Call to Order 2. Pledge of Allegiance to the Flag 3. ORAL COMMUNICATIONS 3.1. Introduction of New Employee: Victoria Chak, Secretary to the City Manager/Deputy City Clerk A new member of City Staffwill be introduced. STAFF RECOMMENDATION: Welcome new City of Dublin Staffmember. 3.2. Acceptance of Donation from the Valley Spokesmen Touring Club Dublin Police Services' Crime Prevention Unit received a generous donation of $1,500 from Valley Spokesmen Touring Club which will be used to expand the Dublin Police Services bicycle safety program. The Dublin City Council will present Valley Spokesmen with a Certificate of Appreciation for their donation. STAFF RECOMMENDATION: Accept the $1,500 donation and recognize the donor; and approve the Budget Change. 3.3. Public Comments At this time, the public is permitted to address the City Council on non-agendized items. Please step to the podium and clearly state your name for the record. COMMENTS SHOULD NOT EXCEED THREE (3) MINUTES. In accordance with State Law, no action or discussion may take place on any item not appearing on the posted agenda. The Council may respond to statements made or questions asked, or may request Staff to report back at a future meeting concerning the matter. Any member of the public may contact the City Clerk's Office related to the proper procedure to place an item on a future City Council agenda. The exceptions under which the City Council MAY discuss and/or take action on items not appearing on the agenda are contained in Government Code Section 54954.2(b)(1 )(2)(3). CONSENT CALENDAR Consent Calendar items are typically non-controversial in nature and are considered for approval by the City Council with one single action. Members of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item. 4.1. Minutes of Regular City Council Meeting of December 6, 2011 The City Council will consider the approval of the minutes of the Regular City Council Meeting of December 6, 2011. STAFF RECOMMENDATION: Approve the minutes of the Regular City Council Meeting of December 6,2011. 4.2. Approval of Final Map and Tract Improvement Agreement, Approval of Agreement for Long-Term Encroachment for Landscape Features, and Acceptance of Park Land Dedication In-Lieu Credits for Tract 7617, Fallon Crossings (Standard Pacific Homes) Standard Pacific Homes is filing a Final Map for Tract 7617 (Fallon Crossings) to create 106 individual lots for the construction of homes. STAFF RECOMMENDATION: Adopt Resolution Approving Final Map and Tract Improvement Agreement for Tract 7617, Fallon Crossings; adopt Resolution Approving the Agreement for Long Term Encroachment for Landscape Features for Tract 7617, Fallon Crossings; and adopt Resolution Accepting Park Land Dedication In-Lieu Credits and Payment of Fees for Park Land Dedication Requirements for Tract 7617, Fallon Crossings. 4.3. Annual Report of Developer Impact Fee Funds Deposits: Pursuant to Government Code Sections 66002, 66006 and 66008 (AB 1600) State law requires the City to review and report on an annual basis the status of Development fees collected to finance public improvements. The report covers activity which occurred in these funds during Fiscal Year 2010-2011. The analysis has determined that all funds held for more than 5 years are necessary to complete identified projects. ST AFF RECOMMENDATION: Accept the Annual Report of Developer Impact Fee Funds for the Year Ended June 30, 2011; and adopt Resolution Making Findings Regarding Unexpended Traffic Mitigation Contributions for Fiscal Year 2010-2011. 4.4. Request for Waiver of Competitive Bid Process and Authorization to Purchase Fire Apparatus through Purchasing Contract with Alameda County Fire Department In order to ensure reliability, the City of Dublin and the Alameda County Fire Department routinely review fleet vehicles for potential replacement. During the current year, one wildland Type 3 fire apparatus has been scheduled for replacement based upon general vehicle condition and history of maintenance and repair expenses. STAFF RECOMMENDATION: Adopt Resolution "Authorizing Staff to Purchase One Wildland Type 3 Fire Apparatus Vehicle through purchasing contract with Alameda County Fire Department". The City Purchasing Ordinance provides the City Council with authority to waive the competitive bid process by a four-fifths [4/5] vote specifically for the purchase of vehicles. 4.5. Check Issuance Report and Electronic Transfers The City Council will receive a listing of payments issued from November 10,2011 - November 30, 2011 totaling $3,734,564.14. Acceptance of Work - Contract No. 11-09, Dougherty Hills Park Slope and Drainage Repair Project (Evans Brothers Inc. - CIP No. 950017) A contract was awarded by the City Council on August 16, 2011 to Evans Brothers, Inc. for the Dougherty Hills Park Slope and Drainage Repair project (CIP No. 950017) which included slope stabilization and drainage repair and improvements on a hillside within Dougherty Hills Park immediately above Topaz Circle. The Public Works Department has determined that the work under this contract is now complete and ready for acceptance. STAFF RECOMMENDATION: Accept the improvements under Contract No. 11-09, Dougherty Hills Park Slope and Drainage Repair Project, with Evans Brothers, Inc., and authorize the release of retention after 35 days if there are no subcontractor claims; and approve the Project Budget Change in the amount of $2,360. 4.7. Acceptance of Work - Contract No. 11-02, Weber Tractor Services and Approval of Resolution Repealing Resolutions 124-02 and 125-02 and Amending the Dublin Traffic Code Approving a Parking Regulation on Village Parkway On April 19, 2011, the City Council approved award of contract to Weber Tractor Services for Contract No. 11-02. This contract provided for improvements related to three separate Capital 'Improvement Projects. On October 4, 2011 the City Council authorized a change order and additional work. The Public Works Department ha~ determined that the work under this contract is now complete and ready for acceptance. A Budget change is required for one of the projects. Due to the changes in conditions along Village Parkway, the City Council will also consider an update to the Traffic Code related to parking restrictions. STAFF RECOMMENDATION: 1) Accept the improvements under Contract No. 11-02, with Weber Tractor Service, and authorize the release of retention after 35 days if there are no subcontractor claims; 2) Approve the Budget Change; and 3) Adopt Resolution Repealing Resolutions 124-02 and 125-02 and Amending the Dublin Traffic Code Approving a Parking Regulation on Village Parkway. 4.8. Approval to Procure Traffic Engineering Consulting Services in Excess of $20,000 for the development of a Travel Demand Model Various on-going and future development projects and an update to the Circulation Element of the City ofDub~in General Plan currently underway require the use of a Citywide Travel Demand Model to project future traffic patterns. Development of a new model to replace the existing model is needed to support existing and future projects. The City Council will consider the procurement of consulting services to develop the new Citywide Travel Demand Model. STAFF RECOMMENDATION: Authorize the City Manager to procure consulting services with Fehr & Peers for the development of a Citywide Travel Demand Model for an amount not to exceed $118,860; and approve the Budget Change allowing the total project expenditures to be recorded in the Engineering Operating Budget. 4.9. Acceptance of Offer of Dedication for Positano Hills Park Site, Parcel 3, Parcel Map 10049, Positanol Fallon Village Parcel Map 10049 dedicated a 4.60-acre Neighborhood Park Site to the City of Dublin. The City Council accepted the offer of dedication on June 21, 2011, subject to completion of grading and other infrastructure improvements to be completed as part of the adjoining Neighborhood "D" in Positano/Fallon Village. These improvements are now complete and it is appropriate for the City to accept the offer of dedication. STAFF RECOMMENDATION: Adopt Resolution Accepting the Offer of Dedication for Positano Hills Park Site, Parcel 3, Parcel Map 10049, PositanolFallon Village. 5. WRITTEN COMMUNICATION - None. Review of City Fireworks Ordinance Permit Process Vice Mayor Hart asked that the City Council discuss the language in the City's Fireworks ordinance regarding eligibility for the type of organization that could be included in the drawing to sell fireworks. In completing the review, Staff has noted potential amendments to the ordinance for City Council consideration STAFF RECOMMENDATION: Consider this item and provide Staff with appropriate direction. 7.2. Town Hall Meeting on Sign Regulations The City Council will be asked to appoint two Councilmembers to participate in a Town Hall . Meeting on February 9, 2012 where amendments to Chapter 8.84 (Sign Regulations) of the Dublin Zoning Ordinance will be discussed with interested members of the community. STAFF RECOMMENDATION: Receive the report and appoint two Councilmembers to participate in the Town Hall Meeting. 8. NEW BUSINESS 8.1. Adoption of Transit District Fee Deferral Program for Multifamily Residential Staff is seeking City Council authorization to implement a two-year fee deferral program for multi-family residential developments of twenty units or more within. the designated Transit Districts at the East Dublin BART Station and the new West Dublin BART Station are part of the City's continued efforts to support economic development activities in Dublin. STAFF RECOMMENDATION: Adopt Resolution Establishing the Transit District Multi-Family Residential Development Fee Deferral Program. . 8.2. Adoption of Commercial Fac;ade Improvement Grant Program Staff is seeking City Council authorization to implement a Commercial Fac;ade Improvement Grant Program for commercial businesses in the Downtown Dublin Specific Plan Area and the segment of Dublin Boulevard between Village Parkway and Dougherty Road as part ofthe City's continued efforts to support economic development activities in Dublin. STAFF RECOMMENDATION: Adopt Resolution establishing the Commercial Fac;ade Improvement Grant Program. 8.3. City Councilmember Dublin Pride Week Committee Appointments The City Council will consider appointing two of its members to the 2012 Dublin Pride Week Committee for a limited term beginning January 2012 and ending December 2012. The Dublin Pride Week Committee plans and prepares this annual event, which seeks to engage individuals and/or groups in action based activities to help improve the community. STAFF RECOMMENDATION: Discuss two Councilmember appointments to the Dublin Pride Week Committee and confirm the appointments for the limited term of January 2012 through December 2012. 8.4. Authorization for the City Manager to execute a Consulting Services Agreement with RBF Consulting to prepare a Specific Plan and an Environmental Impact Report for the Dublin Crossing development project at Camp Parks The City Council will consider authorizing the City Manager to execute a Consulting Services Agreement with RBF Consulting, a planning, engineering, and environmental consulting firm, to prepare a Specific Plan and the necessary environmental documentation in accordance with the California Environmental Quality Act (CEQA) for the Dublin Crossing Project at Camp Parks for an amount not to exceed $368,535. ST AFF RECOMMENDATION: 1) Receive Staff presentation; 2) Take testimony from the Applicant and the public, 3) Deliberate; December 20, 2011 Dublin City Council Agenda Page 4 of 5 and 4) Adopt Resolution approving a Consulting Services Agreement with RBF Consulting to prepare a Specific Plan and an Environmental Impact Report for the Dublin Crossing development project at Camp Parks. 8.5. Consideration of Changing City Council Minutes to Action Minutes The City Council will consider changing the format of City Council meeting minutes from summary minutes to action minutes. STAFF RECOMMENDATION: Consider this matter and take the appropriate action. 8.6. Appointment of Delegate to Attend the National League of Cities Congressional City Conference and Designation of Voting Delegate for the 2012 National League of Cities Annual Conference The City Council will consider appointing one of its members as a delegate, and one as an alternate, to attend the National League of Cities (NLC) Congressional City Conference in March 2012, and appointing a voting delegate, and an alternate, to attend and vote, on the City's behalf, at the NLC Annual Conference in November of2012. STAFF RECOMMENDATION: Review and discuss appointing one of its members as a delegate, and oneas an alternate, to attend the National League of Cities (NLC) Congressional City Conference in March 2012, and appoint a voting delegate, and an alternate, to attend and vote on the City's behalf at the NLC Annual Conference in November of2012. 9. 9.1 OTHER BUSINESS Brief INFORMATION ONLY reports from Council and/or Staff, including Committee Reports and Reports by Council related to Meetings Attended at City Expense (AB 1234). 10.
