CALL TO ORDER & PLEDGE OF ALLEGIANCE TO THE FLAG 2. ORAL COMMUNICATIONS At this time, members of the audience are permitted to address the City Council on any item which is NOT on the City Council Agenda. COIIIllents should not exceed 5 minutes. If any person feels that this is not sufficient time to address their concern, that person should arrange with the City Clerk to have their particular concern placed on the agenda for a future meeting. The City Council ~ deliberate or take action on a non-agenda item UNLESS there is factual evidence presented to the Council indicating that the subject brought up falls into one of the exceptions under Government Code Section 54954.2. 2.1 Proclamation Honoring Alice pitchford 2.2 Presentation of Citizen of the Year Award to Karen Seals 2.3 Presentation of Organization of the Year Award to the Dublin Soroptimists 2.4 Proclamation declaring April, 1990 as "California Earthquake Preparedness Month" 3. CLOSED SESSION 3.1 Government Code Section 54956.9(a), Title of Litigation is not stated because to do so would jeopardize the City's ability to conclude existing settlement negotiations to its advantage. 4. CONSENT CALENDAR Consent Calendar items are typically of a non-controversial nature and are considered for approval by the City Council with one single action. Members of the audience who would like an item removed from the Consent Calendar for purpose of public input may request the City Council to remove the item. The request may be made at the time that the Mayor asks the audience members if there is anyone interested in removing an item from the Consent Calendar. 4.1 Minutes of Regular Meeting of March 12, 1990 STAFF RECOMMENDATION: Approve 4.2 1990 Census April 1, 1990 will mark the nation's 21st census. The 1990 Census is expected to be the largest and most complex ever undertaken. The Census Bureau expects to count 250 million people and 106 million housing units. STAFF RECOMMENDATION: Adopt Resolution declaring March 25-31, 1990 as "Census Awareness Week". 4.3 Request from Dublin Little League to Waive Use Fees for Challenger Division Dublin Little League has requested that the use fees be waived for the Challenger League of Little League designed for handicapped youth. STAFF RECOMMENDATION: Grant request to waive fees for Challenger Division of Dublin Little League. 4.4 Lucky/A's Youth Baseball Fields Program Staff has prepared an application for grant funding for the renovation of the Dublin High School baseball fields under the Lucky/A's Baseball Fields Program. STAFF RECOMMENDATION: Adopt Resolution 4.5 Frederiksen School Kindergarten Tot Lot The City Council will review a proposal for landscape architectural services for the renovation of the Frederiksen School Tot Lot. STAFF RECOMMENDATION: Authorize Staff to prepare necessary contract agreement documents with a cost not to exceed $5,300. 4.6 Award of Bid, Contract 90-3, Annual Sidewalk Safety Repair Program; Handicap Ramp Construction, Modification of Civic Center Service Driveway; and Dublin Boulevard Sidewalk (South Side @ Clark Avenue) The low bid, $107,731.85, is within total funds budgeted for 3 portions of the project. The 4th portion, the Civic Center Service Entrance, was not budgeted at the time the project was bid. STAFF RECOMMENDATION: 1) Adopt Resolution awarding bid to B & B Concrete; 2) authorize Mayor to execute agreement; 3) authorize budget transfer in the amount of $2,200 from the Sidewalk Repair Capital Improvement Project (CIP) to the Dublin Boulevard Sidewalk @ Clark Avenue CIP; and 4) create a new ClP for the previously unbudgeted Civic Center Service Entrance and authorize a budget transfer in the amount of $18,000 from Annual Overlay Project. 4.7 Award of Bid, Contract 90-2, Alamo Creek Park Phase II The low bid received ($229,556 for base bid; $$271,356.91 with alternates) exceeds funds budgeted; however, Staff is recommending that all bid items be constructed at this time. STAFF RECOMMENDATION: 1) Adopt Resolution awarding bid to RMT Landscape; 2) authorize Mayor to execute agreement; 3) authorize budget transfers of a) $38,000 from the Underground utilities- Dougherty Road project; b) $10,000 from the Traffic Signal Pre- Emption project; c) $10,000 from the Traffic Signals-Village Pkwy/Brighton Dr and Village Pkwy/Tamarack Dr project; d) $17,000 from the 1-580/1-680 Ramp Widening project; and e) an unallocated appropriation of $26,285 from Unallocated Reserves. 4.8 Acceptance of Final Map, Tract 6258, Park Wood Circle (Village III) - Rafanelli & Nahas Tract 6258 is located at the intersection of Dougherty Road and wildwood Road. STAFF RECOMMENDATION: Adopt Resolution accepting Final Map and authorizing Mayor to execute agreement. 4.9 Award of Bid, Contract 90-4, Annual Street Overlay and Repair Program Staff is recommending that the low bid be rejected because the bidder's submittal is incomplete. The low bidder, Bay Cities Paving, has protested this recommendation. The second lowest bid ($419,674), from Granite Construction, is within funds budgeted for construction. STAFF RECOMMENDATION: 1) Deny protest from Bay cities Paving; 2) reject bid submitted by Bay Cities Paving and adopt Resolution awarding bid to Granite Construction; and 3) authorize Mayor to execute agreement. 4.10 Acceptance of Work, Contract 88-7, San Ramon Road Phase III Street Reconstruction, Widening, Traffic Signals, Bike Path, and Landscaping This project was completed within overall funds budgeted; however, the portion of the project completed in FY 1989-90 is over budget this year and will require additional funds. STAFF RECOMMENDATION: 1) Accept improvements under Contract 88-7; 2) authorize release of securities and retention payment to Gallagher and Burk in the amount of $48,168.22; and 3) authorize a transfer of $94,497.84 from unallocated reserves. 4.11 Warrant Register Dated March 26, 1990 STAFF RECOMMENDATION: Approve 4.12 Resolution Declaring Intention to Issue Bonds for the Purpose of Providing Financing for Certain Public Street Improvements By adopting this ReSOlution, the City will be able to take advantage of tax exempt bonds for the purpose of financing public infrastructure improvements in the future by reducing the overall cost of constructing improvements through future assessment districts. STAFF RECOMMENDATION: Adopt Resolution 5. WRITTEN COMMUNICATION - None 6. PUBLIC HEARING - None 7. UNFINISHED BUSINESS 7.1 First Western Development PD, Planned Development Rezoning On March 12, 1990, the City Council held a public hearing on PA 89-050, First Western Development Planned Development Rezoning. After closing the public hearing, the city Council directed Staff to develop language for wall signage on the east building elevation, subject to a Conditional Use Permit. The City Council continued the item. STAFF RECOMMENDATION: Receive Staff presentation; question Staff, Applicant and -the public; deliberate; adopt Resolutions -OR- give Staff and Applicant direction and continue the item to the April 9, 1990 City Council meeting. 8. NEW BUSINESS - None 9. OTHER BUSINESS 10. ADJOURNMENT - Adjourn to Soecial Meeting on Tuesday, March 27. 1990. 6:30 D.m.. Civic Center Regional Meeting Room, for Status Report on 1989 Goals & Objectives and Establishment of 1990 City Goals & Objectives The Special Joint City Council/Planning Commission meeting scheduled for Monday, ADril 2. 1990 to discuss land use alternatives for the West Dublin study Area has been cancelled. A new date will be scheduled. The next Reaular Meeting of the Dublin City Council will be Monday, April 9, 1990, 7:30 p.m., Dublin civic Center.
