The packet is available in the City Clerk's Office and also at the Dublin Library. REGULAR MEETING 7:00 PM 1. CALL TO ORDER 2. PLEDGE OF ALLEGIANCE TO THE FLAG 3. ORAL COMMUNICATIONS 3.1. Introduction of New Employee:\Yuliana Tjeng, Accountant A new member of City Staff will be introduced. STAFF RECOMMENDATION: Welcome new City of Dublin Staff member. 3.2. Special Joint Presentation by Senators Loni Hancock and Mark DeSaulnier The City Council will receive a presentation from State Senators Loni Hancock and Mark DeSaulnier. ST AFF RECOMMENDATION: Receive the presentation. 3.3. Acceptance of Gifts to City from St. Patrick's Day Event Sponsors The City Council will receive a report on the numerous sponsors that provided monetary as well as in- kind donations to support the City's 2012 St. Patrick's Day Celebration and Fun Run. STAFF RECOMMENDATION: Recognize the sponsors and formally accept the contributions. . 3.4. Acknowledgement of Rotary Superstars Ms. Janine Thalblum, Community Service Chair of the Dublin Rotary Club, will recognize the winners of the Dublin Rotary Superstars from City of Dublin, Alameda County Fire Department, Alameda County Sheriff's Office, and the Dublin Unified School District. STAFF RECOMMENDATION: Receive the presentation. 3.5. 2012 National Bike Month During National Bike Month, a series of regional events such as Bike to Work Day are organized by the East Bay Bicycle Coalition to promote bicycling as an alternative mode of transportation. This presentation is intended to update the City Council on the City's involvement with National Bike Month events taking place in Dublin and in the Tri-Valley area. STAFF RECOMMENDATION: Receive the presentation and approve the proclamation declaring the month of Mayas National Bike Month in the City of Dublin. Please step to the podium and clearly state your name for the record. COMMENTS SHOULD NOT EXCEED THREE (3) MINUTES. In accordance with State Law, no action or discussion may take place on any item not appearing on the posted agenda. The Council may respond to statements made or questions asked, or may request Staff to report back at a future meeting conceming the matter. Any member of the public may contact the City Clerk's Office related to the proper procedure to place an item on a future City Council agenda. The exceptions under which the City Council MAY discuss and/or take action on items not appearing on the agenda are contained in Government Code Section 54954.2(b)(1 )(2)(3). 4. CONSENT CALENDAR Consent Calendar items are typically non-controversial in nature and are considered for approval by the City Council with one single action. Members of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item. 4.1. Minutes of the Regular City Council Meeting of April 17, 2012 The City Council will consider the approval of the minutes of the Regular City Council Meeting of April 17, 2012. STAFF RECOMMENDATION: Approve the minutes ofthe Regular City Council Meeting of April 17, 2012. 4.2. Silvera Ranch Phase 4 Planned Development Zoning Amendments with Related Stage 1 and Stage 2 Development Plan Amendments for a 0.95-acre Site North of Fallon Road in the Neighborhood known as Bella Monte The City Council will hold a second reading of an Ordinance approving Planned Development Zoning Amendments and related Stage 1 and Stage 2 Development Plan Amendments to change the zoning from Rural Residential/Agriculture to Single-Family Residential and related CEQA findings for a 0.95- acre site north of Fallon Road in the neighborhood known as Bella Monte. STAFF RECOMMENDATION: Waive the reading and adopt an Ordinance adopting Planned Development Zoning Amendments for a 0.95-acre area within Silvera Ranch Phase 4 ~(Bella Monte) from Planned Development (PD) Rural Residential/Agriculture to PD Single-Family Residential and approving related Stage 1 and Stage 2 Development Plan Amendments. 4.3. Resolution in Support ofthe Community Access Preservation Act (CAP Act) of 2011 In June 2011, the franchise agreement between Comcast and the City of Dublin ended, and the City became subject to Assembly Bill 2987, the Digital Infrastructure and Video Competition Act (DIVCA). DIVCA shifted oversight of cable television franchises from local governments to the State through the California Public Utilities Commission. As a result of DIVCA, Tri-Valley Community Television (TV30) lost its flexibility to use PEG (Public, Education, and Government) fees collected from subscribers for ongoing operations. Although PEG fees continue to be collected from subscribers by the cable operators, these fees are now specifically designated for capital costs only. This change detrimentally impacted TV30 as well as public access channels throughout the country with similar state laws. The federal Community Preservation Act of2011 (CAP Act) would rectify this situation. STAFF RECOMMENDATION: Adopt Resolution Supporting the Community Access Preservation Act of2011 (CAP Act). 4.4. Tralee Townhomes Planned Development Rezone Stage 2 Development Plan Amendment to Revise the Public Art Requirement The City Council will hold a second reading of an Ordinance adopting a Planned Development Rezone . Stage 2 Development Plan Amendment to revise the land plan to remove the public art feature. The Tralee project is comprised of 130 condominiums (apartments) and 103 townhouses as well as approximately 34,950 square feet of commercial retail office at the comer of Dublin Blvd and Dougherty Road. The original Stage 2 Development Plan provided a location for public art which was to sit on the podium parking structure. Issues with the weight of the art piece, structural concerns with the podium itself and the actual proposed location were determined to be problematic and the public art component is proposed to be replaced with an in-lieu payment. May 1,2012 Dublin City Council Agenda Page 2 of 4 ST AFF RECOMMENDATION: Waive the reading and adopt an Ordinance Approving a Planned Development Rezone with a Stage 2 Development Plan Amendment to revise the public art requirement for the Tralee Mixed-Use development project. 4.5. Brannigan Street: Planned Development rezone with related Stage 1 Development Plan Amendment and new Stage 2 Development Plan and a Development Agreement The City Council will hold a second reading of ordinances approving a Planned Development rezone. with related Stage 1 Development Plan Amendment and a new Stage 2 Development Plan to change the zoning from PD Public/Semi-Public to PD Medium Density Residential as well as approving a Development Agreement between the City of Dublin and Lennar Homes of California, Inc. STAFF RECOMMENDATION: Waive the reading and adopt an Ordinance adopting a Planned Development rezone with a related Stage 1 Development Plan Amendment and a new Stage 2 Development Plan for a 3-acre site on Brannigan Street north of Gleason Drive; and waive the reading and adopt an Ordinance Approving a Development Agreement for a 3-acre site on Brannigan Street North of Gleason Drive between the City of Dublin and Lennar Homes of California, Inc. 4.6. Zoning Ordinance Amendments to Chapter 8.84 (Sign Regulations), PLPA-2011-00026 In October 2011, Staff presented to the City Council City-initiated amendments to the Dublin Zoning Ordinance, including Chapter 8.84 (Sign Regulations). The City Council reviewed the proposed amendments and directed Staff to obtain input from the community on the proposed changes to the Sign Regulations Chapter. A Town Hall Meeting was held on February 9, 2012 and Staff obtained input from the community. Staff presented the feedback received from the community at the March 6, 2012 City Council meeting. The City Council did not adopt the proposed amendments but instead directed Staff to modify them to change the amount of time. that Temporary Promotional Signs are allowed to be displayed. The draft Ordinance was presented at the April 17, 2012 City Council meeting and the City Council waived the reading and introduced the Ordinance. A second reading of the Ordinance is required prior to adoption. STAFF RECOMMENDATION: Waive the reading and adopt an Ordinance amending Chapter 8.84 (Sign Regulations) of the Zoning Ordinance. 4.7. The Dublin Ranch Street Light Pole Painting Contract (CIP No. 960023) provides for the painting of 146 decorative street light poles in the Dublin Ranch Street Lighting Assessment District (99-1). STAFF RECOMMENDATION: Adopt Resolution Awarding Contract No. 12-05, Street Light Pole Painting Contract to California Custom Painting. 4.8. Purchase of Network Computer Equipment and Services under a Public Agency Cooperative Purchase Agreement with Dell, Inc. The main data storage server currently in place at the City is limited in capacity. The replacement of the network storage addresses current and future storage requirements as well as improvements for disaster recovery. The City plans to acquire Storage Area Network (SAN) technology to increase data storage. The purchase of equipment and services is proposed to be obtained using contract pricing from the Western State Contracting Alliance (WSCA). The Municipal Code requires the City Council to authorize purchases in excess of $20,000 which use this type of arrangement. STAFF RECOMMENDATION: Adopt Resolution Authorizing the Purchase of Network Computer Equipment and Services under a Public Agency Cooperative Purchase Agreement with Dell, Inc. 5. Review of Engineering Survey Results and Establishment of Speed Limits for Various Roadways This item seeks City Council approval to introduce a proposed ordinance which would establish, based on the findings of engineering and traffic surveys, new speed limits of 40mph on Dublin Boulevard between Schaefer Ranch Road and Inspiration Drive, 35 mph on Schaefer Ranch Road between Dublin Boulevard and the City Limit at Interstate 580, 40 mph on Fallon Road between Signal Hill Drive and Tassajara Road, and 35 mph on Positano Parkway between Fallon Road and La Strada Drive. STAFF RECOMMENDATION: Conduct public hearing, deliberate, waive the reading and INTRODUCE an Ordinance amending the Dublin Traffic Code to establish a new speed limit on portions of Dublin Boulevard (Schaefer Ranch Road to Inspiration Drive), Schaefer Ranch Road (Dublin Boulevard to City Limit), Fallon Road (Signal Hill Drive to Tassajara Road), and Positano Parkway (Fallon Road to La Strada Drive). 7. UNFINISHED BUSINESS - None 8. NEW BUSINESS 8.1. Alameda Countywide Clean Water Program Memorandum of Agreement The Agreement to implement the Alameda County Urban Runoff Clean Water Program was initially adopted in 1991. In October 2009, the Regional Water Board reissued a permit covering Alameda County and 56 other storm water dischargers throughout the San Francisco Bay Region. In light of the new requirements in the permit, it is recommended that each agency within Alameda County adopt the new updated Agreement. STAFF RECOMMENDATION: Adopt Resolution Approving the new Agreement to Implement the Alameda Countywide Clean Water Program. 8.2. Resolution Supporting Proposition 29 - the California Cancer Research Act of 2012 The City Council will consider adopting a Resolution in support of Proposition 29 - the California Cancer Research Act of 2012, which is a qualified ballot initiative that will be placed before voters in June 2012. Through a $1.00 per-pack tax on cigarettes, Proposition 29 is expected to generate over $700 million every year for cancer research and program to prevent the proliferation of smoking among the youth. STAFF RECOMMENDATION: Adopt Resolution Supporting Proposition 29 - the California Cancer Research Act of2012. 8.3. Letter of Support for SB 1337 (DeSaulnier) - Zone 7 Water Agency Act The City Council will consider a letter of support for SB 1337 (DeSaulnier)' - the Zone 7 Water Agency Act. SB 1337 would allow the complete separation of Zone 7 from Alameda County as well as adjust the District's boundaries to include the Dougherty Valley. STAFF RECOMMENDATION: Consider the proposed letter and take the appropriate action. 9. OTHER BUSINESS Brief INFORMATION ONLY reports from Council and/or Staff, including Committee Reports and Reports by Council related to Meetings Attended at City Expense (AB 1234). 10.
