CLOSED SESSION (6:30 D.m.J - NONE 1. CALL TO ORDER 2. PLEDGE OF ALLEGIANCE TO THE FLAG 3. ORAL COMMUNICATIONS 3.1 Proclamation declaring November 21-27, 2004 "National Family Week" (File # 610-50) 3.2 Public Comments At this time, the public is permitted to address the City Council on non-agendlzed items, Please step to the podium and clearly state your name for the record. COMMENTS SHOULD NOT EXCEED THREE (3) MINUTES, In accordance with State Law, no action or discussion may take place on any Item not appearing on the posted agenda, The Council may respond to statements made or questions asked, or may request staff to report back at a future meeting concerning the matter, Any member of the public may contact the City Clerk's Office related to the proper procedure to place an Item on a future City Council agenda. The exceptions under which the City Council MAY discuss and/or take action on items not appearing on the agenda are contained in Government Code Section 54954.2(b)(1)(2)(3). 4. CONSENT CALENDAR Consent Calendar items are typically non-controvef$lal In nature and Ire considered for approval by the City Council with one single action. llembets of the audience, Staff or the CIty Council who would like an Item removed from the Consent Calendar for putposes of public input may request the Mayor to temøve the item. 4.1 Minutes of Regular Meetings of October 5 and October 19, 2004 STAFF RECOMMENDATION: Approve 4.2 Acceptance of Street Improvements associated with Tract 7136, Dublin Ranch Area A, Neighborhood A-I (ToU Brothers, Inc.) (File # 600-60) As part of the development of Tract 7136, Dublin Ranch Area A, Neighborhood A~l, the Developer constmcted street improvements. Sin~ these improvements have now been completed, it is appropriate for the City to accept the improvements for maintenance by the Pinnacles at Dublin Ranch Sub-Association, and release the bonds that guaranteed the street improvement work. STAFF RECOMMENDATION: Adopt Resolution accepting the street improvements and approving regulatory traffic control devices. 4.3 Award of Bid, Contract 04-11, Civic Center Roof Repair (File # 600-35) This project would repair the roof deck area on the second floor of the Administrative Wing of the Civic Center. The deck, which also serves as a roof for some of the first floor offices, was the source of some leaks during the winter of 2003-04, The low bid received is within funds budgeted for construction of this project STAFF RECOMMENDATION: Adopt Resolution awarding contract to RoSa Construction ($79,884). 4.4 Amendment to Tract Developer Agreement and Partial Acceptance of Landscape Improvements associated with Tract 7136, Dublin Ranch Area A, Neighborhood A-I (ToU Brothers, Inc.) (File # 600-60) Toll Brothers, Inc., has asked the City to amend the Tract Developer Agreement that governs the landscaping improvements within Tract 7136. The amendment will release the developer from obligations for the completed landscaping work within the Tract and reduce the improvement security to an amount necessary to assure that the work within the remaining parcels is completed. STAFF RECOMMENDATION: Adopt Resolution amending IDA for Landscape to release Toll Brothers, Inc., from obligations for the completed landscaping work governed by the original agreement, and to reduce the improvement security to an amount necessary to assure that the landscaping work within remaining parcels is completed as originally required with Tract 7136. c.. 4.5 Second Amendment to Tract Developer Agreement, Tract 7327 Dublin Ranch Area G, Neighborhood B-2 (Toll-Dublin, LLC) (File # 600-60) The developer of Tract 7327, Dublin Ranch Area G, Neighborhood H-2, has requested a second amendment to the Tract Developer Agreement to extend the time to complete the remaining subdivision improvements and landscaping to November 5,2005, STAFF RECOMMENDATION: 4.6 Warrant Register (55,920,110.93) dated November 2,2004 (Fße # 300-40) STAFF RECOMMENDATION: Approve 5. WRITIEN COMMUNICATIONS - None 6. PUBLIC IfEARING 6.1 Cancellation of the Commerce One Development Agreement (File # 600-60) This is the second reading of an Ordinance which would cancel a Development Agreement (DA) between the City of Dublin, Alameda County Surplus Property Authority and Commerce One. The DA is being canceled because the project (Commerce One Headquarters) has been withdrawn and a new project has been approved in its place, STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and adopt Ordinance. 7. UNFINIS!ŒD BUSINESS 7.1 Execution of Solid Waste Colleetion and Disposal Agreements (File # 600-30) The current solid waste collection and disposal service contract with Waste Management Inc., expires on June 30,2005. The City is engaged in a competitive proposal process to procure solid waste services beginning July 1,2005. The City Council will consider proposals submitted by Waste Management, Republic Services and Amador Valley Industries for the provision of collection and disposal services for the City of Dublin. STAFF RECOMMENDATION: Determine the preferred contractor(s) and service alternatives for collection and disposal services and adopt Resolutionls) authorizing the City Manager to execute I) the Collection Services Agreement with the selected contractor and 2) the Disposal Services Agreement with the selected contractor. 8. NEW BUSINESS - NONE 9. OTHER BUSINESS 9.1 Brief INFORMATION ONLY reports from CouncD and/or Staff, including Committee Reports 10.
