I. CALL TO ORDER 2. PLEDGE OF ALLEGIANCE TO THE FLAG 3. ORAL COMMUNICATIONS 3.1 Introduction of New Employee, Associate Planner Tasha Huston 3.2 Appointment of Patrice Geist to the Planning Commission Mayor Snyder has appointed Patrice Geist to fill the vacancy on the Planning Commission for the unexpired portion of Dan Downey's term which expires December 1996. STAFF RECOMMENDATION: Confirm appointment of Patrice Geist to the Planning Commission. At this time, members of the audience are permitted to address the City Council on any item which is NOT on the City Council Agenda. Comments should not exceed 5 minutes. If any person feels that this is not sufficient time to address their concern, that person should arrange with the City Clerk to have their particular concern placed on the agenda for a future meeting. The City Council CANNOT deliberate or take action on a non-agenda item UNLESS there is factual evidence presented to the Council indicating that the subject brought up falls into one of the exceptions under Government Code Section 54954.2. 4. CONSENT CALENDAR Consent Calendar items are typically of a non-controversial nature and are considered for approval by the City Council with one single action. Members of the audience who would like an item removed from the Consent Calendar for purpose of public input may request the City Council to remove the item. The request may be made at the time that the Mayor asks the audience members if there is anyone interested in removing an item f~om the Consent Calendar. 4.1 Minutes: Regular Meeting of August 22, 1994 STAFF RECOMMENDATION: Approve 4.2 Award of 1994 Street Slurry Seal Program Bid - Contract No 94-06 The low bid received by Valley Slurry Seal Co for $39,146.20 is within funds budgeted for the work. STAFF RECOMMENDATION: Adopt Resolution awarding bid to Valley Slurry Seal Co. and authorize Mayor to execute agreement. 4.3 Revisions to Personnel System This item amends the Resolutions establishing Management Positions Exempt from Competitive Service to include the new Economic Development Manager ClaSsification and to include Administrative Time Off provisions. STAFF RECOMMENDATION: Adopt Resolution. 4.4 Dougherty Road/Sierra Lane Traffic Signal, Contract 94-04 This project will construct a traffic signal system at the intersection of Dougherty Road and Sierra Lane as well as pavement and median work between Sierra Lane and Dublin Blvd. Plans and Specifications are now complete and ready for public bid. STAFF RECOMMENDATION: Authorize Staff to advertise for bids. 4.5 Fiscal Year 1993-94 Year-End Budget Adjustments In order to finalize the. 1993-94 .Financial RePort, certain budget adjustments are required. The current City Finance Policies require City Council authoriZation on budget adjustments between different activities. STAFF RECOMMENDATION: Receive Report. 4.6 Authorization to Solicit Proposals - Data Processing Cabling System Upgrades The 1994-95 Capital Improvement Program includes the installation of a local area computer entwork (LAN) in the Civic Center. The Network requires upgrades to the cabling system to connect computers and printers. STAFF RECOMMENDATION: ~Authorize Staff to distribute the Cablin Bid to Qualified Vendors. 4.7Warrant Register Dated September 12, 1994 STAFF RECOMMENDATION: Approve 5. WRITTEN COMMUNICATION 5.1 Invitation from the Dublin Historical Preservation Association The City Council has been invited to participate in a ceremonial event to turn over the keys for the Heritage Center to the City of Dublin. The event is sponsored by Dublin Historical Preservation Association. STAFF RECOMMENDATION: Consider Request. 5.2 Request from the Alameda County Art Commission The City Council will consider a request from the Alameda County Art Commission to support the efforts of the Foundation for the Arts in Alameda County to be recognized as a charity federation. STAFF RECOMMENDATION: Approve request & direct Staff to submit the attached letter to the Alameda County Board of Supervisors for consideration. 6. PUBLIC HEARING 6.1 Amendment to Dublin Municipal Code Chapter 5.108 related to Trip Reduction Ordinance This is the second reading of a proposed ordinance .that would adopt the BAAQMD Trip Reduction Ordinance by reference and there by allow the BAAQMD to enforce its ordinance within the City of Dublin. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and ADOPT Ordinance. 6.2 Enforcement of Vehicle Code on Dublin Boulevard from Sebille Road to Hacienda, Hacienda Drive from Dublin Boulevard to 1- 580 and Dublin Boulevard, Hacienda Drive to Tassajara Road Section 21107.5 of the California Vehicle Code (CVC) provides for enforcement on privately-owned streets which are found to be open for public use and to be indistinguishable from public streets. STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt Resolution. 6.3 Ordinance Establishing Speed Limits for Dublin Boulevard East of Southern Pacific Railroad Right-of Way and for Hacienda Drive This is the first of two public hearings on this subject. The recommended speed limits are: Dublin Blvd from the Southern Pacific Right-of-Way to Hacienda, 45 mph; Dublin Blvd from Hacienda to Tassajara, 50 mph; Hacienda Drive, 45 mph. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and INTRODUCE Ordinance. 6.4 Ordinance Amending City's Conflict of Interest Code This is the first of two public hearings on this subject. The Political Reform Act requires every local government agency to review its Conflict of Interest Code biennially to determine if it is accurate and up-to-date. Dublin's was last amended in June 1992. Since that time, there has been a reorganization in the City Manager's Office and Administrative Services Department, as well as a new position of Economic Development Director created. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and INTRODUCE Ordinance. 7. UNFINISHED BUSINESS - None 8. NEW BUSINESS 8.1 AcCeptance of Gifts to City The Dublin Senior Center has received two donations; one being a Weber BBQ from Target and the other is a $216 check from the United Way. The City will consider formal action to accept the donations. STAFF RECOMMENDATION: Accept Gifts and direct Staff to prepare formal acknowledgement to the Donors. 8.2 Civic Center Plaza Fountain/ Reactivation & Operating Cost The City Council has requested a report on the cost of re- activating and operating the Civic Center Plaza Fountain. STAFF RECOMMENDATION: Receive report & provide appropriate direction. ..... 8.3 Parks & Recreation Commission/Recreation Department Name Change The City Council will consider changing the name of the Recreation Department to Parks & Community Services Department and the Parks & Recreation Commission to Parks & Community Services Commission. STAFF RECOMMENDATION: Approve Commission & Department Name Change & Adopt Resolution. 8.4 Authorization to Secure Consultant Services for Solid Waste Collection, Landfill & Recycling Services The initial term of the current agreements for solid waste collection and recycling services will expire on April 1, 1996. Staff is requesting authorization to obtain consultant services to prepare a competitive process for extending these services. It is anticipated that the process will also result in additional programs to meet State mandated goals. STAFF RECOMMENDATION: Authorize Staff to circulate a RFQ for Consultant services and to assist with a competitive Request for Proposal process from multiple providers of solid waste services which will provide for solid waste, recycling, & landfill services after April 1, 1996. 8.5 ABAG Draft Recommended Revisions to the Constitution of the State of California The State of California recently formed a Constitutional Revision Commission t° review the budget process and how it relates to local government financing and program responsibilities. The AssociatiOn of Bay Area Government has drafted recommendations to the Commission which were forwarded to cities for comments. STAFF RECOMMENDATION: Review the proposed revisions & direct Staff to provide the appropriate written comments and/or direct the City's ABAG delegate to communicate those concerns at the General Assembly meeting which is scheduled for December 9, 1994. 8.6 Graffiti Abatement The City has experienced a substantial growth in vandalism costs primarily due to graffiti. A solution that includes participants from the private sector, community groups, as well as the City will be necessary to effectively address this growing problem. STAFF RECOMMENDATION: AuthOrize Staff to pursue formation of a Graffiti Community Task Force 9. OTHER BUSINESS - Brief INFORMATIONAL ONLY Reports from City Councilmembers and/or S~ 10.
