ORAL COMMUNICATIONS 3.I Appointment to Parks & Community Services Commission (File # 110-30) The Mayor has appo~ted Steven Jones to the Parks & Community Services Commission to tilt the remainder of~e unexpired term o£Betsy Zajac, who recently resigned. STAFF RECOMMENDATION: Con£n'm Mayor's appointment o£ Steven Jones to the P&CS Commission to a term which ends in December 2004. 3.2 Appointments to Tri-VaUey Community Television Board (File # 110-30) The terms for both o£the City o£Dublin's representatives, Valefie Barnes and Patrick Hannigan, expire at the cad of February, 2003. Ms. Barnes and Mr. Hannigan have bo~ expressed interest in continuing their service on this Board, and the Mayor has reappointed them to an additional term. STAFF RECOMMENDATION: Confirm Mayor's reappointment of Valerie Barnes and Patrick Hannigan to the CTV Board. 3.3 Public Comments At this time, the public is permitted to address the City Council on non-agendized items. Members of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item. 4.1 Minutes of Regular Meeting of February 4, 2003 STAFF RECOMMENDATION: Approve 4.2 Change Order Authorization - Contract 02-15, Fire Station 17 (File # 600-35) The City Council will consider approval of a Change Order in the amount of $41,630 associated with the provision of utilities to Fire Station 17 (Emerald Glen Fire Station). STAFF RECOMMENDATION: Approve Change Order. 4.3 Disaster Service Worker Resolution (File # 520-30) This Resolution allows for the participation in the State Workers Compensation Program to protect registered Disaster Service Workers. STAFF RECOMMENDATION: Adopt Resolutio...__._.._~n. 4.4 Agreement with Berryman & Henigar, Inc., for Assessment District Consulting Services (File # 600-30) This agreement provides for preparation of Engineer's Reports, StaffReports~ and other documentation related to the City's Assessment Districts. The cost of the service is budgeted in and paid by the individual Assessment Districts. Approval of this agreement will not cause a change in any of the assessments. STAFF RECOMMENDATION: Adopt Resol,ufi.on approving agreement. 4.5 Acceptance of Improvements for Parcel Map 7537, '~Iron Horse Trail Apartments" (Archstone Communities Trust) (File # 600-60) This project is located to the east of Dougherty Road and north of Houston Place. It contains 177 apartment units. Requdred public improvements have been completed and it is appropriate for the City to accept these improvements for maintenance. STAFF RECOMMENDATION: Adopt R__esolution accepting improvements and approving installed traffic control devices. 4.6 Authorization to Prepare Engineer's Report for Citywide Street Lighting Maintenance Assessment District 83-1 (File # 360-50) This assessment district funds the maintenance and energy cost for street lighting throughout the City, except for Dublin Ranch and Clifden Parc. This action would authorize Staff to begin preparation of the preliminary Engineer's Report for Fiscal Year 2003-04. At least one public hearing will be held prior to levy of assessments. STAFF RECOMMENDATION: Adopt Resolution. 4.7 Authorization to Prepare Engineer's Report for Landscaping & Lighting Maintenance Assessment District 83-2 (Stagecoach Road Area) (File # 360-20) This assessment district funds maintenance and utility cost for landscaping along Stagecoach Road and on the interior slopes of Dublin Hills Estates. This action would authorize Staff to begin preparation of thc preliminary Engineer's Report for Fiscal Year 2003-04. At least #nc public hearing will be held prior to levy of assessments. STAFF RECOMMENDATION: Adopt Resolution. 4.8 Authorization to Prepare Engineer's Report for Landscaping & Lighting Maintenance Assessment Distr~ct 86-1 (Dougherty Road) (File # 360-20) This assessment district funds maintenance and utility cost for landscaping associated with the Villages ~ Willow Creek development along Dougherty Road. This action would authorize Staffto begin preparation of the preliminary Engineer's Report for Fiscal Year 2003-04. At least one public hearing will be held prior to le'~3~ of assessments. STAFF RECOMMENDATION: Adopt Resolution. 4.9 Authorization to Prepare Engineer's Report for Landscaping & Lighting Maintenance Assessment District 97-1 (Santa Rita Area) (File # 360-20) This assessment district funds maintenance and utility cost for landscaping in the Santa Rita development area bounded by Arnold Road, Gleason Drive, Tassajara Road and 1-580. This action would authorize Staff to begin preparation of the preliminary Engineer's Report for Fiscal Year 2003-04. At least one public hearing will be held prior to levy of assessments. STAFF RECOMMENDATION: Adopt Resolution. 4.10 Authorization to Prepare Engineer's Report for Street Lighting Maintenance Assessment Distr~ct 99-1 (Dublin Ranch) (File # 360-20) This assessment district funds maintenance and utility cost for street lighting in Dublin Ranch and the Cli£den Parc subdivision (Tract 7067). This action would authorize Staffto begin preparation of thc preliminary Engineer's Report for Fiscal Year 2003-04. At least one public hearing will be held prior to levy of assessments. STAFF RECOMMENDATION: Adopt Resolutio___......__qn. 4.11 .Acceptance of Improvements for Tract 6962, "The Arbors", Dublin Ranch Phase I, Neighborhood M-1 (Standard Pacific Corporation) (File # 600-60) Tract 6962 is located north of North Dublin Ranch Drive and east of Tassajara Road. It contains t 11 single-family residential lots. The improvements are now complete and it is appropriate to accept these public improvements for maintenance. STAFF RECOMMENDATION: Adopt Resolutio_..._.._.__.qn accepting improvements and approving installed traffic control devices. 4.12 Acceptance Of Improvements for Tract 69639 "The Laurels", Dublin Ranch Phase Ia Neighborhood M-2 (Standard Pacitlc Corporation) (File # 600-60) Tract 6963 is located between North Dublin Ranch Drive and South Dublin Ranch Drive and just east of Tassajara Roa& It contains 45 single-family residential lots. The improvements arc now complete and it is appropriate to accept the public improvements for maintenance. STAFF RECOMMENDATION: Adopt Resolution accepting improvements and approving installed traffic control devices. 4.13 Acceptance of Improvements for Tract 6964, "The Courtyards", Dublin Ranch Phase I, Neighborhood M-3 (Standard Pacific Corporation) (File # 600-60) Tract 6964 is located south of South Dublin Ranch Drive and east of Tassajara Road. It contains 123 single-family residential lots and all thc interior streets are private. The improvements are now complete and it is appropriate to accept the public improvements for maintenance. STAFF RECOMMENDATION: Adopt Resolution accepting improvements and approving installed traffic control devices. 4.14 Preliminary Financial Reports for the Month of January 2003 (File # 330-50) STAFF RECOMMENDATION: Receive Reports. 4.15 Approval of Amendment No. 3 to Agreement with CCS Planning & Engineering~ Inc., for additional Construction Support Services for the 1-580/Tassajara Road Interchange Improvement Project (File # 600-30) This contract amendment is necessary to accommodate additional construction support services needed to prepare several construction change orders requested by Caltrans and City Staff. STAFF RECOMMENDATION: Adopt Resolution approving amendment to Agreement. 4.16 Amendment to Agreement with BSA Architects (File # 600-30) Staff proposes an amendment to thc Agreement with BSA Architects to provide for additional consultant services related to the Dublh~ Library project. STAFF RECOMivIENDATION: Approve Change Order to the Agreement (not to exceed $45~000) and Budget Change. 4.17 Warrant Register ($1,206,596.44) dated February 18, 2003 (File # 300-40) STAFF RECOMMENDATION: Approve 5. WRiTTEN ..COMMUNICATIONS 5.1 Request from American Cancer Society (ACS) for reclassification and fee waiver under Shannon Community Center Facility Use Policy (File # 610-20) The American Cancer Society has reserved the Shannon Community Center on Friday, March 28, 2003 for a fundraiscr for the Dublin "Relay for Li£c". Thc ACS has requested reclassification and fee waiver under the Facility Usc Policy. STAFF RECOMMENDATION: Consider Request. 5.2 Modification to Baseball Field B at Emerald Glen Park (File # 920.20) The City has received correspondence from Dublin Little League (DLL) requesting to modify Field B at Emerald Glen Park so that the diamond can be configured for both 80' and 90' play. STAFF RECOMMENDATION: Approve DLL's request to modify Field B and to reirnburse the City for the cost of the improvements. 5.3 Plaque Monument and Flagpole Installation at the Iteritage Center (File # 295-30) As part of the fundraising campaign for the restoration of the Murray School Bell Tower, the Dublin Rotary Club would like part of their funds to pay for a monument thanking the donors for their contributions. The Dublin Historical Preservation Association would also like to donate a flagpole to be installed in conjunction with the monument. STAFF RECOMMENDATION: Approve installation of plaque and flagpole. 6. PUBLIC HEARING 6.1 Toll Brothers - Dublin Ranch Areas A-4 & A-5 Development Agreements (DA) PA 02-022 & PA 02-023 (F~le # 600-60) This is the second reading of an Ordinance approving Development Agreements between the City of Dublin and Toll CA II, L.P. The DA's are required by the Eastern Dublin Specific Plan. These Agreements will vest the project approvals recently granted by the City Council. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and adopt Ordin nanananananananana_qce. 6.2 Apartment Temporary signage PA 02-060 (File # 400.30) This is the second reading of an Ordinance to amend the Sign Regulation Section of the Zoning Ordinance to allow temporary signage for apm~ment communities. Temporary banners would be allowed to be 12 square feet maximum in size, allowed to be up I 0 days and down 20 days with a maximum duration of 90 days per calendar year. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and adopt Ordinance. 7. UNFINISHED BUSINESS 7,1 Acceptance of Work- Murray School Bell Tower (Ftc # 600-30) In January of 2003, Staff, along with a representative of TGK Contracting completed the final inspection of the Murray Schoolhouse Bell Tower. Upon review of the project with the City Inspector, it was determined that the Contractor had successfully completed the requirements of the contract. STAFF RECOMMENDATION: Adopt Resolution accepting project as complete and authorize Staff to accept a maintenance bond of $11,692 at a future date. 7,2 Public/Semi-Public Facilities General Plan and Specific Plan Amendment Study Status Report PA 02-017 (File # 420-30) The City Council will review the Public/Semi-Public Facilities General Plan and Specific Plan Amendment Study and review possible alternatives for implementation of a new policy. STAFF RECOMMENDATION: Provide direction to Staff on: 1) whether any of Alternatives 1 - 5 listed in the Study should be refined and implemented; 2) whether Alternative 6, the formation of a Task Force to make a recommendation on a new policy should be implemented; OR 3) whether the City Council has other direction they would like Staff to pursue. 7.3 Report on Grand Opening Activities for the new Dublin Public Library (File # 940-50) The City Council will review plans for two grand opening events for the new Dublin Library. The first is the preview party planned by the Alameda County Library Foundation and the second is the Grand Opening Celebration planned by the City of Dublin and the Alameda County Library Staff. STAFF RECOMMENDATION: Provide input on planned events. 7.4 Schematic Design for New Dublin Senior Center (File # 600-30) In order to begin the Design Development Phase of the Senior Center project, the City must approve the schematic design. The City Council will receive a presentation from the Dahlin Group on the refined floor plan and proposed building elevations and facades. STAFF RECOMMENDATION: Approve schematic design - OR - provide aitemate direction. 7.5 Dublin Ranch Area G - Park Design Development and Park Name Selection (File # 600-30) As approved in the 2002-07 Capital Improvement Program, design of the 4.8 acre Neighborhood Park in Dublin Ranch Area G will begin in FY 2002-03, and construction will be complete in FY 2003-04. As part of the design development process, the City Council will provide input on site fumishlngs, play equipment, restroom facility, entry trellis, lighting, plant palette, and refinements to the overall design. In addition, names for the park were solicited and 4 names are being recommended by the Parks & Community Services Commission for consideration, including: Bray Park, Finnian Commons, John Monego Memorial Park and Nielsen Park. STAFF RECOMMENDATION: Approve design development plan and determine park name. 8. NEW BUSINESS Letter Supporting Alameda County Congestion Management Agency's (CMA) request to Congressman Richard Pombo to earmark $30 million of Federal Funds for the 1-580 High Occupancy Vehicle 0tOV) Lane Project (File # 1060-90) The existing Federal Transportation Program, also called the Transportation Equity Act for the 21st Century, will expire at the end of Fiscat Year 2003. In anticipation of the reauthorization of this program, the Alameda County CMA has requested Congressman Richard Pombo to earmark $30 million of federal funds for the 1-580 HOV land project. STAFF RECOMMENDATION: Approve and authorize Mayor to sign and send letter of support. 8.2 Dublin Ranch Affordable Housing Proposal (File # 430-80) Dublin Ranch dcvel6pers have submitted a proposal to allow concentration of all Dublin Ranch affordable housing requirements into a single project on 25 acres east of Kecgan Road between Central Avenue and Dublin Boulevard. STAFF RECOMMENDATION: Review Applicant's proposal in light of established Inclusionary Zoning Ordinance requirements; evaluate Staff comments on issues of this request; and give direction to Applicant and Staff regarding options: 1)proceed to process a specific request to allow the concentration of al! Dublin Ranch affordable housing requirements into a single project on 25 acres immediately west of the Toll Area G project with certain requirements as suggested by Staff; - OR- 2) have the developer create a new series of projects in the future that would concentrate a portion of the Dublin Ranch affordable housing requirements in several locations as suggested by Staf~ - OR - 3) instruct Staffto continue to require (to the extent possible) that affordable housing requirements for the Dublin Ranch property be met for each future project when submitted on the individual project site and based on the present requirement of 50% moderate, 20% low and 30% very iow household income levels. 8.3 Brown Act (OPen Meeting Law) and Political Reform Act (Conflict of Interest) Requirements (File # 640-40/630-60) The City Attorney wilt give a brief presentation on the requirements of the Brown Act and the Political Reform Act. STAFF RECOMMENDATION: Receive Repo~. Grant Agreement with Alameda County Waste Management Authority (AC~) (File # 600-40) As approved in thc 2002-07 Capital Improvement Program, construction of Fire Stations 17 and t 8 will begin in Fiscal Year 2002-03 and be complete in FY 2003-04. The grant funding will provide $100,000 towards construction of Fire Stations 17 and 18 in eastern Dublin, which are currently under construction. STAFF RECOMMENDATION: Authorize the City Manager to execute an agreement with ACWMA. 8.5 Public Art Master Plan (File # 900-30) The Public Art Master Plan will provide a comprehensive plan to establish guidelines for the operation of the Public Art Program. The first step to hiring a consultant or firm is to solicit qualified proposals. STAFF RECOMMENDATION: Approve and authorize Staff to distribute Request for Proposals (RFP). 8.6 Proposed Alternative Work Schedule for Police Services (File # 580-10) Police Services are provided to the City of Dublin through contract with the Alameda County Sheriff's Department. The City Council will consider a report which came out of a study to identify cost effective alternatives to improve the overall delivery of police services to the commurdty and, at the same time, assure the City that Dublin continues to attract the most qualified personnel. The City would potentially realize savings of at least $27,600 annually, if an alternate work schedule is approved. STAFF RECOMMENDATION: Approve 12-hour alternate work schedule as a 2-year pilot program and authorize elimination of unfilled 2002-03 Higher Service Level Administrative Sergeant Position 9.
