CALL TO ORDER 2. PLEDGE OF ALLEGIANCE TO THE FLAG 3. ORAL COMMUNICATIONS At this time, members of the audience are permitted to address the City Council on any item which is not on the City Council Agenda. Comments should not exceed 5 minutes. If any person feels that this is not sufficient time to address their concern, that person should arrange with the City Manager to have their part.icular concern placed on the agenda for a future meeting. 4. CONSENT CALENDAR Consent Calendar items are typically of a non-controversial nature and are considered for approval by the City Council with one single action. Members of the audience who would like an item removed from the consent calendar for purpose of public input may request the Ci ty Council to remove the i tern from the consent calendar. The request may be made at the time that the Mayor asks the audience members if there is anyone interested in removing an item from the Consent Calendar. 4.1 Minutes of Regular Meeting of October 12, 1987 STAFF RECOMMENDATION: Approve 4.2 Financial Report for Period Ending September 30, 1987 STAFF RECOMMENDATION: Approve 4.3 Transportation Development Act (TDA) Projects This action authorizes Staff to apply for Transportation Development Act funding for two projects: 1) handicap curb ramps and 2) bicycle safety grates for catch basins. STAFF RECO~~ENDATION: Adopt Resolution 4.4 Tri-Valley Community Television Request for Funds The City of Dublin has received a request from Tri-Valley Community Television Board for the payment of its share of the annual operating budget. The other member cities have agreed to contribute $20,000 each, however, the current City of Dublin budget provides an appropriation of $19,800. The Corporation has requested equal funds from each of the member cities. Therefore, the City Council will need to appropriate an additional $200 from the contingent reserve. One-half of the annual operating budget contribution would be made at this time with the second half paid after a 6-month performance evaluation. The Corporation has also requested that the City provide its share of capital grant funds which were distributed to each of the cities by the Cable Television operator. STAFF RECOHMENDATION: Approve an increase in Dublin's contribution to the Tri-Valley Community Television Corporation Operating Budget from $19,800 to $20,000; authorize a budget transfer from the City's contingent reserve in the amount of $200; authorize Staff to contribute the $55,000 in Capital Equipment Funds upon request from the Corporation. 4.5 Report from Recreation Director re 1987 Summer Recreation Program The Recreation Director has prepared a report summarizing the activities offered by the Recreation Department during the past summer quarter. STAFF RECOMMENDATION: Receive Report. 4.6 Sale of Surplus Vehicle - 1974 Mercedes On September 28, 1987 the Council rejected bids received on a 1974 Mercedes and directed Staff to again advertise for sealed bids for the sale of this vehicle. On October 9th, Staff opened 10 sealed bids ranging from $4,202 to $6,555. STAFF RECOMMENDATIOtJ: Award bid to highest bidder, Robert D. Reineccius for $6,555. 4.7 Opposition to Agreement between Bay Area Rapid Transit (BART) and Samtrans The BART Board of Directors recently voted to approve agreement principles for a Colma Station Project. On October 12, 1987, the City Council requested that this issue be placed on the agenda for discussion. STAFF RECOMMENDATION: Consider adoption of resolution opposing agreement between BART and Samtrans 4.8 Award of Bid - Contract 87-8 - Dublin Boulevard Widening @ Clark Avenue The low bid received was $76,142.85. This is within the amount budgeted for construction of the project. STAFF RECO~ll1ENDATION: Adopt Resolution awarding Contract 87-8 to Ambo Engineering, Inc., and authorize Mayor to execute agreement. 4.9 TDA Measure B paratransit Funds The passage of Measure B in Alameda County included funding for paratransit programs. The Metropolitan Transportation Commission has requested that each City submit a claim for funds under this program. Staff has recommended that the City request funding which will replace the TDA funding shortfall experienced by the City of Dublin between the 1986-87 and 1987-88 Fiscal Years. It is also recommended that the City request funding for a contribution towards the purchase of an additional paratransit vehicle to be placed in service in the 1988-89 Fiscal Year. STl-\FF RECOMHENDATION: Adopt Resolution authorizing the filing of a claim with MTC for allocation of TDA Measure B Paratransit Funds for Fiscal Year 1987-88 4.10 Senior Center Remodel - Contract 87-10 This action authorizes Staff to advertise for bids for the renovation of the Fallon School Multi-Use Room for a Senior Citizen Center. STAFF RECOMMENDATION: Authorize Staff -to advertise Contract 87-10 for bids. 4.11 Warrant Register dated October 26, 1987 STAFF RECOMMENDATION: Approve 5. WRITTEN COHMUNICATIONS 5.1 Request from Chamber of Commerce regarding Holiday Decorations The Chamber has requested that the City Council consider installing holiday decorations on street light poles. Staff has studied the options and recommends the banner type, with a cost not to exceed $6,200 (purchase and installation) for 1987. STAFF RECOMMENDATION: Consider request. 6. PUBLIC HEARING 6.1 Corwood Car Wash - Appeal of Planning Commission's Action Denying Conditional Use Permit and Site Development Review & Request for a Variance to Sideyard Setback Requirements and Parking Regulations, Village Parkway @ Lewis Avenue On September 28, 1987, the City Council approved a CUP for a 12-year period, determined that the proposed 19.5 foot building height for -the detail shop is acceptable, and directed Staff to work with the Applicant regarding a third drive aisle lane along Lewis Avenue STAFF RECOMMENDATION: Conduct public hearing; continue item to November 23, 1987 Council meeting. 6.2 Ordinance Requiring Permits for the use of Sound Amplification Equipment This ordinance, which was introduced at the City Council meeting of October 12, 1987, would require a permit for the operation of any mobile public address sound system equipment on any street within the City. The permit process is outlined as well as the appeal procedure, should an application for permit be denied. STAPF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and adopt ordinance. 6.3 Ordinance Regulating Gaming This ordinance, which was introduced at the City Council meeting of October 12, 1987, \vould regulate against the establishment of 'card rooms' within the corporate limits of the City. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and adopt ordinance. 6.4 Ordinance Establishing Requirments for the Protection of Hatercourses This ordinance is part of the City's Municipal Code update. It provides a permit procedure and regulations regarding construction and maintenance in and around a watercourse. STAFF RECOMHENDATION: Conduct public hearing; deliberate; waive reading and introduce ordinance 7. UNFINISHED BUSINESS 7.1 Dublin Civic Center - Authorization to Request Bids - Contract 87-9 On June 8, 1987 the City Council approved the design development concepts presented by the Civic Center Design Team. The Architects and their consultants have now developed final plans and specifications. The City is proposing a bid opening date of December 10, 1987. The final drawings are consistent with the previous discussions on the development of the Civic Center and include several public amenities. In addition to several public areas, the facility contains office space to accommodate the current City needs and projected future staffing levels. STAFF RECOMMENDATION: Approve Final Plans & Specifications and authorize Staff to solicit bids on the Dublin Civic Center; provide direction with regard to clocktower. 8. NEW BUSINESS 8.1 Request for Acceptance of Maintenance - Koopman Canyon Trash Rack The Developer of Foothill Estates has requested that the City assume maintenance of a large drainage facility behind one of the homes in Tract 4749. Staff concurs that this maintenance cannot be performed by the homeowner. STAFF RECOMMENDATION: Approve acceptance of maintenance of the trash rack behind Lot 17 Fenwick Court of Estate Homes Tract 4749, subject to Estate Homes' completion of construction of the trash rack to the satisfaction of the City Engineer, providing an all-weather vehicle access to the top of the slope and pedestrian access to the trash rack. 8.2 Environmental Assessment Report - Federal Detention Center (FDC)/Federal Correctional Institution (FCI) Facilities The U. S. Department of Justice has released an Environmental Assessment for a proposed 100-cell Federal Detention Center in the Camp Parks area. The Environmental Assessment proposes a finding that the project will not have any significant impacts. Staff believes more analysis is needed regarding socioeconomic impacts, traffic, sewerage and project alternatives. STAFF RECOMMENDATION: Direct Staff to send comments to U. S. Department of Justice. 9. OTHER BUSINESS 10. CLOSED SESSION - Potential Litigation, Government Code Section 54956.9(c) 11. ADJOURNMENT
