CALL TO ORDER AND PLEDGE OF ALLEGIANCE TO THE FLAG 2. REPORT ON CLOSED SESSION 3. ORAL COMMUNICATIONS 3.1. Recognition of Dr. Ted C. Woy, M.D. The City Council will recognize Dr. Ted Woy, M.D. as a founding Board Member of the Dublin Senior Foundation and thank him for his 18 years of service to the Foundation and community. STAFF RECOMMENDATION: Present the Certificate of Recognition. 3.2. Introduction of Dublin Police Services Captain Garrett Holmes The City Council will be introduced to Captain Garrett Holmes of Dublin Police Services. STAFF RECOMMENDATION: Welcome Dublin Police Services Captain Garrett Holmes. 3.3. Dublin San Ramon Services District Drought Update The City Council will receive a presentation from Dublin San Ramon Services District updating the City Council on the recycled water conversion project. STAFF RECOMMENDATION: Receive the presentation. 3.4. Public Comments At this time, the public is permitted to address the City Council on non-agendized items. Please step to the podium and clearly state your name for the record. COMMENTS SHOULD NOT EXCEED THREE (3) MINUTES. In accordance with State Law, no action or discussion may take place on any item not appearing on the posted agenda. The Council may respond to statements made or questions asked,or may request Staff to report back at a future meeting concerning the matter. Any member of the public may contact the City Clerk's Office related to the proper procedure to place an item on a future City Council agenda. The exceptions under which the City Council MAY discuss and/or take action on items not appearing on the agenda are contained in Government Code Section 54954.2(b)(1)(2)(3). CONSENT CALENDAR Consent Calendar items are typically non-controversial in nature and are considered for approval by the City Council with one single action. Members of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item. 4.1. Minutes of the September 15,2015 Regular City Council Meeting The City Council will consider approval of the minutes of the September 15, 2015 Regular City Council meeting. STAFF RECOMMENDATION: Approve the minutes of the September 15, 2015 Regular City Council meeting. 4.2. Resolution Consenting to the Inclusion of Properties,within the City's Jurisdiction, in the California HERO Program to Finance Distributed Generation Renewable Energy Sources,Energy, and Water Efficiency Improvements and Electric Vehicle Charging Infrastructure and Approving a Related Amendment to a Joint Powers Agreement to Participate in the HERO Program EXECUTIVE SUMMARY: The City Council will consider adopting a Resolution authorizing the City to join the HERO Program, which is a program designed to assist in financing energy and water saving projects, the financing of which is accomplished through an assessment on a resident's property. The program is coordinated by the Western Riverside Council of Governments through a joint powers authority, which the City would be joining. The City Council action will authorize the HERO Program to accept applications from Dublin property owners who wish to finance energy and water saving improvements. The action will also authorize the HERO Program to conduct contractual assessment proceedings and levy contractual assessments on behalf of the City within the territory of the City of Dublin for the repayment of program financing. The HERO Program is a Property Assessed Clean Energy Program (PACE). The City already has one such residential program in place through the CaliforniaFIRST Program. HERO Program participation would provide residents with an additional alternative to consider. STAFF RECOMMENDATION: Adopt the Resolution Consenting to the Inclusion of Properties within the City's Jurisdiction in the California Hero Program to Finance Distributed Generation Renewable Energy Sources, Energy and Water Efficiency Improvements and Electric Vehicle Charging Infrastructure and Approving the Amendment to a Certain Joint Powers Agreement Related Thereto. 4.3. Agreement with SwattlMiers Architects for Design Services for City Council Chamber Renovation The City Council will consider an Agreement with SwattiMiers Architects for the design of renovations within the City Council Chamber. STAFF RECOMMENDATION: Adopt the Resolution regarding Agreement with SwattlMiers Architects for Design Services for the Renovation of the City of Dublin City Council Chamber. 4.4. Resolution Supporting an Amendment of the Communications Act of 1934 Community television stations provide transparency and access for residents and business owners by broadcasting local government meetings and programming. California law allows a local entity to establish a fee to support public, educational and governmental (PEG) channel facilities consistent with federal law, which limits the use of PEG fees to capital costs incurred for PEG access facilities. The Community Access Preservation Act (CAP Act), U.S. Senate Bill S.1244, would modify the Communications Act of 1934 to allow PEG fees to be used for both capital and operational expenses. STAFF RECOMMENDATION: Adopt the Resolution Supporting U.S. Senate Bill S.1244 to Amend the Communications Act of 1934. October 6,2015 Dublin City Council Agenda Page 2 of 5 4.5. Acceptance of Work—Contract No. 15-02,Annual Sidewalk Safety Repair Program and Curb Ramp Installation The City Council will consider accepting the Annual Sidewalk Safety Repair Program and Curb Ramp Installation project, which provided for the repair of over 3,800 square feet of damaged sidewalk, installation of four (4) pedestrian curb ramps, and installation of new sidewalk, driveway, and curb ramps in front of the Public Safety Complex and Alameda County Fire District Administration Building. The project also included replacement of wood decking with concrete surfaces at Dolan Park. In conjunction with accepting the construction work, the City Council will consider approving a change order. STAFF RECOMMENDATION: Adopt the Resolution Accepting Improvements under Contract No. 15-02, Annual Sidewalk Safety Repair Program and Curb Ramp Installation; approve the Change Order; and authorize the City to release retention after 35 days if there are no subcontractor claims. 4.6. Commercial Facade Improvement Grant Program Agreement with B&B Borden LLC In December 2011, the City Council adopted the Commercial Facade Improvement Grant Program as a way to improve the physical appearance of the Downtown Dublin Specific Plan Area and the segment of Dublin Boulevard between Village Parkway and Dougherty Road, and encourage the retention of existing businesses, as well as increase property values, tenant stability, and lease rates in the area. B&B Borden LLC requested participation in the Commercial Facade Improvement Grant Program to assist them with the substantial facade improvements for 7032 Village Parkway valued at an estimated cost of$146,764. STAFF RECOMMENDATION: Adopt the Resolution Approving a Commercial Facade Improvement Grant Program Agreement with B&B Borden LLC relating to facade and patio improvements to be performed on the property located at 7032 Village Parkway. 4.7. Approval of Parcel Map 10145 for Amador Crossings (Red Mountain Retail Group, Inc.) Red Mountain Asset Fund I, LLC, by Red Mountain Retail Group is filing Parcel Map 10145 to subdivide an existing 5.9 acre parcel into three new parcels at the Amador Crossings retail center. Amador Crossings is located at the southeast corner of the intersection of Amador Valley Boulevard and Amador Plaza Road. STAFF RECOMMENDATION: Adopt the Resolution Approving Parcel Map 10145 for Amador Crossings. 4.8. Dublin Library Tenant Improvement Project, Contract No. 15-05 On August 3, 2015, the bids were publicly opened for Dublin Library Tenant Improvement Project (Contract 15-05). The City received three bids for the project, all of which exceed the funding available for construction. The City Council will consider rejecting all bids and rebidding the project in the future. STAFF RECOMMENDATION: Adopt the Resolution Rejecting All Bids for the Dublin Library Tenant Improvement Project, Contract 15- 05, and direct Staff to rebid the project at a later date and include the modifications to the scope of improvements as recommended by Staff. 4.9. National Fire Prevention Week 2015 The City Council will recognize National Fire Prevention Week, sponsored by the National Fire Protection Association(NFPA), to highlight the need for continued fire safety within communities. STAFF RECOMMENDATION: Approve the proclamation declaring October 4 through 10, 2015, as "National Fire Prevention Week" in the City of Dublin. 4.10 Approval of Correspondence to Zone 7 Water Agency Regarding Water Rate Adjustments The City Council will consider authorizing the Mayor to sign a letter regarding a proposed increase in the water rates by the Zone 7 water agency. STAFF RECOMMENDATION: Authorize the Mayor to sign a letter on the City's behalf to Zone 7 regarding the revised water rates that Zone 7 is currently considering. 5. WRITTEN COMMUNICATION—None. October 6,2015 Dublin City Council Agenda Page 3 of 5 6. PUBLIC HEARINGS 6.1. General Plan/Eastern Dublin Specific Plan Amendments, Planned Development Rezoning with related Stage 1 Development Plans for portions of: 1) Jordan Ranch (PLPA 2015-00045); 2) Dublin Ranch Subarea 3 (PLPA 2015-00046); and 3) Wallis Ranch (PLPA 2015-00047). In addition,Jordan Ranch has submitted an application for Planned Development Zoning with Stage 2 Development Plan, Site Development Review Permit and Vesting Tentative Maps 8267 and 8269 for Parcel H and Neighborhood 7; and a Development Agreement amendment with BJ-ROF Jordan Ranch LLC Mission Valley Properties. The City Council will consider the following General Plan and Eastern Dublin Specific Plan Land Use changes: 1) Jordan Ranch - change 3.7 acres from Parks/Public Recreation to Public/Semi Public and change 4.6 acres identified as Parcel H from Mixed Use to Medium Density Residential (6.1 to 14.0 units per acre); and 2) Dublin Ranch Subarea 3 - (Irongate) change 10.4 acres from Rural Residential/Agriculture to Parks/Public Recreation. A Planned Development rezone with related Stage 1 Development Plan is proposed in accordance with these land use changes. Jordan Ranch also proposes to include Planned Development Zoning with a Stage 2 Development Plan, Site Development Review Permit and Vesting Tentative Maps for Parcel H (VTM 8267) and Neighborhood 7 (VTM 8269). An amendment to the Jordan Ranch Development Agreement is also proposed. Changing Parcel H to MDR would remove the potential for 115 units and 5,000 square feet of retail commercial and replaces it with 45 units (five units are detached 2-story homes and 40 units are 3-story duets). Neighborhood 7, approved previously for approximately 100 Medium Density units, includes 105 detached 3-story units. The City Council will also consider land use changes for the Wallis Ranch project to help address a potential future parkland deficit that is unrelated to the school/park site changes in Jordan Ranch. The City and the Wallis Ranch developer propose to create additional parkland by way of a General Plan and Eastern Dublin Specific Plan Amendment and Planned Development Zoning to change 1.9 acres from Semi-Public to Parks/Public Recreation. This proposal does not modify the number of residential units in the Wallis Ranch development. STAFF RECOMMENDATION: Staff recommends that the City Council conduct the public hearing; deliberate; and take the following actions: a) Adopt the Resolution Adopting a Mitigated Negative Declaration, Mitigation Monitoring and Reporting Program and Statement of Overriding Considerations for the Jordan Ranch/Subarea 3/Wallis Ranch Project; b) Adopt the Resolution Approving General Plan/Eastern Dublin Specific Plan Amendments for portions of Dublin Ranch Subarea 3 (Irongate), Wallis Ranch and Jordan Ranch; c) Waive the reading and INTRODUCE an Ordinance approving a Planned Development Rezoning with related Stage 1 Development Plan for portions of Jordan Ranch, Dublin Ranch Subarea 3 and Wallis Ranch, and approving a related Stage 2 Development Plan Amendment for portions of Jordan Ranch; d) Adopt the Resolution Approving a Site Development Review Permit and Vesting Tentative Maps 8267 (Parcel H) and 8269 (Neighborhood 7) for the Jordan Ranch project; and e) Waive the reading and INTRODUCE an Ordinance Approving a Development Agreement Amendment between the City of Dublin and BJ-ROF Jordan Ranch LLC (Mission Valley Properties) for the Jordan Ranch Project. 7. Trumark Wallis Ranch Public Art Project Trumark Homes ("Trumark") is under construction with Wallis Ranch, a 184-acre residential development near the northeasterly City limit, west of Tassajara Road, near the intersection with Fallon Road. As part of their Development Agreement, the developer has opted to install public art instead of paying the in-lieu fee. Per the Public Art Master Plan, all private developers are required to meet with the Heritage and Cultural Arts Commission for review of the artwork. Upon recommendation by the Heritage and Cultural Arts Commission, the developer must seek final approval of the artwork by the City Council. STAFF RECOMMENDATION: Approve the proposed public artwork for Trumark's Wallis Ranch development. 8.2. Request for City Sponsorship of Diwali Celebration in City Park The City Council will consider a request from a Dublin resident for City-sponsorship of a Diwali celebration, which would include safe and sane fireworks, at a City park (preferably in East Dublin) on Saturday, November 14, 2015. STAFF RECOMMENDATION: Provide direction regarding the request for a City-sponsored Diwali celebration. 9. OTHER BUSINESS - Brief INFORMATION ONLY reports from Council and/or Staff, including Committee Reports and Reports by Council related to Meetings Attended at City Expense (AB 1234). 10.
