PUBLIC EMPLOYEE PERFORMANCE EVALUATION pursuant to Government Code Section 54957, Title: City Manager 1. CALL TO ORDER & PLEDGE OF ALLEGIANCE TO THE FLAG 2. REPORT OF CLOSED SESSION ACTION 3. ORAL COMMUNICATIONS 3.1 Dublin Unified School District 2009 Academic Performance Index Growth Proclamation (610-50) 3.2 Alameda County Community Food Bank Certificate of Appreciation (150-20) Ms. Rosanna McDonald, Corporate & Foundation Relations Manager, will present the City Council with a certificate of appreciation for participation in the 2009 Summer Food Drive. STAFF RECOMMENDATION: Receive presentation. 3.3 National Domestic Violence Awareness Month Proclamation (610-50) 3.4 Red Ribbon Week Proclamation (610-50) 3.5 Public Comments At this time, the public is permitted to address the City Council on non-agendized items. Please step to the podium and clearly state your name for the record. COMMENTS SHOULD NOT EXCEED THREE (3) MINUTES. In accordance with State Law, no action or discussion may take place on any item not appearing on the posted agenda. The Council may respond to statements made or questions asked, or may request Staff to report back at a future meeting concerning the matter. Any member of the public may contact the City Clerk's Office related to the proper procedure to place an item on a future City Council agenda. The exceptions under which the City Council MAY discuss and/or take action on items not appearing on the agenda are contained in Government Code Section 54954.2(b)(1)(2)(3). 4. CONSENT CALENDAR Consent Calendar items are typically non-controversial in nature and are considered for approval by the City Council with one single action. Members of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item. 4.1 Minutes of Regular Meeting of September 15, 2009 and Special Meeting of September 29, 2009 STAFF RECOMMENDATION: Approve minutes. October 20, 2009 Dublin City Council Agenda Page 1 of 4 4.2 Acceptance of Work -Contract No. 09-03, Dublin Sports Grounds Renovation -Snack Bar and Restrooms Remodel (600-35) Work under Contract No. 09-03, Dublin Sports Grounds Renovation -Snack Bar and Restrooms Remodel is now complete. The City Council will accept the final facility improvements. STAFF RECOMMENDATION: Adopt Resolution Accepting Improvements to Dublin Sports Grounds, Contract No. 09-03. 4.3 Approval of Contract for Services with Association of Bay Area Governments to Fund Village Parkway Storm Drain Inlet Filter Inserts, Amador Valley Boulevard to Brighton Drive (600-35) The City of Dublin is eligible for funding through the Association of Bay Area Governments (ABAG) to purchase and install storm drain inlet filter inserts on Village Parkway between Amador Valley Boulevard and Brighton Drive. City Council approval of a Contract for Services with ABAG is required, along with authorization to purchase the inserts and approval of a budget change to reflect additional funding and expenditures. STAFF RECOMMENDATION: Adopt Resolution Approving Contract for Services with the Association of Bay Area Governments for the Village Parkway Storm Drain Inlet Filter Insert Project; approve Budget Change; and authorize Staff to issue a Purchase Order in the amount of $4,939 to Revel Environmental Manufacturing, Inc. 4.4 Authorization to Solicit Bids -Contract No. 09-11, Fiscal Year 2009-2010 ADA Curb Ramp Installation Program (600-35) This year's Americans with Disabilities Act (ADA) Transition Plan Project (CIP No. 930007) will include the construction of approximately 18 pedestrian curb ramps. The ramps are funded through a Community Development Block Grant Recovery (CDBG-R) grant and the General Fund (1001) as identified in the ADA Transition Plan Project (CIP No. 939101). STAFF RECOMMENDATION: Approve the Budget Change in the amount of $36,760 for the portion of the project funded by Community Development Block Grant Recovery Funds; and authorize Staff to advertise for bids for Contract No. 09-11, Fiscal Year 2009-2010 ADA Curb Ramp Installation Program. 4.5 Amendment to Existing Agreement with Dublin Housing Authority in Connection with Demolition and Disposition of Arroyo Vista (600-60) The City Council will consider an Amendment to the existing Agreement with Dublin Housing Authority in connection with demolition and disposition of Arroyo Vista. This amendment will allow the Dublin Housing Authority to continue provision of services as the project progresses. STAFF RECOMMENDATION: Authorize City Manager to execute First Amendment to Agreement between the City of Dublin and the Dublin Housing Authority for the performance of services by the Housing Authority in connection with the demolition and disposition of Arroyo Vista. 4.6 Informational Report: Dublin Municipal Code Chapters in Title 2 Tat Do Not Required Revision (660-60) As part of the comprehensive update to the Dublin Municipal Code (Code), Staff reviewed three chapters (Chapters 2.10, 2.46 and 2.48) that do not need any revision. STAFF RECOMMENDATION: Receive the report. October 20, 2009 Dublin City Council Agenda Page 2 of 4 4.7 Positano Affordable Housing Agreement -Amendment No. 4 to the Affordable Housing Agreement for the First Phase of Positano (600-30) Braddock and Logan has proposed an amendment to the Affordable Housing Agreement for the First Phase of the Positano Project, which consists of a total of 1,043 single-family lots east of Fallon Road. The amendment proposes a minor change to the location of two of the Inclusionary secondary units and anon-substantive change to the provisions requiring construction of the Inclusionary Units concurrently with the market-rate units. STAFF RECOMMENDATION: Adopt Resolution Approving Amendment No. 4 to the Affordable Housing Agreement for the First Phase (416 Units) of Positano to modify the location of the inclusionary units within Part One of the First Phase of the project. 4.8 Warrant Register ($2,265,035.52) dated October 20, 2009 (300-40) STAFF RECOMMENDATION: Review and authorize the issuance of payments. 5. WRITTEN COMMUNICATIONS -None. 6. PUBLIC HEARINGS 6.1 Introduction of Ordinance Amending Dublin Municipal Code Chapters 2.08 (City Council), 2.16 (Parks and Community Services Commission), 2.18 (Heritage and Cultural Arts Commission) and 2.44 (Disaster Preparedness) (660-60) The City Council will consider minor changes to Title 2 of the Dublin Municipal Code related to Chapters 2.08 (City Council), 2.16 (Parks and Community Services Commission), 2.18 (Heritage and Cultural Arts Commission) and 2.44 (Disaster Preparedness). STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive the reading and INTRODUCE the Ordinance Amending Chapters 2.08 (City Council), 2.16 (Parks and Community Services Commission), 2.18 (Heritage and Cultural Arts Commission) and 2.44 (Disaster Preparedness) of the Dublin Municipal Code. 7. UNFINISHED BUSINESS -None. 8. NEW BUSINESS 8.1 Oral History Program Update (910-60) The City Council has a high priority objective for Fiscal Year 2009-2010 to obtain and preserve the oral histories of Dublin seniors and long-time residents. The City Council will receive an update on an Oral History Program being developed by a Consultant and Steering Committee under the direction of the Heritage and Cultural Arts Division Staff. STAFF RECOMMENDATION: Receive report. 8.2 Authorization to Participate in a Statewide Securitization Program Related to the State of California Borrowing City of Dublin Property Tax (600-50) Proposition lA, enacted by the voters in 2004, limited the State's ability to borrow or take cities' property tax revenues. This year the State of California has exercised emergency authority under Proposition lA to borrow 8% of local property taxes to assist with balancing the State Budget. This equals approximately $2.2 million for the City of Dublin. The City Council will consider authorizing participation in a financing program that will allow the City to relinquish its rights to the repayment with interest by the State of California in 2013, in exchange for the payment of the amount borrowed in two installments this fiscal year without interest. STAFF RECOMMENDATION: Authorize participation in the Proposition lA Securitization Program; adopt Resolution Approving the Form of and Authorizing the Execution and Delivery of a Purchase and Sale Agreement and Related Documents with Respect to the Sale of the Seller's Proposition lA Receivable From the State; and Directing and Authorizing Certain Other Actions In Connection Therewith. October 20, 2009 Dublin City Council Agenda Page 3 of 4 8.3 Request from Dublin Little League to Construct Bullpens at the Dublin Sports Grounds (600-30) The City Council will consider a request from Dublin Little League to construct two bullpens on Field #3 (the 90' baseball diamond) at the Dublin Sports Grounds. STAFF RECOMMENDATION: Adopt Resolution Approving Agreement Between City of Dublin and Dublin Little League Regarding Construction of Bullpens on City Property. 8.4 Year 2010-2011 Goals & Objectives and Budget Process (100-80) The City Council will be asked to confirm proposed dates for the Fiscal Year 2010- 2011 Goals and Objectives and Budget Process. STAFF RECOMMENDATION: Confirm the proposed dates associated with the Fiscal Year 2010-2011 Goals and Objectives and Budget Process. 8.5 Authorize an Agreement with Lew Edwards Group as Lead Consultant to Evaluate Opportunities for Revenue Enhancement (600-30) A high priority City Council goal for this Fiscal Year is to "undertake voter opinion research to determine community support for a revenue measure targeting resident valued enhancements." Given the threat from the State of California raiding traditional local revenues, and the inadequacy of revenue growth to keep pace with expenditures, scoping for possible additional revenue is timely and prudent. The City requested proposals from firms with expertise in the following two areas: Voter Opinion Polling and Funding Strategy / Communication Services. The City Council will consider approving an agreement with Lew Edwards Group. STAFF RECOMMENDATION: Adopt Resolution Approving Agreement with Lew Edwards Group (Lead Consultant) for Evaluation of Opportunities to Enhance Local Revenues. 9. OTHER BUSINESS 9.1 Brief INFORMATION ONLY reports from Council and/or Staff, including Committee Reports and Reports by Council related to Meetings Attended at City Expense (AB 1234). 10.
