Reports and exhibits related to each agenda item is available for public information several days prior to a Council meeting in the City Clerk's Office & also at the Dublin Library. 1. CALL TO ORDER 2. PT.~DGE OF ALLEGIANCE TO THE FLAG 3. ORAL COMMUNICATIONS At this time, members of the audience are permitted to address the City C0unci[ on items of interest to the public, however, in accordance with GC 54954.2, no ACTION or DISCUSSION shall take place on any item which is NOT on the City Council Agenda. The Council may respond briefly to statements made or questions posed, or may request Staff to report back at a future meeting concerning the matter. Furthermore, a member of the City Council may direct Staff to place a matter of business on a future agenda. An~person may arrange with the City Clerk (no later than 11:00 a.m., on the Tuesday preceding a regular meeting) to have an item, of concern placed on the agenda for the next regular meeting. The exceptions under which the City Council MAY discuss and/or take action on items not appearing on the agenda are contained in GC 54954.2(b)(1)(2)(3). 4. CONSENT CALENDAR Consent Calendar items are typically non-controversial in nature and are considered for approval by the City Council with one single action. Members of the audience or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item. 4.1 Minutes:. Regular Meeting of July 25, 1994 STAFF RECOMMENDATION: Approve 4.2 Preliminary Financial Report for Period Ending June 30, 1994 STAFF RECOMMENDATION: Receive Report 4.3 Award of Bid Contract 94-05, Annual Overlay/Street Monuments The low bid received, $235,684.90, is approximately $15,000 higher than the construction budget for this project. Staff is proposing to reduce the scope of work in order to bring the project within budget. STAFF RECOMMENDATION: Adopt Resolution awarding contract to EaSt Bay Excavating Co., Inc., and authorize the Mayor to execute the agreement; and direct Staff to reduce the scope of work to bring project within budget. 4.4 Award of Contract for Fiscal Analysis for PA 94-030 Eastern Dublin Annexation/Detachment and Prezone ~1 A consultant is needed to prepare a fiscal analysis of PA 94-030 Eastern Dublin Annexation/Detachment and Prezone #1 in a timely and cost effective manner. STAFF RECOMMENDATION: Award contract for Consultant Services to Economics Research Associates (not to exceed $15,000) and authorize the City Manager to execute the contract. 4.5 Commitment for Local Matching Funds for ISTEA Grant Projects Dublin is eligible to receive $3,420,250 in 4 Intermodel Surface Transportation and Efficiency Act grants for 4 separate projects. As part of the grant requirements, Dublin must agree to pay the 11.5% matching project costs. STAFF RECOMMENDATION: Adopt Resolution. 4.6 Warrant Register ($643,393.01) Dated August 8, 1994 STAFF RECOMMENDATION: Approve 5. WRITTEN COMMUNICATION 5.1 Request from Valley Volunteer Center for Use of the Regional Meeting Room The Valley Volunteer Center has requested free use of the Dublin Civic Center for their management assistance workshop series for non-profit organizations. They anticipate holding a maximum of 21 separate workshops between September 1994 and June 1995. STAFF RECOMMENDATION: Consider request. 5.2 Request to FormaliZe the City's Relationship with Sister City, Bray, County Wicklow, Ireland The President of the Dublin Sister city Association has received a request from the Secretary of the Bray Sister City group stating they would like to formally twin the two cities. STAFF RECOMMENDATION: Consider request and provide appropriate direction to Staff. 5.3 Dublin United Soccer League (DUSL) Parade DUSL would like to hold a parade on Saturday, August 27th, to kick off their 1994 season and to celebrate World Cup Soccer being played in the Bay Area. for the first time. Total City costs are estimated at $1,600; including $500 in Police Services costs charged to existing overtime account. STAFF RECOMMENDATION: Approve parade route; authorize issuance of and waive permit fee; and approve $1,100 additional appropriation to cover Public Works costs. 5.4 Dublin Fine Arts Foundation (DFA) Loaned Arts Program Sculpture Agreement #4 DFA is requesting permission to locate a bronze sculpture entitled "Sirius" created by Peter Woulkos at the Civic Center. DFA will pay all direct costs and depending upon the location, the City may incur additional landscape maintenance expenses. STAFF RECOMMENDATION: If the Council concurs with the conditions under which the artwork will be displayed, authorize the Mayor to execute the agreement and direct Staff to work with DFA to complete the installation. 6. PUBLIC HEARING 6.1 Landscaping and Lighting Maintenance Assessment District 83-2 (Tract 4719) This is the second public hearing for this assessment district which funds landscaping maintenance along Stagecoach Road and the 'interior slopes' of Dublin Hills Estates. No increase is proposed over the 1993-94 assessment. STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt Resolution approving Engineer's Report, confirming diagram and assessment, and ordering levy of assessment. 6.2 Citywide Storm Water Utility Fee The City has obtained a storm water discharge permit together with Alameda County and the other Cities in Alameda County as part of the Federally mandated National Pollution Discharge Elimination System (NPDES) Program. The fees collected under the City program pay for the coSt of carrying out the program. The proposed fee for FY 1994 95 is $14.72 for a single-family property, which is the ~ same amount as the 1993-94 fee. ~ STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt Resolution establishing storm water utility fee for FY 1994-95. 6.3 Sign Ordinance Revision PA 93-062 The Planning Commission, Business Sign Task Force and City Staff have worked for Several months to completely revise and improve the Sign Ordinance. Proposed revisions will improve sign visibility for businesses and simplify the sign permit/application process. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and INTRODUCE Ordinance. 7. UNFINISHED BUSINESS - None 8. NEW BUSINESS 8.1 Report on Zoning Ordinance Amendment Request to Consider Expresso Carts Ms. Jaynie Bunnell is requesting the City Council to modify and expand the Zoning Ordinance Amendment Study related to outdoor sales to consider allowing businesses without a place of business in Dublin to have ongoing outdoor food sales. STAFF RECOMMENDATION: Give policy direction to either 1) modify and expand the Zoning Ordinance Amendment Study or 2) continue the Zoning Ordinance Amendment Study as previously directed. 8.2 Heritage Center Renovation The city Council will review the survey and recommendations report for the Heritage Center renovation and provide direction on the recommended improvements. STAFF RECOMMENDATION: Approve preliminary design and authorize Architect to proceed with construction documents incorporating bid item alternates as necessary; direct Staff to identify those aspects of the project that can be under- taken by volunteers, confirm volunteer labor and report back to the Council at a future meeting; and direct Staff to pursue an advance from the City's 1995-96 allocation of CDBG funds. 9.
