The City Council adopted Ordinance 8 - 95 amending the Zoning Ordinance on August 8, 1995 to add '.Outdoor Sales Not Related to On-Site Established Business" approved as a Conditional Use Permit by the Zoning Administrator. This allowed certain outdoor sales by non-Dublin businesses. New Zoning Ordinance. The City Council adopted a new Zoning Ordinance on September 2, 1997. The language in the new Zoning Ordinance does not allow Outdoor Sales Not-Related To A Dublin Business (sidewalk sales), however the language in the current ordinance is somewhat misleading. The section reads as follows: N. Temporary Outdoor Sale Not Related To On-Site Established Business (Sidewalk Sale). A temporary outdoor sale of goods by an established Dublin business, at the site ofthat business, of goods and merchandise which are of the same and type as the goods and merchandise sold indoors by the business. Promotional give-aways, such as free food, are allowed if they are related to and subsidiary to the sale. Each individual outdoor sales event shall be subject to standards established by the Director of Community Development and shall be limited to a maximum of 4 consecutive days, and no business may participate in more than 6 events during a one-);ear period at one site. -._----------------------------~----------------------------------------------------------------------------- COPIES TO: Nancy Feeley Senior Planner ITEl\1 NO. 1':2 G :agendas/1999/3-2srl Temporary Use Permit. On February 8, 1999. Community Development Staff inadvertently issued a it Temporary Use Permit (Attachment 1) for an individual to sell roses at the Shell Gas Station at 8999 San Ramon Road from February 11, 1999, until February 14. 1999. The permit was issued in error. A review of the Temporary Use Permit log revealed that the TUP in question is the only one to have been issued for ... Outdoor Sales Not Related to On-Site Established Business since the adoption of the revised Zoning . Ordinance in 1997. Chamber of Commerce Letter. The Chamber of Commerce sent a letter (Attachment 2) to .Mayor Guy Houston on February 16, 1999, regarding a complaint received from a business member regarding a street vendor selling merchandise on a street corner in the City of Dublin. It was the understanding of the Chamber of Commerce that only Dublin-based businesses would be allowed permits for outdoor sales. RECOMMENDATION: In order to clarify the language in the current ordinance Staff recommends that the City Council give direction to Staff to draft an amendment to the Zoning Ordinance that would read as follows: ~. Box 2340 Dublin, Califo:nia 94568 Dear Mayor Ho~ston; On February 12, 1999 the Dublin Chamber of Commerce office received a complaint irom one of it's business members regarding a "street vendor" selling merchGIloise on a street comer in the Cit"/ of Dublin. The City Pl~Jl.'1ir.g Department v.-as contacted regarding this matter and the Chamber was infor::J.ed by staff member Dennis Carrington that a three day tempora.')' use per.r.1it was issued to the yendor by the City in accordance with the guidelines of the Ctt:Tent ordinance for outside sales. It W<,".S the understanding oftbe Chamber 2.Ild members of the Committee thst worked on the revision of the outside s.s.les ordinance several years ago that only Dublin based businesses with Dublin commercial addresses and a Dublin city business permit would be allowed penn its for outdoor sales. It is disappointing to think a temporary use permit was issued to a street vendor selling the same merchandise as several other businesses within the City of Dublin. Dublin businesses pay a fee to the City of Dublin for the privilege of operating a business within the City. In addition, there are the normal business expenses ofrent, ta.xes, etc. not to mention the ::r!~ation of jobs. It is difficult to understand how the City Planning Department can justify issuing a use permit for $25.00 to en individual that does not live or nave a business within Dublin and, most importantly, does not support the Dublin community through donations to schools, communit)' projects, sports programs, etc. The Dublin Chamber of Commerce and City have worked diligently over the years on the image of Dublin. Street vendors selling products out of the trunb of their vehicles on eveI}' corner and in parking lots is not the best image for our City. The Chlunber urges the City Council to review the outdoor sales ordinance again and td:e the necessary precautions to "close the loopholes" to insure our City streets are rree of outdoor vendors selling their v,7..res. We believe Dublin should look it's "best" at al1 times.
