The packet is available in the City Clerk's Office and also at the Dublin Library. 1. CALL TO ORDER 2. PLEDGE OF ALLEGIANCE TO THE FLAG 3. ORAL COMMUNICATIONS 3.1 Selection of Vice Mayor (610-20) The City Council's policy is to select, in December of each year, a member of the City Council to serve as Vice Mayor for a period of one year. In the absence of the Mayor, the Vice Mayor would become Mayor Pro Tempore and would assume the temporary responsibilities of the Mayor. STAFF RECOMMENDATION: Determine who shall serve as Vice Mayor for a .one-year period. 3.2 Public Comments At this time, the public is permitted to address the City Council on non-agendized items. Please step to the podium and clearly state your name for the record. COMMENTS SHOULD NOT EXCEED THREE t31 MINUTES. In accordance with State Law, no action or discussion may take place on any item not appearing on the posted agenda. The Council may respond to statements made or questions asked, or may request Staff to report back at a future meeting concerning the matter, Any member of the public may contact the City Clerk's Office related to the proper procedure to place an item on a future City Council agenda. The exceptions under which the City Council MAY discuss and/or take action on items not appearing on the agenda are contained in Government Code Section 54954,2(b)(1)(2)(3). 4. CONSENT CALENDAR Consent Calendar items are typically noncontroversial in nature and are considered for approval by the City Council with one single action. Members of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item. 4.1 Minutes -None 4.2 Adoption of Ordinance Amending Dublin Municipal Code Chapter 5.56 (Smoking Pollution Control) (560-90) The City Council will consider adopting an ordinance that would amend Chapter 5.56 (Smoking Pollution Control) of the Dublin Municipal Code. The proposed ordinance requires 50% of the units in new and existing multi-unit rental residences to be designated as non- . smoking within 24 months, prohibit smoking within 20 feet of windows, doors, and vents of non-smoking units, and requires disclosure to prospective tenants the number and location of smoking and non-smoking units, and procedures for addressing smoking related complaints. This will be the second reading of this ordinance. STAFF RECOMMENDATION: Waive the reading and adopt Ordinance Amending Chapter 5.56 of the Dublin Municipal Code Relating to Smoking Pollution Control. December 2, 2008 Dublin City Council Agenda Page 1 of 4 4.3 Amendments to the City of Dublin Inclusionary Zoning Regulations (PA 08-041) (450-20) The City Council will consider adopting an Ordinance which would amend Chapter 8.68 of the Dublin Municipal Code (Inclusionary Zoning Regulations) to modify the method by which the sales price is calculated for inclusionary units from individual household income to fixed income and household-size assumptions within each of the two income levels (i.e., low and moderate); eliminate the requirement to build owner-occupied very-low income units; and amend the ratio for providing inclusionary owner-occupied units to be 60% for moderate units and 40% for low income units. This will be the second reading of this ordinance. STAFF RECOMMENDATION: Waive reading and adopt Ordinance Amending Chapters 8.68 of the Dublin Municipal Code (The Inclusionary Zoning Regulations) relating to Establishing Fixed Sales .Prices for Owner-Occupied Inclusionary Units; Eliminating the Requirement to Construct Owner-Occupied Very-Low Income Units; and Altering the For-Sale Inclusionary Unit Income Ratios (PA 08-041) 4.4 Ordinance Adding Chapter 5.66 to Title 5 (Public Welfare) of the Dublin Municipal Code Relating to Maintenance of Foreclosed Residential Properties (660-60) The City Council will consider adopting an Ordinance, adding Chapter 5.66 to the Dublin Municipal Code which will. require the maintenance of foreclosed residential properties in the City of Dublin. STAFF RECOMMENDATION: Waive reading and adopt Ordinance Adding Chapter 5.66 to Title 5 (Public Welfare) of the Dublin Municipal Code Relating to Maintenance of Foreclosed Residential Properties. 4.5 Croak and Jordan Medium Density -Planned Development Rezone with Amended Stage 1 Development Plan to Establish Revised Development Standards for Private Yards within the Medium Density Land Use Designation on the Croak and Jordan Properties (PA 07- 056) (450-20) The City Council will hold a second reading and consider adopting an Ordinance approving a Planned Development Rezone with amended Stage 1 Development Plan with revised development standards that require 50% of the units in the Medium Density land use designation on the Croak and Jordan properties to provide private, flat, yards with a minimum dimension of 18'x18' and a minimum of 400 square feet. STAFF RECOMMENDATION: Waive reading and adopt Ordinance Approving a PD-Planned Development Rezone with Amended Stage 1 Development Plan to Establish Revised Development Standards for Private Yards within the Medium Density Land Use Designation on the Croak and Jordan Properties. 4.6 Amendment No. 3 to the Consulting Services Agreement with BKF Engineers for Additional Construction Staking for the Dougherty Road Improvements -Houston Place to I-580 Project (600-35) This amendment to the Consultant Services Agreement with BKF Engineers will cover additional construction staking services over and above that included in the original contract for the Dougherty Road Improvements -Houston Place to I-580 Project. STAFF RECOMMENDATION: Adopt Resolution Approving Amendment No. 3 to the Consulting Services Agreement with BKF' Engineers for Additional Construction Staking for the Dougherty Road Improvements -Houston Place to I-580 Project. 4.7 Consultant Agreement to Update Eastern Dublin Fiscal Impact Analysis (600-30) The proposed update to the Eastern Dublin Fiscal Impact Analysis is intended to determine the amount of deficit (if any) in eastern Dublin that would need to be funded by DR Acquisitions L.L.C. and others. STAFF RECOMMENDATION: Adopt Resolution Approving the Selection of Willdan Financial Services, Inc. to Update the Eastern Dublin Fiscal Analysis; and authorize the Mayor to execute the agreement with Willdan Financial Services, Inc. in the amount not to exceed $25,000. December 2, 2008 Dublin City Council Agenda Page 2 of 4 4.8 Agreement with JS Building Maintenance Service for Janitorial Services for the Dublin Library (600-35) The City has been notified that the County of Alameda will no longer provide janitorial services to the County Library space at the Dublin Library. This results in the need to amend the Agreement for Maintenance and Operation of the Dublin Library and to contract for janitorial services for the County Library space. STAFF RECOMMENDATION: Adopt Resolution Approving Amendment No. 1 to the Agreement for Maintenance and Operation of the Dublin Library; adopt Resolution Approving Agreement with JS Building and Maintenance Service for Janitorial Services for the Dublin Library; and approve Budget Change. 4.9 Warrant Register ($6,494,934.34) dated December 2, 2008 (300-40) STAFF RECOMMENDATION: Approve. 5. WRITTEN COMMUNICATIONS -None 6. PUBLIC HEARINGS 6.1 Proposed Ordinance Establishing Bus Stop on Kohnen Way (1060-20) This item seeks City Council adoption of an ordinance to designate a bus stop on Kohnen Way. This is the first reading of this ordinance. STAFF RECOMMENDATION: Conduct public hearing; deliberate, waive reading, and INTRODUCE Ordinance Establishing a Bus Stop on Kohnen Way. 6.2 Ordinance Amending Chapter 2.24 of the Municipal Code Pertaining to the City's Conflict of Interest Code (640-40) The Political Reform Act requires every local government agency to review its Conflict of Interest Code biennially to determine whether amendments to the Code are required. (See Cal. Gov't Code § 87306.5). The City Council will consider Staff's recommended changes. This is the first reading of this ordinance. STAFF RECOMMENDATION: Conduct public hearing, deliberate, waive reading and INTRODUCE the proposed Ordinance Amending Chapter 2.24 of the Municipal Code Pertaining to the City's Conflict of Interest Code. 7. UNFINISHED BUSINESS 7.1 Bray Commons Public Art (900-50) The City Council will be asked to approve a budget change and authorize the artist for the sculpture at Bray Commons Park to make modifications to the artwork. STAFF RECOMMENDATION: Authorize Staff to procure the services of Bill Gould, Artist, in an amount not to exceed $5,000 and approve the Budget Change. 8. NEW BUSINESS 8.1 2008 Crossing Guard Evaluation Study (590-50) This item will present the findings of a traffic engineering study that evaluated the eight existing crossing guard locations and three potential new locations. Staff will provide a recommendation to place a new crossing guard at Oak Bluff Lane/Newfields Lane, as well as implement various safety enhancements adjacent to schools with additional signage and pavement markings. STAFF RECOMMENDATION: Crossing guards remain in place at eight existing locations and requests that the City Council authorize the placement of a new crossing guard .at the uncontrolled crossing of Oak Bluff Lane at Newfields Lane; and signs and pavement markings. be installed at several locations to enhance visibility of school activities and safety; and direct Staff to notify the adjacent residents at the Oak Bluff Lane/Newfields Lane intersection of proposed no parking zones (95 feet on the south side and 50 feet on the north side of street) and return to the City Council with a resolution establishing no parking zones on Oak Bluff Lane. December 2, 2008 Dublin City Council Agenda Page 3 of 4 8,2 Request by Vice Mayor Sbranti to Consider Creation of an Economic Incentive Program (470-20) The City Council will consider a request by Vice Mayor Sbranti to create an Economic Incentive Program. STAFF RECOMMENDATION: Provide Staff direction regarding the establishment of a High Priority Goal for Fiscal Year 2008-09 to create an Economic Incentive Program. 8.3 City Council Vacancy Created by Election of Councilmember Sbranti as Mayor at the 2008 General Municipal Election (610-30) It appears from the preliminary vote count that City Councilmember Tim Sbranti was elected as Mayor of Dublin on November 4, 2008. His term as Councilmember does not expire until December 2010. The City Council will discuss options as to how to fill Councilmember Sbranti's vacant City Council position, term ending December 2010. STAFF RECOMMENDATION: Discuss options and provide direction to Staff. Staff will report back with the required documents for the selected option within the 30-day time limit. 9. OTHER BUSINESS 9.1 Brief INFORMATION ONLY reports from Council and/or Staff, including Committee Reports and Reports by Council related to Meetings Attended at City Expense (AB 1234). 10.
