resolution approving JPA and authorize expenditure of up to $5,000 from the Street Light Maintenance Assessment District reserves for Phase II of the study. This will allow an estimated $4,000 for the appraisal and a $1,000 contingency. 8.2 Acceptance of Gift to City The parents of the children enrolled in the City's Preschool Program have raised funds to purchase a ceiling fan and microwave oven. The City Council will consider acceptance of these items. STAFF RECOMMENDATION: Accept gifts and direct Staff to prepare formal acknowledgment to the donors. 8.3 Alameda County Offer to Modify the Methodology for Making Property Tax Payments to the City (Teeter Plan) Alameda County has offered cities an option as to the methodology used to distribute local property taxes. Cities may choose a plan which would provide them with nearly 100% of the taxes billed each year, in exchange for the County retaining all of the delinquent taxes, penalties, and interest. The County would also provide a one-time discounted payment for current delinquencies. STAFF RECOMMENDATION: Direct Staff to inform the County that we will not be electing to participate in the Teeter Plan. 8.4 Fiscal Year 1993-94 Mid-Year Budget Report The City Council will receive an update of the City's 1993- 94 Budget as a result of the impact of the 1993-94 State Budget and recent election results. The City Council will determine which services, if any, should be restored in the context of the City's current fiscal situation. STAFF RECOMMENDATION: 1) Receive Presentation; 2) Approve Budget Adjustments to Legal Services (+$145,000); Building Maintenance (+$7,000); Police (+$27,000); Fire (+$8,900); Annual Overlay (+$37,000); Dublin Blvd Extension (+$12,000); 3) Approve services recommended by City Manager for restoration & authorize appropriate budget adjustments; 4) Consider other Budget requests for Council consideration & provide Staff with appropriate direction. 9. OTHER BUSINESS 10. ADJOURNMENT The Regular City Council Meeting scheduled for December 21. 1993 has been cancelled; therefore, the next Regular Meeting will be held on January 10. 1994.
