The City Council will present a proclamation declaring June 11, 2011 as Challenge Butter Day.

3.4 Acceptance of Gifts for the Heritage Park and Museums and Dublin Senior Center
(610-50)
The City Council will receive a report on donations made during Fiscal Year 2010-2011 from
Dublin individuals, businesses and local non-profit organizations to support the Heritage Park
and Museums, and the Dublin Senior Center. Additionally, the City Council will be asked to
accept a donated Studebaker Wagon, circa 1900, as an addition to the Heritage Park &
Museums Collections.
STAFF RECOMMENDATION: Formally accept the gifts and the Studebaker Wagon as part of
the Heritage Park & Museums Collections.

3.5 Report on 2011 Dublin Pride Week Activities and Recognition of Poster Contest Winners
and Pride Week Partners (150-80)
The City Council will formally recognize the contributions made by various individuals and
organizations that helped make the 2011 Dublin Pride Week activities into a successful
community event.
STAFF RECOMMENDATION: Formally recognize poster contest winners and Pride Week
partners.
3.6 2011 Tri-Valley Housing Opportunities Week (610-50)
In recognition of Tri-Valley Housing Opportunities Week, June 4-11, 2011, the City Council
recognizes the Tri-Valley Housing Opportunity Center for their service to the Dublin
Community.

4. CONSENT CALENDAR
Consent Calendar items are typically non-controversial in nature and are considered for approval by the City Council with one single action. Members
of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the
Mayor to remove the item.
4.1 Minutes of Special Meeting of January 22, 2011 and Regular Meeting of May 17, 2011 .
STAFF RECOMMENDATION: Approve minutes.
4.2 Avalon Bay Communities, Dublin Station (Transit Center Site C) for Stage 1 Development
Plan Amendment, Stage 2 Development Plan and Development Agreement submitted by
Avalon Bay Communities, Inc. (400-20/450-30/600-60)
The City Council will hold a second reading of ordinances approving a Planned Development
Rezone and a related Stage 1 Development Plan Amendment and a Stage 2 Development
Plan, and a Development Agreement for the Avalon Transit Genter Site C. The proposed
project is a residential project comprised of 505 apartment units, a 4,223 square foot fitness
center, 733 spaces of structured parking within two buildings, 25 private, on-street parking
spaces, and 40 public on-street parking spaces on a combined 7.2-acre site located within the
Transit Center Village planning area.
STAFF RECOMMENDATION: Waive the reading and adopt Ordinance Approving a PD-
Planned Development Rezone and Related Stage 1 Development Plan Amendment/Stage 2
Development Plan and Finding the Project Exempt Under the California Environmental Quality
Act for the Avalon Bay Communities Dublin Station Project on Site C of the Dublin Transit
Center; and waive the reading and adopt Ordinance Approving a Development Agreement and
Finding the Project Exempt under the California Environmental Quality Act for Dublin Station,
Site C, Dublin Transit Center between the City of Dublin and Avalon Bay Communities.
4.3 Authorization to Modify Agreement with Management Partners, Incorporated for Services
Related to Associated Community Action Program (ACAP) (600-30)
The City of Dublin, in its role as Fiscal Agent assisting with the wrap up of Associated
Community Action Program (ACAP), has entered into an agreement with Management
Partners, Incorporated. It has been determined that ACAP will require additional professional
legal services, which will be obtained as a sub-consultant to Management Partners. Based on
the City of Dublin procurement requirements, the City Council is requested to authorize the
City Manager to execute amendments to the Management Partners Agreement, provided they
do not exceed $50,000. All additional costs are funded from the ACAP Trust Fund
established with member contributions.

STAFF RECOMMENDATION: Authorize a modifications to the agreement with Management
Partners, Incorporated of up to $50,000 which shall be funded from contributions made by the
member agencies to a special trust fund held by the City of Dublin.
4.4 Scarlett Court Zoning Ordinance Amendments to the Dublin Municipal Code related to
the Scarlett Court Overlay Zoning District (Chapter 8.34), PLPA-2011-00019 (450-20)
The City Council will hold a second reading of City-initiated amendments to Title 8 of the
Dublin Municipal Code (Zoning Ordinance) related to the Scarlett Court Overlay Zoning
District. The proposed amendments would streamline the process to allow auto-related uses
in the Scarlett Court Overlay Zoning District by means of a Zoning Clearance or Minor Use
Permit. The amendments include modifications to Chapter 8.12 (Zoning Districts and
Permitted Uses), Chapter 8.34 (Scarlett Court Overlay Zoning District), and Chapter 8.116
(Zoning Clearance).
STAFF RECOMMENDATION: Waive the reading and adopt Ordinance Amending Chapters
8.12 (Zoning Districts and Permitted Uses), 8.34 (Scarlett Court Overlay Zoning District), and
8.116 (Zoning Clearance) of the Zoning Ordinance for Auto-Related Uses in the Scarlett Court
Overlay Zoning District.
4.5 Comprehensive Emergency Management Plan Update (520-30)
The City Council will consider adopting a proposed amendment to the City's Comprehensive
Emergency Management Plan. The amendment adds a Volunteer Coordination Plan to the
City's emergency management practices to provide a mechanism for the City to manage
volunteer resources during a disaster.
STAFF RECOMMENDATION: Adopt the addition to the Comprehensive Emergency
Management Plan.
4.6 Acceptance of Work - Contract No. 10-03 Dublin Sports Grounds - Phase IV (600-35)
Construction Contract 10-03 was work perfortned under a contract awarded to Suarez and
Munoz Construction, Incorporated. This agreement completed the improvements associated
with Capital Improvement Project #95830 (Dublin Sports Grounds Phase IV). The work is
now complete and ready for City Council acceptance. The balance of retention held by the
City will be released after 35 days of acceptance if there are no subcontractor claims.
STAFF RECOMMENDATION: Authorize the City Manager to accept the final facility
improvements; adopt Resolution Accepting Improvements to Dublin Sports Grounds Phase IV;
and authorize Staff to accept a maintenance bond in the amount of $59,500.
4.7 Civic Center Modifications Project - Agreement for Architectural Services (600-30)
The City Council will consider an Agreement for Architectural Services with the Dahlin
Group Architects to prepare plans and specifications for modifications to the Dublin Civic
Center. Improvements included as part of this project include: ADA upgrades to the public
counters in City Hall and Police Services, changes to the police locker rooms that would
increase locker counts without the need for a building expansion, and minor office
reconf'igurations to support better customer service.
STAFF RECOMMENDATION: Adopt Resolution Approving an Agreement with Dahlin
Group Architects for the Civic Center Modifications Project.
4.8 Authorization to Enter into an Agreement with Capital Accounting Partners to Provide a
Cost Allocation and User Fee Study (600-30)
The City's current fee and cost recovery model was last updated in fiscal year 2005-06. An
updated user fee study will allow the City to examine the relationship between the current fees
and the actual costs. The study will also evaluate the equity of fees based on relationship to
payer. The City received proposals from five firms to conduct a Cost Allocation and User Fee
Study. After review of proposals it is recommended that the City engage Capital Accounting
Partners to conduct the Cost Allocation and User Fee Study.
STAFF RECOMMENDATION: Adopt Resolution Authorizing the City Manager to Execute an
Agreement with Capital Accounting Partners to Conduct a Cost Allocation and User Fee Study.

4.9 Assignment and Assumption of and Second Amendment to Disposition and Development
Agreement for the Arroyo Vista Redevelopment Project (600-60)
The City is a party to the Arroyo Vista Disposition and Development Agreement (DDA) with
various parties, including Eden Housing. The DDA provided for the replacement of the
Arroyo Vista public housing project with a new mixed-income housing development. The
Arroyo Vista property has now been transferred to the market-rate and below-market-rate
developers. The below-market rate developer, Eden Housing, is presently engaged in
financing the development of its component of the Project and has requested certain minor,
non-substantive changes to the DDA at the behest of its financiers.
STAFF RECOMMENDATION: Adopt Resolution Approving the Assignment and Assumption
of, and Second Amendment to, tlie Disposition and Development Agreement for the Arroyo
Vista Redevelopment Project.
4.10 Acceptance of Donations for All-America City Awards Competition, Approval of Budget
Change and Authorization for Travel (150-70)
On April 6, 2011, the City of Dublin was named a finalist by the National Civic League for
the 2011 All-America City Award Competition. In order to compete for the title as an All-
America City, a delegation of elected officials, community members and City staff must
travel to Kansas City, Missouri in June 2011 to compete for the prestigious award. Donations
have been raised to send a delegation. Staff recommends that the City Council accept the
donations, approve a Budget Change, and authorize the travel of a delegation out of state at
the City's expense.
STAFF RECOMMENDATION: Adopt Resolution Accepting the Donations for the All-
America City Awards Competition and Authorizing City Travel Expenses and Travel Out-of
State by City Officials, Staff and Community Members to Represent the City of Dublin at the All
America City Awards; and approve the Budget Change.
4.11 Positano/Anderson Affordable Housing Agreement - First Amendment to the Amended
and Restated Subsequent Affordable Housing Agreement for the remainder of the Positano
Development PA 05-038 (600-70)
The City has entered into two agreements with Braddock and Logan entities (Dublin RE
Investors, LLC and Braddock and Logan Group II, L.P.) that describe how the Developer will
satisfy its affordable housing obligations for the Positano project. Those agreements provide
that the Braddock and Logan entities will, among other things: (a) construct a total of 94
inclusionary units (made up of 2 integrated units and 92 second units within the project area);
(b) pay a fee (in three installments) of $1,938,760 in-lieu of construction of inclusionary units;
and (c) pay a$1,000,000 Community Benefit payment in equal installments at building
permit. The proposed amendment alters the location of some of the inclusionary second units.
STAFF RECOMMENDATION: Adopt Resolution Approving the First Amendment to
Amended and Restated Subsequent Affordable Housing Agreement for the Construction of
Inclusionary Units and Payment of Fees in Lieu of Constructing Inclusionary Housing Units.
4.12 Review of Services and Amendment to the Agreement with Alameda County Public Works
Agency for Traffic Signal Maintenance, Street Lighting Maintenance and Real Estate
Services (600-40)
The City Council will consider a Review of Services and an Amendment to the Agreement
with Alameda County Public Works for Traffic Signal Maintenance, Street Lighting
Maintenance and Real Estate Services to extend the contract through June 30, 2014.
STAFF RECOMMENDATION: Review the comparative analysis of the services provided
under this agreement; and Adopt Resolution approving the Amendment to Agreement between
City of Dublin and County of Alameda Public Works Agency for Traffic Signal and
Streetlighting Maintenance, and Real Estate Services.

4.13 Award of Bid - Contract No. 11-06, Striping and Marking Contract (600-35)
This renewal of the City's Striping and Marking Contract (Contract No. 11-06) is for a three-
year contract term and will allow for the installation of new and replacement of existing
pavement striping and markings throughout the City as needed. Chrisp Company submitted
the low bid of $234,770 for the three-year term.
STAFF RECOMMENDATION: Adopt Resolution Awarding Contract No. 11-06, Street Light
Pole Painting Contract to Chrisp Company.
4.14 Award of Bid - Contract No. 11-03, Dublin Traffic Signal Improvements (600-35)
The Dublin Traffic Signal Improvements Project (CIP No. 960022) will install a new traffic
signal at the intersection of Amador Valley Boulevard and Brighton Drive and upgrade an
existing traffic signal at the intersection of San Ramon Road and Shannon Avenue.
STAFF RECOMMENDATION: Adopt Resolution Awarding Contract No. 11-03, Dublin
Traffic Signal Improvements to Columbia Electric, Incorporated; and approve the Budget
Change authorizing additional Measure B Bike/Pedestrian Program Funds for the San Ramon
Road/Shannon Avenue traffic signal upgrade.
4.15 Preliminary Engineer's Reports: Citywide Street Lighting Maintenance Assessment
District No. 1983-1; Landscaping and Lighting Maintenance Assessment District No. 1983-
2(Tract 4719); Landscaping and Lighting Maintenance Assessment District No. 1986-1
(Villages at Willow Creek); Landscaping and Lighting Maintenance Assessment District
No. 1997-1 (Santa Rita Area); Street Lighting Maintenance Assessment District No. 1999-1
(Dublin Ranch and Tract 7067) (360-20)
This action requests approval of the Preliminary Engineer's Report for the 2011-12
assessment and sets a public hearing date of June 21, 2011. Citywide Street Lighting
Maintenance District No. 1983-1 pays the cost of energy and maintenance for the City's street
light system, except for the lights included in Street Lighting Maintenance Assessment
District No. 1999-1 (Dublin Ranch and Tract 7067). Landscaping and Lighting Maintenance
Assessment District No. 1983-2 (Tract 4719) pays the cost of utilities and maintenance for
landscaping improvements along Stagecoach Road and on the interior slopes of the Dublin
Hills Estates development. Landscaping and Lighting Maintenance Assessment District No.
1986-1 (Villages at Willow Creek) pays the cost of utilities and maintenance for certain
landscaping improvements associated with the Villages at the Willow Creek development.
Landscaping and Lighting Maintenance Assessment District No. 1997-1 (Santa Rita Area)
pays the cost of utilities and maintenance for certain landscaping improvements within the
Santa Rita development area.
STAFF RECOMMENDATION: Adopt Resolutions Approving the Preliminary Engineer's
Reports and setting a public hearing date and time (June 21, 2011, 5:30 p.m. in the City Council
Chambers, located at 100 Civic Plaza, Dublin) for the purpose of hearing any comments to the
proposed Fiscal Year 2011-2012 assessments for: Citywide Street Lighting Maintenance
Assessment District No. 1983-1; Landscaping and Lighting Maintenance Assessment District
No. 1983-2 (Tract 4719); Landscaping and Lighting Maintenance Assessment District No. 1986-
1(Villages at Willow Creek); Landscaping and Lighting Maintenance Assessment District No.
1997-1 (Santa Rita Area); and Street Lighting Maintenance Assessment District No. 1999-1
(Dublin Ranch and Tract 7067).
4.16 Letter of Agreement with the County of Alameda for the Continuance of First Responder
Advanced Life Support (FRALS) services (600-30)
The proposed item is a Letter of Agreement between the City of Dublin and the County of
Alameda to extend the current First Responder Advanced Life Support (FRALS) agreement
until October 31, 2011 to allow both parties adequate time to complete a new agreement.
STAFF RECOMMENDATION: Adopt Resolution Approving a Letter of Agreement between
the City of Dublin and the County of Alameda for continued First Responder Advanced Life
Support Services (FRALS Services).

4.17 Award of Bid - Dublin Historic Park Theater Lighting Project to Sousa Electric and
Project Close-Out Budget Change (600-35)
Staff is seeking the conditional approval of the award of bid for the installation of the Dublin
Historic Park Theater Lighting Project to Sousa Electric. Additionally, Staff is seeking
approval of an additional appropriation reflecting estimated final costs for the Dublin Heritage
Parks and Museums Project (CIP #950001).
STAFF RECOMMENDATION: Adopt Resolution Awarding Contract No. 10-09, Dublin
Historic Park Theater Lighting Project to Sousa Electric, subject to approval by Sousa Electric of
the deductive change order in the amount of $34,240; and approve a Budget Change in the
amount of $64,520.
4.18 Award of Bid - Contract No. 11-07, 2010-2011 Annual Street Overlay Program (600-35)
The Annual Street Overlay Program (CIP No. 969102) provides for the resurfacing of various
streets with placing 1'/2" asphalt concrete overlay on top of existing pavement as well as
reconstruct the existing pavement on Dublin Boulevard between Civic Plaza and Dublin
Court.
STAFF RECOMMENDATION: Adopt Resolution Awarding Contract No. 11-07, 2010-2011
Annual Street Overlay Program, to MCK Services, Inc., and; approve the Budget Change
authorizing Alameda County CMA-TIP funds for Dublin Boulevard Improvements.
4.19 Check Issuance Reports and Electronic Funds Transfers (300-40)
STAFF RECOMMENDATION: Review and authorize the issuance of payments.
5. WRITTEN COMMUNICATIONS - None.
6. PUBLIC HEARINGS
6.1 Public Hearing - Adoption of Rates for Garbage Collection, Disposal, and Recycling
Services Provided By Amador Valley Industries and Establishing the 2011-2012 Annual
Assessment (810-30)
The Agreement for solid waste services between the City and Amador Valley Industries
(AVI) requires the City to adopt a rate schedule, which is estimated to produce a specified
revenue amount as identified in the Agreement. The City has also adopted an Ordinance
which requires all parcels in the City to subscribe to weekly minimum garbage service. For
residential properties that are serviced with individual containers, the City collects the annual
cost of minimum service with the property tax bill. The City Council will consider adopting
two separate resolutions establishing the garbage rates effective July 1, 2011 and establishing
the Fiscal Year 2011-2012 refuse related property tax assessment.
STAFF RECOMMENDATION: 1) Open the Public Hearing; 2) Receive the Staff Report and
public testimony; 3) Close the public hearing; 4) Deliberate; 5) Adopt the Resolution Amending
the Schedule for Service Rates for Integrated Solid Waste Services; and 6) Adopt the Resolution
Amending and Establishing the Collection of Minimum Residential Garbage and Recycling
Service Fees for Fiscal Year 2011-2012.
6.2 Solid Waste and Recycling Enclosure Standards Ordinance (810-20)
The Solid Waste and Recycling Enclosure Standards establish design . criteria and size
requirements for new enclosures within the City. The intent of the standards is to ensure that
there is adequate space in newly constructed enclosures for solid waste and recycling,
including organics if applicable. The Solid Waste and Recycling Enclosure Standards apply
to: new development projects; remodeled commercial development projects that trigger a
planning entitlement and consist of grocery stores, restaurants, markets, daycare centers and
auto repair/use; and tenant improvements, where no planning entitlement is required, if the
use has the potential to pollute stormwater.

STAFF RECOMMENDATION: - Conduct public hearing, deliberate, waive the reading and
INTRODUCE an Ordinance Adopting a New Chapter 7.98 relating to Solid Waste and
Recycling Enclosure Standards.
6.3 Public Hearing - Continuance: Amendment of Dublin Municipal Code Chapter 5.56
(Smoking Pollution Control) (560-90)
The City Council will consider continuing, until June 21, 2011, the first reading of an
amendment to the Smoking Pollution Control Ordinance to increase the requirement on the
percentage of apartment residences that must be designated as non-smoking units from 50%
to 75%, which would be accomplished on or before January 1, 2013.
STAFF RECOMMENDATION: Continue the item to the June 21, 2011 Adjourned Regular
City Council meeting, which will begin at 5:30 p.m., in the Dublin City Council Chambers.
7. UNFINISHED BUSINESS
7.1 Agreement Between City of Dublin and Dublin Unified School District Regarding Use of
Facilities (600-30)
The City Council has a high priority objective (Culture & Leisure, Parks & Community
Services, No. 11) to update the existing agreement regarding use of facilities between the City
of Dublin and Dublin Unified School District. The City Council will consider proposed
revisions to the Agreement as negotiated between the City and District and recommended by
the Parks and Community Services Commission.
STAFF RECOMMENDATION: Adopt Resolution Approving Agreeinent between City of
Dublin and Dublin Unified School District Regarding Use of Facilities.
8. NEW BUSINESS
8.1 Window Signage Regulations (400-30)
At the direction of the City Council, Staff has prepared an informational report on the City's
Window Sign Regulations which are contained in Chapter 8.84 of the Dublin Zoning
Ordinance.
STAFF RECOMMENDATION: Receive the report.
8.2 Temporary Use Permit for Circus Vargas (410-30)
Chapter 8.108 (Temporary Use Permit) of the City of Dublin Zoning Ordinance contains
regulations pertaining to temporary land uses. At the May 17, 2011 City Council meeting, the
Dublin Rotary Club addressed the City Council during Oral Communications requesting that
a Circus Vargas be allowed to operate for a longer duration than what Chapter 8.108 allows
for Carnivals. At the request of the City Council, Staff is providing a report on the Temporary
Use Permit chapter as it relates to a circus and requesting direction regarding the proposed
duration of the circus as requested by the Dublin Rotary Club.
STAFF RECOMMENDATION: Provide Staff with direction on the following: 1) Whether
Circus Vargas should be considered a Carnival temporary land use or an Outdoor Skating Rink
temporary land use; 2) if so determined to be a Outdoor Skating Rink temporary land use, is a 13
day event compatible with the surrounding land uses; and, 3) Should Chapter 8.108 (Temporary
Use Permit) be amended to provide greater flexibility.
8.3 Foster General Plan Amendment Study Initiation Request (450-20) '
. The City Council will consider whether to initiate a General Plan Amendment Study to
modify a 10 foot wide strip of property owned by the Hansen Ranch Homeowners
Association that abuts property at 10872 Inspiration Circle from "Open Space" to "Low
Density Single Family Residential".

8.4 Neighborhood Park Names for Positano Development (290-30)
The Positano Development is located east of Fallon Road at Positano Parkway. Two
Neighborhood Parks are included in the Development. The 2010-2015 City of Dublin Capital
Improvement Program includes funding for design and construction of one of the
Neighborhood Parks. The City Council will consider input received from the public and the
Parks and Community Services Commission on possible park names.
STAFF RECOMMENDATION: Select the names for the two neighborhood parks pla.nned for
the Positano development.
