CALL TO ORDER AND PLEDGE OF ALLEGIANCE TO THE FLAG 2. REPORT ON CLOSED SESSION 3. ORAL COMMUNICATIONS 3.1. Presentation by Congressman Eric Swalwell Congressman Eric Swalwell will provide an update on federal government policies and actions. STAFF RECOMMENDATION: Receive the presentation. 3.2. Recognition of Inside Dublin 2013 Participants The City Council will recognize the Inside Dublin 2013 participants. STAFF RECOMMENDATION: Recognize 2013 Inside Dublin participants. 3.3. 2013 Business Anniversary Awards The City Council will recognize those businesses that have been in Dublin 20, 25, 30, 35, 40, 45 and 50 years. STAFF RECOMMENDATION: Recognize those businesses that have been in Dublin 20, 25, 30, 35, 40, 45 and 50 years. 3.4. Proclamation Declaring “Cover Dublin Day” in support of Covered California The City of Dublin, in its efforts to tackle the need for affordable health care in the community, is pledging its support to Covered California by declaring “Cover Dublin Day”. Covered California was created by the State of California to develop an organized marketplace where eligible residents can buy affordable health coverage. STAFF RECOMMENDATION: Proclaim November 20, 2013 as “Cover Dublin Day.” Page 1 of 4 November 16, 2013Dublin City Council Agenda 3.5. Introduction of the Northstar Destination Strategies Team The City Council will be introduced to the Northstar Destination Strategies team conducting the in- market research for the Branding and Marketing Plan this week. STAFF RECOMMENDATION: Receive the report. 3.6. Public Comments At this time, the public is permitted to address the City Council on non-agendized items. Please step to the podium and clearly state your name for the record. COMMENTS SHOULD NOT EXCEED THREE (3) MINUTES. In accordance with State Law, no action or discussion may take place on any item not appearing on the posted agenda. The Council may respond to statements made or questions asked, or may request Staff to report back at a future meeting concerning the matter. Any member of the public may contact the City Clerk’s Office related to the proper procedure to place an item on a future City Council agenda. The exceptions under which the City Council MAY discuss and/or take action on items not appearing on the agenda are contained in Government Code Section 54954.2(b)(1)(2)(3). 4. CONSENT CALENDAR Consent Calendar items are typically non-controversial in nature and are considered for approval by the City Council with one single action. Members of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item. 4.1. Minutes of the November 5, 2013 Regular City Council Meeting The City Council will consider approval of the minutes of the Regular City Council meeting of November 5, 2013. STAFF RECOMMENDATION: Approve the minutes of the Regular City Council meeting of November 5, 2013. 4.2. Approval of Final Map and Tract Improvement Agreement, Approval of Agreement for Long- Term Encroachment for Landscape Features, and Acceptance of Park Land Dedication In-Lieu Credits for Tract 7667, Esprit at Dublin Station (Western Pacific Housing, Inc.) Western Pacific Housing, Inc., is filing a Final Map for Tract 7667 (Esprit at Dublin Station) to create two (2) individual lots for condominium purposes for the construction of 105 townhouse units. Tract 7667 is bounded on the west by Iron Horse Parkway, the south by Martinelli Way, the east by Campus Drive, and the north by Dublin Boulevard. STAFF RECOMMENDATION: Resolution Adopt Approving Final Map and Tract Improvement Agreement for Tract 7667, Esprit at Resolution Dublin Station; adopt Approving the Agreement for Long Term Encroachment for Resolution Landscape Features for Tract 7667, Esprit at Dublin Station; and adopt Accepting Parkland Dedication In-Lieu Credits for Park Land Dedication Requirements for Tract 7667, Esprit at Dublin Station. 4.3. Consulting Services Agreement with Pacific Municipal Consultants (dba PMC) for Housing Services Staff is recommending execution of a Consulting Services Agreement with Pacific Municipal Consultants (dba PMC) to assist with housing services. STAFF RECOMMENDATION: Resolution Adopt Approving a Consulting Services Agreement with Pacific Municipal Consultants for Housing Services. 4.4. Check Issuance Report and Electronic Funds Transfers The City Council will receive a listing of payments issued from October 1, 2013 – October 31, 2013 totaling $6,738,731.65. Dublin Crossing: Zoning Ordinance Amendments and Development Agreement On November 5, 2013, the City Council adopted the Dublin Crossing Specific Plan (DCSP) and associated implementation actions, which will enable the development of approximately 189 acres in the City of Dublin with a residential mixed-use project with up to 1,995 single- and multi-family residential units; up to 200,000 square feet of retail, office and/or commercial uses; a 30 acre Community Park; a 5 acre Neighborhood Park, and a 12 acre elementary school site to serve approximately 900 students. In addition to adopting the DCSP, amendments were approved for the General Plan, and the Final Environmental Impact Report (EIR) for the project was certified. Lastly, an ordinance approving amendments to the Zoning Ordinance was introduced and an ordinance approving a Development Agreement for the project was introduced. The City Council is considering adopting both ordinances at this public hearing. STAFF RECOMMENDATION: Ordinance Waive the reading and adopt an Approving Zoning Ordinance Amendments to create a new Chapter: 8.31 (Dublin Crossing Zoning District), rezone all properties within the Dublin Crossing Specific Plan project area to the Dublin Crossing Zoning District, amend the Zoning Map to identify the location of the new Zoning District, amend Zoning Ordinance Chapter 8.12 (Zoning Districts and and Permitted Uses), and amend Chapter 8.104 (Site Development Review); waive the reading and Ordinance adopt an Approving a Development Agreement between the City of Dublin and Dublin Crossing Venture LLC relating to the Dublin Crossing Project. 5. WRITTEN COMMUNICATION – None. 6. PUBLIC HEARINGS 6.1. Updates to the City’s Construction and Fire Codes in Accordance with Requirements of State Law The 2013 Edition of the California Building Codes Standards (CBSC) was approved by the California Building Standards Commission earlier this year and will go into effect on January 1, 2014. In order to ensure the continuity of the City’s building standards, the City must adopt an Ordinance incorporating the new codes. The City Council is being asked to review and adopt an Ordinance repealing the 2010 California Building Codes Standards and adopting the 2013 California Building Codes Standards. In connection with this action, the City Council is also being asked to adopt a Resolution approving findings relating to the City’s amendments to the California Building Code Standards. STAFF RECOMMENDATION: Resolution Conduct the public hearing, deliberate, and adopt Approving the Finding of Necessity for Amendments to the 2013 California Building Standards Code; waive the reading and adopt an Ordinance Repealing and Adopting Chapters 5.08 (Fire Code), 7.32 (Building Code), 7.34 (Residential Code), 7.36 (Electrical Code), 7.40 (Plumbing Code), Chapter 7.44 (Mechanical Code), and 7.94 (Green Building Code), of the Dublin Municipal Code, in Order to Adopt by Reference and Amend Provisions of the 2013 Edition of the California Building Standards Code, Title 24, California Code of Regulations. 7. UNFINISHED BUSINESS 7.1. Downtown Dublin Bikeway Connectivity Study Presentation The City is currently undertaking an update of the 2007 Bikeways Master Plan and developing a Pedestrian Plan with emphasis on the Downtown area. In conjunction with the update of the Plan, a bikeway connectivity study on Dublin Boulevard through Downtown was conducted and presented to the public at several workshops for input. Staff will present the results of the study to the City Council for action, which will then be incorporated in the update of the Bikeways and Pedestrian Master Plan. STAFF RECOMMENDATION: Receive the Staff presentation and select a preferred alternative for inclusion in the update of the Bikeways and Pedestrian Master Plan. Positano Hills Park – Site Modifications Following the opening of Positano Hills Park, the City received feedback from residents regarding the need for more playground equipment for older children, as well as additional shade in the picnic areas. As guided by input from the community, additional improvements to the play area along with shade trees are proposed for Positano Hills Park. STAFF RECOMMENDATION: Receive the presentation and approve the preferred option. 8. NEW BUSINESS – None. 9. OTHER BUSINESS Brief INFORMATION ONLY reports from Council and/or Staff, including Committee Reports and Reports by Council related to Meetings at City Expense (AB1234). 10.
