HomeMy WebLinkAbout*CC Agenda 07-13-1992 A G E N DA DUBLIN CITY COUNCIL REGULAR MEETING - July 13, 1992 DUBLIN CIVIC CENTER Monday - 7:30 p.m. 100 CIVIC PLAZA A complete packet of information containing all Staff Reports and exhibits related to each agenda item is available for public information and perusal several days prior to a Council meeting in the City Clerk's Office and also at the Dublin library. 1. CALL TO ORDER 2. PLEDGE OF ALLEGIANCE TO THE FLAG 3. ORAL COMMUNICATIONS 3.1 Video Presentation "The California Dream: In Trouble" At this time, members of the audience are permitted to address the City Council on any item which is NOT on the City Counci l Agenda. Conments should not exceed 5 minutes. If any person feels that this is not sufficient time to address their concern, that person should arrange with the City Clerk to have their particular concern placed on the agenda for a future meeting. The City Council CANNOT deliberate or take action on a non-agenda item UNLESS there is factual evidence presented to the Counci l indicating that the subject brought up falls into one of the exceptions under Government Code Section 54954.2. 4. CONSENT CALENDAR Consent Calendar items are typically of a non-controversial nature and are considered for approval by the City Council with one single action. Members of the audience who would like an item removed from the Consent Calendar for purpose of public input may request the City Council to remove the item. The request may be made at the time that the Mayor asks the audience members if there is anyone interested in removing an item from the Consent Calendar. 4.1 Minutes: Regular Meeting June 8, 1992; Adjourned Regular Meeting June 9, 1992; Regular Meeting June 22, 1992 STAFF RECOMMENDATION: Approve 4.2 City Treasurer's Investment Report as of June 30, 1992 The City'S investment portfolio totals $19,199,171.88. STAFF RECOMMENDATION: Receive Report 4.3 Support of Senate Bill 1435 - Implementation of New Federal Intermodel Surface Transportation Efficiency Act (ISTEA) The Federal ISTEA program allows for Federal Transportation funding in the State of California. The Federal Legislature has already approved the program; however, the State must adopt enabling legislation for the program to become effective. STAFF RECOMMENDATION: Adopt Resolution and approve draft letter of support. 4.4 Acceptance of Contract 92-08 1992 Street Slurry Seal Program The City annually seal coats a number of the City streets as a preventative maintenance measure to keep water from entering the road base and to provide a new smoother riding surface. The project was completed within the funds budgeted. STAFF RECOMMENDATION: Accept improvements and authorize $56,054.44 payment to California Pavement Maintenance Company. 4.5 certification of June 2, 1992 Election Results The City of Dublin held a special election on June 2nd at which time voters approved the direct election of a Mayor for a 2-year term. STAFF RECOMMENDATION: Adopt Resolution declaring results of June 2, 1992 election and declare the Ordinance duly adopted by the people to be effective on July 23, 1992. 4n6 Agreement for Purchase of Property from five parcels within Tract 4978 (BJ Dublin Commercial) for Dublin Boulevard Extension This agreement provides for purchase of right-of-way for the Dublin Boulevard Extension. The $780,879 cost will be paid by the Dublin Boulevard Extension Assessment District. STAFF RECOMMENDATION: Adopt Resolution approving agreement and authorize Mayor to execute same. 4.7 Detachment from Livermore Area Recreation & Park District Two properties that were annexed to the City of Dublin in 1986 were inadvertently left a part of the Livermore Area Recreation & Park District. This could result in a duplication of neighborhood park and recreation services. STAFF RECOMMENDATION: Adopt Resolutions and direct Staff to submit an application to Alameda County LAFCO. 4.8 Amendment to Resolution Calling the November Election Language was inadvertently left out of a resolution which was adopted by the City Council on June 22, 1992 related to the City paying its pro-rata share of the election expenses to the Alameda County Board of Supervisors. STAFF RECOMMENDATION: Adopt Resolution. 4.9 Preliminary Finance Report for Month of June, 1992 STAFF RECOMMENDATION: Receive Report. 4.10 Comments on Contra Costa County Dougherty Valley Draft Environmental Impact Report Comments have been prepared by Staff on Contra Costa County's Draft EIR for Dougherty Valley, an 11,000 dwelling unit development proposed immediately to the north of the City of Dublin. STAFF RECOMMENDATION: Receive Report. 4.11 Acceptance of Work - Contract 92-04 Dublin Boulevard/ Silvergate Drive MOdification, Phase I This project modified the Dublin Boulevard/Silvergate Drive intersection to a conventional "T" configuration. The funds expended to date for design and this Phase I construction, are within budget for the total capital project. STAFF RECOMMENDATION: Accept improvements and authorize $3,497.55 retention payment to East Bay Excavating Co. Inc. 4.12 Warrant Register Dated July 13, 1992 STAFF RECOMMENDATION: Approve 5. WRITTEN COMMUNICATION - None 6. PUBLIC HEARING 6n1 Consideration of Ordinance increasing Councilmember salaries for 1992 and determination of whether Mayor should receive additional compensation City Councilmember salaries may be increased by 5% per calendar year in accordance with the California Government Code. The salary increase shall not become effective, however, until one or more Councilmembers begin a new term of office. Councilmembers currently earn $382.88 per month. STAFF RECOMMENDATION: Conduct public hearing; deliberate; determine course of action regarding salary increase; provide direction to Staff related to Mayor's compensation. 6.2 Ordinance which adopts the 1991 Edition of the Uniform Building Code, 1991 Edition of the Uniform Plumbing Code and 1991 Edition of the Uniform Mechanical Code State Law requires that the City adopt new editions of the Uniform Codes 6 months after the State has adopted same. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and INTRODUCE Ordinance; set another public hearing for July 27, 1992. 70 UNFINISHED BUSINESS 7n1 Resolution adopting the Western Dublin General Plan Amendment and Specific Plan PA 88-144 At its June 8, 1992 meeting, the City Council directed Staff to have two resolutions available for its July 13, 1992 meeting = one resolution approving up to 74 units and the other resolution up to 2 units on the Milestone property. Both resolutions would approve up to 3,131 units on the Eden property. Staff has also prepared a third resolution requested by Milestone which would proceed with a decision on the Eden property at the July 13th meeting, but defer a decision on the Milestone property until the August 24th meeting, or some subsequent date. STAFF RECOMMENDATION: 80 NEW BUSINESS 801 Alameda County Abandoned Vehicle Abatement Program Alameda County is developing an Abandoned Vehicle Abatement Authority to administer funds received by the $1.00 registration fee assessed to all vehicles registered in Alameda County. STAFF RECOMMENDATION: Adopt Resolution approving Joint Powers Agreement and authorize Mayor to execute agreement and appoint Chief of Police or designee to serve on Authority. 802 status Report on Applications for Exemption from Mandatory Garbage Service Since adoption of the Mandatory Garbage Service Ordinance earlier this year, 38 individual residents have applied for an exemption from garbage service. Since specific circumstances have surfaced which the Council may not have anticipated when the exemption process was originally developed, Staff is requesting that the Council review its policyo STAFF RECOMMENDATION: Review options and provide direction to Staff. 9.
