FINANCIAL STATEMENT: See below. DESCRIPTION: Since 1983, the City has contracted with a private firm for services related to Building Law Enforcement. The firm of Taugher & Associates, Inc. , provides the services typically offered by a City Building and Safety Department. These services include: plan checking; inspection of building construction; housing code enforcement; zoning enforcement; and general administrative direction of the Building and Safety department. The contract- review will focus on the Building Inspection and Plan Checking components. In Fiscal Year 1989-90, the City hired an Assistant Planner/Zoning Investigator to perform zoning investigation. BUILDING INSPECTION Personnel Provided Mr. Taugher serves as the Building Official. His services are estimated to account for approximately 1,100 hours during Fiscal Year 1989-90. This equates to slightly more than a one-half time position ( .60 full-time equivalent) . In addition, it is estimated that the firm will provide 4,000 hours of building inspection services. This equates to approximately two full-time Building Inspector positions. Overall, staff is pleased with the caliber of personnel provided through the contract. Mr. Taugher is very active with the International Conference of Building Officials and respected within his field. Mr. Taugher has also been able to provide the City with a Senior Building Inspector who has a great deal of experience and knowledge of the construction field. The quality and stability of Building and Safety personnel over the past several years has been an asset to the community. Given that the building industry can experience fluctuations, a contract arrangement allows the City to easily adjust to meet the demands. The contract arrangement has also been beneficial in obtaining services on a less than full- time basis from highly qualified individuals. ------------------------------------------------------- COPIES TO: ITEM NO. e 6 n Hours of Service - ilding and Safety The Building and Safety Office maintains regular office hours from 8:00 a.m. to 5:00 p.m. each weekday. Typically, the—Building Official is available from 8:00 .a.m. to 12:00 noon, Monday through Friday. In addition, Mr. Taugher is available for special appointments if a client desires. The inspection staff members are available in the office between 8:00 and 10:00 a.m. , and by special appointment. Throughout the day, the public counter is staffed by City personnel from the Development Services Department. This includes a Building Secretary who is capable of processing applications and answering questions of general nature. Presently, staff does not have any indication that the hours of service need to be modified. Proposed Building and Safety Service levels for 1990-91 During 1990-91, it is anticipated that the Building and Safety Department will experience an increased workload. This also coincides with significant increases in estimated dwelling units finaled (up 116%) . It is also anticipated that the number of dwelling units issued will be significantly less during Fiscal Year 1990191 (24%) . Attached to Mr. Taugher's memo (Exhibit A) is an outline of specific projects expected to impact workloads through 1990-91. To meet the continuing demands of the Department, Mr. Taugher proposes to provide 4,000 hours of inspection services. In addition, Mr. Taugher's time as Building Official is estimated to remain consistent with the 1989-90 Fiscal year at 1,100 hours. Cost of Building Inspection Services As has been discussed in previous Building Law Enforcement contract reviews, the cost of services fluctuates depending upon the level of construction activity. The City is also able to recover some costs through revenue collected from building permit fees. The City has maintained the fee structure utilized by Alameda County since incorporation in 1982. Although no adjustments have been made to the fees since that time, it is proposed that City staff will conduct a fee survey in FY 1990-91. The provision of Building Inspection services includes both the contract costs and City expenses for support services. The following outlines the combined costs for Building Inspection services: ACTUAL ACTUAL ESTIMATED RECOMMENDED 1987-88 1988-89 1989-90 1990-91 Taugher & Associates $278,666 . $257,577 $280,000 $305,100 City Support Costs $ 41,391 42,878 44,607 51,419 Total Cost $320,057 $300,455 $324,607 $,356,519 Total Revenue $513,550 $282,014 $330,000 $351,500 Although it is estimated that in Fiscal Year 1989-90, the projected revenues will exceed the estimated expenses, it should also be noted that permits may be obtained by the builder in one year (revenues collected) and the actual building inspection service is rendered in a future year (expenses incurred) . Therefore, in reviewing revenues and expenses, it is important to do so over a period of several years. Another measure of the cost of service is to evaluate the contract costs per inspection as shown below: ACTUAL ESTIMATED ESTIMATED 1988-89 1989-90 1990-91 Contract Cost Per Inspection $ 35.02 $ 40.00 $37.21 It is estimated that the cost per inspection will decrease in FY 1990-91. This is due to the fact that while a number of large construction projects were issued permits and completed plan checks during FY 1989-90, the inspections are not scheduled to be conducted until FY 1990-91. Consequently, the Building Official will spend fewer hours reviewing the plans, and the building inspectors will spend more hours conducting inspections. As indicated below, the Building Official is paid at a higher rate than the building inspectors. 1990-91 Proposed Costs and Contract Modifications The 1990-91 costs are based on the proposed amendment to the current agreement. Taugher & Associates have been able to retain a relatively constant level of cost .per inspection. The only modification to the agreement proposed for Fiscal Year 1990-91 is an adjustment to the hourly 'rates. The percentage increase proposed is approximately 5%, and would result in the following changes: Current Rates Proposed Rates Building Official $ 77.00 p/hr $ 81.00 p/hr Building Inspector $ 48.50 p/hr $ 51.00 p/hr It is important to note that the rates charged include benefits, vehicles and the contractor's overhead. It should also be noted that there has been a significant reduction in Mr. Taugher's insurance surcharge. Since Fiscal Year 1986-87, Mr. Taugher has charged an insurance surcharge for errors and omissions insurance. Since 1987-88, the surcharge has remained constant at $16,000 per year. The insurance cost is billed as an additional hourly fee until the maximum amount has been paid. The current agreement calls for a $4.00 per hour surcharge with an annual maximum of $16,000. Mr. Taugher has obtained an estimate for errors and omissions insurance for Fiscal Year 1990-91. The total estimated cost for insurance is $36,085, and Mr. Taugher has requested that a surcharge totalling $12,000 be authorized. This represents a $4,000 or 33% reduction in insurance costs over the 1989-90 estimate. Cost Effectiveness of Building Inspection Activity In previous Building and Safety contract reviews, it was noted that the certainty of development within the extended planning areas would warrant consideration of planning for an in-house Building and Safety function. The study process for the extended planning areas is now underway; however, it is not clear as to when actual development may occur. This issue is further clouded by policies adopted by Alameda County; specifically, policies relating to the Open Space Element of the County General Plan. Given that these areas will also require significant infrastructure improvements to service the development, it is unlikely that the construction in these areas will be impacting the Building and Safety Department in the 1990-91 Fiscal Year. If the City were to provide Building and Safety services with City employees, the personnel costs including fringe benefits are estimated as follows: Chief Building Official $ 86,177 Senior Building Inspector 65,626 Building Inspector 58,342 Total Personnel Costs $210,145 Additional Costs Contract Coverage for Vacation/Relief $ 31,565 Vehicle Expenses (2 vehicles) 16,800 Services & Supplies 3,150 Indirect Costs (Additional insurance, Personnel, Finance Administration) 11,550 Sub-Total Additional Costs $ 63,065 Total estimated 1990-91 Cost of In-House Building & Safety Services $273,210 Estimated 1990-91 Contract Costs 305,100 Difference $ 31,890 The projections shown above indicate that the services can be provided at less cost in-house. It should also be noted that 'in-house personnel are calculated at a full-time rate; while contract personnel are calculated at a less than full-time rate. Also, in estimating City personnel costs, staff surveyed the cities of Livermore, Pleasanton and San Ramon with regard to the Building Official and Inspector positions. The 1990 survey showed significant changes from prior years, due to substantial salary changes in this rather limited survey. The impact of the updated survey data resulted in salary increases ranging from 7% to 23%. One method of evaluating the cost of contracting is to observe trends over more than one year. Each year, the City has conducted a cost analysis. The estimated additional cost to the City to provide these services under contract, over a seven year period (beginning in 1983-84 and ending in 1989-90) , was estimated to be $12,756. This calculation was made in June of 1989. If the estimated cost noted above are included, the cost to the City increases to $44,646 over an eight year period. Given that the timing of development in the extended planning areas is still somewhat uncertain, staff is not recommending a change to in-house Building Inspection services at this time. In addition to the extended planning area, staff has noted that the developer time lines for construction would also impact the decision to bring these services in-house. For example, staff anticipates that if approved projects within the City limits continued through completion in the next 12 to 18 months, it is anticipated that the workload would drop off prior to construction taking place in the extended areas. If this occurs, it is advantageous to remain under a contract arrangement. However, if developers extend their construction process to the point that "build-out" is followed immediately by work in the extended areas, it would then be to the City's advantage to bring the services in-house. It should also be noted that if the latter occurs, it might still be necessary to obtain certain services from a contract provider to provide supplemental coverage during peak periods and vacation relief. Lastly, it should bt. Aed that the 1990-91 budget L. ides a higher service level ($9,065). The higher service level would fund costs associated with the implementation of the Earthquake Damage Assessment Program identified in the 1990 Goals & Objectives Program. The Building Official will be responsible for coordinating the implementation of this program. ZONING ENFORCEMENT Personnel Provided As discussed above, this service is being evaluated separately, as a change was implemented in Fiscal Year 1989-90. In accordance with the Management Audit prepared by Hughes, Heiss and Associates, the City has assumed zoning enforcement services in Fiscal Year 1989-90. Beginning in November 1989, these services have been performed by an Assistant Planner/Zoning Investigator, which is a City position. Zoning Enforcement Workload From July 1, 1989 through November 1989, Taugher & Associates provided interim zoning enforcement services. The following represents zoning enforcement services provided by Taugher & Associates during Fiscal Year 1989-90: ACTUAL 1989-90 (5 months) Zoning Investigations 517 Open Cases 117 New Cases 144 Cases Closed 135 Cases Pending 133 Total Hours 396 As noted, this service is no longer provided by Taugher & Associates. The data is being presented as information only. The proposed amendment to the agreement with Taugher & Associates for Fiscal Year 1990-91 does not include zoning enforcement services. Conclusion Staff would recommend that the City Council review the performance of Taugher & Associates and adopt the resolution approving the proposed contract amendment, and adjust the hourly rate schedule (effective August 1, 1990). Staff will continue to evaluate the potential for performing other Building and Safety services with City personnel. Taugher and Associates, Inc. No increase in the subsidy for liability insurance is requested. B. Insurance I have discussed insurance rates with my broker. While it is too early to obtain a definite quote, it is esti- mated that the cost of errors and omissions insurance for next year will be about the same as this year. Accordingly I have reduced the sub- sity from $16, 000 to $12, 000. It is requested that the City continue to subsidize insurance costs this year in the amount of $ 12, 000 with an hourly rate of $4 . 00 per hour. C. Staffing Levels The attached bar chart is a projection of scheduling of major projects. The time frame for these projects should only be considered indicators of work load. Depending on the economy and other factors, these times could either compress or lengthen out. Changes in Work Method We are still looking foreward to an automated land information system and permit system which hopefully will be up and running in 1990-91. After last year's contract evaluation it was decided to discontinue contracting for zoning enforcement. This was implemented at the end of November. The change appears to be beneficial to the City. E. Self Evaluation Building Inspection Services were provided in a timely manner in 1988-89. The attached statistical data show that services are being provided in an efficient manner. The bottom line cost per inspection increase is nominal when considering the increases in hourly rates. The sign enforcment program proceeded in an orderly manner until June 12, 1989. Three year extensions were granted to most non-conforming signs. Consequently, the program will continue well into 1992 . Statistical information on the property maintenance ordinance has been integrated into zoning enforcement because many complaints involve both ordinances. Thus, it was difficult to separate statistical data. The overall effect of enforcement of the zoning and property maintenance ordinance on the City has been remarkable. Owners are again taking pride in their properties and there has been a perceptable improvement in the appearance of many residential neighborhoods. In conclusion, I believe that contract performance has been carried out in an exemplary manner. 3 D. The number of permits and inspections is down about 15%. Contract cost per inspection is up about 14%. Zoning enforcement inspections are up and the cost per inspection is down somewhat. Notices and follow up inspections on the non- conforming sign program were completed by June 12 , 1989 . However, many sign owners were granted three year extensions so this program will continue well into 1992 . W I T N E S S E T H : WHEREAS, the Building Official has submitted to the City a proposal to provide building law enforcement services to the City; and WHEREAS, the City has determined that it is advantageous and in the best interest of the City to enter into the Agreement hereinafter set forth; NOW, THEREFORE, in consideration of the mutual promises , conditions and covenants herein contained, the parties agree as follows : 1 . Building Inspection Services . Building Official shall enforce the provisions of the City ' s Building, Electrical, Plumbing, Mechanical and Housing Codes ; the City ' s Zoning Ordinance ; and related State laws . Building Official shall make such inspections and investigations as may be required to effect such enforcement and issue permits as are required by City ' s Ordinances and Codes . Such enforcement shall include the duties as set forth in the Ordinance of the City for the Building Official and in the performance of such work, the employees of the Building Official shall do the following: a . Plan Review. Building Official shall review the plans prepared by or on behalf of private developers for compliance with applicable State and City ordinances and regulations . Building Oficial shall maintain close liaison with the City ' s Planning Director in order that the appropriate requirements of the Zoning Ordinance are incorporated within such building plans . Building Official shall arrange review by other appropriate agencies having jurisdiction in such matters relative to enforcement of fire codes , sanitation codes and health codes . When satisfied that the appropriate requirements of the City ' s codes have been met, Building Official shall issue permits as set forth in such codes . b . Building Inspection . Building Official shall provide building inspection service during the course of construction of private facilities to enforce compliance with the provisions of the applicable State and City ordinances and regulations set forth on the plans for which the permit is issued. In the performance of such duties, Building Official shall provide prompt inspection for each project at the completion of the various stages of construction to determine compliance . C . Zoning Enforcement. Building Official shall provide enforcement of all aspects of the City ' s Zoning Ordinance and will make all necessary investigations and follow-up inspections to assure compliance with the Zoning Ordinance and the conditions of approval of various variances, conditional use permits, site reviews and other zoning approvals . Enforcement will include . preparation of cases for citation hearings and criminal proceedings in municipal court. Building Official shall perform other activities as directed by the City. d. Housing Code Enforcement . Building Official shall enforce the City ' s Housing Code by investigation of' complaints regarding sub-standard housing ccnditions and where necessary, prepare cases for citation hearings , criminal proceedings in municipal court, and civil abatement proceedings . w Building Official shall perform other activities as directed by the City. Page 1 e . Facilities for Records . The City shall provide an office for conducting the duties set forth in this Agreement, and shall provide necessary furnishings , telephone, permit forms and codes . Within this office, Building Official shall assemble such records customarily maintained by a City Building Department. Such records shall, at all times, be the property of the City. 2 . Collection of Fees . All fees to be collected in connection with the carrying out of the functions set forth above, shall be collected by the City . Building Official shall review the appropriate ordinances and fee schedules in effect by the City, and shall compute the amount of such fees to be collected by the City. 3 . Compensation to Building Official . Building Official shall be compensated monthly for services rendered in accordance with the schedule contained on Exhibit "A" which is attached hereto. 4 . General Conditions . a. Avoidance of Conflicts . During the life of this Agreement, Building Official shall not provide services to any client for a project which requires any permit or approval from the City. b . Compliance with Laws . Building Official, his agents and employees , shall comply with all laws , ordinances , rules and regulations of the State, County, the City of Dublin, and all governing bodies having jurisdiction applying to work done or "to be done under the Agreement . C . Insurance and Indemnification. Building Official shall assume liability and pay all costs of defense, including legal fees and court costs , and hold the City harmless from loss, damages , costs or expenses caused by any negligent or wrongful acts , errors , or omissions of Building Official ' s officers , employees and agents which may occur in the performance of the terms , duties and obligations of this Agreement. Building Official shall provide a certificate of insurance to the City, to be included as part of this Agreement, which will give evidence of general liability insurance of not less than $1, 000 , 000 . 00 for personal injury, accidental death and property damage ; and further provide to the City a Certificate of Insurance, which gives evidence of automobile liability insurance coverage of not less than $1, 000 , 000 . 00 for personal injury and accidental death, and $50 , 000 . 00 for property danage per occurrence . City shall be named as an additional insured in any such liability insurance policy. Building Official shall pay all premiums for said insurance . Building Official shall also provide the City with a certificate of insurance, to be included as part of this Agreement, which will give evidence that Building Official ' s employees are covered by worker ' s compensation insurance . All certificates of insurance which are a part of this Agreement shall be approved by the City Manager and City Attorney as to form and content . d. Assignability. Building Official shall not assign this contract without prior written consent of the City. e . Clerical Support . City agrees to provide adequate clerical support to the Building Department function as mutually agreed upon by City and Building Official . f . Subcontractor . The name, background and experience of any and every firm to which any work outlined in these specifications is to be sub-contracted by the person or firm to which the prime agreement is awarded must be submitted to the City Manager for his approval . Unless a sub-contract is approved by the City Manager, the holder of the prime agreement must do all the work outlined in these specifications , using his own equipment and personnel . It must be clearly understood that the holder of the prime agreement, Page 2 irrespective of any approved sub-contract, will be held entirely responsible for the quality and quantity of work to be done under the terms of the agreement . No sub-contract to do any work outlined in these specifications is to run longer than one year, and the extension or renewal of any such sub-contract agreement can only be made with the approval of the City Manager . The agreement will not be assignable in whole or part, without the express written approval of the- City Manager. 5 . Responsible Individual . The individual directly responsible for the performance of the duties of Building Official as hereabove set forth shall be Victor L . Taugher, a California Registered Civil Engineer, License #9556 , and Fire Protection Engineer License #911 . Upon mutual agreement and direction of the City Manager, Building Official may substitute other individuals in the above capacity as responsible individual . 6 . Term of Agreement . a. Term of Agreement . This Agreement shall be effective until terminated. This Agreement may be cancelled by the City, upon thirty ( 30 ) days advance written notice . This Agreement may be cancelled by Building Official upon ninety (90 ) days advance written notice . b . Notices . FOR BUILDING LAW ENFORCEMENT SERVICES WHEREAS, the City of Dublin (hereinafter referred to as "City") , and Taugher and Associates, Inc. (hereinafter referred to as "Building Official") , first emtered into an Agreement on August 1, 1983 to provide Building Law Enforcement Services to the City of Dublin; and WHEREAS , the fees established in Exhibit "A" of the original agreement were to be annually reviewed and adjusted as mutually agreed upon by the Building Official and the City; and WHEREAS, an adjustment of fees for services has been made by the City on an annual basis in the past; and WHEREAS, the City wishes to continue contracting for services from Building Official; and WHEREAS, an adjustment of fees for services rendered is desired by both the City and Building Official. NOW, THEREFORE, the parties hereto agrees as follows: SECTION I. ADJUSTMENT OF RATES The Taugher & Associates, Inc. hourly rate schedule (Exhibit A) shall replace the rate schedule which was adopted by the City Council and became effective August 1, 1989 . The change in rate shall be effective August 1, 1990 and shall continue in effect until recinded or amended by the City Council, according to the provisions of the agreement. The rates will be adjusted thereafter annually, as mutually agreed upon by the Building Official and the City of Dublin. In the event that the Building Official is requested to perform services in excess of forty (40) hours in any one (1) week, or in the event that there is an emergency requiring the services of the Building Official and the City is reimbursed for said services, the Building Official shall be compensated at 1 - 1/2 times the above hourly rates. Standard rates will apply for Building Official ' s attendance at Planning Commission and City Council Meetings. * An additional insurance surcharge of $4 . 00/hour not to exceed $12, 000. ** Supervision duties include review and coordination of work performed by Inspectors and clerical support staff. Administrative duties include City Council and Commissions meeting attendance when requested, meetings With applicants and developers, inter-agency coordination and coordination with Staff, development of office procedures, operations, etc. 2
