S. Army RECOMMENDATION: Approve conceptual agreement and authorize (V1*:- City Manager to deliver a letter to Colonel Pellegrino at Camp Parks outlining this conceptual agreement. - FINANCIAL STATEMENT: Near future - cost of moving auto- - transformer ( $10 , 000 to $15 ,000 range) . Ultimate costs - when east side of Dougherty Road is widened, curb returns and paving would be installed at the Camp Parks entrances up to the right-of-way line at a relatively small extra cost over placing improvements straight through ( in the $3 , 000 - to $5 , 000 range) . DESCRIPTION: City Staff has been meeting with members of the Army Staff to attempt to obtain a right-of-way for future widening of Dougherty Road to the East including an area for bikeway and underground utilities. The attached letter represents the points of need and discussion on a Staff level. The next step is to make an official request to the Army outlining these City desires as well as concessions that the City is willing to make to the Army. . The area requested from Camp Parks for the ultimate widening is about 6-1/2 acres. The right-of-way would average forty feet in width and extend from the Southern Pacific Railroad right-of-way on the south to the City limit on the north. 1 • ITEM NO. ,S . ii, COPIES TO: Col. Dear Col. ?ellegrino, By this letter and exhibits, the City of Dublin is requesting a permanent easement along the easterly side of Dougherty Road for the purpose of constructing and maintaining a permanent road together with a pedestrian/bicycle path and public utility lines, conduits, and utility structures. The attached draft agreement outlines the needs of the City for the construction and the proposed conditions under which this proposed easement would be granted. We would expect that final wording of the agreement would be refined through the various levels of Army and City review. Please call if you need further input from the City. Sincerely, Richard C. Ambrose City Manager RCA/gr RIGHT-OF-WAY A~ Between the CITY OF DUBLIN and the UNITED STATES ARMY. The CITY OF DUBLIN, hereinafter referred to as "CITY," and the UNITED STATES ARMY, hereinafter referred to as "ARMY," do hereby agree as follows: 1. A permanent easement will be provided by the Army for City street and pathway improvements, together with public utilities. A. The Army would provide the necessary right-of-way easement for the expansion of Dougherty Road and bicycle path by way of permanent grant of easement. The right-of-way shall be approximately as located in the field and reviewed by the City and Army on December 20, 1985 and as outlined on Exhibit "A" plans attached hereto. It shall be the obligation of the City to prepare the legal description of the right-of-way easement to be approved by the Army. B. The Army shall provide a right-of-entry in those areas where grading construction of Dougherty Road extends beyond the ultimate right-of-way line of the street. The City shall prepare and submit to the Army a plan showing those areas where a right-of-entry for grading will be required. C. The Army will provide a right-of-entry for the purpose of constructing an earthen berm as provided below. 2. Improvements to be constructed.by the City: A. The City shall arrange for the relocation of Pacific Gas and Electric's step-down transformer serving power to Camp Parks. The transformer shall be relocated from its current location to a position directly opposite on the east side of Dougherty Road as determined by the Army and the City. The Army agrees to cooperate with the City during any periods when power is lost to Camp Parks due to the relocation. B. The City agrees to construct or cause the developers of the proposed Alamo Creek subdivision to construct a left-hand turn storage lane on the southbound lanes on Dougherty Road to accommodate the relocation of Camp Parks' entrance. The location of this new entrance shall be shown on exhibits to the easement agreement. This left-hand turn storage lane shall be part of the expansion of Dougherty Road from two to four lanes (Phase 1). Upon the ultimate development of a six-lane road on Dougherty Road (Phase 2), the City will provide for the left-hand turn storage lane as well as a median break and curb returns on the east side of Dougherty Road up to the ultimate right-of-way to accommodate Camp Parks' proposed new entrance. C. The City shall require the developers of the proposed Alamo Creek project to utilize excess fill to construct a berm commencing at the reserve center and extending northward approximately halfway to the Alameda County Line or to the existing hills. The exact height and extent of this berm must be determined upon completion of final grading plans, but it is anticipated to be between 10 and 15 feet high with a 3 to I slope on the west side and a 2 to 1 slope on the east side. -1- D. Together with the construction of the road within the ultimate right-of- way of Dougherty Road south of Amador Valley Blvd., the City shall be responsible for relocating the existing fence. The City's obligation to move and reconstruct the existing perimeter fence shall be limited to those areas where there is no berm. 3. Improvements to be constructed by the Army: A. The Army shall relocate the existing perimeter fence in those areas where the City causes the developer of the Alamo Creek subdivision to construct the berm. These areas shall be shown on a map to be approved by the two parties. B. The Army shall provide irrigation and landscaping on the berm once it is complete and shall maintain such irrigation and landscaping. It is not intended that landscaping on the berm will include lawn or other high maintenance landscaping. 4. Proposed schedule: The following schedule assumes that the developer of the Alamo Creek project, hereinafter referred to as "Developer," will proceed in a timely manner through his development and that this development receives City approval. B. Grant of easement for Dougherty June 30, 1986 Road right-of-entry for graded slopes. C. Relocation of transformer by July 30, 1986 City (depends on PG&E's schedule).
