THE FLAG RE, PORT OF.CLOSED SESSION ACTION OR~, CO~UN~,, CATIONS 3.1 Presentation by Student Justin Minor regarding the People to People Program (File #130-50) Justin Minor will speak about the People to People Program and discuss the education he received regarding city government and schools in Australia during a related trip. STAFF RECOMMENDATION: Receive presentation. 3.2 Acceptance of Gift to City (File #150-70) The Green Gators Parent's Committee is a group of dedicated volunteers who assist as volunteer staff and fundraisers for the Green Gators Swim Team. Through their fundraising efforts, the Committee has purchased a timing system for the program and wishes to donate that system to the City. STAFF RECOMMENDATION: Accept gift and direct Staffto prepare formal acknowledgement to donors. 3.3 Public Comments At this time, the public is permitted to address the City Council on non-agendized items. Please step to the podium and clearly state your name for the re. cord. COMMENTS SHOULD, NOT ,EXCEED .THREE (3) MINUTES. In accordance with State Law, no action or discussion may take place on any item not appearing on the posted agenda. The Council may respond to statements made Or questions asked, or may request Staff to report back at a future meeting conceming the matter. Any member of the public may contact the City Clerk's Office related to the proper procedure to place an item on a future City Council agenda. The exceptions under which the City Council MAY discuss and/or take action on items not appearing on the agenda are contained in Government Code Section 54954.2(b)(1)(2)(3). 4. CONSENT CALENDAR Consent Calendar items are typically non. controversial in nature and are considered for approval by the City Council with one single action, Members of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item. 4.1 Minutes of Regular Meeting of September 2, 2003 STAFF RECOMMENDATION: Approve 4.2 Consultant Services for Construction Management, Bray Commons (File #600-30) At its September 2, 2003 meeting, thc City Council authorized thc award of contract for the construction of Bray Commons. As the project moves into construction, Staff recommends hiring the Zahn Group as construction manager to oversee the construction of the park. STAFF RECOMMENDATION: Authorize Mayor to execute agreement. 4.3 Authorization to Solicit Bids for Contract 03-16 Street Light Pole Replacement, Phase 2 (File 8600-35) This is thc second year of a six-year phased project to replace deteriorating steel street light poles in subdivisions that were constructed in the 1960's. The cost of construction for this phase would be paid by the Citywide Street Lighting Maintenance Assessment District' STAFF RECOMMENDATION: Authorize Staff to solicit bids. 4.4 Approval of Grant of Easement to Dublin San Ramon Services District (DSRSD) for Fire Station No. 18 (File 0670-40) As part of the development of Fire Station No. 18 in Dublin Ranch Area A, DSRSD has asked the City to grant an easement for a fire service line and fire hydrant serving the fire station. The City acquired title of the property and can convey easement. STAFF RECOMMENDATION: Adopt Resolution and authorize Mayor to execute Grant of Easement. 4.5 Preliminary Financial Reports for the Months of July and August 2003 (File #330.50) STAFF RECOMMENDATION: Receive report. 4.6 Change Order Authorization - Contract No. 01-12,1-580/Tassajara Road Interchange Improvement Project (File 0600.35) The City Council will consider approvals of three Change Orders (Nos. 10, 18 and 33) to install landscape improvements along the diagonal on-ramp to westbound 1-580 adjacent to the Koll Dublin Corporate Center, required revisions to the drainage systems along the eastbound and westbound auxiliary lanes of 1-580 between Tassajara Road and Fallon Road, and the installation of additional pipe culverts along the westbound onramp. STAFF RECOMMENDATION: Approve Change order Nos. 10, 18 and 33 in the total amount of $201,954.10. 4.7 Warrant Register ($2,917,768.85) dated September 16, 2003 (File # 300-40) STAFF RECOMMENDATION: Approve WRITTEN COMMUNICATIONS, - None 6. PUBLIC HEARING e 6.1 Assessment for Weed and Refuse Abatement (File #540-50) The City Council declared that there is a public nuisance created by weeds and combustible debris growing or accumulating upon the streets, sidewalks and property within the City of Dublin. The property owner has been notified of the violations and ordered to abate the property. The property is located at and adjacent to the Alamo Creek in Dublin. An Abatement Notice was mailed via certified mail to the property owner. The property owner failed to complete the abatement and bids for completion of the abatement were received, The City contracted with Andy's Brush Clearing Service to complete the abatement, which was completed on July 18, 2003, and the Property Owner was billed for the cost of the abatement. The Property Owner has not paid for the invoice for the abatement and has been notified of the time and date of this hearing by certified mail. Notice of Hearing on Report and Assessment for Weed and Refuse Abatement was posted as required in Section 5.70.090 of the Municipal Code. STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt Resolution confirming the Report and Assessment List; and direct Staff to proceed with assessment of levy for abatement costs. UNFINISHED BUSINESS 7.1 City's Annual Volunteer Recognition Event Date (File #610-50) The CitY Council will establish a date in February 2004 for the Annual Volunteer Recognition Event. STAFF RECOMMENDATION: Establish event date. 7.2 Downtown Business Association Feasibility Study (File #600-30/470-50) The City Council will discuss the findings of the Downtown Business Association Feasibility Study, and consider retaining the Downtown Revitalization Consultants to conduct another workshop with interested downtown businesses and property owners. STAFF RECOMMENDATION: Accept the report findings and retain Downtown Revitalization Consultants to conduct another workshop; and approve Budget Change in the amount o£ $2,500. 7.3 Update on the City of Dublin Public Safety Memorial (File #610-20) The City Council will hear an update on the fundraising efforts for the Public Safety Memorial. The Council will also consider a possible authorization of a fundraiser for this project for donor engraved names on the two existing concrete benches located by the site in the Civic Center Courtyard and recognition plaques for the major donors on the sides of these concrete benches. STAFF RECOMMENDATION: 1) Approve the statue and placement of the Public Safety Memorial; and 2) Approve fundraising activity for the concrete engravings and plaques for major donors for the two existing concrete benches located along the west wall of the center courtyard of the Civic Center; - OR - 3) Provide Staff with additional direction. NEW BUSINESS 8.1 Recent Approval of State and Federal Environmental Permits (404 Permit) for the Dublin Ranch Properties and Implications for the Future (File # 600-60) Staff will present an informational report and give highlights of the Army Corps of Engineer's permit conditions, as well as the land use implications on the City's General Plan. STAFF RECOMMENDATION: Accept Staff informational report and hear presentation from representative of Dublin Ranch. 8.2 Update on the State Budget for Fiscal Year 2003-2004 (File #330-80) This report will provide the City Council with the information that is known to-date regarding the State Budget and the impacts to the City's Fiscal Year 2003-2004 Budget. STAFF RECOMMENDATION: Receive report and approve Budget Change in the amount of $456,000. Day on the Glen Festival (File #95040) The City of Dublin is producing the 2003 Day on the Glen Festival at Emerald Glen Park on September 27, 2003, from 10:00 a.m. to 8:00 p.m., and September 28, 2003, from 10:00 am. to 5:00 p.m. Staffwill present the Council with a summary of the planning to-date. STAFF RECOMMENDATION: Receive report. 8.4 Annual Report on the Status of the Dublin General Plan (File 0420-30) The City Council will review the Annual Report on the Status of the Dublin General Plan. STAFF RECOMMENDATION: Receive presentation and accept report. 8.5 Fiscal Year 2003-04 Goals & Objectives Status Report & CIP Schedule (File #100-80) Staffhas prepared a report apprising the City Council of the status of the Fiscal Year 2003-04 Goals & Objectives as of August 31, 2003, as well as a schedule for the City's Capital Improvement Program indicating estimated project start and completion dates.
