ORAL COMMUNICA nONS 3.1 Recognition of Participants in Dublin's Inaugural Leadership Academy The Dublin Leadership Academy, a l2-week program, was designed to inform participants abont !be iS5lles facing the community, and to encourage community involvement at all levels. Thc Academy, which held its last class on March 10"', included topics such as public safety, local government and community services. Participants were: John Archer, Ronald DeDiemar, Steve Johns, Patricia Kohnen, John Ledahl, Duane Legins, Margaret Me; Lee, Brent Moffitt, Greer Payton, Patrick Schmidt, Kyung·Seon Stempf, Thomas Taylor, Doreen Wehrenberg, John West and Rose Zaragoza. STAFF RECOMMENDATION: Recognize participants of Dublin's first Leadership Academy 3.2 Presentation by Alameda COUDty Library (File # 940-50) The City ConnciJ wiJ] receive a presentation by the Dublin Library Branch Manager on a community partnership to showcase the statewide campaign fur the "Califurnia Stories Uncovered" program. STAFF RECOMMENDATION: Receive presentation 3.3 Appointment by Mayor to Tri-VaJley Community Television (CTV) Board (File # 110-30) The Cities of Dublin, Livermore, Pleasanton and San Ramon make two appoiDlments per City to the Tri-Valley CTV Board. According to the CTV Bylaws, there is no limit on the number of terms board members may serve. Mayor Lockhart has reappointed Valerie Barnes for an additional term. STAFF RECOMMENDATION: ConfIrm the Mayor's reappointment of Ms. Barnes to the CTV Board. 3.4 Public Comments At thi" time, the public 16 permitted to address the City Council on non-agendlzed items. Members of the audience, Staff or the City Council who would like an i!em removed from the Consent Calendar for purposes of publiC input may "quest the Mayor to remove the il8m. 4.1 Minutes of Special Meetiug of February 26, 2005 STAFF RECOMMENDATION: Approve 4.2 Authorization to prepare Engineer's Report for Street LightiDg MainteDance AssessmeDt District 83---1 (File # 360-50) This assessment district funds the maintenance of the City's street lighting system, except for lights in Dublin Ranch and Tract 7067 (Clifden Parc). This action would authorize Staff to begin preparation of the Engineer's Report for 2005-06. A public hearing will be held prior to the levy of assessments. STAFF RECOMMENDATION: Adopt Resolution. 4.3 Authori:zation to prepare EDgineer's Report for Landscaping & Lighting MainteDance Assessment District 83-2 (Stagecoach Road Area) (File # 360-20) This assessment district funds the maintenance of street-side landscaping aJong Stagecoach Road and on the interior slopes of the Dublin Hills Estates development. This action would authorize Staff to begin preparation ofthe Engineer's Report for 2005-06. A public hearing will be held prior to the levy of assessments. STAFF RECOMMENDATION: Adopt Resolution. 4.4 Authorization to prepare Engineer's Report for Landscaping & Lighting Maintenance Assessment District 86--1 (Dougherty Road) (File # 360-20) This assessment district funds the maintenance of street-side landscaping along portions of Dougherty Road and Amador Valley Boulevard and certain common area landscaping within the Villages @ Willow Creek development. This action would authorize Staff to begin preparation of the Engineer's Report for 2005-06. A public hearing will be held prior to the levy of assessments. STAFF RECOMMENDATION: Adopt Resolution. 4.5 Authorization to prepare Engineer's Report for Landscaping & Ligbting MainteDance Assessment District 97·1 (Santa Rita Area) (File # 360-20) This assessment district funds the maintenance of street-side landscaping within the Santa Rita development area, which is generally bounded by 1-580, Gleason Drive, Arnold Road and Tassajara Road. This action would authorize Staff to begin preparation of the Engineer's Report for 2005-06. A public hearing will be held prior to the levy of assessments. STAFF RECOMMENDATION: Adopt Resolution. 4.6 Authori;¡:ation to prepare EDgineer's Report for Street Lighting Maintenance AssessmeDt District 99-1(Dublin Ranch) (File # 360-20) This assessment district funds the maintenance of the City's street lighting system in Dublin Ranch and Tract 7067 (Clifden Parc). This action would authorize StafI'to begin preparation of the Engineer's Report for 2005-06. A public hearing will be held prior to the levy of assessments. STAFF RECOMMENDATION: Adopt Resolution. 4.7 Approval of Pareel Map 8275 and Improvement Agreement (Dublin Transit Center, Site A) (File # 600-60) Parcel Map 8275 subdivides the property owned by the Surplus Property Authority of the County of Alameda, referred to as Site A in the Dublin Transit Center. Site A is the area surrounded by Dublin Boulevard, DeMarcus Boulevard, the BART property and the Iron Horse Trail This Parcel Map subdivides 8.3 acres into three parcels and dedicates the right-of-way for Campbell Lane. Parcel 2 of this Parcel Map is being purchased by EAII, Inc., to be developed in accordance with the Stage 2 Planned Development Zoning approved by Planning Commission Resolution No. 04-14 on February 24, 2004. STAFF RECOMMEND A nON: Adopt ResolutioD. 4.8 FinaDcial Reports for the Months of January and February, 2005 (File # 330-S0) STAFF RECOMMENDATION: Receive Reports. 4.9 Records Management Program - Retention Schedule (File # 160-20) An up-to-date Retention Schedule is the City's legal authority to receive, create, retain and dispose of official public records, and the Retention Schedule is a key component to the City's Records Management Program. In order to include a wider range of records than what is contained in the City's current Retention Schedule which was adopted in 1996, the City Clerk's Office recommends that the City adopt the Local Government Records Management "City Records Retention Guidelines" as provided for in Government Code Section 12336, and as may be amended trom time to time. Additionally, Government Code Section 34090.5 addresses destruction of duplicate records once stored on other mediums. STAFF RECOMMENDATION: Adopt Resolutiou adopting the Local Government Records Management "City Records Retention Guidelines" as the City's Records Retention Schedule and granting authority for destruction of records in compliance with Government Code Section 34090.5. 4.10 Emerald GleD Park Phase m - Consultant Services for Construction Management (File # 600-30) In January 2005, Staff solicited a Request for Proposal from 12 construction management firms. After receiving 4 proposals, Don Todd Associates had demonstrated in their proposal aud interview the experience necessary for the project. STAFF RECOMMENDATION: Approve and authorize Mayor to execute Agreement. 4.11 WarraDt Register (53,307,437.04) dated March IS, 2005 (File # 300-40) STAPF RECOMMENDATION: Approve S. PUBLIC HEARING 6.1 Amendments to the IDelusionary Zoning Regulations elarifyiDg the sales price for very low- income units, adding additional priorities for selection of occupaDts of iDelusionary affordable units, and other clarifying ameDdments PA 01-038 (File # 430-20) This is the second reading of an Ordinance which would amend the Inclusionary Zoning Ordinance regulations by making clarifying amendments and which would authorize changing the "Layperson's Guide to the Inclusionary Zoning Ordinance Regulations" to reflect the changes. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and adopt Ordinance amending Chapter 8.68 of the Dublin Municipal Code. 6.2 Pfeiffer RaDcb Investors n, Inc. - Development AgreemeDt for Silvera Ranch (PiDD Brothers Fine Homes) PA 02-024 (File # 600-60) This is the second reading of an Ordinance approving a Development Agreement (as revised by the City Council) between the City of Dublin and Pfeiffer Ranch Investors II, Inc., for the Silvera Ranch residential subdivision being developed by Pinn Brothers Fine Homes. The Development Agreement proposed for approval will serve to implement the conditions of approval, physical improvements and other requirements for the project. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and adopt OrdiDance. 6.3 Dublin Ranch West submitted by James TODg on behalf of ChaDg Su-O (aim Jennifer) Lin, et al to consider Planned DevelopmeDt (PD) Prezone; Anoexatlon Applicatioo; AmeDdment to the General Plan; Amendment to the Eastern Dublin Specific PlaD;Planned Develop· ment RezonelStage 1 Development Plan; Environmental Impact Report (EIR)/MitigatioD Monitoring & Reporting Program; and Pre-Annexation Agreement PA 02-028 (File # 620-20/42( ...301600-60) This projcct consists of approximately 189 acres of land proposed for annexation to both the City and DSRSD. The site is located in unincorporated Alameda Connty. The project includes a General Plan and EDSP Amendment for the Lin Property only to replace a 9.7 acre elementary school site with Medium High Density residential to replace neighborhood commercial land use with Open Space Land Use and approval of a Stage I prezoning for the entire property. STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt ResolutioD(s) I) certifying the Supplemental ElR and adopting CEQA findings, a statement of overriding considerations, and a Mitigation Monitoring & Reporting Program; and 2) approving Amendments to the GP and EDSP for the Lin Family property; waive reading and INTRODUCE Ordinance approving a PD Prezone with Stage 1 Development Plan for Dublin Ranch West; adopt Resolutionls) 1) approving a Pre-Annexation Agreement; and 2) direCting Staff to file an application with Alameda County Local Agency Fonnation Commission (LAFCO) for annexation to the City and to DSRSD. 6.4 Emerald Glen Park Phase ill - EDvironmental Review and Award or Bid (File # 600-35) In February, 200S, the City Council authorized Staff to advertise for bids for Emerald Glen Park, Phase m. After a 4-week bid period, on March 7, 2005, the City received S bids (Interstate Grading & Paving, Cleary Brothers Landscape Incorporated, }Wbert A. Rothman, ValleyCrest Landscape Development, and 0 C Jones and Sons, Inc.). In addition, the City prepared an Initial Study and draft Mitigated Negative Declaration for PA OS--009, Emerald Glen Park Phase III, dated February 22, 200S for the third phase of improvements to the park, consistent with CEQA Guidelines Section IS162. STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt Resolution adopting the Mitigated Negative Declaration and Mitigation Monitoriug Program; adopt Resolution awarding base bid - OR - awarding base bid with alternates, as appropriate, to Cleary Brothers Landscape, Incorporated. 7. JNFINI&HED BUSINESS 7.1 Review of park and open spue issues with the AlternatIve Land Use PlaDs for future private development at Camp Parks (File # 420-20) The City Council will review and consider Staff's analysis ofthe top 3 land use plans for Camp Parks as they relate to parks and open space issues and provide direction to Staff and the Army on 2 main issues: linear parks and unique park fucilities. STAFF RECOMMENDATION: Consider Staff's analysis and provide direction on the following issues: I) size and configuration of linear parks; and 2) retaining a consultant for park planning purposes. 8. NEW BUSINESS 8.1 Approval of Agreemeut with the Lin Family regardiug a proposed Community Park in DubliD Ranch (File # 60( ...60) A Condition of Approval for the Tract 7281 Final Map requires th.e Lips to enter into an agreement with the City regarding the conveyance and grading of a community park site prior to obtaining a grading peffiÚt for the area west of Lockhart Street. The Agreement regarding a. Proposed Community Park in Dublin Ranch will satisfY this requirement. The Agreement details the responsibilities of the Lins and thc City for conveying the community park site to the City and preparing the site for development. STAFF RECOMMENDATION: Adopt ResolutioD approving the Agreement regarding a Proposed Community Park in Dublin Ranch. 8.2 Report on 2005 Dublin Pride Week Activities and Acceptance of Donations to the City (File # 150-70/150-80) Dublin Pride Week is an annual event which seeks to promote a positive image for the City of Dublin. This year's event includes activities such as senior and school assistance volunteer projects, nature walk, poster contest, blood drive, canned food drive, e-wastc collection, and "Pride of Dublin" orchid sales. Dublin Pride Week is schednled for April 16-23. STAFF RECOMMEND A nON: Accept donations &om Waste Management, ANG Newspapers, Dublin/San Ramon Women's Club, Dublin Chamber of Commerce, Dublin San Ramon Services District, Dublin Lions Club and Citilinks, and direct Staff to prepare fonnal acknowledgement to the donors. 8.3 Senior Center Furniture Request for ProposaJs (FUe # 350-20) The Senior Center project is nOw under construction and the schednle requires that the Senior Center Furnishings Proposal be released in order for produetion dates to meet the overall move in schedule for the Senior Center opening. STAFF RECOMMENDATION: Authorize Staff to solicit bids for furnishings for the new Senior Center. 8.4 Fiscal Year 2004-05 Mid-Year Budget Report and December 2004 Monthly Report of Finandal Activities (File # 330..50) Staff has prepared a detailed Mid- Y car Budget Review to identify any material deviations from the adopted FY 2004-05 Budget. The prillllllY focus of the report is on the General Fund, which accounts for the majority of City operations. Staffhas identified proposed adjustments to Revenues and Expenditures. This item also provides the report of the financial statements for the month of December 2004 and a preview of potential impacts on the City's FY 2005-06 Budget. STAFF RECOMMENDATION: Approve Budget Changes and authorize the use of $556,285 &om General Fund Senior Center Reserves to pay for the current FY portion of the Senior Center project. 8.5 Approval of Housing IDcentive Program Grant Application aDd Priority of Capital Projects to be included in the Grant ApplicatioD (File # 430-10/1060-90) The City proposes to apply to the Metropolitan Transportation Commission (MTC) for a Housing Incentive Program Grant to fund transportation capital projects in the City that support Transportation for Livable Communities goals. A list of capital projects to accompany the Grant Application will also be presented to the City Council for prioritization. STAFF RECOMMENDATION: Approve Housing Incentive Program Grant Application; approve Priority List ofProjccts to be included in the Grant Application - OR - reprioritize the List. 8.6 Establish Date of Public Bearing for Garbage Company Rates and Annual Fees for MiDimum Residential Garbage Service (File # 810-30) In order to generate the compensation required to satisfy the reqnirements of the City's new Solid Waste Collection Services Agreement with Amador Valley Industries (A VI), it is necessary to adjust the City's garbage rates. A Public Hearing must be held to give the public a chance to comment on the proposed changes to the rates. STAFF RECOMMENDATION: Establish a Public Hearing on May 3,2005 for the adoption of garbage rates for Fiscal Year 2005-06. 9.
