II. CONFERENCE WITH LEGAL COUNSEL -- EXISTING LITIGATION

3.1 Acceptance of Gifts to City from Day on the Glen Festival and Family Movie Nights
(150-70)
The City Council will receive a report on contributing sponsors for the Day on the Glen
Festival and Family Movie Night Events and will be asked to formally accept the gifts.
STAFF RECOMMENDATION: Recognize donors for their contributions and formally accept
gifts.
3.2 Appointments to the Art Selection Committee for Dublin Transit Center Project (110-30)
The City Council will be asked to approve selected members who will represent an Arts
Selection Committee to review artwork for the Dublin Transit Center Public Art project.
STAFF RECOMMENDATION: Confirm Mayor's appointments to Art Selection Committee for
the Dublin Transit Center project.
3.3 Awards for the Tri-Valley Adolescent Health Initiative (TVAHI) (150-20)
The Tri-Valley Adolescent Health Initiative (TVAHI) was selected to receive two awards
from the League of California Cities. Staff will give a brief presentation of the award-
winning program.
STAFF RECOMMENDATION: Receive report.
3.4 Introduction of Melissa Tench-Stevens, Executive Director, Tri-Valley Community
Television (1050-50)
The City Council will be introduced to Ms. Melissa Tench-Stevens, the new Executive
Director of Tri-Valley Community Television.
STAFF RECOMMENDATION: Receive presentation.
3.5 Public Comments
At this time, the public is permitted to address the City Council on non-agendized items. Please step to the podium and clearly state your name
for the record. COMMENTS SHOULD NOT EXCEED THREE (3) MINUTES. In accordance with State Law, no action or discussion may take
place on any item not appearing on the posted agenda. The Council may respond to statements made or questions asked, or may request
Staff to report back at a future meeting concerning the matter. Any member of the public may contact the City Clerk's Office related to the
proper procedure to place an item on a future City Council agenda. The exceptions under which the City Council MAY discuss andlor take
action on items not appearing on the agenda are contained in Government Code Section 54954.2(b)(1)(2)(3).
4. CONSENT CALENDAR
Consent Calendar items are typically non-controversial in nature and are considered for approval by the City Council with one single action. Members
of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the
Mayor to remove the item,
4.1 Minutes of Regular Meeting of September 2, 2008
STAFF RECOMMENDATION: Approve.
4.2 Adoption of Ordinance Amending Dublin Municipal Code Chapter 5.56 (Smoking
Pollution Control) (560-90)
The proposed ordinance was introduced at the October 7, 2008, City Council Meeting
regarding Dublin Municipal code chapter 5.56, entitled Smoking Pollution control. This is the
second reading of this ordinance, and if the ordinance is adopted, it would provide smoke free
neighborhood parks and squares and provide a 100 foot barrier around park recreation areas
within the City's community parks. If the ordinance is adopted, it would also provide smoke-
free City events.
STAFF RECOMMENDATION: Waive the reading and adopt Ordinance Amending Chapter
5.56 of the Dublin Municipal Code Relating to Smoking Pollution Control.

4.3 Shannon Community Center Furnishings Award of Bid (600-35)
The 2008-13 Capital Improvement Program includes funds to purchase furnishings for the
new Shannon Community Center. The City Council will consider adopting a resolution
awarding Contract No. 08-10 to One Work Place.
STAFF RECOMMENDATION: Adopt Resolution Awarding Contract No. 08-10 Shannon
Community Center Furnishings to One Work Place.
4.4 Shannon Community Center Audio Visual Systems Award of Bid (600-35)
The 2008-13 Capital Improvement Program includes fund to purchase audio visual systems
for the new Shannon Community Center. The City Council will consider adopting a
resolution awarding Contract No. 08-15 to PCD, Inc.
STAFF RECOMMENDATION: Adopt Resolution Awarding Contract No. 08-15 Shannon
Community Center Audio Visual Systems to PCD, Inc.
4.5 Acceptance of Improvements and Approval of Regulatory Traffic Control Devices for
Tract 7641, Sorrento at Dublin Ranch (West)
Toll Brothers has constructed the improvements for Aviano Way, Palermo Way, Capoterra
Way and Perugia Street between Palermo Way and Capoterra Way in accordance with the
Improvement Agreement for Tract 7641, Sorrento at Dublin Ranch (West). It is now
appropriate for the City to accept these improvements.
STAFF RECOMMENDATION: Adopt Resolution Accepting Improvements and Approving
Regulatory Traffic Control Devices for Tract 7641, Sorrento at Dublin Ranch (West).
4.6 Approval of California River Parkways Grant Program Application for the Alamo Canal
Trail Under I-580 Project and Authorization to Manage Construction of the Project (600-
40)
The City proposes to submit a California River Parkways Grant Program application for the
construction of the Alamo Canal Trail Under I-580 Project. One of the requirements of the
funding application is the inclusion of a City Council resolution approving the filing of the
application and appointing a designated position as agent for the City. In addition, Council
will consider authorizing City Staff to manage construction of this project.
STAFF RECOMMENDATION: Adopt Resolution Approving the Application for Grant Funds
for the California River Parkways Grant Program Under the Safe Drinking Water, Water Quality
and Supply, flood Control, River and Coastal Protection Bond Act of 2006 (Proposition 84).
4.7 Preliminary Financial Reports for the Month of July and August 2008 (330-50)
This item provides the preliminary report of the financial statements for the months of July
2008 and August 2008.
STAFF RECOMMENDATION: Receive reports.
4.8 Budget Carryovers and Adjustments from Fiscal Year 2007-2008 to Fiscal Year 2008-2009
(330-20)
As part of the process of reviewing the Final Financial Reports for Fiscal Year 2007-2008,
Staff noted that several Capital Projects and operating expenditure line items originally
anticipated to be completed in 2007-2008 will not be completed until Fiscal Year 2008-2009.
The City Council will consider these changes.
STAFF RECOMMENDATION: Approve Budget Changes.
4.9 Warrant Register ($2,540,897.26) dated October 21, 2008 (300-40)
STAFF RECOMMENDATION: Approve.

7. UNFINISHED BUSINESS
7.1 Eastern Alameda County Regional Conservation Strategy -Presentation by Zone 7 Water
Agency and Alameda County Resource Conservation District (410-10)
The City of Dublin previously agreed to participate with the California Department of Fish
and Game, the U. S. Fish and Wildlife Service, and six local agencies in the development of
the Eastern Alameda County Conservation Strategy (EACCS). The City Council approved a
budget increase at its meeting of June 17, 2008, and requested additional information on the
scope of work and specific details on the public outreach and education component of the
EACCS. The City Council will receive a presentation of this requested information from the
Zone 7 Water Agency and the Alameda County Resource Conservation District.
STAFF RECOMMENDATION: Receive presentation and provide comments as appropriate.
7.2 Presentation of the Eastbound Ramp Metering Before-and-After Study Results (800-30)
Staff will present the results of a "Before-and-After" traffic study of the Phase 2 eastbound
ramp metering activation. The study was funded by a Traffic Engineering Technical
Assistance Program (TETAP) grant from the Metropolitan Transportation Commission.
STAFF RECOMMENDATION: Receive presentation and provide comments as appropriate.
7.3 Amendment to Kolb Trust Donation Agreement (295-10/600-30)
The City Council will consider an amendment to the Donation Agreement with Casey Strom,
trustee of the William P. Kolb Revocable Trust, to extend the date that the structures from the
Kolb Ranch would need to be removed from January 1, 2009 to April 30, 2009.
STAFF RECOMMENDATION: Authorize the City Manager to execute the Amendment to the
Agreement.
7.4 Authorization to Bid Dublin Historic Park, Phase I (600-30)
The 2008-2013 Capital Improvement Program includes funds to develop Phase I of the
Historic Park and relocate several historic structures from the Kolb Ranch on Dublin Canyon
Road.
STAFF RECOMMENDATION: Authorize Staff to bid the project with additive alternates.
8. NEW BUSINESS
8.1 Participation in the Solar Cities Program (600-40)
The City of Dublin has been approached to join the Solar Cities Program and make the
information available to Dublin residents and businesses. The Cities of Livermore and
Pleasanton have created the Solar Cities Program website and are working on additional
outreach materials. Staff is requesting City Council direction as to the potential of entering
into a Memorandum of Understanding with the Cities of Livermore and Pleasanton for
program. If the City is interested in joining forces, the expected costs of revising the Solar
Cities' website and additional outreach materials would be approximately $3,500 for Fiscal
Year 2008-2009.
STAFF RECOMMENDATION: Provide Staff direction regarding entering into a Memorandum
of Understanding (MOU) with the Cities of Livermore and Pleasanton for the Solar Cities
Program.
8.2 Grant Award from National Endowment for the Humanities (900-70)
The City Council will receive information on a $1,000 Grant Award to the Dublin Heritage
Center from the National Endowment of the Humanities.
STAFF RECOMMENDATION: Approve Budget Change.
8.3 Designation of a No Parking Zone on Crossridge Road (570-30)
In response to a citizen request, this item seeks City Council approval fora 15-foot no parking
zone on the north side of Crossridge Road west of Squirrel Creek Circle. The purpose of this
zone is to improve sight distance.
STAFF RECOMMENDATION: Adopt Resolution regarding Approval of No Parking Zone on
Crossridge Road.

8.4 Letter of Support for ACTIA's Active Transportation Program (590-90)
The Alameda County Transportation Improvement Authority (ACTIA) is supporting Alameda
County as a recipient of bicycle and pedestrian funding under the federal Non-Motorized
Transportation Pilot Program. The Funding will be used to increase walking and biking
funding in the next federal transportation bill, which is schedule to be adopted by 2010.
ACTIA has requested a letter from the City of Dublin endorsing these efforts.
STAFF RECOMMENDATION: Approve Resolution Endorsing the Alameda County Active
Transportation Campaign and Authorizing the Mayor to Sign a Letter in Support of the
Campaign.
8.5 Bray Commons Public Art (900-50)
The City Council will receive a report on resident concerns regarding the public artwork at
Bray Commons Park.
STAFF RECOMMENDATION: Receive report and provide direction to Staff.
9. OTHER BUSINESS
9.1 Brief INFORMATION ONLY reports from Council and/or Staff, including Committee
Reports and Reports by Council related to Meetings Attended at City Expense (AB 1234).
