FINANCIAL STATEMENT: An annual assessment is collected on the Property Tax bill to cover the cost of Basic Residential Garbage and Recycling Services. The proposed 1996197 annual assessment is $112.60 per single family household. This assessment reflects a rate reduction resulting from the new Franchise Agreement with Waste Management of Alameda County. .:. DESCRlPTION: Each year, the City Council is required to conduct a public hearing to set rates and establish an assessment to fund Residential Basic Garbage and Recycling Services. The amount of this assessment is based upon the cost charged by the garbage company (Waste Management of Alameda County - Livermore-Dublin Disposal), as specified in the Franchise Agreement. Other factors influence the amount of the assessment These factors include administrative costs, estimated delinquencies and estimated prior year surplus funds. BACKGROUND: The City has provided mandatory basic residential garbage and recycling services since July 1, 1993. Basic service includes weekly collection from: one 35-gallon trash can, one 64-gallon greenwaste container, and recycling bins. All containers are provided by the trash company. The program was initially . implemented in recognition of the fact that the entire community benefits by assuring that basic garbage . .' and recycling services are provided to residential units on a weekly basis. The annual cost of basic service . is funded from an assessment included on the property tax bill. From these collections, the City pays the . ITEM NO. -"..9 ~ .. garbage company twice each year. Customers who request services beyond the basic service level are billed directly by the garbage company for the additional services. e:",. 1996/97 PROPOSED ANNUAL ASSESSMENT: For the upcoming Fiscal Year, Staff is proposing to decrease the annual assessment to $112.60 from the 1995/96 assessment of $121.30. This represents an annual rate decrease of $8.70 or 7.17 %. The reduction results from the first full year of implementation of the new franchise agreement between the City of Dublin and Waste Management of Alameda County, which was effective January 1, 1996. Under the new agreement, residential waste collection and recycling rates have been reduced from $10.27 to $9.50 per month per residential unit. 1 ~. The $9.50 per month rate has been adjusted by Staff to account for administrative expenses (County collection charge of 1.7% and data transmission charges), estimated delinquencies (2.5%), Alameda County Waste Management Authority grant funds ($10,000), and estimated prior year surplus funds ($14,000). These adjustments result in the proposed annual assessment of $112.60, which is approximately $9.38 per month for each residential unit which receives individual garbage services. ADDITIONAL SERVICES: e., The annual assessment covers basic services previously described in this staff report Customers who wish to have additional services, such as additional or larger cans, are billed directly by the garbage company for these services. These rates are consistent with the City's policy of providing high quality municipal servicesat the lowest cost possible. RECOMMENDATION: Staff recommends that the City Council conduct a public hearing and adopt the Resolution Approving and Establishing the Collection of Minimal Residential Garbage and Recycling Service Fees for Fiscal Year 1996-97 . - 3 - . RESOLUTION NO. - 96 . APPROVING AND ESTABLISIDNG THE COLLECTION OF MINIMUM RESIDENTIAL GARBAGE AND RECYCLING SERVICE FEES FOR FISCAL YEAR 1996-97 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ********* WHEREAS, the City of Dublin is mandated by the state of California, under AB 939, to reduce the amount of solid waste going into the landfill; and WHEREAS, through the Mandatory Garbage Ordinance and other means, the City of Dublin is taking a proactive stance to meet the State Mandated Goals; and WHEREAS, the goal of the Mandatory Garbage Ordinance is to protect the health and welfare of the community, to' provide recycling services to all residential property owners, and to equally share the costs of these programs by mandating that every residence contributes towards the cost of the service; and WHEREAS, it is the intent of the City Council to provide solid waste management services as effectively and inexpensively as possible; and WHEREAS, the collection of the charges for these services is best completed by charging every residence for the minimum service on the property tax bill; and WHEREAS, minimum service includes service described in the current Agreement with the franchised waste hauler; and . WHEREAS, the City Council has considered this action as part of a noticed public hearing on July 23, 1996 NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin does hereby approve and establish the collection of minimum residential services fees by the City on the property tax bill as shown in the attached Exhibit A. attached hereto and by reference made a part of. BE IT FURTHER RESOLVED that the City Staff are hereby authorized to undertake all administrative tasks to implement the assessments, including, but not limited to an agreement with Alameda Countj for collection which may provide payment to Alameda County of its reasonable costs of collection not to exceed 1.7% of the total amount levied. CITY OF DUBLIN CALCULATION OF ASSESSMENT FOR MINIMUM RESIDENTIAL GARBAGE SERVICE Purpose of Fee: The purpose of the fee is to provide a basic level of garbage and recycling services to all residences which receive individual garbage service. This includes certain programs and services necessary to comply with the California Integrated Waste Management Act of 1989 (AB 939). Provision of the basic service level on a City-wide basis protects the health, safety and welfare of the community. Allocation: The cost of this program and the method of allocating the cost among all residential properties offered such services shall be as set forth herein Use of Fees: The fees collected pursuant to this program shall be used to pay for minimum residential garbage collection and recycling services and associated administrative costs. ." . . ." Limitations: The amount to be raised through the collection of the Minimum Garbage Fee for Fiscal Year 1996-97 does not exceed the estimated total cost of the services and related expenses as described in the Staff Report presented at the July 23, 1996 Public Hearing before the Dublin City Council. Method To Be Used To Calculate the Minimum Garba2:e Service Fees For Different Land Uses General: The fee shall only apply to residential properties which receive individual garbage collection and disposal and are not serviced by a centralized commercial dumpster.
