PLEDGE OF ALLEGIANCE TO THE FLAG 3. ORAL COMMUNICATIONS At this time, members of the audience are permitted to address the City Council on any item which is not 0~ the City Council Agenda. Comments should not exceed 5 minutes. If any person feels that this is not .fficient time to address their concern, that person should arrange with the City Manager to have their particular concern placed on the agenda for a future meeting. 3.1 proclamation declaring December 20, 1986 as "The Holiday Project Day" 4. CONSENT CALENDAR Consent Calendar items are typically of a non-controversial nature and are considered for approval by the City Council with one single action. Members of the audience who would like an item removed from the consent calendar for purpose of public input may request the Ci ty Council to remove the i tern from the consent calendar. The request may be made at the time that the Mayor asks the audience members if there is anyone interested in removing an item from the Consent Calendar. 4.1 Minutes of Adjourned Regular Meeting November 18, 1986 and Regular Meeting November 24, 1986 STAFF RECOMMENDATION: Approve 4.2 Transportation Development Act (TDA) Projects This resolution approves 3 safety related projects and directs Staff to apply for funding. STAFF RECOMMENDATION: Adopt Resolution 4.3 Additional Appropriation of $38,955 for payment of Property Tax on Civic Center Property The County Assessor has determined that non-profit corporations are not exempt from property taxes unless a building is in progress, and therefore, Dublin Information, Inc., must pay property tax on the Civic Center property. STAFF RECOMMENDATION: Approve the appropriation of $38,955 from the fund balance of the Civic Center Enterprise Fund to pay (under protest), the property tax bill for the Civic Center Property. 4.4 Amendment to Street Sweeping Agreement This agreement calls for $1 million of General Liability Insurance and $1 million of Auto Liability Insurance. A-I Enterprises currently maintains $500,000 of General Liability Insurance and a total of $1.5 million of Auto Liability. A-I Enterprises has requested an amendment to the agreement to allow the existing insurance limits. STAFF RECOMMENDATIOfJ: Adopt Resolution amending the agreement. 4.5 Shannon Center Bid for Janitorial Services In order to satisfy the City's lease agreement with DSRSD for Shannon Center, janitorial service must be provided on a daily basis. The present contractor has been terminated, thus requiring that new bids be solicited. Staff has prepared a bidder's packet including the proposed Building Maintenance Contract. STAFF RECOMMENDATION: Authorize Staff to solicit bids for janitorial services. 4.6 City Treasurer's Investment Report for Period Ending November 30, 1986 STAFF RECOMMENDATION: Approve 4.7 Final Financial Report for Period Ending June 30, 1986 STAFF RECOMMENDATION: Approve 4.8 Pro-Forma Financial Report for Period Ending October 31, 1986 STAFF RECOMMENDATION: Approve 4.9 Revisions to Accounting Procedures Staff is proposing revisions to the City's adopted Accounting Procedures as they relate to accounts receivable, and future modification of the Accounting Procedures. STAFF RECOMMENDATION: Approve revision to Accounting Procedures 4.10 Warrant Register dated December 8, 1986 STAFF RECOMMENDATION: Approve 5. WRITTEN COMMUNICATIONS 5.1 From City of Pleasanton Regarding 1-580 Improvements The City has received a letter from the City of Pleasanton requesting that the City of Dublin initiate a study to determine the amount of benefit property owners will receive from the proposed 1-580 improvements and how those improvements will be financed. STAFF RECOMMENDATION: Discuss letter from City of Pleasanton in light of their previous position on September 22, 1986. 5.2 Report from Assistant City Attorney on Development of Municipal Code The development of a Municipal Code is being pursued which would incorporate the City's ordinances into one volume which will make it easier for City Officials, as well as the public to use. The Assistant City Attorney is proposing a format for Council consideration. STAFF RECOMMENDATION: Receive presentation from Assistant City Attorney and approve format of Proposed Table of Contents of Dublin Municipal Code. 6. PUBLIC HEARING 6.1 Request for Variance to Sections 508 and 3804 of the Uniform Building Code and Request for Interpretation of Sections 42.3 and 42.4 of Ordinance No. 02-84. The developers of The Villages @ Alamo Creek are requesting to vary from the Uniform Building Code and City Ordinance No. 02-84. STAFF RECOMMENDATION: Conduct public hearing; adopt resolutions denying requests or direct Staff to prepare resolutions approving requests. 6.2 Ordinance Establishing Title I of the Dublin Municipal Code (General provisions) This ordinance is being brought to the Council as part of the comprehensive revision of the City's ordinances and development of a Municipal Code. The ordinance establishes definitions for words which will be used throughout the Municipal Code; penalty provisions for violation of any provision of the Municipal Code; an appeal process; a severability clause which would apply to all ordinances adopted and included in the Code; and a 90 day statute of limitations for filing a writ of mandate to challenge any administrative action taken by the Councilor a Commission. STAFF RECOMMENDATION: Conduct public hearing; waive reading and introduce ordinance 6.3 Ordinance Regulating Private Patrol Operators This proposed ordinance provides for the revision of the provisions of Chapter 7 of Title 2 of the Alameda County Code, which the City adopted by Ordinance No. 13-82. This ordinance requires a Private Patrol Operator to conform with State Law; to register with the Dublin Police Department; and to receive approval from the Police Department regarding the uniform to be used by the Operator. STAFF RECOMMENDATION: Conduct public hearing; waive reading and introduce ordinance 6.4 Ordinance Regulating Fortunetelling for Pay This draft ordinance makes it unlawful for a person to engage in the business of fortunetelling within the City without first obtaining a permit from the Chief of Police. STAFF RECOMMEIJDATION: Conduct public hearing; waive reading and introduce ordinance 6.5 Ordinance Regulating the Sale to, Use by, or Possession by any Minor of Dangerous ~veapons This proposed ordinance provides for the revision of Title 4, Chapter 1, Article 6 of the Alameda County Code which the City adopted by Ordinance No. 13-82. This ordinance regulates the sale to, use by or possession by any minors of dangerous weapons. STAFF RECOMMENDATION: Conduct public hearing; waive reading and introduce ordinance 7. UNFINISHED BUSINESS 7.1 Five Year Cityhood Birthday Celebration February 1, 1987 marks the five-year anniversary of the City's incorporation. To commemorate this event, a Cityhood Birthday Celebration is planned the weekend of January 30 - February 1, 1987. STAFF RECOMMENDATION: 1) Approve events scheduled for Five-Year Birthday Celebration; 2) Authorize a budget transfer in the amount of $5,000 from the contingent reserve. 7.2 Selection of Civic Center Construction Management Firm The City Council authorized Staff to seek proposals for Construction Management & Inspection Services on the Civic Center Project. A sub-committee reviewed the 6 submittals received. STAFF RECOMMENDATION: Review the background provided and authorize the Mayor to execute an agreement with Harris & Associates. 7.3 City Council Committee Appointments Staff has prepared an up-to-date list of those committees, commissions and governing bodies upon which Councilmembers presently serve. STAPF RECOMMENDATION: Review and take appropriate action 7.4 Commission and Committee Appointments made by City Council At its November 24, 1986 meeting, the City Council requested that Staff prepare a list of the appointees to the various commissions and committees established by the City Council. The Council also requested a copy of all the policies related to these appointments. STAFF RECOMMENDATION: Review and take appropriate action. 7.5 Report from City Engineer regarding Public Service Signs for Howard Johnson's Motor Lodge At its November 24, 1986 meeting, the Council requested that Staff review the feasibility of installing public service "Lodging" signs on San Ramon Road between the freeway and Dublin Boulevard for northbound trafic and on Dublin Boulevard between San Ramon Road and Regional Street for Dublin Boulevard eastbound trafic. STAFF RECOMMENDATION: Authorize Staff to install Public Service Lodging Sign on Dublin Boulevard and authorize Staff to obtain encroachment permit for installation of sign on San Ramon Road. 7.6 Bids for Community Calendar The City Council authorized the solicitation of sealed bids for the printing of a Community Calendar. The bids were to be opened on Friday, December 5, 1986. The bid results will be presented at the City Council meeting. STAFF RECOMMENDATION: Consider bid results b. NEW BUSINESS - None 9.
