HomeMy WebLinkAbout*CC Agenda 11-28-1995A G E N D A DUBLIN CITY COUNCIL REGULAR MEETING - Tuesday, November 28, 1995, 7:00 p.m. DUBLIN CIVIC CENTER, 100 Civic Plaza A complete packet of information containing Staff Reports and exhibits related to each item is available for public review several days prior to a Council meeting in the City Clerk’s Office and also at the Dublin Library. 1.CALL TO ORDER 2.PLEDGE OF ALLEGIANCE TO THE FLAG 3.ORAL COMMUNICATIONS 3.1Recognition of Awards to City for Excellence in Financial Reporting The City has received an Outstanding Financial Reporting Award for Fiscal Year 1993-94 and Certificate of Achievement for Excellence in Financial Reporting for its Comprehensive Annual Financial Report for FY ending June 30, 1994. STAFF RECOMMENDATION: Receive awards 3.2Proclamation - 100th Anniversary of Chiropractic Profession At this time, the public is permitted to address the City Council on non-agendized items. The Council must, however, comply with all State Laws in regard to items not appearing on the posted agenda. The Council may respond to statements made or questions asked, or may request Staff to report back at a future meeting concerning the matter. Any member of the public may contact the City Clerk’s Office related to the proper procedure to place an item on a future City Council agenda. The exceptions under which the City Council MAY discuss and/or take action on items not appearing on the agenda are contained in Government Code Section 54954.2(b)(1)(2)(3). 4.CONSENT CALENDAR Consent Calendar items are typically non-controversial in nature and are considered for approval by the City Council with one single action. Members of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item. 4.1Minutes of Regular Meeting of November 14, 1995 STAFF RECOMMENDATION: Approve 4.213th Annual St. Patrick’s Day Celebration The 13th Annual St. Patrick’s Day Celebration is scheduled for Saturday, March 16, 1996. The Dublin Lion’s Club will sponsor the parade; the Dublin Chamber of Commerce will work with the business community to promote the celebration; and the City’s Parks & Community Services Department will plan and organize the community celebration. STAFF RECOMMENDATION: Approve parade route; approve location of community celebration; and adopt Resolution 4.3Support of East Bay Regional Park District (EBRPD) and Alameda County Applications for ISTEA Funding for 2 Bicycle Paths: Iron Horse Trail from Dougherty Road to East Dublin BART Station and North Side of Dublin Boulevard from Tassajara Creek to East Dublin BART Station The City will not incur any construction cost for either of these bicycle paths. The Iron Horse Trail bicycle path will ultimately be maintained by the East Bay Regional Park District. The City will incur future maintenance cost for the Dublin Boulevard bicycle path. STAFF RECOMMENDATION: Adopt Resolutions 4.4Purchase of Computers and Equipment Bid specifications have been prepared for 2 personal computers with monitors, network server computer with monitor for AutoCad and GIS, and E-Sheet plotter. The estimated cost of the proposed equipment and software is $18,750 STAFF RECOMMENDATION: Authorize Staff to solicit bids 4.5Award of Bid for Landscaping on San Ramon Road at Amador Valley Boulevard (Northwest and Northeast Corners) Contract 95-06 This contract will provide landscaping on the northwest and northeast corners of San Ramon Road and Amador Valley Boulevard. The low bid received exceeds funds budgeted for construction. Staff is recommending an additional appropriation from the San Ramon Road Specific Plan Assessment District reserve. STAFF RECOMMENDATION: Approve additional $3,135 appropriation from San Ramon Road Specific Plan Assessment District Fund and adopt Resolution awarding bid to Nimco ($12,229.26) 4.6Warrant Register ($931,880.05) dated November 28, 1995 STAFF RECOMMENDATION: Approve 5.WRITTEN COMMUNICATIONS - None 6.PUBLIC HEARING 6.1Underground Utility District 95-1 Dublin Boulevard from I-680 to 600’ west of Clark Avenue This is the second reading of a proposed ordinance which would establish Underground Utility District 95-1. The cost of undergrounding is paid by CPUC Rule 20A funds. There will be no cost to adjacent private property owners. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and ADOPT appropriate Ordinance (no protests received OR protests received and denied) 7.UNFINISHED BUSINESS 7.1Report on Crossridge Slope Slides A petition was received by the City Council requesting repair to two earth slides in the Dougherty Hills Open Space Park and behind Crossridge Road. STAFF RECOMMENDATION: Receive report and direct Staff to include improvements to the slope area as part of the 1996-97 Capital Improvement Program. Preliminary estimates are in the range of $20,000 to $70,000, depending on the extent of the improvements made. 8.NEW BUSINESS 8.1Transfer of Cable Television Franchise from Viacom Cable to Tele-Communications, Inc. (TCI) The City Council will consider an agreement approving the transfer of the City’s cable television franchise from Viacom Cable to Tele-Communications, Inc. In the event that the City fails to approve or deny the request prior to December 2, 1995, the request is deemed to be approved. STAFF RECOMMENDATION: Adopt Resolution approving transfer, subject to TCI’s acceptance of the Transfer Agreement’s terms, and authorize City Manager to execute the Agreement 8.2Master Development Agreement - Eastern Dublin In October, 1994, the City Council adopted a Master Development Agreement to serve as the format for negotiating development agreements with developers in Eastern Dublin. During the process of negotiating the first development agreement, Staff identified several changes which should be made, mainly for the purposes of clarity. STAFF RECOMMENDATION: Adopt Resolution approving revisions to Master Development Agreement 8.3Trumark Homes General Plan Amendment Study (Feasibility) ± The City Council will consider the feasibility of a General Plan Amendment for an 8.9 acre site along Dougherty Road and the former Southern Pacific right-of-way. The proposed amendment would change the Land Use Designation from Transportation Corridor to Medium Density Residential. The Applicant is paying the cost of preparation of the General Plan Amendment Study. STAFF RECOMMENDATION: Discuss; deliberate; authorize Staff to continue with the process to prepare environmental documents and a formal GPA for the proposed project 9.OTHER BUSINESS - Brief INFORMATIONAL ONLY reports from Councilmembers and/or Staff 10CLOSED SESSION . 10.1 Conference with Legal Counsel - Existing Litigation pursuant to Government Code Section 54956.9 subdivision (a): City of Dublin v. John E.
