A complete packet of information containing Staff Reports and exhibits related to each item is available for public review several days prior to a Council meeting in the City Clerk’s Office and also at the Dublin Library. 1.CALL TO ORDER 2.PLEDGE OF ALLEGIANCE TO THE FLAG 3.ORAL COMMUNICATIONS 3.1Proclamation declaring April 13-19, 1997 National Library Week 3.2Proclamation declaring April 6-12, 1997 International Building Safety Week At this time, the public is permitted to address the City Council on non-agendized items. In accordance with State Law, however, no action or discussion may take place on any item not appearing on the posted agenda. The Council may respond to statements made or questions asked, or may request Staff to report back at a future meeting concerning the matter. Any member of the public may contact the City Clerk’s Office related to the proper procedure to place an item on a future City Council agenda. The exceptions under which the City Council MAY discuss and/or take action on items not appearing on the agenda are contained in Government Code Section 54954.2(b)(1)(2)(3). 4.CONSENT CALENDAR Consent Calendar items are typically non-controversial in nature and are considered for approval by the City Council with one single action. Members of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item. 4.1Minutes of Regular Meeting of March 18, 1997 STAFF RECOMMENDATION: Approve 4.2Status of Long Term Permit for Surplus Land at Camp Parks At the January 21, 1997 meeting of the City Council, the Council directed Staff to submit a letter to Col. Bain requesting a long term permit of approximately 20 acres of surplus land at Camp Parks. Staff recently met with Col. Bain and he indicated that he has initiated the process but that it may be 6 to 8 months before a long term permit is granted. STAFF RECOMMENDATION: Receive Report. 4.3Senior Center Gifts The Senior Center received a $500 grant from Sandia National Laboratories that has been held in a liability account. The funds have since been used for a recent Resource Fair, so it is necessary to process a Budget Change Form. Additionally, the Center received a donation from Robin E. Andrew which will be formally accepted by the City Council. STAFF RECOMMENDATION: Approve Budget Change Form and direct Staff to prepare formal acknowledgment to donor. 4.4Designation of California Federal Bank as the Provider of Bank Services for the City's Police Investigation Account The City has an account used by Police Services which is currently maintained with 1st Nationwide. Due to a recent acquisition, 1st Nationwide has decided to change its name and operate as California Federal Bank. A resolution has been prepared which will reflect the change in the name as part of the City's financial records. STAFF RECOMMENDATION: Adopt Resolution. 4.5Award of Bid - Contract 97-03, San Ramon Road Landscape Repair and Silvergate Drive Median Landscaping The San Ramon Road landscape repair will replace roadside groundcover on the west side of San Ramon Road between West Vomac Road and Silvergate Drive. The Silvergate Drive median landscaping project will install median landscaping and irrigation at the east end of Silvergate Drive between Peppertree Road and San Ramon Road. STAFF RECOMMENDATION: Adopt Resolution awarding bid to Herzer Landscaping, Inc. ($107,750) and approve transfer of funds ($25,825) from Unallocated Gas Tax Reserves to these projects. 4.6Approval of Master Consultant Contracts on an as needed basis for overflow services in the Community Development Department With the acceleration of new development projects in both western and eastern Dublin and the requirements related to Eastern Dublin Implementation measures (Scenic Corridor, Biology, Noise, etc.), the Community Development Department has contracted with numerous outside consulting firms on a project by project basis. Anticipated workloads over the next several years dictate that this Department retain ongoing consultant firms to handle overflow work. STAFF RECOMMENDATION: Adopt Resolution approving Agreements with: Stevenson, Porto and Pierce, Inc. (Planning); Cannon Design Group (Planning); Jerry Haag and Associates (Planning); Erny Planning & Management Associates (Planning); and LSA Associates, Inc. (Biologists); and authorize the City Manager to sign on behalf of the City. 4.7Warrant Register ($743,878.08) dated April 1, 1997 STAFF RECOMMENDATION: Approve 5.WRITTEN COMMUNICATIONS - None 6.PUBLIC HEARING 6.1Adoption of an Urgency Ordinance Extending a Moratorium on Applications for Building Permits for Accessory Structures in Agricultural Zones for 10 Months and 15 Days The City Council will consider the adoption of an Urgency Ordinance that would extend the existing moratorium on applications for building permits for Accessory Structures in Agricultural Zones. The City Council adopted an Interim Urgency Ordinance (for 45 days) on this issue on March 4, 1997. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and ADOPT Urgency Ordinance. 6.2Ordinance Establishing Penalties for Cable TV Violations On March 18, 1997, the City Council introduced an Ordinance which would establish a penalty schedule for violations of the Video Customer Service Act. The Act is included in State Law and it establishes certain service requirements for Video Service Providers which includes Cable Television services. If the Ordinance is adopted, it would become effective in 30 days. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and ADOPT Ordinance. 7.UNFINISHED BUSINESS 7.1Proposed Skate Park The City Council will consider adding a skate park to the Update to the Five-Year Capital Improvement Program. STAFF RECOMMENDATION: Prioritize skate park by giving a rating of high, medium, low, or no priority (delete). 8.NEW BUSINESS 8.1Mape Memorial Park Dedication The City Council will review the preliminary plans for the dedication of Mape Memorial Park. Staff is recommending that the dedication be held on August 23, 1997. STAFF RECOMMENDATION: Review and approve preliminary plans and direct Staff to include funds in the FY 1997-98 Budget. 8.2Distribution of Dougherty Regional Fire Authority Assets & Liabilities As a result of the dissolution of the Dougherty Regional Fire Authority effective June 30, 1997, the Fire Authority will have assets & liabilities which will need to be distributed to the Cities of Dublin & San Ramon. The Dougherty Regional Fire Authority Board of Directors has agreed to a distribution method and is recommending that the method be ratified by the City Councils of the City of San Ramon and the City of Dublin. STAFF RECOMMENDATION: Ratify decisions made by the Dougherty Regional Fire Authority Board of Directors on February 24, 1997: 1) All remaining assets (including cash) and liabilities will be distributed on the basis of Joint Powers Agreement Section 8.1 Termination and Section 8.3 Disposition of Assets. This distribution will be based upon the percentages calculated by the Authority's Auditor, Maze and Associates. 2) Direct Staff to distribute Fire Impact Fees to the City of origin on a Last In/First Out Basis. 3) Authorize the distribution of all facilities and equipment on the basis of need, with the unneeded items to be sold. 8.3Summer Concerts at the Civic Center The City Council will review the preliminary plans for a summer concert at the Civic Center Plaza. STAFF RECOMMENDATION: Review and approve preliminary plans; provide direction on date and type of band. 9.OTHER BUSINESS - Brief INFORMATIONAL ONLY reports from Councilmembers and/or Staff 10CLOSED SESSION . 10.1Conference with Legal Counsel - Existing Litigation pursuant to Government Code Section 54956.9 subdivision (a): City of Dublin vs. Woolverton, et al., Alameda County Superior Court Case No. V-009571-4. REPORT OF CLOSED SESSION ACTION 11ADJOURNMENT . Note: The City Council and Planning Commission will hold a joint study session to review and discuss May 6, changes to update the City's Zoning Code Ordinance. The meeting will be held just prior to the 1997 City Council meeting, beginning at 5:30 p.m., in the Council Chambers.
