CALL ·TO ORDER 2. PLEDGE OF ALLEGIANCE TO THE FLAG 3. ORAL COMMUNICATIONS 3.1 Proclamation declaring October 2004, Crime Prevention Month (File #610~50) 3.2 Proclamation to the Tri-Valley Babe Ruth 13-Year Old All Star Team for their lri Place Finish at the 2004 Babe Ruth World Series (File #610-50) 3.3 Public Comments At this time, the public is permitted to address the City Council on non-agendized items. Please step to the podium and clearly state your name for the record. COMMENTS SHOUW NOT EXCEED THREE (3) MINUTES. In accordance with State Law, no action or discussion may take place on any item not appearing on the posted agenda. The Council may respond to statements made or questions asked, or may request Staff to report back at a future meeting concerning the matter. Any member of the public may contact the City Clerk's Office related to the proper procedure to place an item on a future City Council agenda. The exceptions under which the City Council MAY discuss and/or take action on items not appearing on the agenda are contained in Government Code Section 54954.2(b)( 1 )(2)(3). 4. CONSENT CALENDAR Consent Calendar items are typically non-controversial in nature and are considered for approval by the City Council with one single action. Members of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item. 4.1 Minutes of Regular Meeting of September 21,2004. STAFF RECOMMENDATION: Approve 4.2 Acceptance of Work - Contract No. 02-10, Traffic Signal Upgrade - Village Parkway/ Amador Valley Boulevard (File # 600-35) This project upgraded the traffic signal system at the intersection of Village Parkway and Amador Valley Boulevard and eliminated the ftee right-hand turn island at the southeast comer at the intersection. The work is now complete and it is appropriate for the City to accept the improvements. STAFF RECOMMENDATION: Approve Change Order Nos. 2, 3 and 4; approve Budget Change in the amount of $6,001 to fully fund the project in FY 2004-05; and accept improvements and authorize the release of retention after 35 days if not subcontractor claims. 4.3 Approval ofthe Final Map and Improvement Agreement for Tract 7524, Dublin Ranch Area G, Neighborhood B-2, Phase 2 (TollaDublin, LLC) (File # 600-60) Toll-Dublin, LLC, is seeking City Council approval of the Final Map and Improvement Agreement for Tract 7524. The project is the second phase of a two-phase condominium project in Dublin Ranch Area G (Neighborhood H-2) at the northwest comer of Dublin Boulevard and Keegan Street. STAFF RECOMMENDATION: Adopt Resolution approving Final Map and Improvement Agreement. 4.4 Agreement with S&C Engineers, Inc., for Construction Management Services: I~580/ Fallon Road Interchange Improvement Project (File # 600-30) The plans and specifications for the I-580/Fallon Road Interchange Improvement Project are nearing completion, and to ensure compliance with Caltrans procedures, it is necessary to hire a consultant to perform a constructability review of the project. STAFF RECOMMENDATION: Adopt Resolution approving an agreement with S&C Engineers, Inc., not to exceed $48,658. 4.5 Approval of Consulting Services Agreement with Precision Planning Utility Consultants to Perform Design and Consulting Work for Dougherty Road Underground Utility District 2003~01 at Dublin BoulevardlDougherty Road (File #600-30) This item would approve a consultant contract with Precision Planning Utility Consultants to perform design and consulting work for Underground Utility District 2003-01, which falls within the project limits of the Dougherty Road Improvements project fTom 1-580 to Houston Place. STAFF RECOMMENDATION: Adopt Resolution approving agreement with Precision Planning Utility Consultants, not to exceed $44,500. 4.6 Approval of Consulting Agreement with WAN LAN Solutions for Network Data Switch Installation (File #600~30) WAN LAN Solutions (WLS) has submitted a proposal to provide and install network data switches to replace the City's aging equipment. The WLS proposal was the lowest in cost among the three proposals received, and has also been determined to be comprehensive and meets the needs for the City of Dublin. STAFF RECOMMENDATION: Adopt Resolution approving service agreement with WAN LAN Solutions and authorize City Manager to execute the agreement. 4.7 Acceptance of Work- Contract No. 04-06, 2003-2004 Annual Street Overlay Program (File #600-35) This annual street overlay project repaired and resurfaced various City streets with 1 W' asphalt concrete. A change order covering extra work will be presented to the City Council for approval. The work is now complete and it is appropriate for the City to accept the improvements. STAFF RECOMMENDATION: Approval Change Order No.2; and accept improvements and authorize the release of retention after 35 days if there are no subcontractor claims. 4.8 Annual Report on the Status of the Dublin General Plan: July 1, 2003 - June 30, 2004 (File # 420-30) The City Council will review the Annual Report for 2003-2004 on the Status of the Dublin General Plan (with Housing Compliance Report attached) prior to submittal to the California State Office of Planning and Research (OPR) and the State of California Department of Housing and Community Development (HCD). STAFF RECOMMENDATION: Receive and accept Annual Report on the Status of the Dublin General Plan; and direct Staff to forward the Annual Report with Attachment to the OPR and HCD. 4.9 Authorization of a Five-Year (July 1, 2004 - June 30, 2009) First Responder Advanced Life Support (FRALS) Agreement with the County of Alameda (File #600~40) This item would approve a new five-year First Responder Advance Life Support (FRALS) Agreement with the County of Alameda. The new agreement reimburses the City of Dublin for providing four (4) first responder units, which supplies an enhancement to the emergency medical services within the City of Dublin. STAFF RECOMMENDATION: Adopt Resolution authorizing Mayor to execute the FRALS Agreement. 4.10 Warrant Register ($993,586.54) dated October 5,2004 (File # 300-40) STAFF RECOMMENDATION: Approve 5. WRITTEN COMMUNICATIONS 5.1 Request from Dublin Lions Club to Reserve Emerald Glen Park for a Special Event, "Ride for the Blind" (File #290-10) The Dublin Lions Club is requesting the use of Emerald Glen Park on Saturday, June 4,2005, for their "Ride for the Blind" special event. The "Ride for the Blind" is a motorcycle poker run and is the first of what the Dublin Lions Club hopes will become an annual event. The Lions Club would like to have Emerald Glen Park be the ending point where a barbecue for the participants would be held. Additionally, the Lions Club would like to serve beer and utilize a portion of the surrounding streets for motorcycle parking. STAFF RECOMMENDATION: 1) Consider request rrom Dublin Lions Club; and 2) If approved, determine if authorization should be given to serve beer at the barbeque; if Central Parkway or Gleason Drive should be used for motorcycle parking; and if the Lions Club should be billed the cost of Staff time incurred for the event. 6. PUBLIC HEARING 6.1 Amendments to Conflict of Interest Code (Municipal Code Chapter 2.24) (File # 640-40) The Political Reform Act requires cities to adopt a Conflict of Interest Code that designates the Staff positions within the City making governmental decisions that could foreseeably affect a financial interest of the employee. This is the second reading of an Ordinance which would make changes to Section 2.24.020 of the existing Ordinance related to designated employees. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and ADOPT Ordinance. 6.2 Vicious Dog Hearing Appeal (File # 500-40) In accordance with Dublin Municipal Code (DMC) §5.36, Animal Control, a vicious dog hearing was conducted on August 11,2004. Based on substantial evidence presented at the hearing and property inspections conducted at both parties' properties, the Hearing Director determined that the dog, "Saake," owned by Morgan King, technically fit the criteria for viciousness as defined in the Municipal Code. Pursuant to DMC §5.36, Mr. King filed an appeal to the Hearing Director's determination on the grounds that he does not feel the evidence supports the determination of viciousness and the statute was not applied in a reasonable manner. STAFF RECOMMENDATION: Conduct public hearing; take testimony and evidence rrom interested parties; deliberate; and determine whether or not the findings and determination of the August 11,2004, hearing should be upheld. If the City Council determines that the findings should be upheld, it should adopt the Resolution affirming the decision of the Hearing Officer. If the City Council determines that said findings and determination should not be upheld, the City Council will need to issue alternate findings regarding the merits of the appeal, and Staff will return to the October 19, 2004, Council meeting with a Resolution setting forth the Council's findings. 6.3 City of Dublin, Emergency Shelter and Transitional Housing Regulations, Zoning Ordinance Amendment - Amendment to Chapter 8.08, Definitions; Chapter 8.12, Zoning Districts and Permitted Uses of Land; Chapter 8.20, Residential Zoning Districts; Chapter 8.24, Commercial Zoning Districts; Chapter 8.28, Industrial Zoning Districts; and Chapter 8.64, Home Occupations Regulations of the Zoning Ordinance, PA 04-029 (File #450-20) This is the first reading of a Zoning Ordinance Amendment which would regulate the use and development of emergency shelters and transitional housing for homeless persons in Dublin, and other matters, to comply with the requirements of California State Government Code Section 65863(a), Article 2, Planning and Zoning Law, and Goal F, Policy 1, and Program F.l.l of the Housing Element of the Dublin General Plan. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and INTRODUCE Ordinance. 7. UNFINISHED BUSINESS 7.1 Donlon Way Historic Area Specific Plan Update (File #910-40) Staff has completed a land use summary for properties in the proposed Specific Plan area, and is now seeking direction rrom the City Council on what potential land use changes should be considered as a part of this study. STAFF RECOMMENDATION: Provide direction to StatTon land use changes that should be considered as part of the Specific Plan study. 8. NEW BUSINESS 8.1 Dublin Ranch West (formerly Wallis Ranch) Study Session, PA 02-028 (File #410-20) The City Council will determine its direction regarding Villages, Parks, Public/Semi-Public and Neighborhood Commercial Land Use on the Dublin Ranch West (formerly Wallis Ranch) project. STAFF RECOMMENDATION: Provide StatT direction in the following areas: 1) Application of Village Policy; 2) Provision of parks in the northern section of Dublin; 3) Neighborhood Commercial site in the northern section of Dublin; and 4) Application of Public/Semi-Public Policy. 8.2 Proposed Off-Leash Dog Park at Dougherty Hills Open Space (File #920-20) The City Council has identified a dog park as one of the City's high priority goals. Staff has evaluated the Dougherty Hills Open Space site and determined that it will accommodate a two-acre dog park with areas for both large and small dogs. STAFF RECOMMENDATION: Determine if the Dougherty Hills Open Space should be modified to include an off-leash dog park; and, if approved, identify a preference for parking lot entrance location. 8.3 Response to Initial Study and Proposed Negative Declaration for the Northbound 1-680 High Occupancy Vehicle (HOV) and AuxUiary Lanes Project along the Sunol Grade (File #800-30) Caltrans is proposing to adopt a Negative Declaration concluding that a proposed project to install an HOV lane and auxiliary lanes on northbound 1-680 between Route 237 in Milpitas and Route 84 in Pleasanton would have no adverse impact on transportation and traffic in the area. Staff has reviewed the Initial Study for this project and determined it to be inadequate as it lacks supporting document and fails to analyze potential project impacts on Dublin Boulevard and other downstream routes along the 1-580 corridor resulting rrom regional cut- through traffic in the area. STAFF RECOMMENDATION: Approve proposal to submit a joint Tri-Valley response to Caltrans with detailed comments rrom the Cities of Livermore, Pleasanton and Dublin on the Initial Study and proposed Negative Declaration for the northbound 1-680 HOV and Auxiliary Lanes project along the Sunol Grade. 9.
