CONFERENCE WITH LEGAL COUNSEL--ANTICIPATED LITIGATION Initiation of litigation pursuant to subdivision (c) of Section 54956.9: 1 case. 1. CALL TO ORDER & PLEDGE OF ALLEGIANCE TO THE FLAG 2. REPORT OF CLOSED SESSION ACTION 3. ORAL COMMUNICATIONS 3.1 Recognition of Nominees for City of Dublin's 2008 Citizen and Young Citizen of the Year (610-50) The nominees for Young Citizen of the Year are: Brian Del Rosario and Joey Van Loon. The nominees for Citizen of the Year are: Ted Hoffman, Jr., Fawn Holman, and John Zukoski. The winners will be announced at the City's "Dublin Volunteers -Our Shining Stars" event on Friday, February 20, 2009, at the Dublin Senior Center. STAFF RECOMMENDATION: Present Certificates of Recognition to nominees. 3.2 Recognition of Nominees for 2008 Organization of the Year (610-50) The nominees for Organization of the Year are: Dublin 4H, Friends of the Dublin Library, and Hope Hospice. The winning organization will be announced at the "Dublin Volunteers - Our Shining Stars" event on Friday, February 20, 2009, at the Dublin Senior Center. STAFF ~tECOMMENDATION: Present Certificates of Recognition to nominees. 3.3 Proclamation to Partner with the U. S. Census Bureau for Census 2010 (610-50) The City Council will receive a presentation from the U. S. Census Bureau on the 2010 Census. The proclamation demonstrates the City of Dublin's commitment to partner with the U. S. Census Bureau to help ensure a full and accurate count in the 2010 Census. STAFF RECOMMENDATION: Receive presentation, provide comments, and proclaim that the City of Dublin is committed to partnering with the U. S. Census Bureau to help ensure a full and accurate count in 2010. 3.4 Dublin Heritage Center Website (295-20) One of the Fiscal Year 2008-2009 high priority objectives of the City Council was to create a dedicated website for the Dublin Heritage Center. STAFF RECOMMENDATION: Receive presentation on the new Dublin Heritage Center Website. Please step to the podium and clearly state your name for the record. COMMENTS SHOULD NOT EXCEED THREE !3) MINUTES. In accordance with State Law, no action or discussion may take place on any item not appearing on the posted agenda. The Council may respond to statements made or questions asked, or may request Staff to report back at a future meeting concerning the matter. Any member of the public may contact the City Clerk's Office related to the proper procedure to place an item on a future City Council agenda. The exceptions under which the City Council MAY discuss and/or take action on items not appearing on the agenda are contained in Government Code Section 54954.2(b)(1)(2)(3). 4. CONSENT CALENDAR Consent Calendar items are typically non-controversial in nature and are considered for approval by the City Council with one single action. Members of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item. 4.1 Minutes of Regular Meeting of January 6, 2009 STAFF RECOMMENDATION: Approve. 4.2 Declaration of Weeds and Combustible Refuse as a Public Nuisance (540-50) In accordance with Dublin Municipal Code Section 5.70.030, the City Council may declare that there is a public nuisance created by weeds and combustible debris growing, accumulating upon the streets, sidewalks and property within the City of Dublin. STAFF RECOMMENDATION: Adopt Resolution Declaring Weeds and Combustible Refuse a Public Nuisance and Ordering the Abatement Thereof; and direct Staff to notify the public of the adoption of this Resolution; and schedule a public hearing for the April 7, 2009, City Council meeting at which time the Council will hear and consider objections to this abatement order. 4.3 Authorization to Engage the Firm of Caporicci & Larson to Conduct the Fiscal Year 2008-2009 Financial Audit (600-30/310-30) The current engagement with the firm of Caporicci & Larson was scheduled to end with the completion of the Fiscal Year 2007-2008 Audit. The City is currently undergoing implementation of a new computer accounting system, which requires significant Staff resources. A one year extension will allow the City to conduct a Request for Proposals for another multi-year audit services agreement, after the new software is implemented. STAFF RECOMMENDATION: Authorize the Mayor to execute the Engagement Letter and direct Staff to proceed with planning for the completion of the audit. 4.4 City Treasurer's Investment Report for 2°d Quarter 2008-2009 (320-30) The City's Investment portfolio totals $120,350,694 (par value). As of December 31, 2008, funds were invested at an average yield of 3.661 %. Staff will provide a background report on the City investment portfolio as well as the investment results as of December 31, 2008. STAFF RECOMMENDATION: Receive report. 4.5 Approval of Contract Change Order No. 27 and Acceptance of Improvements -Contract No. 07-01, Dublin Boulevard/Dougherty Road Intersection Improvements (CIP No. 96852, Dougherty Road Improvements -Houston Place to I-580) (600-35) This project widened the Dublin Boulevard and Dougherty Road intersection to provide additional traffic lanes and increase the intersection's capacity in order to accommodate existing and future development in Dublin. Construction of this project is now complete, and the City Council will consider approving the final Contract Change Order and accepting the improvements. STAFF RECOMMENDATION: Approve Contract Change Order No. 27 in the amount of $150,000; accept the improvements under Contract No. 07-01, Dublin Boulevard/Dougherty Road Intersection Improvements; and authorize the release of retention after 35 days if there are no subcontractor claims. 4.6 Warrant Register ($1,282,993.52) dated February 17, 2009 (300-40) STAFF RECOMMENDATION: Review and authorize the issuance of payments. 5. UNFINISHED BUSINESS 7.1 Follow-Up Report On Traffic Safety Measures (590-50) This item will present the findings of a follow-up report that evaluated the potential additional traffic control measures that could be used to enhance safety at the intersection of North Dublin Ranch Drive and Oak Bluff Lane. STAFF RECOMMENDATION: Consider the possible methods to enhance safety at the study intersection and their relative costs, and provide direction to Staff on the measures they would like to consider for incorporation. 8. NEW BUSINESS 8.1 Authorization of Enter into a Master Contract with the East Bay Regional Park District (EBRPD) for Local Grant Funds under Measure WW Park Bond Extension (600-40) The City Council will consider approving a Resolution to enter into a Master Contract with the East Bay Regional Park District in order to obtain funding under Measure WW. STAFF RECOMMENDATION: Adopt Resolution regarding Authorization to Enter into a Master Contract with the East Bay Regional Park District for Local Grant Funds Under Measure WW Park Bond Extension. 8.2 Annual Audit Report for Fiscal Year 2007-2008 (310-30) The City of Dublin has compiled and published its comprehensive Annual Financial Report (CAFR), for the fiscal year ending June 30, 2008. This report includes financial statements prepared by Caporicci and Larson (C&L), the independent auditors selected by the City Council. STAFF RECOMMENDATION: Receive reports and confirm the Reservations of Fund Balances for Fiscal Year 2007-2008. 8.3 Station Area Planning Grant Draft Funding Agreement for the Downtown Dublin Specific Plan Environmental Impact Report (400-20) The City of Dublin was awarded a Planning Grant of up to $200,000 to prepare an Environmental Impact Report for the Downtown Dublin Specific Plan. In order to obtain the grant money, the City is required to enter into a Funding Agreement with the Metropolitan Transportation Commission which is the agency distributing the grant money. The Funding Agreement includes a scope of work, a project budget and schedule and the terms and conditions of the grant. STAFF RECOMMENDATION: Adopt Resolution Approving a Draft Funding Agreement for a Station Area Planning Grant for an Amount Not to Exceed $200,000 for the preparation of an Environmental Impact Report for the Downtown Dublin Specific Plan and Authorizing the City Manager to Sign the Final Funding Agreement. 8.4 Designation of "No Parking" Zones on Glynnis Rose Drive (570-20) The City received a citizen request fora "No Parking" zone on the east side of Glynnis Rose Drive at Roscommon Way between two curb ramps and 20 feet north and south of the curb ramps. The purpose of this zone is to increase visibility of pedestrians to oncoming traffic before pedestrians begin crossing the street. . This item also provides clarification of the designation of existing "No Parking" zones on the east side of Glynnis Rose Drive. The designation of the entire right-turn pocket just south of Central Parkway as a "No Parking" zone, as well as to modify the existing "No Parking" zone on Glynnis Rose Drive just north of Dublin Boulevard to extend to the end of the median island. STAFF RECOMMENDATION: Adopt Resolution regarding Approval of "No Parking" Zone on Glynnis Rose Drive. February 17, 2009 Dublin City Council Agenda Page 3 of 4 9. OTHER BUSINESS 9.1 Brief INFORMATION ONLY reports from Council and/or Staff, including Committee Reports and Reports by Council related to Meetings Attended at City Expense (AB 1234). 10.
