The ultimate price paid for the street lights may be higher. Acquisition Group Staffwill continue to negotiate withPG&E and will return to the City Council with progress reports. Legal and consulting costs will be incurred as necessary during this process. Funds have been budgeted in the Five- Year Capital Improvement Program for acquisition of the lights. Once the City takes possession of the lights, the monthly billing from PG&E will decrease substantially, and the City will begin to incur additional maintenance costs. The annual savings to the City is estimated to be between $68,00d"and $70,000, based on current rates and excluding replacement costs. (See body of report for additional information on rates.) 'j .. ~. ,'. , ....., DESCRIPTION: The City's adopted Goals and Objectives includes acquisition of .',' street lights as a goal. In addition, the City's Five- Year Capital Improvement Program identifies a project . ,., for purchase of street lights and street light facilities from PG&E. City street light ownership provides the following public benefits: 1. The City can substantially reduce its PG&E street light bill by taking electric service under the LS-2 rate tariffinstead of the LS-1 (see Financial Statement above and additional information below regarding gross and net savings). Since electric service for street lights is a major expense of the City, reduction of this expense also reduces the cost of local government. 2. The City can provide a higher standard oj maintenance than offered by PG&E and can also ensure prompt repair oj street light outages, thereby improving public safety and convenience. 3. The City can impose higher construction and installation standards to assure greater public safety and maximize energy efficiency. In December of 1993, the City of Dublin joined the Alameda County Street Light Acquisition (ACSLA) Group. This group consists of the County of Alameda and 10 cities within the County. Over the past two years, the group has met to discuss various aspects of the acquisition, including appraisals, financing, development of standard specifications, maintenance alternatives, and the mechanics of the acquisition. The majority of the City's street lights (1,354) are currently owned by Pacific Gas and Electric Company ."'. and are billed under the "LS-l" rate, which includes a considerable charge for maintenance.' PG&E performs aU maintenance on the lights under this rate schedule, including bulbs, photoelectric controls, lenses, knockdown replacement, and underground or overhead wiring replacement. The City currently owns 415 lights which are billed under the LS-2C rate. This rate also includes a charge from PG&E for maintenance; however, the charge is lower and only includes replacement of bulbs, photoelectric controls, and lenses. The City is responsible for any other maintenance needed by the City-owned lights. Once the City acquires the PG&E-owned lights, the rate schedule for these lights would change to the "LS-2A" rate, which includes only energy cost and a small amount of overhead. This rate is substantially lower than the LS-l rates. For example, the current LS-IA rate for a 70-watt street light is $7.75 per month, and the LS-IE rate is $10.87, as opposed to an LS-1A rate of$2.67. The majority of residential area street lights are 70 watts. There are a number of variations in the LS-l rate schedule; these ac~unt primarily for differences in pole type and ownership: When the City acquires the PG&E lights, it is also proposed to change the City-owned lights from the LS-2C to the LS-2A rate. The City will incur maintenance costs for the street lights, as well as some increased administrative costs. The feasibility study that was performed in 1993 estimated $1.55 per light per month for normal maintenance (bulbs and photocells), exclusive of extraordinary repairs such as knockdowns, with a total annual maintenance cost of$40,000. It is proposed to expand the scope of the existing traffic signal and street lighting maintenance contract with Alameda County to include the newly-acquired lights. Staffhas further estimated the administrative cost to be approximately $9,500 per year (same as budgeted for FY '. 1995-96). After deducting the estimated maintenance and administrative costs, the total net annual savings e:. is estimated at approximately $68,900, based on the current LS-l rates. :- Page 2 . . . ,~- ,"" PG&E recently filed a rate adjustment request with the CPUC which provides for a 20% reduction in LS-l rates. When these rates take effect on July 1st, the spread between the LS-I and LS-2 rates will change so that the annual savings to the City is less. The Acquisition Group's appraiser has analyzed the proposed rate schedule and estimates the gross annual savings to be $89,100. After deducting the estimated maintenance and administrative cost, the net annual savings is estimated at $39,600. The City's street lighting energy and maintenance costs are funded entirely by the City-Wide Street Lighting Assessment District. The City's property owners therefore pay the cost of street lighting based on various factor rates. A single-family lot, which is assigned a factor rate off~I," has been paying $19.34 per year. Conunerciallots are assessed on the basis of lot size. The reduction in the cost of street lighting energy and maintenance can therefore be passed on to the property owners in the form of a reduced assessment. The Acquisition Group has submitted several offers and counteroffers to,PG&E for purchase of the street lights. PG&E has, to date, rejected these offers and counteroffers. The latest offer is attached as Exhibit 2. In, order to achieve the cost savings at the earliest possible date, Staff is reconunending that the City Council adopt the Resolution of Necessity, so that the City can take possession of the lights and begin paying the lower LS-2A rates. The other jurisdictions in the Acquisition Group have agreed to take this same step toward acquiring the lights ,within their respective territorial limits. A Categorical Exemption has been tiled regarding the acquisition of the street lights and street lighting facilities (see Exhibit 3). Staff recommends that the City Council conduct a public hearing, delibc;,rate, and adopt the Resolution of Necessity. . Page 3 RESOLUTION NO. - 96 .'- " A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ********* NECESSITY OF ACQUISITION OF STREET LIGHTING FACILITIES BY EMINENT DOMAIN WHEREAS, the City of Dublin, a General Law city, is authorized to acquire by eminent domain public utility facilities for the public use of street lighting pursuant to, among other provisions of State Law, California Code of Civil Procedure Section 1240.110; California Constitution Article XI, Section 9; Government Code Section 37350.5; Government Code Section 39732; and Government Code Section 40404(f); and WHEREAS, the City of Dublin desires to acquire certain public utility facilities, namely all Pacific Gas and Electric Company (hereinafter "PG&E") street lighting facilities located within the territorial limits of the City of Dublin that are on PG&E's LS-l rate schedule, and which are generally described in the Attachment "A". and , . WHEREAS, the City Council has provided the notice and has held the hearing required by California Code of Civil Procedure Section 1245.235, and no legal impediment to proceeding with the acquisition has been shown; NOW, THEREFORE, BE IT RESOLVED that: 1. following: The City Council of the City of Dublin declares that it has found and determined each of the a. The public utility facilities (generally described herein and in Attachment "A") are to be acquired pursuant to California Code of Civil Procedure Section 1240.610 and, as provided in . California Code of Civil Procedure Section 1240.650, said facilities are a more necessary public use than the present use to which said facilities are appropriated. PACIFIC GAS & ELECTRIC COMPP~Y 77 Beale Street San Francisco, CA 94120 Re: Alameda County street Light Acauisition Dear Mr. Garber: The purpose of this letter is to respond to your counter- offer of a sales price of $9 million for PG&E's street lights, which facilities are located within the pUblic entities that comprise the Alameda County Street Light Acquisition group. First, the group appreciates PG&E's willingness to reduce its original offer to $9 million. Unfortunately, according to our appraiser, Ms. Nancy Hughes, PG&E's proposed reduction in its LS-l rates would reduce the value of the PG&E street lights to a level that is much lower than what is reflected in PG&E's latest counteroffer. Furthermore, based on our recent discussions with persons involved in PG&E's general rate case, we have every reason to believe that PG&E's proposed LS-l rate reduction (which no party is opposing in the general rate case) will be adopted by the CPUC in the next several months. The members of the Alameda County street Light Acquisition group, therefore, respectfully decline to accept PG&E's latest counteroffer of $9 million. The group, however, is willing to purchase PG&E's streetlights at a price based on Ms. Hughes' new appraised value of PG&E's streetlights, which reflects the proposed decrease in the LS-1 rates. I have enclosed:a copy of Ms. Hughes' appraisal summary of November 1, 1995, which has been approved by each of the group members. The group's new counteroffer of $3,439,388.00, revokes all prior offers by the group or any of its members. If PG&E is willing to accept the group's counteroffer of $3,439,388.00, please let us know as soon as possible. The group members are doing this to avoid any additional delay in being placed on PG&E's LS-2 rate tariffs, regardless of how the necessary status of streetlight ownership is finally achieved, whether by negotiation or condemnation.
