PUBLIC EMPLOYEE PERFORMANCE EVALUATION Title: City Attorney REGULAR MEETING 7:00 PM 1. CALL TO ORDER AND PLEDGE OF ALLEGIANCE TO THE FLAG 2. REPORT ON CLOSED SESSION 3. ORAL COMMUNICATIONS 3.1. Recognition of Outstanding Work Conducted by the Dublin Police,Alameda County Fire Department, and Alameda County Sheriff's Dispatch Dublin Police Services Officers Jessica Schott, Gabriel Tamondong, Alameda County Fire Captain Amanda Benfield, Captain Bryan Dillingham, Engineer Steve O'Neil, Engineer Scott Krauss, Firefighter Lee Phillips, Firefighter Ed Bidmead, and Alameda County Sheriff's Office Dispatcher Dennis Parish will be recognized for their outstanding work to rescue a two year-old child who had accidentally fallen into a swimming pool at an apartment complex. STAFF RECOMMENDATION: Recognize and commend the members of Dublin Police Services, Alameda County Fire, and Alameda County Sheriffs Office Dispatch for the outstanding collaborative effort to save the life of a two year-old child. 3.2. Presentation of the League of California Cities Helen Putnam Award of Excellence to the City of Dublin Representatives from the League of California Cities will present the League's Helen Putnam Award for Excellence to the City of Dublin for its work on the Emerald Vista housing development. The Helen Putnam Award is designed to recognize and promote the outstanding efforts and innovative solutions made by city governments each year. This is the second time that the City of Dublin has received a Helen Putnam Award. STAFF RECOMMENDATION: Receive the award. 3.3. Freedom From Workplace Bullies Week The City Council will proclaim the week of October 19-25, 2014, as "Freedom from Workplace Bullies Week" in the City of Dublin. National Fire Prevention Week 2014 The City Council will recognize National Fire Prevention Week, sponsored by the National Fire Protection Association(NFPA),to highlight the need for continued fire safety within communities. STAFF RECOMMENDATION: Receive the presentation and approve the proclamation declaring October 5 through October 11, 2014, "National Fire Prevention Week" in the City of Dublin. 3.5. Annual Investments Report The City Council will receive a report from Chandler Asset Management, on the structure and performance of the City's investment portfolio. STAFF RECOMMENDATION: Receive the report. 3.6. Public Comments At this time,the public is permitted to address the City Council on non-agendized items. Please step to the podium and clearly state your name for the record. COMMENTS SHOULD NOT EXCEED THREE(3)MINUTES. In accordance with State Law, no action or discussion may take place on any item not appearing on the posted agenda. The Council may respond to statements made or questions asked,or may request Staff to report back at a future meeting concerning the matter. Any member of the public may contact the City Clerk's Office related to the proper procedure to place an item on a future City Council agenda. The exceptions under which the City Council MAY discuss and/or take action on items not appearing on the agenda are contained in Government Code Section 54954.2(b)(1)(2)(3). 4. CONSENT CALENDAR Consent Calendar items are typically non-controversial in nature and are considered for approval by the City Council with one single action. Members of the audience,Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item. 4.1. Minutes of the September 16,2014 Regular City Council Meeting The City Council will consider approval of the minutes of the Regular City Council meeting of September 16, 2014. STAFF RECOMMENDATION: Approve the minutes of the September 16, 2014 Regular City Council meeting. 4.2. Amendment to Agreement with North Star Destination Services for City's Marketing and Branding Plan The City Council will consider an amendment to the agreement with North Star Destination Strategies to create the City's Marketing and Branding Plan based on a revised scope of work. The proposed amendment would extend the agreement until March 1, 2015 and includes additional creative work, as well as an additional in-person presentation. This amendment would increase the contract amount by $8,000, bringing the total cost to $136,000. STAFF RECOMMENDATION: Adopt the Resolution Approving the Amendment to the Agreement between the City of Dublin and North Star Destination Strategies. 4.3. Drought Emergency Continuance On March 18, 2014, the City Council adopted a Resolution declaring a State of Emergency in the City of Dublin due to extreme drought conditions within the State and City. The City Council will receive a report on the City efforts to reduce water consumption and will consider continuing extending the State of Emergency for an additional 30 days. STAFF RECOMMENDATION: By motion, as required by Government Code Section 8630(c), which states that the City Council shall review the need for continuing a local emergency at least once every 30 days until the governing body terminates the local emergency, continue the State of Emergency that was declared on March 18, 2014, based on the fact that extreme drought conditions continue to exist within both the State of California and City of Dublin, and the threat to the safety and welfare of Dublin residents remains. Acceptance of Work Shannon Park Water Play Area Renovation—Contract 13-06 On June 4, 2013, the City Council awarded Contract No. 13-06 to McNabb Construction, to renovate the Shannon Park Water Play Area. The work by McNabb Construction is now complete and ready for City Council acceptance. STAFF RECOMMENDATION: Adopt the Resolution Accepting Improvements to the Shannon Park Water Play Area Under Contract No. 13-06 4.5. Temporary Road Closures for Camp Parks Veterans Day Run Parks Reserve Forces Training Area (PRFTA) is sponsoring a Veterans Day 5k/1 0k Run that will partially be run on City streets. The City Council will consider adopting a Resolution authorizing the temporary closure of City streets for the 2014 Camp Parks Veterans Day 5k/10k Run on Saturday, November 15, 2014. STAFF RECOMMENDATION: Adopt the Resolution Authorizing Temporary Street Closures for the 2014 Camp Parks Veterans Day 5k/10k Run. 4.6. Tr -Valley Intergovernmental Reciprocal Services Master Agreement with Dublin San Ramon Services District, Zone 7 and the Cities of Dublin,Pleasanton,Livermore,and San Ramon to Facilitate Coordination in the Tr-Valley. The Cities of Dublin, Pleasanton, Livermore and San Ramon, along with Dublin San Ramon Services District (DSRSD) and Alameda Flood Control and Water Conservation District Zone 7 (Zone 7), have developed an agreement which can be used to facilitate coordination between the agencies for contracting services, or sharing resources and materials. This agreement would allow two or more agencies to formally work together on an as needed basis that would be task specific. STAFF RECOMMENDATION: Adopt the Resolution Approving the Tr -Valley Intergovernmental Reciprocal Services Master Agreement, among the Cities of Dublin, Pleasanton, Livermore and San Ramon and Special Districts DSRSD and Zone 7. 4.7. 2014 Development Agreement Review The City Council will receive a report on the City's annual review of Development Agreements to ensure compliance with the terms and provisions of the Agreements, pursuant to State Law and to Chapter 8.56 of the Dublin Municipal Code. STAFF RECOMMENDATION: Adopt the Resolution Finding that the Developers Having Obligations Under the Following Development Agreements Have Complied in Good Faith with the Terms and Provisions of those Agreements and Concluding the 2013 Annual Review for those Agreements: Dublin Crossing; Moller Ranch; Kingsmill (Crown Chevrolet Site); Dublin Ranch Area A-H; Dublin Ranch Supplemental Development Agreement for Areas F, G and H; AMB/Legacy Partners, West Dublin Transit Village; Western Pacific Housing, Transit Center Site E-1; Gateway Medical Group/Triad; Sorrento East/SR Structured Lot Options Amended; Dublin Ranch Amendment to the Master Agreement; Schaefer Ranch South; Wallis Ranch; Dublin Ranch North; Jordan Ranch; Lennar Brannigan Project; Fallon Gateway/Target; Promenade; Avalon Bay, Site C; and Transit Center Master Development Agreement; and 2) conclude the Annual Development Agreement Review for 2014. Approval of a Community Benefit Agreement between the City of Dublin and Bay West Development Partners IV,LLC for a Mixed-Use Retail/Residential Project Bay West Development Partners IV, LLC seeks to develop the former Crown Chevrolet site located in Downtown Dublin. Under the Downtown Dublin Specific Plan, a Community Benefit Agreement is required in order to allocate units from the Downtown Dublin Specific Plan's Development Pool. In exchange for the allocation of residential units from the pool and the waiver of any additional affordable housing requirements on Parcel A, the developer is offering to transfer a portion of their land (Parcel B) to the City or to Eden Housing Inc. (a non-profit affordable housing developer) for future development as an affordable housing site. STAFF RECOMMENDATION: Adopt the Resolution Approving the Community Benefit Agreement between the City of Dublin and Bay West Development Partners IV, LLC for a Mixed-Use Retail/Residential Project. 5. WRITTEN COMMUNICATION—None. 6. PUBLIC HEARINGS 6.1. Adoption of the Dublin Bicycle and Pedestrian Master Plan and Associated Amendments to the Dublin General Plan,Eastern Dublin Specific Plan,Dublin Village Historic Area Specific Plan, Downtown Dublin Specific Plan and Dublin Zoning Ordinance(PLPA-2014-00017) The City of Dublin has prepared the Dublin Bicycle and Pedestrian Master Plan, which combines an update to the Bikeways Master Plan(2007)with the City's first Pedestrian Plan to create a comprehensive document that provides policies, network plans, prioritized project lists, support programs and best practice design guidelines for bicycling and walking in Dublin. Associated amendments to the Dublin General Plan, Eastern Dublin Specific Plan, Dublin Village Historic Area Specific Plan, Downtown Dublin Specific Plan and Dublin Zoning Ordinance are proposed to maintain consistency with the Dublin Bicycle and Pedestrian Master Plan. The City Council is being asked to review the Master Plan, the proposed General Plan, Specific Plan and Zoning Ordinance amendments and the associated environmental document and take action. STAFF RECOMMENDATION: Conduct the public hearing, deliberate, and, 1) Adopt the Resolution Adopting a Negative Declaration for the City of Dublin Bicycle and Pedestrian Master Plan and Related Amendments to the Dublin General Plan, Eastern Dublin Specific Plan, Dublin Village Historic Area Specific Plan, Downtown Dublin Specific Plan and Dublin Zoning Ordinance; 2) Adopt the Resolution Approving Amendments to the Dublin General Plan, Eastern Dublin Specific Plan, Dublin Village Historic Area Specific Plan, and Downtown Dublin Specific Plan; 3) Waive the reading and INTRODUCE an Ordinance Amending Chapter 8.76 (Off-Street Parking and Loading Regulations) of the Dublin Zoning Ordinance; and, 4) Adopt the Resolution Adopting the Dublin Bicycle and Pedestrian Master Plan. 6.2. Resolution Determining That The Public Interest And Necessity Require the Acquisition of a Partial Fee and Temporary Construction Easement From APN 941-0550-007-01 for the Proposed Dougherty Road Improvements Project The City Council will consider the proposed Resolution of Necessity to authorize the commencement of an eminent domain action to acquire a fee simple interest and six month temporary construction easement over portions of the property located along Dougherty Road, Assessor's Parcel Number 941-0550-007- 01, for the construction of the Dougherty Road Improvements Project(the "Project"). STAFF RECOMMENDATION: Conduct the public hearing, deliberate and adopt the Resolution Determining that the Public Interest and Necessity Require the Acquisition of a Partial Fee and Temporary Construction Easement from APN 941- 0550-007-01 for the Proposed Dougherty Road Improvements Project; 4W LLC, Property Owner Property Location: 6271-6309 Dougherty Road, Assessor's Parcel No.: 941-0550-007-01 . The Council must consider all evidence presented at the hearing on the Resolution, and must find and determine each of the following in order to adopt the Resolution: (1) that the public interest and necessity require the Project; (2) that the Project is planned or located in the manner that will be the most compatible with the October 7,2014 Dublin City Council Agenda Page 4 of 6 greatest public good and the least private injury; and (3) that the partial fee acquisition and temporary construction easement are necessary for the Project. 7. UNFINISHED BUSINESS—None. 8. NEW BUSINESS 8.1. Authorization of Units from the Development Pool and Related Community Benefit Agreement Deal Points with Presidio Mana Dublin,LLC Presidio Mana Dublin, LLC seeks units from the Downtown Dublin Specific Plan Development Pool in order to develop a project at 6541-6543 Regional Street. Staff will present the negotiated deal points to be included in the Community Benefit Agreement and is requesting authorization from the City Council to proceed with its preparation. STAFF RECOMMENDATION: Staff recommends that the City Council authorize preparation of a Community Benefit Agreement based on the negotiated deal points summarized in this report. 8.2. Kaiser Permanente General Plan and Eastern Dublin Specific Plan Amendment Study initiation request The City Council will consider whether to initiate a General Plan and Eastern Dublin Specific Plan Amendment Study to consider creating a new "Campus Medical" land use designation and consider changing the land use designation on approximately 58 acres of property south of Dublin Boulevard between Grafton Street and Fallon Road from Campus Office to Campus Medical. STAFF RECOMMENDATION: Either adopt the Resolution Approving the Initiation of a General Plan and Eastern Dublin Specific Plan Amendment Study to consider creating a new "Campus Medical" land use designation and consider changing the land use designation on approximately 58 acres of property south of Dublin Boulevard between Grafton Street and Fallon Road from Campus Office to Campus Medical; OR, adopt the Resolution Denying the Request to Initiate a General Plan and Eastern Dublin Specific Plan Amendment Study to consider creating a new "Campus Medical" land use designation and consider changing the land use designation on approximately 58 acres of property south of Dublin Boulevard between Grafton Street and Fallon Road from Campus Office to Campus Medical. 8.3. Budget Review FY 2013-14 4th Quarter Financial Review The City Council will receive a financial report on the fourth quarter for Fiscal Year 2013-14 and consider amendments to the Fiscal Year 2013-14 Budget as well as the Fiscal Year's reserve designations. STAFF RECOMMENDATION: Receive the report on the preliminary FY 2013-14 financial results and adopt the Resolution Approving a Fourth Quarter Budget Amendment to the City of Dublin's Fiscal Year 2013-14 Budget and Approving Reserve Designations as of June 30, 2014. 8.4. Support for Proposition 1,the Water Quality, Supply,and Infrastructure Improvement Act of 2014 The City Council will consider adopting a Resolution indicating the City's support of Proposition 1, the Water Quality, Supply and Infrastructure Improvement Act of 2014. STAFF RECOMMENDATION: Adopt the Resolution Supporting the Passage of Proposition 1, the Water Quality, Supply and Infrastructure Improvement Act of 2014. Designation of Two Council Members as City Representatives to Discuss Compensation with City Attorney The City Council will consider the designation of two members of the City Council to serve as the City's representatives to discuss terms of the City Attorney's contract, including compensation, with the City Attorney. STAFF RECOMMENDATION: Designate two members of the City Council to discuss compensation with the City Attorney. 9. OTHER BUSINESS - Brief INFORMATION ONLY reports from Council and/or Staff, including Committee Reports and Reports by Council related to Meetings Attended at City Expense (AB 1234). 10.
