Approve staff recommendation to release 9 building pem1its now, 12 at the commencement of 1999 Martin Creek Stream improvement and the final 24 at the completion of all Martin Creek improvements as determined by the Director of Public Works. FINANCIAL STATEMENT: BACKGROUND: An annual review of the Hansen Ranch Development Agreement is required. Below is a status report on conditions of development for this project. Since 1992, the Development Agreement for the Hansen Ranch project has required that Martin Creek Stream Improvements be completed as a part of this project. Great difficulty in obtaining State and Federal agency approvals for the creek improvements has occurred since that time. The 3rd amendment to the Development Agreement was approved by the City Council in October, 1997. Continued Effect ofDeveloDment Al2Teement. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN A RESOLUTION OF THE CITY OF DUBLIN i\.PPRO'VLNG ASSIGNMENT OF K-lliSEN HILL RlliCH DEVELOPMENT AGREEMENT Recitals \VBEREAS, the City ~fDublin and California Pacific Homes, Inc. are parties to a Development Agreement; .and \VREREAS, California Pacific Homes desires to assign its rights and obligations under the Development Agreement to \Vannington Homes, a corporation; and \VHEREAS, Section 16 of the Development Agreement allows for an assigrunent subject to approval of the City Council; and \VHEREAS, the City Council has considered the proposed assignment, as described in the September 22, 1997 letter from California Pacific Homes' President to the City :Manager and \Varmington Homes' September 25, 1997 letter to the City Manager. . NOW THEREFORE, THE CITY COUNCIL DOES RESOLVE AS FOLLO\VS: The assignment of California Pacific Homes' rights and obligations under the Development Agreement, as amended, to Warmington Homes is approved and all obligations of the "Developer" under the Development Agreement, as amended, from the Effective Date of the Development Agreement shall become obligations of\Varmington Homes from the date the assignment becomes effective. BE IT FURTHER RESOLVED THAT this approval shall be conditioned upon (1) Vhrmington Homes providing City with written notice of the date of the assigrunent and (2) 'Warmington Homes providing City with insurance certificates as required by the Development Agreement prior to the effective date of the assignment. REGARDING THE HANSEN HILL PROJECT THIS AMENDMENT ("Amendment") dated for identification as of Of WJiA ) 7. 1997, is entered into by and betvveen the City of Dublin, a municipal corporation ("City"), and California Pacific . Homes, Inc., successor in interest to the Donald 1. Bren Company, and its successprs and assigns ("Developer") RECITALS A. On or about March 25, 1992, City and Developer's predecessor in interest, the Donald L. Bren Company, entered into that certain Development Agreement/City of Dublinfar the Hansen Hill Ranch Project, as amended on February 27, 1995, and September 17, 1996 (the "Development Agreement"). B. The Development Agreement contains certain provisions relating to the timing of public improvements to Martin Canyon Creek, the fulfillment of which have been delayed due to ongoing discussions with the Regional Water Quality Control Board, San Francisco Bay Region ("R WQCB"), relating to the final design of such public improvements previou~ly approved by City. C. Because such delays are and have been beyond the reasonable control of Developer, the parties now 'wish to amend the Development Agreement to ensure that (i) adequate security is provided for the construction and dedication of such public improvements and (ii) Developer may proceed with construction of the Hansen Hill Ranch subdivision. . AGREEMENT d ~ 0 ~ ~i Y . NOW THEREFORE, in consideration of the mutual coven~ts and promises set forth herein, the receipt and adequacy of which are hereby acknowledged, the parties hereto hereby agree to amend the Development Agreement as follows: 1. Modification of SubDaralZraDh 5.3.2 (a). Condition (a) of Subparagraph 5.3.2 of Exhibit B of the Development Agreement is hereby modified to read as follows: - "DEVELOPER" shall construct an 8-foot wide aggregate base access trail (the "Access Trail") over the Property along Manin Canyon Creek as described in Condition No. 76 to the CITY'S approval of the Tentative Map for PA 89-062 ("Condition 76'} and as modified in various conditions ofth.e CITY'S approval of Tentative Map Amendment for PA 94-054 and for Tentative Map .t\mendment PA 95-007. The aggregate-base access road (the "Access Road") proposed along the north side of the creek and east of Martin Canyon Road shall be 12 feet wide. The width of the Access Road may be reduced in some limited areas where needed for tree preservation, but the Access Road shall be no less than 8 feet wide in these limited segments. The improvements to Martin Canyon Creek (the "Creek Improvements"), and those portions of the Access Road affecting same, shall be designed and constructed in compliance with the requirements of the R V/QCB and other state and federal agencies with relevo.nt jurisdiction. . DEVELOPER shall offer to dedicate to CITY (i) the Access Trail, together with that portion of the Property lying bet\veen the fence to be constructed by Developer pursuant to Condition 76 and the northern boundary of the Property, and (ii) any and all portions of the Access Road (to the northern boundary of the Property) and the Creek Improvements that may have been constJ1lcted by DEVELOPER at the time of dedication. All such property offered ~o be dedicated is referred to below as the "Dedication Property". The Dedication Property shall be offered to be dedicated to CITY upon (i) completion of construction by DEVELOPER of the Access Trail, the Access Road and the Creek Improvements or, (ii) if DEVELOPER has not by July 1, 1998 received the "Required Creek Approvals" (defined below) and executed the "Creek Improvement Contrac!" (defined below), such later date as may be determined by the parties as set forth more fully below. \\Then the Dedication Property is accepted by CITY, CITY will be fully responsible for the ownership, operation and maintenance of all improvements therein. DEVELOPER and CITY acknowledge and agree that the design and construction of the Access Road, the Access Trail and the Creek Improvements are or may be subject to the approval of the RWQCB (as required by Section 401 of the Clean Water Act) and the United States Fish and Wildlife Service (pursuant to Section 7 of the federal Endangered Species Act). QEVELOPER and CITY acknowledge and agree that from and after the date hereoftbrough July 1, 1998, while DEVELOPER is seeking such approvals (collectively, the "Required Creek Approvals"), DEVELOPER shall have the right to the issuance of building permits for the Hansen Hill Ranch project up to and including the 135th building permit (i.e., the 63rd unit in Phase II). . If at any time on or before July 1, 1998, DEVELOPER has (i) obtained the Required Creek Approvals and (ii) delivered to CITY a copy of an executed contract for the construction of the Creek Improvements (the "Creek Improvement Contrac!"), then thereafter CITY immediately shall process the remaining building permits for the Hansen Hill Ranch project as submitted and CITY'S building department shall, provided applicable legal requirements are satisfied, issue such permits as and when requested by DEVELOPER. If DEVELOPER has not obtained the Required Creek Approvals and delivered to CITY a copy of an executed Creek 1m rovement Contract n or bet; ul 1 I998 then DEVELOPER shall. on Julv 1. , . c::;:..(C\ or o'j 1998) replace the bond for the Access Road) the Access Trail and the Creek Improvements previously provided to CITY \vith a letter of credit) bank deposit or other cash security in a form acceptable to the Public Works Director and in an amount equal to one hundred thirty percent (130%) of the projected cost of constructing the Access Road, the Access Trail and the Creek Improvements m accordance v.ith the last set of plans for such improvements submitted before July 1, 1998 to the agencies from which . DEVELOPER is seeking the Required Creek Approvals. No building permits beyond the 135th building permit shall be released or issued by CITY until such time as DEVELOPER and CITY have met to develop a mutual understanding as to the most appropriate means of ensuring the construction of the Access Road) the Access Trail and the Creek Improvements. City Council approval of any such understanding shall be required prior to the release or issuance of building permits beyond the 135th buildi?g permit. , If the Required Creek Approvals are issued and the Creek Improvement Contract is executed on or before July 1) 1998, but Developer fails to complete construction of the Access Road and the Creek Improvements by January 1) 1999) the City shall stop issuance of any building permits as of that date and then CITY may (i) serve written notice to DEVELOPER that CITY has elected to complete such construction) (ii) demand the offer of dedication of the Dedication Property and (iii) draw dOViTI or othenvise avail itself of the full amount of the security currently held by CITY for the work, and upon dedication and acceptance of the Dedication Property, complete construction of the Access Road, the Access Trail and the Creek Improvements. The City Council shall then approve any Resolution of this failure to complete the project and shall decide what further action is required. All work associated v.ith the Access Road, the Access Trail and the Creek Improvements shall be performed in accordance with the requirements of the Exhibit B to the Development Agreement. 2. Continued Effect of Deve10pment A~reement. Except as expressly modified in this Third . Amendment, the Deyelopment Agreement remains unmodified and in full force and effect. Hansen Hill Project Building Permits Dear Mr. Peabody: Thank you for meeting with us to discuss the issue of the Martin Canyon Creek Improvements and the building threshold limits in Tract 6308. As you are aware the Development Agreement states the following: No building permits beyond the 135th building permit shall be released or issued by CITY until such time as DEVELOPER and CITY have met to develop a mutual understanding as to the most appropriate means of ensuring the construction of the Access Road, the Access Trail and the Creek Improvements. CONSTRUCTION SCHEDULE On September 21, 1998 we started construction within the jurisdictional limits immediately upon receipt of the Corps' permit. However, the Agency's permit conditions allows for construction between April 1 to October 15, 1998. After requests for time extensions we were allowed to continue construction through October 20, 1998. (See enclosed as-built report prepared by LSA Associates.) We will begin construction within jurisdictional limit of the Creek (item 3 below) in the spring of this year and will complete them by October 1999. Areas outside the Creek (items 4, 5, 7 & 8 below) will begin through the winter as weather permits. The following is a summary of the Martin Canyon Creek Project status and our proposal for the release and issuance of the remaining 45 building permits. PROJECT DESCRIPTION The Martin Canyon Creek streambank stabilization project is designed to provide flood control and erosion protection in the reach of the watercourse on the Hansen Hill property. This streambed stabilization project is required by the City of Dublin as a condition of approval for the associated Tentative Map 5766. An important part of the project is to halt or reduce the amount of sedimentation occurring downstream of the project, and to minimize flood waters and potential damage to existing and planned facilities, such as roads, fences, and drainage structures adjacent to and downstream of the project. The project consists of: 1) installation of a flood wall above the existing culvert under Silvergate Drive; 2) installation of 21 streambank revetment structures to prevent lateral erosion at primary meanders; 3) installation of eight rock drop structures within the streambed to ensure the development of a stable, long-term streambed profile; 4) installation of an emergency access bridge to allow emergency access to the adjacent residential development; 5) armoring of a storm drain outlet channel; and 6) installation of arch culverts where a hiking trail crosses Tributaries A and B. 12/09/98(p:\ WH0730\RESTORE\ASBUn.n 2 3tJ cf gV /.SA Associates, /nc. II. ACTMTIES PRIOR TO CONSTRUCTION . IMPLEMENTATION PLAN LSA prepared an environmental Implementation Plan, as a supplement document to the Mitigation and Monitoring Plan (LSA 1998). This document served as a guidance document for tl)e contractors, providing a summary of the key environmental stipulations and permit conditions. EMPLOYEE EDUCATION PROGRAM During the pre-construction meeting for this project, the project biologist conducted an employee education program for all the contractors. This education program reviewed permit conditions, wetland regulations, and the Endangered Species Act. Photographs of red-legged frogs were given to the contractors to familiarize each crew member with this special status species. TREE REMOVAL Prior to construction, Contra Costa Landscaping removed the trees and limbs in all of the construction areas, as per the Tree Preservation Plan (!.SA 1998). Although the Tree Preservation Plan called for the removal of a total of 98 trees and limbs, upon further revision it was determined that only 36 trees and . limbs exceeding 4 inches in diameter needed to be removed. All trees, stems, and limbs 4 inches in diameter or greater were counted as "trees" to be replaced. Additional smaller limbs were removed, which were classified as tree "trimming." Appendix A provides the Revised Tree Preservation Plan. DEliNEATION OP ACCESS AND STAGING AREAS Prior to construction activities in each area, the project biologist flagged the access routes for equipment and materials, and defined the staging areas, to minimize disturbance by construction activities to the surrounding habitat. Construction crews were informed that construction activities would not be allowed outside these designated areas. The access routes and staging areas are indicated on the Construction Access Plans. CAliFORNIA RED-LEGGED FROG SURVEYS Three days prior to construction activities in the Martin Canyon Creek corridor, the project biologist conducted diurnal and nocturnal surveys for the California red-legged frog. III. 1998 CONSTRUCTION ACTIVITIES . The descriptions of the construction activities, below, are subject to engineering review. References in the text to Typical Sections, and Cross Section Details are provided in the engineering drawings and Mitigation and Monitoring Plan (LSA 1998) which were submitted previously. Appendix B provides a photographic record of each site prior to construction activities, and following installation of the feature. The Applicant was given an extension by the California Department of Fish and Game (CDFG) to complete construction activities in Revetment 5. The ex"tension was until October 20, 1998. This extension was also approved by the u.s. Army Corps of Engineers (Corps) and the Regional Water Quality Control Board (RWQCB) (pers. comm.). TOP SOIL COllECTION AND SALVAGE The top 3 to 6 inches of topsoil and trench material were salvaged during construction activities, and re-applied over the back-filled areas above the revetments and in the staging areas to enhance plant establishment. REVETMENTS - SLOPE STABIUZATION Each of the revetments were constructed in a similar fashion. The toe of the existing slope was excavated for the placement of large diameter rock. The prepared slope was covered with filter fabric, between the rock and native soil, to prevent migration of fine material from the streambank. Drain rock was placed in the bottom of the trench prior to the placement of the large rock armor. Smaller rock were used to fill the gaps in the rock armor wall. Each end of the revetment was keyed into the slope to provide a smooth transition from the natural bank to the rock armored section of bank. . Revetment 1 This revetment was constructed in two phases, the first phase was constructed from top of bank using an excavator and manual labor. In the second phase, an excavator worked from the creek bed to place additional rock armor along the outside bend for additional re-enforcement. The rock armor spans 49 linear feet. The opposite nose of the creek bank was removed to create a more gradual transition in the band, resulting in a creek width of comparable width to pre-construction. This revetment was built to conform to the detail shown in Typical Section F-F, with the modification of the adjustment of the inside bank. . 12/09198(P:\ WH0730\REST0RE\ASBUn.1) 5 . ". . This revetment was also constructed in two phases, and during the second phase, an excavator operating from the creek bank installed rock armor along 75 linear feet of the outside bend of the creek, as per Section 6p6 and Typical Section E-E. The inside bank was sloped and an active gravel bar was created. This revetment was constructed using manual iabor to excavate the trench, and an excavator working from top of bank to place the rock armor. This method was used due to the spacing constraints at this location, and to minimize impacts to the creek bed. The rock armor e>.."tends 48 linear feet along the outside bend, and built to conform to Section G-G. This revetment was also built from top of bank, using manual labor for excavation and other equipment working from top of bank. The rock annor extends 98 linear feet, which was adjusted to provide increased protection to this bend. This reveonent was built to conform to Typical Section G-G and Section 5p5. ThiS revetment, also called the oxbow, was installed to realign the channel at an unstable meander bend. The design of this revetment was modified as per the PWA letter (5;26/98). Figure 5 proviaes a detail of this structure. Rock drop control structures were constructed at either end of the realignment (Figure 15). The total channel area between the twO rock drop structures was designed to be 2210 sq ft, resulting in a net gain of 475 sq feet of jurisdictional area. Two active gravel bars were created on the inside bends. The revetment extends along 122 linear feet along the outside bend. ROCK DROP STRUCTURES Three grade control structures, or rock drop structures, were installed as per a new PWA design. Figure 15 provides a plan view and cross section of the rock drop structures. The location of these rock drop structures differs from the engineering drawings, and are described as follows: The first grade control structure is located further downstream, at a more narrow portion of the creek, and in an area where fewer trees would be impacted by the structure. The second and third grade control structures are on either end of the realignment of creek channel at Revetment 5. The orientation and location of these structures differs from the engineering drawings only . slightly. STORMDRAIN OUTLET ROCK UNED CHANNEL Stabilization of an existing storm drain channel involved minor excavation of the sides and bottom to prepare the channel for rock armoring. Filter fabric 'WaS placed between the rocks and n'ative soils. The armored chann~l covers 54 linear feet of jurisdictional area, and is 6 feet wide (Figure 16). El'tfERGENCY ACCESS BRIDGE An arch bridge was installed over Martin Canyon Creek to provide emergency vehicle access to the adjacent residential development. This bridge was installed above the ordinary high water level (Figure 4). ARCH CULVERTS Two arch culvertS were installed where hiking trails cross Tributaries A and B. These crossings span the tributaries above the ordinary high water level (Figure 17). . STORM DRAIN OUTFALLS Two storm drain outfalls were installed. The first is adjacent to Grade Control No.5, at Station 36 + OS, and the second is above Revennent 1. IMPACTS TO JURISDICTIONAL AREAS The total project is permitted to impact 0.15 acre and 1,257 linear feet of jurisdictional waters. While the project is not yet complete, the total linear feet impacted by the construction activities this year has exceeded the total linear feet proposed for those features installed. The total linear feet proposed for the features installed in 1998 was 448 feet, and the total linear feet actually impacted was 522 feet. Consultation with the Corps approved design modifications providing the linear extent of impact was + 10 percent. If the rest of the project is constructed according to approved plans, actual impacts would exceed planned impacts by only 6 percent, which would be within the Corps threshold for overall compliance. The area of jurisdictional fill was the same as planned for 1998, 2,935 square feet, indicating compliance on this parameter. COMPLIANCE SUMMARY Throughout the construction period, both the Applicant and the . construction contractor, Delta Excavating,Inc., employed Best Management Practices in an effort to meet the permit conditions. Overall, a good-faith eff9rt was made to implement measures to protect the resources of Martin Canyon Creek. Considering the complexity of working in a creek situation, no significant problems occurred. In the instances of non-compliance reported below, both the Applicant and Delta Excavating were rf7sponsive, and remedied the situations in a timely fashion. PROJECT PERMIT CONDITIONS AND COMPLIANCE LSA conducted daily site inspections to monitor for compliance with permit conditions. A daily field monitoring form was completed. These forms are available at the LSA office. The permit conditions from the California Department of Fish and Game, Regional Water Quality Control Board, and U.S. Army Corps of Engineers have been summarized below, and compliance actions for each condition is noted: California Department of Fish and Game (CDFG) CONDITION 1. Agreed work includes activities as stated in the application. . ACTION: Project is not yet complete, and not all activities have been completed to date. CONDITION 2. All work shall be done in accordance with the submitted plans. CDFG shall be notified of any modifications made to the project plans. ACTION: LSA notified CDFG of minor design modifications recommended by the project engineer (pers. comm. with Nicole Kozicki 10/13/98) CONDITION 3. Work shall be confined to the period of April 1 to October 1. CDFG shall be notified of the date of commencement and completion of operations. ACTION: LSA provided pre-construction notification on September 22, 1998. Work activities started on September 22, 1998. A crew supervisor shall be on site the entire time the crew is working within the riparian zone. The supervisor shall be completely familiar with the terms and conditions of the agreement and shall ensure compliance. ACTION: Delta Construction designated Daniel Condon and Dennis Daikoku as the crew supervisors on site during construction. These supervisors were provided with copies of the Implementation Plan, and conditions of all pennits. CONDITION 5. Prior to the commencement of construction, the Operator will identify and flag access and project alignment corridor for each work site. The contractor shall limit entry to the minimum number of approaches necessary to complete operations. Flagging will be in place during all periods of operation. ACTION: The project biologist and the contractor flagged the access routes and staging areas prior to construction activities in each area. Most of the work was conducted from top of bank, and equipment movement in the creek corridor was minimized. Construction activities were restricted to the flagged areas in each construction site, as per Construction Access Plan. . CONDITION 6. Vehicles will not be driven or equipment operated in water covered portions of the stream, or where wetland vegetation, riparian vegetation, or aquatic organisms may be destroyed, except as otherwise provided for in this agreement and as necessary to complete authorized work. ACTION: In some of the work areas, groundwater seeped into the de. watered section of creek. Each day the small pools of water were pumped to the adjacent uplands, and equipment was not operated until the area was dewatered. On September 29, the excavator inadvertently broke the dewatering pipe, releasing water into the work area. All work was immediately ceased, equipment was removed from the creek corridor, and no construction activities were conducted until the area was dewatered again. During the construction of Revetment 5, groundwater began to seep into the creek bed from a sub.suiface spring. Construction activities were completed in this portion of the revetment, and no equipment was operated in the area with the active spring. CONDITION: Trench material shall be placed outside the stream's normal high.water mark or on dry portions within the stream's high water mark when the material is placed on filter fabric. . ACTION: Initially the trench material was side-cast during the trenching activities. However, this was quickly remedied, and all trench material was either placed above the OHWM, or on filter fabric in the creek bed. 12/09198(p:\WH073O\RESTORf.\ASBUn.1) 12 flf o:J 5/ LSA Associates. CONDITION: If stream is flowing at the time work is to be done, the contractor shall implement a water diversion plan which allows stream . flows to gravity flow around or through the work site using temporary culverts or stream flow is pumped around the work site using pumps and hoses. A sandbag barrier shall be placed in the stream both upstream and downstream, to isolate the work area from the flowing water. The entire work area shall be dewatered. The sandbags shall be filled with clean sand. The sandbags shall be placed and removed by hand. The sandbag barrier shall remain in place until all stream bank work is complete. Barrier construction shall be adequate to prevent seepage into or from the work area. Normal flows 'will be restored to the affected stream immediately upon completion of work at that location. A.CTION: An inflatable water bladder was used to dam and dewater the creek. On September 25, the site was vandalized, and holes were punctured in the bladder, which resulted in flows into the construction areas. On October 2, it was obseroed that water had eroded under the bladder, resulting in seepage into the construction areas. This seepage was quickly repaired. Nonnal flows were restored to the entire construction section of the creek on October 20, 1998. CONDITION 7. When any dam or other artificial obstruction is in place in the stream, sufficient water shall at all times be allowed to pass downstream to maintain aquatic life below the affected area. . A.CTION: Water was diverted around the dewatered section of the creek via a flexible pipe, which provided water to the downstream section of the creek. CONDITION 8. Streambed and banks at all access points shall be restored to the existing conditions, including grade, slope, and the possible replacement of streambed cobble. ACTION: All slopes where equipment had accessed the creek corridor were restored following construction activities. Streambeds affected by construction activities were restored, including the re-distribution of the streambed cobble. CONDITION 9. All turbid water from the excavation and/or project activities shall be pumped into a holding facility or into a settling pond located in flat stable areas outside the stream channel, or sprayed over a large area outside the stream channel to allow for natural filtration of sediments. At no time shall turbid water from settling ponds be allowed to enter back into the stream channel until water is clear of silt. ACTION: In some of the work areas, groundwater seeped into the de~ watered section of creek. Each day the small pools of water were pumped to the adjacent uplands, to allow for natural filtration of the water. . This water was allowed to settle into a pool, which was pumped out of the construction area. The intake for the pump included several sediment control measures such as drain rock in a slotted bucket, covered with filter fabric. This allowed the water to be filtered before it was pumped downstream. The seepage from the spring appeared to increase, and pumping was unable to keep up with the volume of water. Once construction activities were completed in this portion of the revetment, and no equipment was operated in the area with the active spring and it was allowed to flow naturally. To prevent any turbid water from flowing downstream, a sediment control dam was installed at the end of the construction zone. This sediment control dam involved several layers of haybales, covered with several layers of filter fabric. This filter dam appeared to serve its purpose by reducing the volume of sediment in the water below the construction zone. CONDITION 10. Approved erosion control measures shall be utilized. Sediment run-off from exposed slopes shall be prevented from entering the stream. At no time shall silt laden run~off be allowed to enter the stream. --. AC110N: Following project construction, all exposed slopes were covered with jute fabric to control erosion and run-off. The jute fabric was installed using staples at 2 to 3 foot intervals to secure the fabric to the slope. Straw waddles were staked along the top of each of the revetments to prevent run-off from the road from running down the backfilled slopes. Straw waddles were also secured along the bottom of each of the slopes to control run-off from entering the creek. CONDITION 11. Staging and storage areas for equipment, materials, fuels, lubricants and solvents, will be located outside of the Stream channel and banks. Stationary equipment will be positioned over drip pans. Equipment shall be checked and maintained daily. Vehicles will be removed away from the stream prior to refueling and lubrication. AC110N: All equipment and fuels were stored in a large staging area away from the creek. All refueling activities occun'ed away/rom the creek. No equipment remained parked near the creek over night. CONDITION 12. Any substances which could be hazardous to aquatic life, wildlife, or riparian habitat shall be prevented from contaminating the soil and/or entering the stream. AC110N: There was no contamination of the creek or surrounding soils. CONDITION 13. During construction, the contractor shall not dump any litter or construction debris within the riparian/stream zone. Some construction . debris from the Hansen Hills project entered the creek via the stonn drain outfall. This situation was addressed. CONDITION 14. If any wildlife is encountered during the course of construction, it shaH be allowed to leave the construction area unharmed, and shall be flushed, or herded in a safe direction away from the project site. ACT10N: The construction crew was very careful in surveying the area prior to constroction activities. One California newt was observed in the constroction area. It was moved out of the constroction area unhanned. CONDITION: Pre.construction surveys for red-legged frog shall be conducted no more than 7 days prior to construction. Results shall be submitted. . A.CT10N: Diurnal and nocturnal surveys of California red-legged frogs were conducted two days prior to the dewatering activities. No frogs were observed. The results were submitted in a letter dated August 12, 1998. CONDITION 15. The disturbance or removal of vegetation will not exceed the minimum necessary to complete operations. Precautions will be taken to avoid other damage to vegetation by people or equipment. . ACT10N: Vegetation was removed in areas only as required due to the construction activities. Damage to vegetation was minimized by placing a plywood protective barrier in front of trees and shrobs, which served to deflect rip-rap rolling down the slopes. CONDITION 16. Pruning shall take place on all trees with limbs that over hang construction sites, staging area and/or access corridors, prior to mobilization of equipment into that area. ACI10N: Prior to construction, all trees, limbs and shrobs were removed from the constroction, staging, and access areas. CONDITION 17. Riparian vegetation shall be cut off no lower than ground level to promote rapid regrowth. ACT10N: Some of the trees and root balls were removed completely from the banks to accommodate construction of the revetment stroctures. CONDITION: Clean river cobble shall cover access roads and work areas built over riparian vegetation, to prevent damage to the underlying soil and root structure. . Restoration shall include the revegetation of stripped or exposed areas with vegetation native to the area. ACTION: All slopes covered with jute fabric shall be seeded by broad.cast seeding of native grasses. Other exposed areas shall be revegetated with native trees and shrubs, as detailed in the Mitigation and Monitoring Plan. A Conceptual Revegetation and Restoration Plan provides a supplemental document for the implementation of the revegetation of tbe project site. CONDITION 19. Ali planting shall be done between October 15, 1998 and January 31, 1999 to take advantage of the winter rainy season. ACTION: It is anticipated that the revegetation of the 1998 construction areas will be completed by January 31, 1999. CONDITION 20. All planting shall have a minimum of 80% survival after five years. .4CTION: Annual survival of the plantings will be reported. CONDITION 21. An annual repon shall be submitted each year for five years after planting. -. AcnON: Next year the first annual report will be submitted. CONDITION 22. All revegetation work shall be done according to plans submitted. The specific trees and shrubs shall be identified on the plans. ACTION: Minor modifications have been made to the revegetation plan, as seen the Conceptual Restoration and Revegetation Plan (ZSA 1998). CONDITION 23. A copy of the Agreement must be provided to all contractors, subcontractors, and project supervisors. This Agreement shall be available at the project site. ACTION: The Agreement was provided to all contractors. CONDITION: CDFG personnel shall be allowed on the site for the purposes of verifying compliance with the Agreement. ACTION: CDFG personnel was invited to visit the site by the project Applicant. CONDITION 24. The Operator, Contractor, and lor subcontractor are liable for compliance with the terms of this agreement. .. The project area was stabilized by the installation of jute fabric and straw waddles to serve as erosion control measures. The construction areas will be revegetated with native grasses, shrubs, trees, and willow stakes along the revetments. CONDITION 4. During construction of all creek related strucrures, an on- site tree plan monitor will be present, with the authority to stop work or direct the contractor to alter work method to meet the specifications of the tree plan and preserve the riparian tree inventory. This monitor cannot be an employee of the contractor. ACTION: This condition was revised (.lSA letter 8/4/98): "the biological monitor will be available on-call at all times, and will be present on the job site during all initial ground disturbing activities and at other times as warranted." LSA project biologists were present on-site daily, to provide guidance, to ensure compliance with permit conditions, and to preserve the biological resources in the creek. u.s. Army Corps of Engineers (Corps) CONDITION Authorized to place native rock protection stone in 1,192 linear feet covering 0.15 acres. ACTION: Project has not been completed. However, the project has not exceeded this authorized limit offill. CONDITION All instream work shall be conducted between April 1 and October 15. ACTION: Corps authorized extension until October 20, in light of the extension allowed by CDFG. (.lSA memo 10/15/98) CONDITION All work shall be carried out in accordance with the attached plans and drawings, and the Mitigation and Monitoring Plan (LSA 1998) shall be adhered to. ACTION: LSA letter (9/29/98) provides a summary of the Corps guidance on project modifications and compliance. POST CONSTRUCTION ACTIVITIES EROSION CONTROL Following the 1998 construction activities, the disturbed areas were returned to their approximate original contOurs. Reclamation of the sites included light grading and placement of native topsoil to a depth of 2 to 6 inches. This site reclamation work was performed by Delta Excavations, Inc. Contra Costa Landscaping implemented the remaining erosion control measures. Steep banks above the revetment structures were covered with jute fabric stapled to the back-fill. Straw waddles were placed at the top of slopes, to control water sheeting down the slopes, and at the base of the slope to control sediment run-off from entering the creek. REVEGETATION PLAN All of the areas disturbed during construction in 1998 will be revegetated, as per the Mitigation and Monitoring Plan (LSA 1998). The revegetation plan has been refined to accommodate on~site conditions. A Conceptual Revegetation and Restoration Plan was written to provide implementation guidance for the revegetation of the construction areas. Revegetation areas will include the revetment structures, access routes, and staging areas. Disturbed areas will be seeded with native seed, native shrubs and ground cover will be planted, and all of the trees removed from the construction areas will be replaced at a 3:1 ratio. Willow pole cuttings will be planted in the revetment structures. The revegetation areas have been marked in the field by the project biologist. The revegetation will be implemented by Circuit Rider Productions, Inc. swppp MONITORING SWPPP monitoring will be 'conducted by Applicant, in compliance with the RWQCB requirements. The Martin Canyon Creek construction project is part of the Hansen Hill NOI and General Permit. Inspection reports will be prepared in conjunction with the Hansen Hill project inspections which are conducted before, during, and after storm events. Any erosion, maintenance or repair activities, and monitoring information will be included in the Hansen Hill project inspection reports. CONSTRUCTION PLANS FOR 1999 The Applicant intends to complete construction of the Martin Canyon Creek streambed stabilization project in 1999. LSAstaff biologists surveyed Martin Canyon Creek in October and November 1997 and May 1998. They were variously accompanied by project engineers, prospective construction contractors, officials from the City of Dublin Public Works Department, and representatives from Warmington Homes. The purpose of these visits was to develop a construction access plan that would minimize impacts to trees, the streambed, and other sensitive resources. Trees that could be directly affected by the project were marked with numbered aluminum tags. The tags were placed at approximately breast height (Le., 4.5 feet) on the side of the tree that faces the centerline of the creek. Trees were assessed according to standard forestry mensuration practices. A Biltmore stick was used to measure diameter at breast height (DBH) on the upslope side of each tree. and the diameter of limbs. Only trees with a trunk diameter of..2.. 4 inches were considered. A single aluminum tag was placed on one of the stems of multiple.stemmed trees, but all stems and limbs with a diameter of 2:..4 inches were measured and are considered "trees" for mitigation purposes. Table A lists the trees and includes information on the distance of each tree from the centerline of Martin Canyon Creek, species of tree, number of stems, or limbs, per tree, DBH of trees, or limb diameter, in inches, percentage of decay, the location of trees, and treatment.
