HomeMy WebLinkAbout*CC Agenda 08-24-1992 AGENDA DUBLIN CITY COUNCIL REGULAR MEETING - August 24, 1992 DUBLIN CIVIC CENTER Monday - 7:30 p.m. 100 CIVIC PLAZA A complete packet of information containing all Staff Reports and exhibits related to each agenda item is available for public information and perusal several days prior to a Council meeting in the City Clerk's Office and also at the Dublin Library. 1. CALL TO ORDER 2. PLEDGE OF ALLEGIANCE TO THE FLAG 3. ORAL COMMUNICATIONS 3.1 Proclamation "School's Open - Drive Safely" 3.2 September Customer Service Award - Kris Uyeno At this time, members of the audience are permitted to address the City Council on any item which is NOT on the City Counci 1 Agenda. Comments should not exceed 5 minutes. If any person feels that this is not sufficient time to address their concern, that person should arrange with the City Clerk to have their particular concern placed on the agenda for a future meeting. The City Council CANNOT deliberate or take action on a non-agenda item UNLESS there is factual evidence presented to the Council indicating that the subject brought up falls into one of the exceptions under Government Code Section 54954.2. 4. CONSENT CALENDAR Consent Calendar items are typically of a non-controversial nature and are considered for approval by the City Council with one single action. Members of the audience who would like an item removed from the Consent Calendar for purpose of public input may request the City Council to remove the item. The request may be made at the time that the Mayor asks the audience members if there is anyone interested in removing an item from the Consent Calendar. 4.1 Minutes: Regular Meeting of August 10, 1992 STAFF RECOMMENDATION: Approve 4.2 Annual Review of Balances Remaining in Developers Fees for Off-Site Improvements (AB1600) Government Code Section 66001 authorizes the City to charge developer fees for off-site improvements and requires the City Council to make annual findings regarding the amount of fees not spent within 5 years of the date of receipt. STAFF RECOMMENDATION: Receive Report 4.3 Amendment to Joint Exercise of Powers Agreement for Waste Management The City of Dublin is a member entity in the Alameda County Waste Management Authority. The Authority recognized that the amendment approved in 1990 did not address issues of importance to the member agencies. The Authority has requested approval of an amendment which is intended to address the local concerns related to the Authority of local agencies to levy fees and other matters. STAFF RECOMMENDATION: Adopt Resolution. 4.4 Abandonment of Portion of Access and Public Utility Easement The area proposed to be abandoned is the bulb of a cul-de-sac at the end of a road on the U-Haul property adjacent to Chabot Channel (off Scarlett ct.). The road is being extended to connect with the Dublin Boulevard Extension, and the bulb portion is no longer needed by the City or any utilities. STAFF RECOMMENDATION: Adopt resolution. 4.5 Infrastructure Financing Workshop The City Council had identified as a goal the development of a workshop to address options for financing infrastructure. The workshop will identify the mechanisms available, as well as present case studies. The workshop is being jointly planned with the Staff from DSRSD and Dublin Unified School District to also address their officials. Staff has prepared an agreement with a Municipal consultant to coordinate this workshop. STAFF RECOMMENDATION: 1) Approve agreement with The Davis Company; 2) Authorize the Mayor to execute the agreement; and 3) Authorize an additional appropriation of $5,833. 4.6 Financial Reports for July 31, 1992 STAFF RECOMMENDATION: Accept and file the financial reports. 4.7 Application for Assembly Bill (AB) 434 Funding Assembly Bill 434 allowed the Bay Area Air Quality District to impose a surcharge on motor vehicle registration fees to fund projects that would reduce air pollution from motor vehicles. Staff is proposing that Dublin apply for $5,335 for materials for distribution for Dublin Trip Reduction Ordinance and $30,000 for one electric vehicle for use by one of the City's Public Works Inspectors. STAFF RECOMMENDATION: Adopt Resolution. 4.8 Warrant Register Dated August 24, 1992 STAFF RECOMMENDATION: Approve 5. WRITTEN COMMUNICATION 5.1 Request for Support of Maintenance Road/Bike Path Under Interstate 580 at Alameda County Flood Control District Zone 7 Channel The City received a letter from a resident requesting support for construction of a Zone 7 maintenance road along Alamo Creek under I- 580. This road may also serve as a bicycle/pedestrian pathway in the future and provide a link between Dublin and Pleasanton. STAFF RECOMMENDATION: Support construction of maintenance road and approve sending letter to Zone 7. 6. PUBLIC HEARING 6.1 Establishment of Bus stops on Amador Valley Boulevard near Dougherty Road An Ordinance was introduced at the August 10th City Council meeting which would provide for the location of bus stops on Amador valley Boulevard near Wildwood Road/Cross Creek Circle. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and ADOPT Ordinance. 6.2 Amendment to Resolution No. 96-84 Adopting Fees for Certain Municipal Services This is an amendment to Resolution No.96-84 adopting fees for certain municipal services to include the following: Services performed - Zoning Clearance Cost: $25.00; Waiver of fees for Zoning Clearance; Photo Copies: $1.00 first page and $.10 per page thereafter; and Certification of Official City Records: $5.00 per request plus copy charge. STAFF RECOMMENDATION: 1) Open public hearing; 2) Receive Staff presentation; 3) Receive public testimony; 4) Close public hearing; 5) Deliberate; 6) Adopt Resolution. 6.3 Request for Variance to Section 3704-C Dublin Building Code to Permit an Existing Brick Fireplace and Chimney to Remain without Proper Reinforcing and Ties to the Framing at 7884 Tamarack Drive. STAFF RECOMMENDATION: 1) Open Public Hearing; 2) Receive Staff Report; 3) Receive Public Testimony; 4) Close Public Hearing; 5) Deliberate; and Adopt Resolution Approving/Denying Variance. 6.4 Appeals of Determination of Applications for Exemption from Mandatory Garbage Service In January, the City implemented an ordinance which requires a minimum level of garbage service. An exemption process is included in the law, which allows Staff to approve exemptions for those individuals which can show that garbage is not produced at the residence. Those exemptions denied by Staff can be appealed to the City Council. The City Council must conduct a public hearing regarding the appeal. Staff has prepared information on the 5 appeals received. STAFF RECOMMENDATION: 1) Receive Staff report; 2) Open a public hearing; 3) Hear Testimony from applicants and public; 4) Close Public Hearing; 5) Deliberate and make a final determination and adopt resolution approving/denying the exemption for each appeal considered. 7. UNFINISHED BUSINESS 7.1 Joint Powers Agreement for Financing Construction of East County Animal Shelter The City of Dublin in conjunction with the cities of Livermore and Pleasanton and Alameda County have been developing a mechanism to jointly develop a new Animal Shelter. A Joint Powers Agreement (JPA) has been developed which provides for the agencies to jointly share the development cost. In return, they will retain an equity interest in the facility. The City Council is requested to approve the JPA. STAFF RECOMMENDATION: Adopt Resolution. 8. NEW BUSINESS 8.1 Declaring Illegal On-Premises Advertising Display (Sign) as a Public Nuisance Council has directed Staff to begin nuisance abatement procedures for an illegal sign. To begin the abatement process, Council must declare an illegal sign as a public nuisance as specified by the Business and Professions Code. STAFF RECOMMENDATION: Adopt resolution and begin nuisance abatement proceedings. 8.2 Amendments to the Congestion Management Agency (CMA) Joint Powers Agreement to Change Quorum for CMA Board The existing CMA Joint Powers Agreement (JPA) defines a quorum as a majority of the members representing a majority of the votes. This can cause a problem when the larger cities are absent as they have the majority of the votes (by population). Also the existing JPA is silent on payment to the CMA Boardmembers at committee meetings. This amendment would cure both problems. STAFF RECOMMENDATION: Consider request to amend CMA Joint Powers Agreement to change the quorum of the CMA Board and its committee meetings, and to pay reasonable sum to elected officials for attending the meetings. 8.3 I-580/I-680 Flyover Project A subcommittee of the Business Task Force has identified potential issues with the proposed I-580/I-680 Flyover. The need for adequate mitigation measures to be included in the project, as well as flexibility with the financing is considered imperative. Without these efforts, the project will be detrimental to the City of Dublin. STAFF RECOMMENDATION: Receive report on current implications of the project, provide input, adopt resolution, and direct Staff to notify the appropriate agencies of the action taken. 9.
