Costs of the land acquisition are being paidforthrough developer advances of each developer's respective Eastern Dublin Traffic Impact Fees. DESCRIPTION: As part of the construction of arterial street improvements in Eastern Dublin, it is necessary for the City to acquire property to create or e1.'tend Dublin Boulevard, Central Parkway and Gleason Drive, and to 'widen Tassajara Road. These improvements are described as part of the circulation system of the City's General Plan and Eastern Dublin Specific Plan. These streets must be oversized in order to accomniodate the regional traffic needs for the orderly development of the Eastern Dublin Specific Plan. The portions of the subject streets required by the City to complete the oversizing are all owned by the Dublin Land Company. Property ovmers fronting the aforementioned streets will provide right-of~way and improvements for local traffic needs, which include a 20-foot outside traffic lane and curb and gutter, sidewalk and frontage' landscaping. The resolution of necessity is basically a finding that the project is necessary and that the property to be acquired is essential to the project. -...1 The improvements to be constructed within the lands to be acquired include the completion of four lanes of roadway along Tassajara Road, two center lanes of roadway along Gleason Drive and Central Parkway, and four center lanes of roadway along Dublin Boulevard, together .with associated public service/utility, construction and slope easements. Appraisals of the .lands to be acquired have been conducted and the City has made a purchase offer to the property owner. In fact, the offer was recently updated and presented to the property owner, but has not been accepted. In order to proceed with the work, a Resolution of Necessity must be approved by the City Council and pleadings filed with the Court so thatthe City may obtain possession of the land. Negotiations can still take place after this process. If a negotiated settlement is not attained, the condemnation action will proceed to trial for determination of compensation for the property. Before the earlier set hearing on this matter was postponed, the attorney for the Dublin Land Company submitted a letter requesting to be heard at the Public Hearing. The letter is attached. The City Staff and Special Condemnation Council met with the property owner and his attorney to discuss the topics contained in the letter and the project in general. Based on these discussions, it appeared that most, if not all, of the property owner's concerns and questions have been addressed. Furthermore, numerous maps and exhibits were provided to the property owner. It is anticipated that the property owner will still wish to make a presentation at the public hearing. I'-":~..' '....,J Staff recommends that the City Council conduct a public hearing, deliberate, and adopt the Resolution of Necessity . ,,.,...,,-...., '~ Page 2 /~~ f""---' RESOLUTION NO. .99 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN DETERMINING THAT THE PUBLIC INTEREST AND NECESSITY REQUIRE THE ACQUISITION OF CERTAIN LAND AND DIRECTING THE FILING OF EMINENT DOMAIN PROCEEDINGS Assessor's Parcel No. 985.0004.001.03 (portion) [T IS RESOLVED by the City Council of the City of Dublin, California, as follows: WHEREAS, it is desirable and necessary for the City of Dublin to acquire fee title to and easements (Le., public service/utility, slope, and temporary construction) within certain real property, particularly described in Exhibits uN through "G", attached hereto and made a part hereof by reference, in order to construct, widen and/orirnprove Tassajara Road, Dublin Boulevard, Central Parkway and Gleason /"" Drive (the "Project"). REQUEST TO BE HEARD AT HEARING ON NOTICE OF INTENTION TO ADOPT RESOLUTION OF NECESSITY Assessor's Parcel No. 985-0004-001-03 Dublin Land Company, through its principals and representatives, including John DiManto, Sam Zulo, and George Speir, among others, request the right to appear and be heard by the City Council of the City of Dublin and the Redevelopment Agency of the City of Dublin when it considers adoption of a Resolution of Necessity and the filing of an action in eminent domain with respect to the above-referenced property. The hearing is presently scheduled for December 7, 1999. Dublin Land Company will provide evidence at the time of the hearing that the proposed Resolution of Necessity does not comply with the requirements of the Code of Civil Procedure including section 1240.030 in that, inter alia: (a) The public interest and necessity do not require the project at this time; rather, the project is being required by the private interests of developers to the north and east of the property; (b) The project is not planned or located in a manner that will be most compatible with the greatest public good and least private injury, in that the City has failed to acquire all of .~ the property necessary for it to construct the streets which have been proposed by the Department of Public Works and City Engineer; (c) The project is not planned or located in a manner which will be most compatible with the greatest public good and least private injury in that the City plans to implement only a portion of the overall project at this time, i.e., not installing drainage and not fully relocating utilities, thereafter requiring that utilities be relocated a second time, drainage be reinstalled a second time, and other improvements be further revised, to the greater public and private expense; (d) The project is not planned or located in a manner that will be mos~ compatible with the greatest public good and least private injury in that descriptions of the property to be acquired does not include necessary construction easements which will be necessary for the City to fully install the improvements which are contemplated by the proposed public project; ( e) The proposed resolution does not comply with Code of Civil Procedure section 1245.230 in that the property proposed to be taken is not clearly defined and the purposes for which the property is to be used is not clearly set forth, particularly with respect to the "drainage and utilities easements" proposed to be taken, and described on Exhibit B to the notice. The notice states that the easements are for the purposes of grading, installing utilities in the ultimate location, and paving a portion of the streets. The project as explained to Dublin Land Company, however, does not involve relocating the utilities "in the ultimate location."
