HomeMy WebLinkAbout*Agenda 04-06-1999DUBLIN CITY COUNCIL A G E N D A REGULAR MEETING - Tuesday, April 6, 1999, 7:00 p.m. DUBLIN CIVIC CENTER, 100 Civic Plaza · Agendas are posted on the City’s Internet Website (www.dublinca.org) · A complete packet of information containing Staff Reports and exhibits related to each item is available for public review prior to a Council meeting in the City Clerk’s Office and also at the Dublin Library. · Agendas may be picked up at the City Clerk's Office for no charge, or to request information on being placed on the annual subscription list, please call 833-6650. 1.CALL TO ORDER 2.PLEDGE OF ALLEGIANCE TO THE FLAG 3.ORAL COMMUNICATIONS 3.1Presentation by Zone 7, Flood Control regarding Draft Environmental Impacts for Zone 7’s Water Supply Planning Zone 7 Staff will explain Zone 7’s future water service planning and concurrent environmental document, including any impacts on the Del Valle Reservoir. STAFF RECOMMENDATION: Receive presentation and provide direction to Staff for Environmental Report comments, if necessary. 3.2Presentation related to East Bay Stand Down for Needy Veterans The Vietnam Veterans of Diablo Valley, a non-profit veterans’ organization, is requesting use of space at Parks RFTA to host the East Bay Stand Down for needy veterans on September thrd 30 through October 3. Stand Down is a term coined during the Vietnam War, which describes the practice of removing combat troops from the field and taking care of their basic needs in a safe area. STAFF RECOMMENDATION: Receive presentation and provide appropriate direction to Staff. At this time, the public is permitted to address the City Council on non-agendized items. COMMENTS SHOULD NOT EXCEED THREE (3) MINUTES. In accordance with State Law, however, no action or discussion may take place on any item not appearing on the posted agenda. The Council may respond to statements made or questions asked, or may request Staff to report back at a future meeting concerning the matter. Any member of the public may contact the City Clerk’s Office related to the proper procedure to place an item on a future City Council agenda. The exceptions under which the City Council MAY discuss and/or take action on items not appearing on the agenda are contained in Government Code Section 54954.2(b)(1)(2)(3). 4.CONSENT CALENDAR Consent Calendar items are typically non-controversial in nature and are considered for approval by the City Council with one single action. Members of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item. 4.1Minutes of Regular Meeting of March 16, 1999 STAFF RECOMMENDATION: Approve 4.2Acceptance of Gifts to City The City Council will consider accepting the following gifts that were received by the Dublin Senior Center: $300 to be used for entertainment for the Center’s special events; a hand- braided wool rug; and a phonograph. STAFF RECOMMENDATION: Accept gifts, direct Staff to prepare formal acknowledgments to donors, and approve budget change form. 4.3Authorization to Solicit Bids for Contract 99-05 Slurry seal treatment consists of an oil/sand mixture applied to streets to seal cracks and to provide a new wearing surface. The sealing of the streets prevents water from entering the street subgrade, which accelerates the destruction of the pavement. STAFF RECOMMENDATION: Authorize Staff to advertise for bids. 4.4Authorization to Solicit Bids – Downtown Theme Banners The City Council approved a new set of banners to be installed on street lights in the 1998-99 Capital improvement Program. These banners are proposed to promote Dublin and the Downtown Farmers Market. STAFF RECOMMENDATION: Approve proposed design for downtown theme banners and farmers market banners and authorize Staff to solicit bids. 4.5All Aboard Mini Storage General Plan Amendment PA 98-024 This GP Amendment applies the Campus Office designation to the Primary Planning Area, a policy allowing both the Retail/Office and Medium-High Density Residential designations to be applied to the same property, changing the land use designation of the Wright and Omernick properties north of the eventual extension of Houston Place from Business Park/Industrial: Outdoor Storage to both Retail/Office and Medium-High Density Residential and changing the land use designation of the Union Pacific Railroad Company property from Transportation Corridor to both Retail/Office and Medium-High Density Residential. STAFF RECOMMENDATION: Adopt Resolution. 4.6Award of Bid – Contract 99-03, Annual Street Repair and Overlay This maintenance contract will repair and overlay those streets included in the 1998-99 annual overlay program as well as repair streets to be slurry sealed this fiscal year. A petition has been received to overlay Darian Court in lieu of slurry sealing the street this year. STAFF RECOMMENDATION: Adopt Resolution awarding bid to Bay Cities Paving & Grading, Inc., and approve a Budget Change of $19,724 from New Revenues (SB300 Funds), and approve homeowners’ petition to overlay Darian Court and direct Staff to generate a Change Order to include Darian Court in Contract 99-03 and approve a budget appropriation of $7,230 from Gas Tax reserves. 4.7Approval of Final Map, Tract 6957 (Dublin Ranch L-2); and Approval of Tract Developer Agreement with MSSH Dublin Development (Shea Homes) for On-Site Tract Improvements This subdivision is located in Phase I of the Dublin Ranch development and is east of Tassajara Road and north of Gleason Drive. The tract includes 69 single family lots. STAFF RECOMMENDATION: Adopt Resolution approving Final Map and Resolution accepting In-Lieu Park Dedication Fees. 4.8Warrant Register ($1,302,626.67) dated April 6, 1999 STAFF RECOMMENDATION: Approve 5.WRITTEN COMMUNICATIONS 5.1Letter from Jean Bolger of Ashford Way requesting installation of soundwall along Alcosta Boulevard The street right-of-way for Alcosta Boulevard is located within the City of San Ramon and the homes backing onto Alcosta Boulevard on the south are in the City of Dublin. A property owner within Dublin has requested Dublin and San Ramon investigate the need for and installation of a soundwall along the south Alcosta Boulevard frontage. STAFF RECOMMENDATION: Review request and provide direction. 5.2Presentation by Representative of Alameda County Transportation Authority regarding Reauthorization of the Half-Cent Sales Tax The Alameda County Transportation Authority has requested to make a presentation on the revised Half-Cent Sales Tax Expenditure Plan and is asking for Dublin’s review of the Plan and support in putting the measure before Alameda County voters. STAFF RECOMMENDATION: Receive presentation and provide comments on project list to strengthen voter support. 6.PUBLIC HEARING 6.1Rite Aid/KinderCare Specific Plan Amendment, PD Rezone, Conditional Use Permit, and Site Development Review PA 98-038 The Applicants are requesting a SP Amendment to the San Ramon Road Specific Plan; a Planned Development (PD) District Rezone; Conditional Use Permit and Site Development Review approval to construct a 16,700 square foot retail drug store with a drive-through pharmacy, and a 9,824 square foot daycare center. As part of their project, the Applicants are voluntarily contributing traffic improvement funds in the amount of $129,880. The project will be located at 7348-7372 San Ramon Road (northwest corner of San Ramon Road and Amador Valley Boulevard). STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt 3 Resolutions; waive reading and INTRODUCE Ordinance. 6.2Public Hearing: PA 98-063, Toll Brothers – Emerald Glen #4 Planned Development This request for a Planned Development Rezone from a PD Medium Density Residential to PD Residential would allow development of 295 single family homes located in the Eastern Dublin Specific Plan area. A second reading is required by the City’s Municipal Code for the proposed ordinance prior to final adoption of the rezone. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and ADOPT Ordinance. 6.3Amendment to Public Facilities Fee The City Council will conduct a Public Hearing on proposed revisions to the Public Facilities Fee for future development within the City of Dublin. STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt Resolution; authorize Staff to retain an appraiser to do a land appraisal as of July 1, 1999. 6.4Dublin Ranch Phase I Development Agreement PA 98-045 The City Council will review a Development Agreement between the City of Dublin and MSSH, LLC (master developer) for the Dublin Ranch Phase I project. The DA is required by the Eastern Dublin Specific Plan. Items included in the DA include, but are not limited to, the financing and timing of infrastructure, payment of traffic, noise and public facilities impact fees, and oversizing of roads and general provisions. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and th INTRODUCE Ordinance; schedule second reading of Ordinance for April 20 Council meeting. 6.5Koll Dublin Corporate Center Development Agreement PA 98-047 The City Council will review a Development Agreement between the City of Dublin and Koll Development Company, LLC, and the Alameda County Surplus Property Authority for the Koll Dublin Corporate Center. The DA is required by the Eastern Dublin Specific Plan. Items included in the DA include, but are not limited to, the financing and timing of infrastructure, payment of traffic, noise and public facilities impact fees, oversizing of roads and general provisions. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and th INTRODUCE Ordinance; schedule second reading of Ordinance for April 20 Council meeting. 6.6Dublin Cemetery Interment Fees The City Council will conduct a Public Hearing to consider amending the interment fees for the Dublin Cemetery. If approved, full earth burials would be $1,275 and cremation burials $180. STAFF RECOMMENDATION: Conduct public hearing; deliberate; and adopt Resolution adopting interment fees for the Dublin Cemetery. 6.7Repeal of Limited Parking Zones on Sierra Lane The City has received a request for the elimination of limited parking on Sierra Lane as the reason for the limited parking is no longer valid. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and INTRODUCE Ordinance; approve No Parking Areas (15’ on each side of driveways for sight distance) 7.UNFINISHED BUSINESS 7.1Dublin Ranch Phase I Neighborhood Park Schematic Designs The City Council will review two schematic design alternatives for the proposed 5-acre neighborhood park in Dublin Ranch Phase I.. The Council will also consider whether a DSRSD recycled water pump station should be located in the park. STAFF RECOMMENDATION: Provide direction on the preferred schematic design alternative and determine whether the DSRSD pump station should be located in the park. 7.2Status Report on Fireworks Booth Selection Historically, a lottery system has been used to determine those non-profit groups that will be permitted to sell fireworks in Dublin. It has been suggested that a similar lottery system be used to determine sales locations for the various groups that will sell fireworks. STAFF RECOMMENDATION: Receive Report and maintain current practice as outlined in Fire Marshal’s Memorandum. 8.NEW BUSINESS 8.1Dublin Ranch Phase I Interim Agreement An Interim Agreement for Dublin Ranch Phase I (847 single family and multi family units) will allow the developer (MSSH) to receive up to 125 building permits prior to the effective date of their development agreement which is required before the developers can pull building permits. th The DA is to become effective approximately May 20. STAFF RECOMMENDATION: Adopt Resolution. 8.2Study Session on Zoning Ordinance Sign Regulation Amendments The Council instructed Staff to make possible changes to Sign Regulations regarding vehicular signs, large balloons and auto dealership signs. The purpose of the study session is to receive comments from the Council regarding these issues. Appropriate public hearings will be scheduled to implement the changes. STAFF RECOMMENDATION: Discuss issues and provide Staff with specific direction on any proposed Sign Regulation changes regarding: Vehicular Signs, Large Balloons/Inflatable Signs, and Vehicular Dealership Sign programs. 9.OTHER BUSINESS - Brief INFORMATIONAL ONLY reports from Councilmembers and/or Staff 10CLOSED SESSION - None . 11ADJOURNMENT . 2 K/cc-mtgs/4-6-99agenda Agenda Printed 2/14/00 1:53 AM
