City of Dublin vs. Nichandros 5. al'J'SENT CALENDAR Consent Calendar items are typically of a non-controversial nature and are considered for approval by the City Council with one single action. Members of the audience who would like an item removed from the consent calendar for purpose of public input may request the City Council to remove the item from the consent calendar. The request may be made at the time that the Mayor asks the audience members if there is anyone interested in removing an item from the Consent Calendar. 5.1 Minutes of Regular Meeting of October 28, 1985 STAFF REalVlMENDATIOO: Approve 5.2 City Treasurer's Investment Report for Period Ending October 31, 1985 STAFF RECCMMENDATIOO: Approve 5.3 Resolution Supporting the "Fair Responsibility Act of 1986" A coalition called Taxpayers for Fair Responsibility has been formed to suptx>rt an initiative affecting the "deep pocket" doctrine. The stx>nsors include he League of California Cities, County Supervisors Association, California Cl1amber of Commerce and others. The initiative would support the limitation of awards for non-out-of-poeket costs. The coalition has requested resolutions from local government agencies suptx>rting their efforts. STAFF RECCMMENDATIOO: Adopt Resolution 5.4 Planning Consultant for Downtown Improvement Plan Staff has interviewed and recommends the selection of WEE (Wurster, Bernardi and Emmons, Inc.) as Planning Consultant for the Dublin Downtown Improvement Plan. The WEE proposal calls for 1) identification of issues, options and alternatives, 2) preparation of a consensus plan and 3) preparation of a specific plan and implementation program. The schedule would bring the Plan to the City Council by November, 1986. STAFF RECCMMENDATION: Approve hiring of Wurster, Bernardi & Eh1mons, Inc., and authorize City Manager to execute agreement. 5.5 Amador Lakes Mini Park Plans for the 3/4 acre Amador Lakes Park have been received by Staff. Staff, as well as the Park & Recreation Commission have reviewed them and found the plans to be lacking in he amenities previously requested. The designer has indicated that addi tional monies are needed in order to design the park to City specifications. STAFF RECCMMENDATION: Authorize an additional appropriation of $40,000 in Park Dedication Funds to supplement the developer's contribution toward the developnent of the Park. 5.6 1984-85 Budget Modifications The accounting sysem utilized by the City requires the City to record expenses based on the date of deli very of the goods or services. Due to the number of functions performed under contract, the receipt and payment of invoices delays the recording of expenses. At this time, all of the 1984-85 expenses have been accounted for and some budget modifications are required. STAFF RECCMMENDATlOO: Approve budget transfers and additional appropriations 5.7 Acceptance of Work - Tract 4569 This seventeen lot tract off Shannon Avenue (Shannon Court), was approved under Alameda County jurisdiction and inspected by City inspectors. The work has now been satisfactorily completed and is ready for acceptance. STAFF RECCMMENDATION: Adopt Resolution to accept the work completed in Tract 4569 and authorize continuance of a letter of credit in the amount of $172,000 in connection with the guarantee of work performed in Tract 4569. 5.8 Warrant Register dated November 12, 1985 STAFF RECCMMENDATION: Approve 6. WRI'lTEN CXlv1MUNICATIONS 6.1 Metropolitan Transportation Oommission Proposed Legislation to Authorize a County Transportation Tax MTC has drafted proposed legislation which would allow the voters in any Bay Area County to place a measure on he ballot related to the funding of transportation improvements. The legislation would have to be enacted by the State Legislature. MTC has requested input on provisions to be included and types of taxation which would be authorized. STAFF RECCMMENDATION: Review proposed legislation and direct Staff to forward appropriate comments to MTC with respect to the City's position. 7. PUBLIC HEARING 7.1 Cable Television Ordinance and Agreement This is the second reading of the Cable Television Franchise Ordinance. The Cities of Dublin, San Ramon, Pleasanton and Livermore entered into a joint negotiation proces with Viacom Cablevision. The Ordinance establishes the criteria under which the cable company can operate pursuant to the negotiated agreement. STAFF RECCMMENDATIOO: Open public hearing; hear Staff presentation; hear public testimony; close public hearing; waive second reading and adopt Cable Television Ordinance. 7.2 Appeal of Planning Commission Action to Deny PA85-060 Great Western Savings/Hagman Associates Conditional Use Permit and Site Development Review On October 14, 1985, the City Council granted Great Western Savings a continuance on their appeal of the Planning Commission denial to have a gated, attendant controlled parking lot with 230 spaces. Great Western Savins is requestingf a second continuance until the December 9, 1985 City Council meeting. STAFF RECCMMENDATIOO: Reopen public hearing; hear presentation of anyone unable to attend continued hearing; question Staff, applicant and public; continue public hearing until City Council meeting of December 9, 1985. 7.3 Ordinance Regarding Bus Loading Zone (Signs) at Nielsen School This is a request of the Nielsen Elementary School Principal to set aside a two bus loading zone just south of the existing southerly driveway into Nielsen School. Staff recommends approval of signs limiting the bus loading zone to school hours. STAFF RECCMMENDATION : Receive public testimony; close public hearing ; waive reading and adopt ordinance on an urgency basis. 8. UNFINISHED BUSINESS 8.1 Solid Waste Request for Proposals The City Council has indicated its intent to become the franchisor for refuse collection and disposal services. The existing franchise is administered by DSRSD and will expire on April 1, 1986. Pursuant to the City Council diection, Staff has prepared a Request for Proposal which will assist in determining the provider of this service. STAFF RECCMMENDATION: Provide input on specific service levels and requirements to be included in request and direct Staff to circulate the documents among qualified providers. 9. NEW BUSINESS 9.1 Proposed Change in BART Express Bus Route D BART is protx>sing changes in the BART Express Bus Route D from Walnut Creek to Dublin. In the Dublin area, the existing route is along Alcosta Boulevard and Village Parkway. The proposed new route would be along San Ramon Road. The main reason for the proposed change is to reduce the trip time and streamline the express bus service. STAFF RECXlv1MENDATION: Review and identify any concerns for Staff to send to the BART public hearing. 9.2 Amendment to Alameda County Solid Waste Management Plan to Import and Dispose San Francisco Solid Waste and Sludge at Altamont Landfill The Alameda County Solid Waste Management Authority is considering an amendment to the Solid Waste Management Plan. This amendment would accommodate the importation and disposal of solid waste and sludge from San Francisco. An amendment requires the endorsement of a majority of the cities in the County. STAFF RECCMMENDATION: Consider issues and direct City Council Authority Representative to relate the City's position to the Authority and comment as appropriate on Environmental Initial Study. 10. ornER BUSINESS 11.
