DESCRIPTION : As indicated in the attached letter from William H. Fraley, the City has been invited to participate in the Alameda County Community Development Block Grant (CDBG) Program. The program is intended to undertake community renewal and lower income housing assistance projects. Potential activities include housing rehabilitation, construction of streets, parks, and other public works, removal of architectural barriers, housing counseling, public facility improvements, and new construction assistance. The main criteria for project eligibility is that it benefits low and moderate income households. Funds for pedestrian ramps have been designated for this area in the 1984-1985 program year. Funding of other projects may be possible using contingency funds from the current program year. If the City Council wishes to participate in the 1982 CDBG Program, it must execute an agreement with the County of Alameda by September 30, 1982. The City would be required to provide information to the County on only Block Grant funded projects and overall employ- ment records. The agreement would be effective until June 30, 1985. Mr. Lane Bailey from the Alameda County CDBG Program will be present at the City Council meeting to explain the program. Box 2340 Dublin, CA 94568 SUBJECT: Pa icipation of Dublin in the Alameda County Urban County Community De 1oopment Block Grant (CDBG) Program Dear Mr. r : The U.S. epartment of Housing and Urban Development (HUD) provides Community Development Block Grant (CDBG) funding to localities in order to carry out housing and community development projects. Cities in the County with populations of 50,000 or more are considered entitlement communities and receive individual Block Grants. Alameda County currently receives CDBG funds as an Urban County, which is comprised of the unincorporated areas of the County plus the cities of Albany, Emeryville, Livermore, Newark, Pleasanton and Union City. Each of these jurisdictions have entered into a cooperation agreement with the County for the purposes of participation in the CDBG Program. The City of Dublin is invited to join and participate as an active member of the Alameda County Urban County Housing and Community Development Program. Alameda County is currently operating under a three-year program of projects established through June, 1985. Funds for mobility street improvements (pedestrian ramps) have been designated for your area in the 1984-1985 program year. Past projects in the Dublin area include a housing rehabilitation program, pedestrian ramps for the handicapped, mobility improvements at the Alameda County Heritage Center, and playground equipment and a community center at Arroyo Vista. The main criteria for project eligibility is that it benefits low and moderate income households. Other activities may be eligible, such as the removal of architectural barriers to the handicapped. In order for the City to participate in the Urban County in 1983-1984, it is necessary that a cooperation agreement be executed between Dublin and Alameda County by September 30, 1982. To be certain that we meet this deadline, I suggest that a staff person from the City contact Jack Shepherd, HCD Coordinator, at 881-6094 no later than September 15, 1982, in order to discuss the Urban County CDBG Program and Dublin' s possible participation. WHEREAS, the Congress of the United States has enacted the Housing and Community Development Act of 1974, and subsequent amendments to such Act, hereinafter called ACT; and WHEREAS, Title I of Act consolidates previously separate grant programs for open space, public facility loans, water and sewer grants, urban renewal , model cities and rehabilitation loans; and, WHEREAS, Title I makes available entitlement grants to: (1 ) cities whose 1980 Census population exceeds 50,000 persons; and (2) counties who qualify as an urban county; and WHEREAS, the term "urban county" means any county within a metropolitan area which: A. is authorized under state law to undertake essential community development and housing assistance activities in its unincorporated areas, which are not units of general local government; and, B. has a combined population of 200,000 or more in such unincorporated areas and in its included units of local government: (i) in which it has authority to undertake essential community development and housing assistance activities and which do not elect to have their population excluded; or, (ii) with which it has entered into cooperation agreements to undertake or to assist in the undertaking of essential community development and housing assistance activities; and, WHEREAS, eight cities in Alameda County have a 1980 Census population of less than 50,000; and, WHEREAS, these same eight cities may join with the County of Alameda to form a combined 1980 Census population of 200,000 or more persons, thereby qualifying as an urban county, and be eligible for an entitlement of Community Development Block Grant funds; and, WHEREAS, the Department of Housing and Urban Development, hereinafter called HUD, has made a determination that the County has the essential powers to operate as an urban county. THEREFORE, it is agreed that: 1 . CITY and COUNTY will cooperate to undertake, or assist in undertaking, community renewal and lower income housing assistance activities, specifically urban renewal and - - publicly assisted housing, hereinafter called Program, to be carried out with annual Community Development Block Grants, hereinafter called Block Grants, from Federal fiscal years 1982, 1983, and 1984 appropriations. Community renewal and lower income housing assistance activities shall be those designated or referred to within Title I of the Act and the regulations issued pursuant thereto. 2. To carry out community renewal and lower income housing activities, COUNTY shall distribute to CITY a portion of the Block Grant funds received under the Act from Federal fiscal years 1982, 1983, and 1984 appropriations. The funds distributed to CITY shall be determined in accordance with such needs, objectives, or strategies as COUNTY shall decide. In preparing the needs, objectives or strategies, COUNTY shall consult with CITY before making its determinations. 3. It is expressly understood that, as the recipient of the Block Grant from HUD, County must take the full responsibility and assume all obligations under the Act and that HUD will look only to COUNTY in this regard. However, it is also understood that CITY shall comply with all requirements of the Act, the National Environmental Policy Act of 1969, Title VI of the Civil Rights Act of 1964, Title VIII of the Civil Rights Act of 1968, Executive Order 11988, Section 108 of the Act, other applicable laws, and all regulations issued pursuant thereto. 4. CITY shall provide COUNTY with all information concerning CITY and the activities CITY carries out under this agreement which COUNTY requires to prepare 1 ) documents, required to be submitted to HUD, 2) annual performance report, 3) such other documents as COUNTY may require to carry out community renewal and lower income housing activities or meet Federal requirements. All information shall be submitted on forms prescribed by COUNTY. In addition, CITY agrees to make available upon request all records concerning the activities carried out under this agreement for inspection by COUNTY or Federal officials during regular business hours. 5. CITY designates Richard C. Ambrose, City Manager or his or her deputy as the official to whom all notices and communications from COUNTY shall be directed. COUNTY's duty to notify CITY shall be complete when the communication is sent to the designated official or deputy. It is the exclusive duty of the designated official or deputy to notify the correct individuals or department within CITY. 6. CITY shall indemnify and hold harmless COUNTY from liability for any fines, penalties, or damage of any type accruing to COUNTY by virtue of CITY's failure to comply with any requirement of the Act and the regulations issued pursuant thereto, or failure to comply in any respect with the Program described herein. Further, CITY shall indemnify COUNTY, its officers and employees, against any and all liability for injury or damage caused by any act or omission of CITY or any of CITY's employees or volunteers in the performance of the contract or Program and CITY shall hold COUNTY harmless from any and all loss occasioned in the performance of, or otherwise arising out of, this Agreement or Program. 7. This Agreement shall go into effect immediately upon the signature of both parties and shall continue in full force and effect until all activities funded from Federal fiscal years 1982, 1983, and 1984 appropriations are completed. CITY will be included in the urban county for the entire three year period funded by Block Grants from Federal fiscal years 1982, 1983, and 1984 appropriations and may not withdraw from the urban county during this agreement period except: i ) if COUNTY fails to qualify as an urban county, or ii ) if COUNTY does not receive a grant in any year of the three fiscal years. Eligibility: Eligibility of the project in terms of HUD regulations for CDBG; eligibility of budget items. No point value. 2. Fulfillment of Needs and Objectives of the Project Category: Extent to which projects meet the objective of each project category. For example, a neighborhood center will be scored based upon the extent to which it promotes neighborhood revitalization. The more the project fulfills the objectives, the higher the rating. 1-5 Points. 3. Benefit to Low and Moderate Income Individuals: The number of low and moderate income persons or households that will benefit from a project. The more persons or households, the higher the rating. 91% - 100% 4. 1 - 5.0 Points 81% - 90% 3. 1 - 4.0 Points 71% - 80% 2. 1 - 3.0 Points 61% - 70% 1 . 1 - 2.0 Points 51% - 60% 0. 1 - 1 .0 Points 4. Feasibility: Capability of applicant, to complete within time limits, and the ability to complete with funds requested. The more innovative and/or use of other funds the higher the rating. 1-5 Points. 7/16/81 ALAMEDA COUNTY URBAN COUNTY COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM STATEMENT OF OBJECTIVES AND PROJECTED USE OF FUNDS FOR THE 1982-1983 PROGRAM'YEAR Alameda County Urban County (Cities of Albany, Emeryville, Livermore, Newark, Pleasanton, Union City and the Unincorporated County) has developed the following statement of objectives and projected use of funds for the 1982-1983 Community Development Block Grant (CDBG) Program. The Statement was adopted by the Alameda County Board of Supervisors after citizen comment and public hearing on April 20, 1982. STATEMENT OF OBJECTIVES Alameda County Urban County intends to utilize CDBG Funds to fulfil the following - program-objectives: A. Revitalize neighborhoods through the conservation and rehabilitation of existing housing B. Revitalize neighborhoods through the construction of public improvements C: Conserve and rehabilitate existing housing for low/moderate income residents outside of target area neighborhoods D. Promote the development of new affordable housing E. Remove architectural barriers and provide facilities for the handicapped, dis- advantaged, and low/moderate income residents of designated target areas F. Promote economic development within target areas G.
