In accordance with State Law, however, no action or discussion may take place on any item not appearing on the posted agenda. The Council may respond to statements made or questions asked, or may request Staff to report back at a future meeting concerning the matter. Any member of the public may contact the City Clerk’s Office related to the proper procedure to place an item on a future City Council agenda. The exceptions under which the City Council MAY discuss and/or take action on items not appearing on the agenda are contained in Government Code Section 54954.2(b)(1)(2)(3). 4.CONSENT CALENDAR Consent Calendar items are typically non-controversial in nature and are considered for approval by the City Council with one single action. Members of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item. 4.1Minutes of Regular Meeting of November 4, 1997 STAFF RECOMMENDATION: Approve 4.2Renewal of Agreement with NORCAL Employment Relations Training Consortium Since 1987, the City of Dublin has participated in this consortium which provides employee relations training. Dublin is one of 22 participating public agencies. The consortium contracts with the law firm of Liebert, Cassidy & Frierson for consortium services which include training, attorney consultations and a comprehensive monthly newsletter. STAFF RECOMMENDATION: Authorize City Manager to execute agreement. 4.3Request to join as Amicus in LOCC Brief (Long Beach Heritage vs. Board of Harbor Commissioners) The League of California Cities has authorized the preparation of an amicus curiae brief in Long Beach Heritage vs. Board of Harbor Commissioners, which is on appeal before the Court of Appeal. The issue in this case is whether a city can conduct preliminary planning activities prior to completion of CEQA review. There is no cost to the City to join the amicus brief. STAFF RECOMMENDATION: Authorize City Attorney to add City of Dublin to amicus brief. 4.4Amendment to Agreement for Crossing Guard Services The City of Dublin has received and evaluated a request to add one additional school crossing guard to serve the reopened Dublin Elementary School. The City has agreed to fund 50% of the cost of adding one additional crossing guard for the balance of the 1997-98 school year. The Dublin Unified School District has agreed to fund the remaining 50% of the cost. STAFF RECOMMENDATION: Approve and authorize City Manager to execute amendment to Agreement and approve Budget Change Form. 4.5Award of Bid, Contract 97-05, Dougherty Road Improvements/Annual Overlay Program This project will remove the nonlandscaped median islands and widen Dougherty Road between Amador Valley Boulevard and Houston Place. In addition, the City’s annual pavement overlay program is included in this contract. STAFF RECOMMENDATION: Adopt Resolution awarding contract to Teichert Construction ($771,147), and authorize Mayor to execute agreement. 4.6Acceptance of Work, Contract 97-10 This project paved the parking lot at the Dublin Heritage Center and extended water lines to the St. Raymond’s Church. The project is now complete and it is appropriate that the City Council accept the improvements. STAFF RECOMMENDATION: Accept improvements; authorize $49,847.67 payment to Bay Cities Paving and Grading, Inc., for their final invoice and release $5,538.63 retention after 35 days if there are no subcontractor claims. 4.7Warrant Register ($231,760.37) dated November 18, 1997 STAFF RECOMMENDATION: Approve 5.WRITTEN COMMUNICATIONS - None 6.PUBLIC HEARING 6.1Appeal of Planning Commission Approval of PA 97-023 Turan Residential Care Facility Conditional Use Permit The City Council will hold a public hearing on an appeal of a decision by the Planning Commission approving a Conditional Use Permit for a residential care facility for 12 elderly residents at 8521 Valencia Street. The residential care facility is presently operating with a license for 6 or fewer elderly residents. The City Council will either affirm , modify or reverse the decision by the Planning Commission. STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt Resolution EITHER a) affirming Planning Commission approval; b) affirming Planning Commission approval with modifications or additional conditions; -OR- c) reversing Planning Commission approval. 6.2Park Sierra Apartments Rezone for an 8.9 acre site located on the west side of Dougherty Road at the Southern Pacific Right-of-Way On November 4, 1997, the City Council approved a Mitigated Negative Declaration, General Plan Amendment and introduced an Ordinance rezoning the proposed Park Sierra Apartment project, generally located on the west side of Dougherty Road at the former Southern Pacific Railroad tracts, planned to be developed as the Iron Horse Trail. In May, 1996, the City Council approved a GPA on the site from Light Industrial to Medium Density Residential to allow for a 92 unit single family development project. That project was never built, and the property was sold to Shea Properties. The new applicant has applied for a PD Rezone to Medium-High Density Residential and a GPA and is proposing an apartment project which would consist of 209 rental apartment dwellings arranged in a linear fashion along the site. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and ADOPT Ordinance. 6.3Dublin Ranch “Area A” Planned Development (PD) Rezone PA 96-038 This application is the final step in zoning for this portion of the Dublin Ranch project. The development will include up to 573 dwelling units, an 18-hole golf course, and open space on a 352 acre site in Eastern Dublin. STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt Resolutions; waive reading and INTRODUCE Ordinance. 6.4Dublin Ranch “Areas B-E” Planned Development Rezone and Eastern Dublin Specific Plan Amendment/General Plan Amendment This application is the final step in zoning for this portion of the Dublin Ranch project. The development will include up to 1,875 residential units, a community park, portions of 2 school sites, open space, and office and commercial development on a 453 acre site. STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt Resolutions; waive reading and INTRODUCE Ordinance. 7.UNFINISHED BUSINESS 7.1Tri-Valley Transportation Development Fee (TVTDF) The Cities of Danville, Dublin, Livermore, Pleasanton and San Ramon, and the Counties of Alameda and Contra Costa have been working for several years to establish a Tri-Valley Transportation fee to help fund regional transportation improvements needed because of new development. The Council will consider adoption of a resolution approving Principles of Agreement for adoption of a Tri-Valley Transportation Development Fee. STAFF RECOMMENDATION: Adopt Resolution. 7.215th Annual St. Patrick’s Day Celebration Update The City Council will receive a report on the plans to date for the 1998 St. Patrick’s Day Celebration. Additionally, the Council will consider a proposal for professional event management services to coordinate the Celebration.
