COMMENTS SHOULD NOT EXCEED THREE (3) MINUTES. In accordance with State Law, however, no action or discussion may take place on any item not appearing on the posted agenda. The Council may respond to statements made or questions asked, or may request Staff to report back at a future meeting concerning the matter. Any member of the public may contact the City Clerk’s Office related to the proper procedure to place an item on a future City Council agenda. The exceptions under which the City Council MAY discuss and/or take action on items not appearing on the agenda are contained in Government Code Section 54954.2(b)(1)(2)(3). 4.CONSENT CALENDAR Consent Calendar items are typically non-controversial in nature and are considered for approval by the City Council with one single action. Members of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item. 4.1Minutes of Regular Meeting of August 4, 1998 STAFF RECOMMENDATION: Approve 4.2Comments to 1997-98 County of Alameda Grand Jury Recommendations The Government Committee of the Alameda County Grand Jury has made recommendations related to The Brown Act and Code of Ethics - Conflict of Interest Policy. In accordance with the California Penal Code, any public agency subject to its reviewing authority must respond and comment no later than 90 days after the Grand Jury submits its Final Report. STAFF RECOMMENDATION: Authorize Mayor to execute letter and direct Staff to send letter to Presiding Judge Sarkisian with copy to Neil Goodhue, Grand Jury Foreman. 4.3Amendments to Youth Advisory Committee Bylaws and Rules of Procedure The City Council will consider amending the Youth Advisory Committee Bylaws and Rules of Procedure to add two alternates to the composition of the Committee, one representing middle school and one representing high school. STAFF RECOMMENDATION: Adopt Resolution amending Bylaws. 4.4Amendments to Parks & Community Services Commission Bylaws and Rules of Procedure The City Council will consider an amendment to the Parks & Community Services Commission Bylaws and Rules of Procedure to clarify that applications for the Student Representative to the Parks & Community Services Commission go directly to the Mayor, not the Parks & Community Services Commission. STAFF RECOMMENDATION: Adopt Resolution amending Bylaws. 4.5Authorization to Solicit Bids - San Ramon Road Slope Repair, Contract 98-12 During the heavy rains of last winter, a portion of the westerly slope above San Ramon Road failed and moved downhill. This slide is located between West Vomac Road and Alcosta Boulevard. The proposed project will repair the slope by removing and replacing the failed soil area and by installing subdrains. STAFF RECOMMENDATION: Authorize Staff to advertise for bids. 4.6Award of Bid for Mape Memorial Park Pedestrian Bridge, Contract 98-07 This project will construct a pedestrian bridge across Martin Canyon Creek at Mape Memorial Park. It will connect the pedestrian path on the west side of the creek to Mape Memorial Park & Nielsen School. STAFF RECOMMENDATION: Adopt Resolution awarding bid to Biland Construction Co. ($35,720). 4.7Dublin Pasta & Jazz Festival Update GoodTimes Promotions is planning to conduct a Pasta & Jazz Festival in the City of Dublin on September 12 and 13. The planning for the event is well underway with the promoter completing an Advertising Plan, arrangements for use of private property, and scheduling of vendors and entertainment for the event. The report provides additional details about the plans for the event. STAFF RECOMMENDATION: Receive Report. 4.8Warrant Register ($1,702,975.48) dated August 18, 1998 STAFF RECOMMENDATION: Approve. 5.WRITTEN COMMUNICATIONS - None 6.PUBLIC HEARING 6.1General Motors Auto Mall - Planned Development Rezone PA 98-007 This is the second reading of an ordinance introduced at the August 4, 1998 City Council meeting. The Planned Development involves a 15 acre Auto Mall on 3 parcels on the south side of Dublin Boulevard, east of Tassajara Creek and the approved AutoNation project. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and ADOPT Ordinance. 6.2Emerald Pointe Development Agreement and “Interim” Agreement PA 98-025 The City Council will hold a public hearing on a proposed ordinance approving a Development Agreement between the City of Dublin and the Alameda County Surplus Property Authority. The DA is required by the Eastern Dublin Specific Plan. Items included in the DA include, but are not limited to, the financing and timing of infrastructure and the payment of traffic, noise and public facilities impact fees. Additionally, the City Council will consider adoption of an Interim Agreement which would be in effect until the effective date of the DA. The Interim Agreement would include similar items addressed in the DA. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and INTRODUCE Ordinance; adopt Resolution approving Interim Agreement; continue public hearing to September 1, 1998. 7.UNFINISHED BUSINESS 7.1Management Services for St. Patrick’s Day Festival As directed by the City Council at their meeting on June 16, 1998, Staff circulated a Request for Proposal for management services for the St. Patrick’s Day Festival to several firms in Northern California. After a review of the professional qualifications of the two firms who responded to the proposal, Staff is recommending that the City enter into an agreement with Terry Pimsleur & Company, Inc., to produce and manage the St. Patrick’s Day Festival. STAFF RECOMMENDATION: Give conceptual approval to contracting with Terry Pimsleur & Co., for management services. 8.NEW BUSINESS - None 9.OTHER BUSINESS - Brief INFORMATIONAL ONLY reports from Councilmembers and/or Staff 10CLOSED SESSION - None . 11ADJOURNMENT .
