PLEDGE OF ALLEGIANCE TO THE FLAG 3. ORAL COMMUNICATIONS At this time, members of the audience are permitted to address the City Council on any item which is not on the City Council Agenda. Comments should not exceed 5 m:inutes. If any person feels that this is not sufficient time to address their concern, that person should arrange with the City Manager to have their particular concern placed on the agenda for a future meeting. 4. CONSENT CALENDAR Consent Calendar items are typically of a non-controversial nature and are considered for approval by the City Council with one single action. Members of the audience who would like an item removed from the consent calendar for purpose of public input may request the City Council to remove the item from the consent calendar. The request may be made at the time that the Mayor asks the audience members if there is anyone interested in removing an item from the Consent Calendar. 4.1 Minutes of Regular Meeting of June 10, 1985 STAFF RECOMMENDATION: Approve 4.2 Financial Report for Period Ending May 31, 1985 STAFF RECOMMENDATION: Approve 4.3 Acceptance of Contract 84-7 Village Parkway Wall Printex/Sierra Precast, Inc., the contractor for the construction of the precast wall on the west side of Village Parkway, between Amador Valley Boulevard and Kimball Avenue have completed their work under Contract 84-7. STAFF RECOMMENDATION: Accept the improvements as constructed, authorize a budget transfer in the amount of $3,880, and authorize final paYment in the amount of $26,707.80 4.4 Claim of Bette Jean De La Fuente On June 7, 1985, the City received a claim submitted on behalf of Bette Jean De La Fuente, as a result of injuries sustained in an automobile accident on March 8, 1985. The claim contends that a traffic lane was closed and improper warning was given to the motorist. It appears that the accident occurred during the major street rehabilitation project which was performed by an independent contractor, Gallagher and Burk, Inc. STAFF RECOMMENDATION: Deny claim and direct Staff to notify claimant & City's Insurance Broker 4.5 Claim of Dale Eugene Spencer On June 11, 1985, the City received a claim submitted on behalf of Dale Eugene Spencer, as a result of injuries sustained in a bicycle accident on May 20, 1985. The claim contends that a dangerous condition existed on Village Parkway at Tamarack Drive, as a result of a trench dug in the street. It appears that the trench was part of the Village Parkway Wall Landscaping project. This project was being constructed by an independent contractor, MCE Corporation. STAFF RECOMMENDATION: Deny claim and direct Staff to notify claimant & City's Insurance Broker 4.6 Claim of Anthony Buccola On June 17, 1985, the City received a claim submitted on behalf of Anthony Buccola, as a result of an injury sustained by a volunteer firefighter in the parking lot of the Shannon Community Center on March 16, 1985. STAFF RECOMMENDATION: Deny claim and direct Staff to notify claimant & City's Insurance Broker 4.7 Acceptance of, Trafflc Signal Easement Deed - Southeast Corner of Dublin Boulevard and Clark Avenue This easement allows a large mast area traffic signal pole to be installed at its ultimate location. STAFF RECOMMENDATION: Adopt resolution; Instruct City Clerk to record documents. 4.8 Warrant Register dated June 24, 1985 STAFF RECOMMENDATION: Approve 5. PUBLIC HEARING 5.1 Appeal of Planning Commission action to deny PA85-022 Wildis North America Corporation/All Seasons Riding Academy Conditional Use Permit Appeal of Planning Commission denial of All Seasons Riding Academy Conditional Use Permit application to operate a therapy center and public gathering place in the Village Square Shopping Center, 7373 Village Parkway. Issues involve 1) land use; 2) property owner opposition; and 3) bingo competition. STAFF RECOMMENDATION: Open public hearing; hear presentation and testimony; pose questions; close public hearing; deliberate; adopt resolution as appropriate. 5.2 Appeal of Planning Commission to deny PA85-023 James Lange request for 4 variances Appeal of Planning Commission denial of Lange Variance application for four variances to allow construction of an automobile glass replacement facility at 6997 Dublin Boulevard. Issues involve 1) General Plan consistency; and 2) adequacy of site for proposed use. STAFF RECOMMENDATION: Open public hearing; hear presentation and testimony; pose questions; close public hearing; deliberate; adopt resolution as appropriate. 5.3 Adoption of the 1984 National Electrical Code State law requires cities to adopt model codes within 1 year after adoption by the State Department of Housing and Community Development. The proposed code reflects technological changes and clarifies developments in the field. STAFF RECOMMENDATION: Open public hearing and receive testimony from Staff and members of the public; close public hearing; deliberate; waive reading and adopt ordinance 5.4 Amendment to Building Code Relating to Access to Building for the Handicapped State law requires cities to adopt regulations approved by the State Department of Housing and Community Development. The requirement has resulted in the need for the City to adopt standards for accessibility to buildings for the handicapped. The proposed ordinance will also clarify conflicts between the Uniform Building Code and the State Administrative Code. STAFF RECOMMENDATION: Hear Staff presentation; open public hearing; hear public testimony; close public hearing; waive reading and adopt ordinance 5.5 Ordinance Regarding No Parking Zones - Regional Street and on Amador Plaza Road These no parking zones will improve sight distance from various driveways and were part of a study by the City Traffic Engineer for providing 2-way left turn median lanes. STAFF RECOMMENDATION: Wai ve reading and adopt ordinance on an urgency basis. 6. UNFINISHED BUSINESS 6.1 Citywide Street Lighting Maintenance Assessment District During 1984-85, the City levied its first assessments for the maintenance and energy costs associated with street lights throughout the City. It is anticipated that 1984-85 revenues will exceed expenditures by $13,350. It is proposed that the reserve be carried over to 1985-86 to fund the street lighting costs. The total projected costs for 1985-86 are $143,350, which will require assessments totaling $130,000. The increase in cost over the prior year is required by the addition of lights and anticipated increases in energy costs. STAFF RECOMMENDATION: 1) Adopt resolution approving Preltminary ~ngineer~s Report, Confirming Diagram and Assessment; 2) Aaopt resolutlon appoln~lng tlme ahd place of hearing protests in relation to proposed assessments. 7 . NEW BUSINESS 7.1 Dublin Sports Grounds Site Improvements At the Park & Recreation Commission meeting of June 11, 1985, the Commission re- viewed the site improvements for the Dublin Sports Grounds. The Commission found the plan to be favorable but were concerned that the satellite picnic tables were too far from the parking lot; that there needs to be restroom facilities on the far side of the park; and that the group picnic area should have water and BEQ's. STAFF RECOMMENDATION: 1) Review plan and Commission comments; 2) Direct Staff to forward comments to DSRSD 7.2 Restriction of Commercial Truck Parking The City Traffic Engineer has conducted a study as a result of complaints relating to long term truck parking on public streets. The report outlines the potential problems associated with the parking of commercial trucks. A suggested method of dealing with the problem is to restrict the parking of commercial trucks to no more than 2 hours unless they are loading or unloading. STAFF RECOMMENDATION: Direct the City Attorney to develop an ordinance as appropriate and establish a public hearing for July 8, 1985. 7.3 1984-85 Budget Modifications It is anticipated that during Fiscal Year 1984-85 revenues will be in excess of 1984-85 appropriations by approximately $452,010. The precise amount will be determined at the time that the City's accounting ledgers are closed. Pursuant to State Law, the additional revenues must be appropriated. STAFF RECOMMENDATION: Appropriate excess revenues in General and Gas Tax funds to Street Improvement Reserve and appropriate excess revenues in all other funds to Reserve for Authorized Projects 8. OTHER BUSINESS 9.
