CALL TO ORDER 2. PLEDGE,OF ALLEGIANCE TO THE FLAG 3. ORAL COMMUNICATIONS 3.1 Public Comments At this ~(ime, the public is permitted to address the City Council on non-agendized items. COMMENTS SHOULD NOT EXCEED THREE (3) MINUTES. In accordance with State Law, however, no action or discussion may take place on any item not appearing on the posted agenda. The Council may respond to statements made or questions asked, or may request Staff to report back at a future meeting concerning the matter. Any member of the public may contact the City Clerk's Office related to the proper procedure to place an item on a future City Council agenda. The exceptions under which the City Council MAY discuss and/or take action on items not appearing on the agenda are contained in Government Code Section 54954.2(b)(1)(2)(3). 4. CONSENT CALENDAR Consent Calendar items are typically non-controversial in nature and are considered for approval by the City Council with one single acUon. Members of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item. 4.1Minutes of Regular Meeting of May 16, 2000 STAFF RECOMMENDATION: Approve 4.2 Amendments to Youth Advisory Committee Bylaws and Rules of Procedure (File 950-80) The City Council will consider proposed revisions to the Bylaws and Rules of Procedure for the Youth Advisory Committee related to Committee Composition, Term of Office and Removal, Officers, Subcommittees and General Responsibilities of the Committee. STAFF RECOMMENDATION: Adopt Resolution. 4.3 Replacement of Fire Alarm Panel at Civic Center: Request for Waiver of Competitive Bid and Approval of Purchase Orders (File 200-20) The 12 year old fire alarm panel at the Dublin Civic Center is malfunctioning, and its component parts are obsolete. Staff is requesting waiver of the competitive bid requirement on the basis that the replacement constitutes an emergency and that the panel must be obtained from the same manufacturer in order to avoid replacement of the entire system. The total cost of the replacement is estimated to be $33,238. STAFF RECOMMENDATION: Adopt Resolution authorizing waiver of competitive bid and approving issuance of purchase orders to EST Service and Northern States Electric. 4.4 Establishment of New Street Name "Glynnis Rose Street" for "Street A" in Tract 7149 (Connecting Street from Dublin Boulevard to Emerald Glen Park) (File 820-60) In late 1999, the City Council authorized the Dublin Partners in Education to name this street through a fundraising event. The successful bidder haS designated the name "Glynnis Rose Street" for this new street in eastern Dublin. STAFF RECOMMENDATION: Adopt Resolution. 4.5 Informational Report regarding Coyote Incidents at Dougherty Hills Park (File 500-10) Staff has received two reports in the past month about coyote incidents at Dougherty Hills Park. This item provides information on the incidents and the steps being taken to improve public awareness on the matter. STAFF RECOMMENDATION: Receive Report. 4.7 4.8 4.9 4.10 4.11 4.12 4.13 Status Report related to changing Fall Special Clean-up from September to October (File 810-30) Staffwas asked to investigate the possibility of changing the Fall special clean-up date from September to October. Conversations with Livermore Dublin Disposal (LDD) revealed that it is not practical to resehedule the date for this year, but that the Council would have the opportunity to comment on the proposed 2001 clean-up dates when the Council receives notice of the date in September 2000. STAFF RECOMMENDATION: Receive Report. Acceptance of donations made to Dublin Police Services by local businesses for "Adopt-A- Cop" Trading Card Program (File 150-70) Dublin Police Services received 31 donations totaling $3,499 from local citizens and businesses for the "Adopt-A-Cop" trading card program. This program was included on the City's 1999- 2000 Goals & Objectives list. These donations will enable DPS to contract for the photography and printing of the trading cards. STAFF RECOMMENDATION: Accept $3,499 in donations; approve Budget Change; and direct Staffto prepare formal acknowledgments to the donors. Request for Tree Planting (File 295-30) The City Council will consider a request from Guy and Inge Houston to plant a memorial tree at the Dublin Heritage Center in memory of James H. Moran. STAFF RECOMMENDATION: Approve request and direct Staffto develop a memorial policy. Agreement with All City Management Services for Crossing Guard Services (File 600-30) The City Council will consider an amendment to the existing Crossing Guard Services Agreement to cover the period of July 1, 2000 through June 30, 2001. STAFF RECOMMENDATION: Adopt Resolution. Change Order to Agreement with Pacific Program Management for Construction Management Services for the Civic Center Remodel and Emerald Glen Park Phase I (File 600-30) The timelines for both of the above projects have been extended, which has resulted in the need for increased construction management services. STAFF RECOMMENDATION: Approve Change Order and Budget Change. Authorization to Apply to the Metropolitan Transportation Commission (MTC) for Transportation Development Act (TDA) Article 3 Funding for the Alamo Canal Bicycle Path Capital Improvement Project from the Iron Horse Trail to 1-580 (File 930-10) This grant would aid in the funding ora bicycle/pedestrian path along the east side of the Alamo Canal between the Iron Horse Trail and 1-580. STAFF RECOMMENDATION: Adopt Resolution. Authorization to Solicit Bids - Contract 00-09, 1-580/Hacienda Drive Interchange Improvement Project (File 600-35) This project is a traffic mitigation for Eastern Dublin development and is being funded by the Alameda County Surplus Property Authority, which is the major developer in the area. The County will receive Traffic Impact Fee credit for the funding. STAFF RECOMMENDATION: Authorize Staff to advertise for bids. Agreement with MK Centennial for Construction Management Services: 1-580/Hacienda Drive Interchange Improvement Project (File 600-30) This contract will provide resident engineer construction services as well as project inspection. STAFF RECOMMENDATION: Adopt Resolution. 4.14 4.15 4.16 4,t7 Amendment to Agreement with HQE, Incorporated (Modification to Scope of Work and Additional Compensation) (File 600-30) This amendment will extend HQE's contract to provide additional engineering services to the City during the construction of the 1-580/Hacienda Interchange Project. HQE is the design consultant for the .project. STAFF RECOMMENDATIQBL: Adop .tResolution.~ City Manager Employment Agreement (File 600-30) The City's Negotiating Team (Mayor Houston and Cm. Zika) is recommending that the Council approve an employment agreement with the City Manager with ~provisions to: 1) increase annual salary; 2) provide general leave days equal to number provided to other management employees; 3) reduce City's contribution to dental/optical reimbursement trust fund; and 4) modify severance pay provisions. STAFF RECOMMENDATION: Approve Amendment to City Manager's Employment Agreement. Capital Improvement Budget Revisions for the Iron Horse Trail (Amador Valley Boulevard to Northerly City Limit) and the Pavement Management System Update (File 600-40 & These projects are now complete and require budget changes due to changes in project timing and costs. STAFF RECOMMENDATION: Approve Budget Changes. Dublin Ranch, Street Li~htim~ Maintenance Assessment District 99-1: Approval Preliminary Engineer's Report and Setting of Public Hearing Date for Annexation of Tract 7067 and Levy of Assessments (File 360-20) This assessment district pays the cost of energy and maintenance for the decorative street lighting system within the Dublin~Ranch Development. Taylor Woodmw Homeshas requested that their development, Tract 7067, be annexed into this District. STAFF RECOMMENDATION: Adopt Resolution{s}. Warrant Register ($1,358~214.07)dated June 6, 2000 (File 300-40) STAFF RECOMMENDATION: Approve WRITTEN COMMUNICATIONS - None PU~L~_ HEARING 6.1 HOme'Y~epot Expo Design Center Site Development Review PA 99-029 (File 410-30) This Site Development Review would allow a 93,130 square foot Home Depot Expo Design Center on a cleared lot in the Dublin Place Shopping Center, located between Montgomery Ward and Target stores. STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt Resolution{s}. 6.2 General Motors Automall Stage 1 and Stage 2 Planned Development Rezone PA 00-002 (File 450-30) This is the second reading of an Ordinance approving a Planned Development Rezone to modify parcel and building sizes in the General Motors Automall. Parcel A would be increased in size from 3.5 acres to 4.43 acres and the building on Parcel A would be increased from 26,145 square feet to 28,775 square feet. Parcel B would be reduced in size from 3.0 acres to 2.07 acres and the building on Parcel B would be reduced in size from 22,000 square feet to 19,370 square feet. Parcel C will not be changed. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and ADOPT Ordinance. 6.3 6.4 California Vehicle Code (CVC) Enforcement on Inspiration Circle, Georgian Oaks Court, Bloomfield Terrace, Dry Creek Drive, and Mountain Rise Place (Hansen Hill, Phase 2) (File $90-$0) The streets bein$ considered with this item are all within the Hansen Hill Development, Phase 2. This subdivision is located north of Dublin Boulevard and west of Silvergate Drive. The residents of thc subdivision have requested that the City enforce CVC regulations in this area, especially related to the speed limit. The approval of this item would allow for more active enforcement by Dublin Police Services. STAFF RECOMMENDATION: C°nduct public hearing; deliberate; adopt Resolution. Sybase Corporate Headquarters Complex, Eastern Dublin Specific Plan/General Plan Amendment, Planned Development Rezone/Developmeut Plan and Development Agreement PA 99-062 and Corrie Center Phase H Office Development General Plan Amendment PA 99-010 (File 420-30) The City Council will consider an amendment to the Eastern Dublin Specific Plan/General Plan, a Planned Development Rezone and Development Agreement for a new 420,000 square foot corporate headquarters for the Sybase Corporation and an Amendment to the General Plan for the Corrie Center project for a new 46,110 square foot office building. STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt Resolution(s); waive reading and INTRODUCE Ordinance(s); schedule second readings of Ordinances for June 20t~ City Council meeting. UNFINISHED BUSINESS 7.1 Approval of Financial Participation Memorandum of Understanding (MOU) with the San Francisco Bay Area Rapid Transit District (BART) and the City of Pleasanton for the proposed West Dublin/Pleasanton BART Station (File 600-40) This proposed MOU provides for a financial commitment from the City of Dublin to finance the West Dublin/Pleasanton BAKT Station. It proposes that the City of Dublin will lease a 600-space parking garage in Dublin in exchange for rent equivalent to the tax receipts (sales, property, and transient occupancy) generated from the Jones Lang LaSalle private development over a specified length of time (minimum 12 years - maximum 17 years. This action does not commit the City of Dublin to approve the proposed residential or hotel units on the project. The developer will process the private component through the standard planning process of the City of Dublin. STAFF RECOMMENDATION: Adopt Resolution. 7.2 Review Rough Cut of Promotional Marketing Video (File 150-35) The City Council identified the preparation of a Promotional Marketing Video as a high priority for FY 1999-2000. Staffhas worked with Goal Line Productions to produce a 10- minute video that promotes Dublin's quality of life, strategic location, and business-friendly atmosphere. STAFF RECOMMENDATION: Provide Staffwith comments on the rough cut of the video and direct Staffto complete the preparation of the video. 7.3 Heritage and Cultural Arts Assessment Final Report (File 910-80) The City Council will receive the results of a community-wide assessment of art and heritage programming that was conducted by AMS Consultants. The assessment included 5 focus group sessions and a telephone survey of 400 residents. STAFF RECOMMENDATION: Accept Final Report and direct Staffto prepare a long-range plan for heritage and cultural arts programming. 10. NEW BUSINESS 8.1 Construction Truck Access Agreement with Windemere BLC Land Company LLC, A California Limited Liability Company (File 600-30) This agreement will ensure that the developers of the Windemere Ranch in Contra Costa County will repair damage to Dougherty Road in Dublin caused by truck trips to their site during Phase One of their project, which consists of 2,249 residential units. The developer plans to start Phase One construction in June of 2000 and this Phase is expected to last more than two years. STAFF RECOMMENDATION: Adopt Resolution and authorize the Mayor to execute the Agreement. 8.2 Establishing the date of the public hearing for Property Related Fees for Garbage Company Rates and Annual Fees for Minimum Residential Garbage Service, approving amendment to Garbage Franchise Agreement and consideration of proposal to provide 64-gallon recycling carts to Dublin residents (File 810-30) In order to adjust the City's garbage rates and fees for minimum residential garbage service, a Public Hearing must be held in order to give the public a chance to comment on the proposed changes. In addition to setting the Public Hearing date, a Franchise Agreement Amendment is needed to clarify certain provisions of the rate setting methodology included in the Agreement. A proposal has also been submitted by Livermore Dublin Disposal to provide 64-gallon recycling carts to Dublin residents. STAFF RECOMMENDATION: Establish a Public Hearing on August 1, 2000; adopt Resolution approving the Franchise Agreement Amendment regarding the interpretation of prior year compensation; provide direction regarding whether to provide 64-gallon recycling carts; and if so, authorize City Manager to negotiate an agreement with LDD to purchase carts using the City's Measure D fund reserve, for a total not to exceed $200,000.
