DUBLIN CITY COUNCIL
REGULAR MEETING - September 27, 1993 DUBLIN CIVIC CENTER

for public information and perusal several days prior to a Council meeting in the City Clerk's Office and also at
the Dublin Library.

3. ORAL COMMUNICATIONS
3.1 Presentation by Alameda County Regarding Need to Support
Proposition 172 & Measure A (1/29 Sales Tax)
The city of Dublin will not receive any sales tax directly
from Proposition 172 or Measure Ai however, if both ballot
measures fail, severe reductions in County Public Safety
Services will impact the City.
STAFF RECOMMENDATION: Adopt Resolution supporting Proposition
172 and Measure A on the November, 1993 Election Ballot
3.2 Pollution Prevention Week
The San Francisco Bay Area Hazardous Waste Management
Capacity Allocation Committee, a committee formed by the
Association of Bay Area Governments (ABAG), has requested
the city's support for Pollution Prevention Week,
October 4-10, 1993.
STAFF RECOMMENDATION: Adopt Resolution supporting Pollution
Prevention Week.
3.3 Recognition of Award to city of Dublin for Excellence in
Financial Reporting
3.4 Presentation of Savings Bonds to August Recycling Contest
Winners: Robert McCarthy, Russ Speed, Kent Haynes, Julie
Felts and Dennis Klein
3.5 Proclamation to Dublin Little League Minor A Division
"Athletics" Team for 1st District Title.
3.6 Proclamation to Rayme Meyer for past service as Dublin Library
Branch Manager
3.7 Presentation of October Customer Service Award to Bud Brewer,
Public Works Landscape Laborer
At this time, members of the audience are permitted to address the City Council on any item which is NOT on the City
Counci l Agenda. Cooments should not exceed 5 minutes. If any person feels that this is not sufficient time to
address their concern, that person should arrange with the City Clerk to have their particular concern placed on the
agenda for a future meeting. The City Council CANNOT deliberate or take action on a non-agenda item UNLESS there is
factual evidence presented to the Council indicating that the subject brought up falls into one of the exceptions
under Government Code Section 54954.2.
4. CONSENT CALENDAR
Consent Calendar items are typically of a non-controversial nature and are considered for approval by the City Council
with one single action. Members of the audience who would like an item removed from the Consent Calendar for purpose
of public input may request the City Council to remove the item. The request may be made at the time that the Mayor
asks the audience members if there is anyone interested in removing an item from the Consent Calendar.
4.1 Minutes: Regular Meeting of September 13, 1993
STAFF RECOMMENDATION: Approve
4.2 Agreement for On-Call Street Light Maintenance
This agreement provides for maintenance and repair services
for City-owned street lights. The total cost for Fiscal
Year 1993-94 is not to exceed $5,000.
STAFF RECOMMENDATION: Adopt Resolution approving agreement.
4.3 Award of Bid - Dublin Swim Center Bathhouse Renovation,
Contract 93-09
Bids for the Dublin Swim Center Bathhouse Renovation were
opened on September 14th. A total of 8 bids were received
and the low bidder, Skyline Construction, is within the
construction budget for the project.
STAFF RECOMMENDATION: Adopt Resolution awarding bid to
Skyline Construction (base bid $51,160); and authorized the
Mayor to execute the Agreement.
4.4 Scarlett Drive New Street Name PA 93-045
City Council action is required to officially name the
existing Chabot Flood Control Channel connector road
between Scarlett Court and the Dublin Boulevard extension
to Scarlett Drive.
STAFF RECOMMENDATION: Adopt Resolution approving Scarlett
Drive as new street name.
4.5 Amendment to Benefit Plan
The city's Personnel System Rules require the city Council
to adopt a Benefit Plan which prescribes the current
benefits provided to employees of the city. The City's
dental benefit carrier, Delta Dental, has proposed a 9.4%
increase in rates beginning with the October, 1993 premium.
STAFF RECOMMENDATION: Adopt Resolution amending the Benefit
Plan.
4.6 AB 434 Fund Transfer Agreements
These agreements with the Alameda congestion Management
Agency provide for transfer of $10,000 for FY 1992-93 and
$15,951 for FY 1993-94. This funding is provided by the
State through a surcharge on vehicle licenses and is to be
used for programs to reduce air pOllution.
STAFF RECOMMENDATION: Adopt Resolution approving agreements
and authorize City Manager to sign agreements on behalf of
City.
4.7 Warrant Register Dated September 27, 1993
STAFF RECOMMENDATION: Approve
4.8 Fiscal Year 1992-93 Year-End Budget Adjustments
In order to finalize the 1992-93 Financial Report, certain
budget adjustments are required. Overall, total
expenditures are less than the total budget appropriations.
However, current city Finance Policies require city Council
authorization on budget adjustments between different
activities.
STAFF RECOMMENDATION: Receive Report.
4.9 Preliminary June 30, 1993 Financial Report
Staff has prepared a Preliminary Financial Report showing
the status of city revenues and expenditures as of June 30,
1993. This report includes accruals for FY 1992-93
expenses which were paid after July 1, 1993. It does not
include any further adjustments which may be made by the
Auditors and will be disclosed in the Final Annual
Financial Report.
STAFF RECOMMENDATION: Receive Report.
5. WRITTEN COMMUNICATION
5.1 Dublin Fine Arts Foundation (DFA) Proposed Program
The city council will receive a presentation from the DFA
on their proposed new multi-year program called "Art in the
parks"
STAFF RECOMMENDATION: Approve concept to develop the program.
5.2 Economic Development Advisory Board (EDAB) School to Work
Transition Program
The Alameda County Economic Development Advisory Board
Education Committee has requested to make a presentation to
the city Council regarding the School to Work Transition
Program. The Council is also being requested to adopt a
Resolution supporting this program and to commit to
specific actions to enhance the ability of students to
enter the workforce.
STAFF RECOMMENDATION: Receive presentation; consider adoption
of draft Resolution.
5.3 Appointment by the city Council of a Representative to the
Contra Costa County Committee Dealing with the Proposed
Tassajara Valley GPA, Rezone and EIR
This 15-member Committee will review application materials,
help devise alternatives for the EIR, advise and recommend
on the GPA and Rezoning and review operational levels of
service and compliance with growth management standards for
the Tassajara Valley project.
STAFF RECOMMENDATION: Appoint representative.
6. PUBLIC HEARING
6.1 Ordinance Amending Chapter 7.04 Article IV of the city of
Dublin Municipal Code
This proposed ordinance, which was introduced at the
September 13, 1993 Council meeting, would allow the City to
require closure of a hazardous driveway. The ordinance
proposes that City Council approval be required for any
action to be taken, that other access to the site be
available or provided, and that costs be borne by the City.
STAFF RECOMMENDATION: Conduct pUblic hearing; deliberate;
waive reading and ADOPT Ordinance.
6.2 Ordinance Amending Municipal Code sections 6.04.030 and
6.04.290 and Repealing section 6.04.050 (Traffic)
This proposed ordinance, which was introduced at the
September 13, 1993 Council meeting, would simplify the
procedure for approval of turning movement restrictions and
broaden the definition of a time-limited "green" parking
zone.
STAFF RECOMMENDATION: Conduct public hearing; deliberate;
waive reading and ADOPT Ordinance.
6.3 Revision of Chapter 6.80 of the Dublin Municipal Code,
Abatement of Abandoned Vehicles
This is the second reading of an Ordinance which would
amend Chapter 6.80 of the DMC to include the definition of
"highway" into the chapter dealing with abatement of
abandoned vehicles.
STAFF RECOMMENDATION: Conduct public hearing; deliberate;
waive reading and ADOPT Ordinance.
6.4 Revisions to Dublin Municipal Code Chapter 2.28 - Campaign
contribution Limitation Ordinance
The city's current Ordinance restricts contributions to
$300 during an election period, defined as July 1st of an
election year through June 30th of the following year. The
existing Ordinance is unclear with regard to contributions
made between election periods, during "off-years". As a
result of discussion at the August 9th and September 12th
Council meetings, Staff was directed by the City Council to
prepare amendments to the Ordinance which would: 1) define
a 4-year election period for the office of Councilmember;
2) define a 2-year election period for the office of Mayor;
and 3) would allow for maximum contributions of $1,000 for
either office during an election period from a single
source.
STAFF RECOMMENDATION: Conduct pUblic hearing; deliberate;
waive reading and INTRODUCE Ordinance.

8. NEW BUSINESS
8.1 Request from Councilmember Moffatt to Distribute a smoking
Ordinance Survey to Dublin Businesses
The Tri-valley council, comprised of representatives from
the cities of Danville, Dublin, Livermore, Pleasanton and
San Ramon would like to create a uniform smoking ordinance
for all the cities in the Tri-valley. A survey, proposed
for distribution through the Chamber of Commerce newslet-
ter, will attempt to measure the business communities'
attitude regarding smoking regulations. It is proposed
that the issue of smoking regulation will be brought to
each City Council in late October.
STAFF RECOMMENDATION: Consider and provide Staff with
appropriate direction.
