CITY COUNCIL MEETING DATE: September 17, 1996 SUBJECT: Update of the TIi-Valley Transportation Council Proposed Regional Traffic Impact Fee Report Prepared by: Lee S. Thompson, Public Works Director EXHIBITS ATTACHED: Letter to TIi- Valley Transportation Council RECOMMENDATION: ID ;y",/ Authorize Mayor to sign attached letter to the Tri- Valley Y Transportation Council FINANCIAL STATE:MENT: None to the City of Dublin. Could have an impact on the amount of Traffic Impact Fees paid by Dublin developers. DESCRIPTION: The Tri-Valley Transportation Council (TVTC) is in the process of establishing a Regional Traffic Impact Fee for the seven jurisdictions within the Tri-Valley area. It has Meen discussed that this fee be levied on all new developments and on approved developments that request Wo modify their developments, such that modifications are needed to Tentative Maps andlor Development Agreements. The City of San Ramon has stated that they have a few projects, including Bishop Ranch, that have vested tentative maps and may not be interested, even if the opportunity presents itself, in revising these vested tentative maps to include a Regional Traffic Impact Fee. A revision in a vested tentative map could occur in conjunction with a land use change. For example, developers requested land use changes in Pleasanton's Hacienda Business Park, and their development agreement was revised to require future Regional Traffic Impact Fees. The TVTC representatives from other jurisdictions disagreed with the City of San Ramon. They felt that this is a Regional Fee that all Tri- Valley jurisdictions are responsible for, and it should be levied equally and that all jurisdictions would have to agree unanimously to any revisions to the Fee. Further, it was felt that the City of San Ramon, as well as the other six jurisdictions; should at first opportunity, modify previously vested developments or development agreements and insert language allowing collection of the Regional TIP, similar to other jurisdictions. This requirement would occur only to the extent that it is legally possible to levy the Fee. If the City of San Ramon does not incorporate collection of the regional Traffic Impact Fee in their vested tentative maps at the first opportunity and does not mitigate its traffic impact on regional facilities, other developers, such as those within the City of Dublin, will have to subsidize the City of San Ramon's ------------------------------------------------------------------- . Dublin developers. Therefore, Staff recommends that Council authorize the Mayor to sign and send the attached letter to the Tri-Valley Transportation Council outlining Dublin's position and concerns regarding this issue. . ... .~ Page 2 . . Livermore Avenue Livermore CA 94550 SUBJECT: Regional Traffic Impact Fee Dear Mr. Reitter: The City of Dublin would like to the thank the Tri-Valley Transportation Council for taking on the immense task of working together to improve future transportation in the Tri-Valley area for the .ext century. The City is convinced that all Tri-Valley jurisdictions must cooperate with each ther in accomplishing this objective. As you know, one of the major components of improving future transportation is the collection of a Regional Traffic Impact Fee (TIF) from developers. The City of Dublin firmly believes that all developers in the Tri-Valley area should be treated equally, and, at the first opportunity, each jurisdiction should add a condition to development projects to enable that jurisdiction to collect a Regional TIF. This would mean that the Fee would be charged on all new development, as well as on approved development that request revisions to their development such that they need to make revisions to vested tentative maps and/or Development Agreements. We feel that all of the seven jurisdictions should condition their projects and collect the Fee on a uniform basis to the extent that the law will allow such-;fees to be imposed. We strongly recommend, therefore, that the TVTC and all jurisdictions adopt a policy at this time to state: "As part of a modification to a previously vested development or to an existing development agreement, new language shall be added to allow collection a Regional Traffic Impact Fee." Also, the Regional TIF should not be treated as a local fee. Any changes to the Regional Traffic Impact Fee should be approved unanimously by the seven jurisdictions involved. . . .
