At this time, the public is permitted to address the City Council on non-agendized items. The Council must, however, comply with all State Laws in regard to items not appearing on the posted agenda. The Council may respond to statements made or questions asked, or may request Staff to report back at a future meeting concerning the matter. Any member of the public may contact the City Clerk’s Office related to the proper procedure to place an item on a future City Council agenda. The exceptions under which the City Council MAY discuss and/or take action on items not appearing on the agenda are contained in Government Code Section 54954.2(b)(1)(2)(3). 4.CONSENT CALENDAR Consent Calendar items are typically non-controversial in nature and are considered for approval by the City Council with one single action. Members of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item. 4.1Minutes of Regular Meetings of November 19, December 3, and December 17, and Adjourned Regular Meeting of December 4, 1996 STAFF RECOMMENDATION: Approve 4.2Renewal of Agreement with NORCAL Employment Relations Training Consortium Since 1987, the City has participated in this consortium which provides employee relations training. Dublin is one of 22 participating public agencies. In addition to training, the law firm of Liebert, Cassidy & Frierson provides participating agencies with attorney consultation via telephone and with a monthly newsletter covering employment relations issues. STAFF RECOMMENDATION: Authorize the City Manager to execute the Agreement. 4.3Financial Report for the month of November, 1996 STAFF RECOMMENDATION: Receive Report. 4.4Warrant Register ($650,162.27) dated January 7, 1997 STAFF RECOMMENDATION: Approve 5.WRITTEN COMMUNICATIONS - None 6.PUBLIC HEARING 6.1Enea Plaza Planned Development Rezone PA 96-043 The City Council will hear a request for a PD rezone for an existing retail and office complex. The proposed PD Zoning District will update and combine the 3 existing PD Zoning Districts for the site. The proposed District includes those uses presently allowed. In addition, it will allow some new uses such as automotive parts sales and related vehicle servicing, as permitted uses and hotel/motel as conditional uses. STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt Resolution approving Negative Declaration; waive reading and ADOPT Ordinance amending the Zoning Ordinance; adopt Resolution approving and establishing findings and general provisions for a PD Planned Development Rezoning. 6.2Opus Planned Development Rezone for a 25 acre site located within the Eastern Dublin Specific Planning Area The Applicant, Opus Southwest, is requesting a rezone to a Planned Development Zoning District for a Business Office/Industrial Development at the southwest corner of Gleason Road and Hacienda Drive in the Eastern Dublin Specific Planning Area. The project encompasses approximately 25 acres of land. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and ADOPT Ordinance amending the Zoning Ordinance; adopt Resolution approving and establishing findings and general provisions for a PD Planned Development Rezoning. 6.3Graffiti Ordinance In accordance with Graffiti Task Force recommendations, Staff has developed a City Ordinance specific to graffiti, mandating removal of graffiti and achieving the goal of quick eradication. The proposed Ordinance broadens the definition of graffiti, declares graffiti to be a public nuisance, requires property owners and tenants to remove it, and provides various public remedies if graffiti is not removed. These remedies include criminal enforcement, abatement by the City (at the owner's or tenant's expense), and civil litigation. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and ADOPT Ordinance. 7.UNFINISHED BUSINESS 7.1Contract for Consultant Services for Internet Website Design In November of 1996, the City Council directed Staff to accelerate the schedule for City utilization of the Internet. A report will be presented recommending awarding the contract for Website Design Services to Citilinks, in an amount not to exceed $6,695 (which includes 12 months of maintenance costs). STAFF RECOMMENDATION: Authorize City Manager to execute Agreement and approve an additional $6,000 appropriation from Reserves. 8.NEW BUSINESS 8.11997 Goals & Objectives/Budget Study Session The City Council annually holds a special meeting to define the City's Goals & Objectives for the upcoming year and to review the status of G&O for the past year. Last year, a Budget study session was held on the same evening and this provided Staff with guidelines for developing the Annual Budget. STAFF RECOMMENDATION: Determine approach to be used for establishing Citywide Goals & Objectives; establish special meeting date during week of February 24, 1997; and determine if Budget Study Session should be held on the same date or at a separate meeting. 8.2Sale of Public Property - Remnant Parcels from Dublin Boulevard Extension Acquisition The City has received a request to purchase 2 City owned remnant parcels from Main Street Properties. The City properties would be combined with a vacant lot owned by J. Patrick Land Company in order to create a combined parcel large enough for the development of a sit- down restaurant. A restaurant on this proposed site would be part of J. Patrick Land Company's 6-acre planned development that incorporates a 91-unit hotel on a contiguous lot as part of their master plan. STAFF RECOMMENDATION: Authorize Staff to prepare a purchase/sale agreement with Main Street Properties in accordance with terms and conditions set forth in Letter of Interest. 8.3Appointment of Ad-hoc City Council Subcommittee for Dublin Pride Week For the last several years, the City has designated a week in the Spring as Dublin Pride Week and has encouraged residents to participate in clean-up and fix-up activities. A special trash pick-up day is designated during the week. Coloring contests are held for local school children and posters are displayed at the Civic Center. Past promotional items have included Dublin Pride printed pencils, buttons, bookmarks, sunglasses, etc. STAFF RECOMMENDATION: Appoint Ad-hoc Subcommittee to assist with 1997 Dublin Pride Week activities. 8.4Request for Funding from Children's Theatre Wing CTW is proposing to bring Shanachie to Dublin with performances scheduled from January 22 through January 26, 1997, at Dublin Elementary School. CTW is requesting that the City provide flyers and posters for marketing purposes and that the City coordinate distribution of a portion of these flyers and posters in the Dublin schools and businesses. Total printing costs are estimated to be $1,000. STAFF RECOMMENDATION: Consider 8.5Consultant Agreement to Conduct Fire Facilities Impact Fee Study The dissolution of the Dougherty Regional Fire Authority on July 1, 1997, will result in the expiration of the Fire Facilities Impact Fee currently imposed by DRFA on new development within its boundaries. Unless the City of Dublin adopts a new Fire Facilities Impact Fee to replace DRFA's fee, the City will not be able to fund the fire stations, equipment and apparatus necessary to serve new development. Staff received proposals from 3 firms experienced in conducting development impact fee studies. STAFF RECOMMENDATION: Authorize Mayor to execute agreement with Hausrath Economic Group and approve Budget Change Form authorizing transfer of $11,300 from the City's Budgeted Contingent Reserve. 9.OTHER BUSINESS - Brief INFORMATIONAL ONLY reports from Councilmembers and/or Staff 10CLOSED SESSION - None . 11ADJOURNMENT . 2 K/cc-mtgs/agndanew.doc Agenda Printed 2/14/00 2:44 AM
