DUBLIN CITY COUNCIL
REGULAR MEETING - May 11, 1987

3. ORAL COMMUNICATIONS
At this time, members of the audience are permitted to address the City Council on any item which is not
on the City Council Agenda. Comments should not exceed 5 minutes. If any person feels that this is not
sufficient time to address their concern, that person should arrange with the City Manager to have their
particular concern placed on the agenda for a future meeting.
4. CONSENT CALENDAR
Consent Calendar items are typically of a non-controversial nature and are considered for approval by
the City Council with one single action.
Members of the audience who would like an item removed from the consent calendar for purpose of public
input may request the City Council to remove the item from the consent calendar. The request may be
made at the time that the Nayor asks the audience members if there is anyone interested in removing an
item from the Consent Calendar.
4.1 Minutes of Regular Meeting of April 27, 1987
STAFF RECOMMENDATION: Approve
4.2 City Treasurer's Investment Report for Period Ending April 30, 1987
STAFF RECOMMENDATION: Approve
4.3 Claim Submitted by Rose Jurich on April 24, 1987 (No. 0013)
This claim alleges that Ms. Jurich received a fractured elbow and stitches to her upper lip
as a result of a fall on a City sidewalk. The total amount claimed is $100,000.
STAFF RECOMMENDATION: Deny claim and authorize Staff to notify claimant.
4.4 Landscaping and Lighting Maintenance Assessment District No. 83-2 (Tract 4719)
This resolution authorizes Staff to prepare the Engineer's Annual Report for this assessment
district.
STAFF RECOMMENDATION: Adopt resolution directing the preparation of the Annual Report for the
Landscaping and Lighting District No. 83-2.
4.5 Claim submitted by Industrial Indemnity Company on April 28, 1987 (No. 0014)
This claim involves alleged damages when an employee of Castle Construction was injured
during his course of employment, when the employee stepped into a depression between the
unfinished portion of the pavement and a manhole cover located on Ig1acia Street.
STAFF RECOMMENDATION: Deny claim and direct Staff to notify claimant and the City's Insurance
provider.
4.6 Dublin Street Lighting Maintenance Assessment District
This resolution authorizes Staff to prepare the Engineer's Annual Report for this assessment
district.
STAFF RECOMMENDATION: Adopt Resolution directing the preparation of the Engineer's Annual
Report for the Street Lighting Maintenance Assessment District.
4.7 Warrant Register dated May 11, 1987
STAFF RECOMMENDATION: Approve
4.8 Bail Schedule for Infraction Ordinance
On January 26, 1987, the City Council adopted Ordinance No. 7-87 which made violations of
the Building Regulations & Zoning Ordinance infractions. It is now necessary for the City
Council to adopt a bail schedule which must be approved by the court. There are provisions
in the law for reduced bail in the event the violation is corrected within the time
specified.
STAFF RECOMMENDATION: Adopt resolution setting bail schedule for infractions
5. WRITTEN COMMUNICATIONS
5.1 Request by Ted Fairfield to participate in a Traffic Improvement Study
The City has received correspondence suggesting that the City of Dublin participate in an
independent engineering study of the benefits to be derived by properties north of 1-580
from specific improvements scheduled to be built by Pleasanton's North Pleasanton
Improvement District. Prior consideration by the City Council on a related matter resulted
in notification to the City of Pleasanton that a study would be inappropriate prior to the
City receiving a development plan from the impacted area.
STAFF RECOMMENDATION: 1) Consider Request; 2) If Council concurs with Mr. Fairfield's request,
direct Staff to arrange a meeting with the City of Pleasanton and the County of Alameda to
develop ground rules for the study.
5.2 Request from Fire Chief Philip Phillips, DSRSD requesting the banning of sale and use of "safe
and sane" fireworks within the City of Dublin
Fire Chief Phillips has directed a letter to the City requesting consideration of an
ordinance banning the sale of safe and sane fireworks in the City of Dublin. The County
Board of Supervisors recently enacted a similar ordinance affecting all of the
unincorporated areas in the County.
STAFF RECOMMENDATION: Review and consider Chief Phillips' request.
5.3 Administrative Charges for Engineering Services
The City Manager received a request from a representative of Kaufman & Broad to refund
administrative overhead fees collected on engineering work performed by contractors on
behalf of the City of Dublin. The existing City Resolution establishing fees states that
the construction inspection fee shall be the actual cost of inspection. In accordance with
this policy, Staff has collected an administrative fee which reflects overhead items, i.e.,
rental expense, utilities, insurance, supervision, etc.
STAFF RECOMMENDATION: Accept City Attorney's Statement and take no action.
6. PUBLIC HEARING
6.1 Sale of Excess Right-of-Way to the Fishery Restaurant
The Fishery Restaurant has requested to purchase 3,671 sq. ft. of the City's excess right-
of-way on San Ramon Road. The City is required to hold a public hearing prior to sale of
public property.
STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt resolution approving sale and
authorizing Mayor to consummate agreement.
6.2 Ordinance Related to Fly Control
This ordinance, which was introduced at the City Council meeting of April 27, 1987 would
make it unlawful for a person to create, allow or maintain a fly nuisance, allow waste to
become a harborage or food source for rodents, or result in the unreasonable production of
odors.
STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and adopt ordinance
6.3 Dublin Downtown Specific Plan and Associated General Plan Amendment
The Dublin Downtown Specific Plan has been prepared to help maintain the downtown as the
commercial center of the Tri-Valley area. The Plan contains a number of policies, various
implementation strategies and several minor changes to the General Plan.
STAFF RECOMMENDATION: Conduct public hearing; hear Staff and Consultant presentations and
Downtown Improvement Study Committee/public comments on each issue; provide conceptual guidance;
continue until staffing and cost implications are resolved as part of the 1987-88 budget review.

8. NEW BUSINESS
8.1 City of Dublin Membership: Dublin Sister City Association
At the regular City Council meeting of April 27, 1987, Cm. Snyder suggested that the City
consider membership in the newly formed Sister City Association. This group has extended an
invitation to a delegation from Bray, Ireland, to attend the Shamrock Festival in July.
STAFF RECOMMENDATION: Consider membership for the City of Dublin in the Sister City
Association.
8.2 Tri-Valley Transportation Entity
The City has received a request from William Fraley, Alameda County Planning Director, for
$1,500 for several computer runs for a tri-va11ey-wide transportation plan. The letter from
Mr. Fraley also indicates a request for endorsement of a Tri-Valley Transportation Entity.
STAFF RECOMMENDATION: Review and comment, and direct Staff to transmit comments to Alameda
County.

11. ADJOURNMENT - Due to the Memorial Day Holiday, the next regular meeting of the City Council will be
held on Tuesday, May 26, 1987, 7:30 p.m., Dublin Library
