CALL TO ORDER & PLEDGE OF ALLEGIANCE TO THE FLAG 2. REPO1tT OF CLOSED SESSION ACTION 3. ORAL COMMUNICATIONS 3.1 Certificates of Recognition for High School Student Volunteers at Dublin Library (610-50) The City Council will present Certificates of Recognition to High School student volunteers at Dublin Library. STAFF RECOMMENDATION: Present Certificates of Reco~nition. 3.2 Youth Advisory Committee Appointments (110-30) The Mayor is recommending the appointment of three middle school and ten high school youth, along with three alternates, to the Youth Advisory Committee for the term of June 2011 through May 2012. STAFF RECOMMENDATION: Confirm the Mayor's appointments to the Youth Advisory Committee. 3.3 Mayor's Appointment of Student Representative to Parks and Community Services Commission (110-30) Seven applications were received for the Student Representative to the Parks and Community Services Commission and the Mayor is recommending the appointment of Dublin High School student, Jasmine Bafaiz. STAFF RECOMMENDATION: Confirm the Mayor's appointment of Jasmine Bafaiz as the Student Representative to the Parks and Community Services Commission for the term of July 2011 through June 2012. May 17, 2011 Dublin City Council Agenda Page 1 of 5 3.4 2011 Business Anniversary Awards (610-50) The City Council will recognize those businesses that have been in Dublin 20, 25, 30, 35, 40, 45 and 50 years. STAFF RECOMMENDATION: Recognize those businesses that have been in Dublin for 20, 24, 30, 35, 40, 45 and 50 years. 3.5 Public Comments At this time, the public is permitted to address the City Council on non-agendized items. Please step to the podium and cleariy state your name for the record. COMMENTS SHOULD NOT EXCEED THREE (3) MINUTES. In accortlance with State Law, no action or discussion may take place on any item not appearing on the posted agenda. The Council may respond to statements made or questions asked, or may request Staff to repoR back at a future meeting concerning the matter. Any member of the public may contact the City Clerk's Office related to the proper procedure to place an item on a future City Council agenda. The exceptions under which the City Council MAY discuss and/or take action on items not appearing on the agenda are contained in Government Code Section 54954.2(b)(1)(2)(3). 4. CONSENT CALENDAR Consent Calendar items are typically non-controversial in nature and are considered for approval by the City Council with one single action. Members of the audience, Staff or the City Council who'would like an item removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item. 4.1 Minutes of Regular Meetings of May 3, 2011. STAFF RECOMMENDATION: Approve minutes. 4.2 City of Dublin Water Efficient Landscape Ordinance (1000-20) Assembly Bill (AB) 1881 directed the Department of Water Resources to update the Model Water Efficient Landscape Ordinance. Local agencies have the option to either adopt the updated State Model Ordinance or adopt a different Ordinance that is at least as effective in , conserving water as the updated Model Ordinance. If a local agency takes no action, the updated State Model Ordinance takes effect as if it were adopted. The City of Dublin has elected to prepare a Water Efficient Landscape Ordinance. The City's Ordinance is~ based on the updated Model Ordinance; however, slight modifications have been made to the Model Ordinance to make it specific to Dublin. The City's Draft Ordinance is at least as effective in conserving water as the State's Model Ordinance. STAFF RECOMMENDATION: Waive the reading and adopt an Ordinance Deleting Dublin Municipal Code Chapter 8.88 relating to Water Efficient-Landscaping Regulations and Adopting a New Chapter 8.88 relating Water-Efficient Landscaping Regulations. 4.3 Project Acceptance and Final Change Order - Civic Center Security System Project ~ (600-35) Staff is seeking approval of a final Change Order and acceptance of the Civic Center Security System project. STAFF RECOMMENDATION: Adopt Resolution Accepting Improvements to the Civic Center Security System; and approve Change Order #2. 4.4 ~ Approval of Vacation of Land, Acceptance of Grant Deed, and Acceptance of Easements for Final Map 7943, Arroyo Vista (600-60) On February 1, 2011, the City Council approved the Tract 7943 final map for the Arroyo Vista residential project at 6700 Dougherty Road. The Arroyo Vista residential project is a community of 378 residential units (including 198 market rate and 180 affordable housing units) with a Community Center and Childcare Center on approximately 24 acres. Minor land transfers are proposed between the City of Dublin, the Zone 7 Water Agency, Eden Housing, and KB Homes so that property lines follow the existing Alamo Creek Trail. STAFF RECOMMENDATION: Adopt Resolution Approving the Vacation of Land, Acceptance of Grant Deed, and Acceptance of Easements for Tract 7943 (Arroyo Vista). May 17, 2011 Dublin City Council Agenda Page 2 of 5 4.5 Request for Authorization to Use ECS Refining for the Recycling of City Electronic Waste and Surplus C'omputer Equipment and Dispose of other Surplus Property (350-40) The City generates electronic waste in the form of computers, monitors, printers and other items that have reached the end of useful life and dispose of these items in an environmentally responsible manner. It is proposed to use ECS Refining for the recycling of electronic waste and requests the City Council declare certain items as surplus property and authorize Staff to send the items to a professional auction company for auction. STAFF RECOMMENDATION: Adopt Resolution Authorizing the Use of ECS Refining for the Recycling of City Electronic Waste and Surplus Computer Equipment and Declaring Certain Items as Surplus Property, and authorize the transfer of these items to a professional auction company for. sale. 4.6 Appropriation of Funds Required for Citywide Storm Repair (820-40) The City of Dublin, as well as much of Northern California, experienced extremely heavy rainfall on March 24 and 25 of this year. The storm required response by Public Works Staff and MCE at a number of locations throughout the City. Observation at several of these locations showed the need for corrective work to repair damage due to the storm, or to correct pre-existing conditions that resulted in problems during the storm. STAFF RECOMMENDATION: Adopt Resolution Approving the Allocation of Funding for Citywide Storm Repairs; and approve a Budget Change. 4.7 Check Issuance Reports and Electronic Funds Transfers (300-40) STAFF RECOMMENDATION: Review and authorize the issuance of payments. 5. WRITTEN GOMMUNICATIONS 5.1 Consideration of Request from Janet Lockhart to Place a Plaque Recognizing Dave and Bea Burton at the Dublin Heritage Park and Museums (295-30) The City Council will ~consider a request from Janet Lockhart to place a plaque at the Dublin Heritage Park and Museums to recognize the generosity of Dave and Bea Burton for their contributions to the community. STAFF RECOMMENDATION: Defer final approval of the request until such time that the Orchard Garden Phase of the Dublin Heritage Park and Museums is underway. 5.2 Consideration of Request from Dublin Sister City Association for Waiver of Rental fees for International Friendship Soccer Tournament (950-40) The City Council will consider a request from the Dublin Sister City Association for a wavier of fees for use of City facilities and soccer fields for the Dublin Sister City International Friendship Soccer Tournament. STAFF RECOMMENDATION: Consider the request from the Dublin Sister City Association and provide Staff with direction on waiver of fees for the Tournament events. 6. PUBLIC HEARINGS 6.1 Scarlett Court Zoning Ordinance Amendments - Amendments to the Dublin Municipal Code related to the Scarlett Court Overlay Zoning District (Chapter 8.34), PLPA-2011-00019 (450-20) One of the high priority Economic Development Goals and Objectives for the 2010-2011 Fiscal Year is to examine appropriate locations to permit automotive repair businesses within the City. Staff has been identifying locations in the City where additional auto-related uses ~ would be appropriate, and has drafted changes to the Zoning Ordinance to facilitate their development. Staff is proposing amendments to Title 8 of the Dublin Municipal Code (Zoning Ordinance) related to the Scarlett Court Overlay Zoning District. The proposed amendments would streamline the process to allow auto-related uses in the Scarlett Court ' Overlay Zoning District by means of a Zoning Clearance or Minor Use Permit. The amendments include modifications to Chapter 8.12 (Zoning Districts and Permitted Uses), Chapter 8.34 (Scarlett Court Overlay Zoning District), and Chapter 8.116 (Zoning Clearance). May 17, 2011 Dublin City Council Agenda Page 3 of 5 STAFF RECOMMENDATION: Conduct public hearing, deliberate, waive the reading and INTRODUCE an Ordinance Amending Chapters 8.12 (Zoning Districts and Permitted Uses), 8.34 (Scarlett Court Overlay Zoning District), and 8.116 (Zoning Cleazance) of the Zoning Ordinance for Auto-Related Uses in the Scarlett Court Overlay Zoning District. 6.2 Avalon Bay Communities, Dublin Station (Transit Center Site C) for (1) Stage 1 Development Plan Amendment, Stage 2 Development Plan and Development Agreement submitted by Avalon Bay Communities, Inc.; and (2) the appeal of the Planning Commission approval of the Vesting Tentative Map and Site Development Review for Avalon Bay Communities, Inc. PA 06-060 (appeal filed by Carpenters Loca1713) (400- 20/410-30/450-30/600-60) The proposed project, Avalon Transit Center Site C, is a residential project comprised of 505 apartment units, a 4,223 square foot fitness center, 733 spaces of structured parking within two buildings, 25 private, on-street parking spaces, and 40 public on-street parking spaces on a combined 7.2-acre site located within the Transit Center Village planning area. STAFF RECOMMENDATION: Conduct public hearing, deliberate, waive the reading and INTRODUCE an Ordinance Approving a PD-Planned Development Rezone and related Stage 1 Development Plan Amendment/Stage 2 Development Plan and Finding the Project Exempt under the California Environmental Quality Act for Avalon Bay Communities, Site C, Dublin Transit Center; waive the reading and INTRODUCE an Ordinance Approving a Development Agreement and Finding the Project Exempt Under the California Environmental Quality Act for Dublin Station, Site C, Dublin Transit Center, between the City of Dublin and Avalon Bay Communities; and adopt Resolution Affirming the Planning Commission Decision Approving Site Development Review and Vesting Tentative Tract Map 7929 and Finding the Project Exempt Under the California Environmental Quality Act for Avalon Bay Communities, Site C, Dublin Transit Center. 7. UNFINISHED BUSINESS ~ 7.1 Replacement of Day on the Glen Festival (950-40) Staff will present a follow-up report on potential themes for a replacement festival for Day on the Glen starting in fall 2012. Two potential themes for consideration by the City Council include a Pasta and Wine Festival and an International Festival. STAFF RECOMMENDATION: Receive the report and determine a preferred event theme for a new festival to be reintroduced in 2012. Upon City Council direction, Staff will further develop the theme as well as the event components for future consideration. 7.2 Positano Development - Neighborhood Park (600-35) The 2010-2015 City of Dublin Capital Improvement Program includes funding for the design and construction of one of two Neighborhood Parks located in the Positano Development. As part of the design process, Staff is seeking City Council approval on the preferred Conceptual Park Design for the 4.6 acre park located in the Positano Development. ~ STAFF RECOMMENDATION: Approve the preferred Conceptual Park Design; and authorize the Consultant to proceed with preparation of construction documents. 8. NEW BUSINESS 8.1 Sustainable Communities Strateg,y Initial Vision Scenario (430-50) The Association of Bay Area Governments (ABAG) and the Metropolitan Transportation Commission (MTC) are preparing a Sustainable Communities Strategy for the nine-county Bay Area region in accordance with Senate Bill 375 and are soliciting comments from local jurisdictions on the distribution of housing units to accommodate the region's population growth over the next 25 years as well as projected job growth. The proposed allocation of housing units and job growth to the City of Dublin is not consistent with current Planning policies. May 17, 2011 Dublin City Council Agenda Page 4 of 5 i STAFF RECOMMENDATION: Direct Staff to provide comments to the Association of Bay Area Governments (ABAG} on the Initial Vision Scenario. 8.2 Proposal to Release City Weed Abatement Liens on Property Owned by Syed Bukhari (640-70) Syed Bukhari has requested that the City consider accepting a payment of $8,000, in exchange for the City asking that the County of Alameda release a weed abatement lien on his property in Dublin. STAFF RECOMMENDATION: Consider Mr. Bukhari's request that tlie City accept a payment of $8,000 in full satisfaction of the weed abatement lien on his property and provide direction to Staff regarding whether to accept the offer. 8.3 Letter of Support to California Citizen Redistricting Commission (660-40) The City Council will consider a letter to the California Citizen Redistricting Commission. STAFF RECOMMENDATION: Authorize the Mayor to sign the letter to the California Citizen Redistricting Commission. 8.4 Letter of Support for i-GATE Application to the United States Economic Development Administration for the i6 Green Challenge (610-80) The City received a request from the City of Livermore, lead coordinator for the region's State Innovation Hub - i-GATE (Innovation for Green Advanced Transportation Excellence), to ha~e the Mayor sign a letter in support of their application to the Economic Development Administration's "i6 Green Challenge." STAFF RECOMMENDATION: Direct the Mayor to provide a letter of support to the City of Livermore for the U.S. Economic Development Administration's i6 Green Challenge. 8.5 Designation of Two Councilmembers as City Representatives to Discuss Compensation with the City Attorney (600-30) The item provides for the designation of. two members of the City Council to serve as the City's representatives to discuss terms of the City Attorney's contract, including compensation, with the City Attorney. _ STAFF RECOMMENDATION: Designate two members of the City Council to discuss compensation with the City Attorney. 9. OTHER BUSINESS 9.1 Brief INFORMATION ONLY reports from Council and/or Staff, including Committee Reports and Reports by Council related to Meetings Attended at City Expense (AB 1234). 10.
