RECOMMENDATION : FINANCIAL STATEMENT : None DESCRIPTION : One of the 1992 goals given a high priority by the city Council was to "undertake revisions to use policies for city facilities". This goal was initiated by staff in Fiscal Year 1991-92 for two reasons: 1) to standardize the procedures for rental for all city facilities; and 2) to review and update, as necessary, the fee schedules for City facilities. BACKGROUND: The City of Dublin presently operates five community facilities which are available for use by the pUblic. These facilities are as follows: Dublin civic Center, Dublin Senior Center, Dublin Sports Grounds, Dublin Swim Center and Shannon Community Center. Each facility has a separate Facility Use Policy and Fee Schedule which was developed at the time that the facility came under the control of the city. Although there are similarities between the various use pOlicies for each facility, there are also some inconsistencies between the policies which create confusion for potential users of the facilities, thus evidencing the need to standardize the format and reservation procedure for each individual use policy. PROPOSED REVISIONS: Attached in Exhibit A is the existing Facility Use POlicy and Fee Schedule for the Shannon Community Center that was adopted by the city council in september of 1988. The proposed Shannon Community Center Facility Use POlicy and Fee Schedule are attached in Exhibit B. As proposed, the policy follows a standard format containing each of the sections as shown below: 1. Classifications of Users 2. Priority of Users 3. Reservation Procedure 4. Cancellations 5. The sections dealing with "classifications of users", "reservation procedure", "cancellations", "payment schedule" and "insurance certificate" are similar to those included in the policies proposed for the other City facilities. In addition to the change in format, the proposed use policy contains minor modifications to the following sections: Classifications of Users 1) The classifications have been revised and redefined in order to standardize the user groups for all facilities. 2) The user groups eligible to rent the Center have been expanded to include non-resident community groups and non-resident commercial groups. Reservation Procedure 1) Deleted reference to waiting lists from the current pOlicy. 2) Added requirement that resident individuals or groups must submit "proof of residency". 3) Expanded hours that applications are accepted from 9:00AM - 4:00PM to 8:30AM - 4:30PM. 4) Changed submittal deadline from 15 working days to 30 days prior to function. Fee Schedule Use of the Shannon Community Center generally falls into three categories: use by Public Agencies, Chamber of Commerce or Community Groups for the purpose of group or pUblic meetings; use by Public Agencies, Chamber of Commerce or Community Groups for private events or fundraisers; and use by private individuals or commercial organizations for private events or profit making ventures. The fee schedule for the Shannon community Center has been updated to reflect the fees associated with the additional use classifications. Staff also conducted a market survey of the fees charged for similar facilities in the surrounding area and, in addition, reviewed the costs associated with the operation of Shannon Center. Revisions to the Fee Schedule are based on the information derived from this review and are shown as follows: 1) Increase the rates charged to public Agencies, Dublin Chamber of Commerce and Community Groups for use of the Shannon Center for oroup meetinas or public hearinos as follows: Public Agencies Chamber of Commerce Community Groups - Resident Community Groups - Non-resident Use During Business Hours Current/Proposed no fee / no fee no fee / no fee no fee / no fee ** / $10/hr Use outside of Business Hours Current/Proposed $ 8/hr $ 10/hr $ 8/hr $ 10/hr $ 8/hr $ 10/hr ** $ 20/hr . . The recommended increase for the aforementioned use is based on increased costs for attendant coverage from $8 per hour to $~O per hour. It should be noted that this fee has not been adjusted in over four years. **Under the existing Facility Use POlicy and Fee Schedule for Shannon Center, there is not a separate use classification for non-resident community Groups. Further, non-resident groups are assessed a fee which is twenty percent higher than the resident rate. It should be noted that there are currently several senior citizen clubs meeting on a continuous basis at Shannon center whose use, in the past, has been exempted from the use policy and fee schedule. The clubs meet on a weekly basis for four hours per week. The fees charged for their use were established prior to the time that the city acquired the center in 1984 and range from $34.50 per month to $57.75 per month. Consequently these fees have not been adjusted in over eight years. As fifty-one percent of these clubs membership do not reside in Dublin, the clubs would be classified as a non-resident Community Group under the proposed policy. consequently, they would be assessed a fee of $10 per hour (or $120 per month) to utilize the Center for their weekly meetings. The clubs have indicated that the proposed increase in fees could not be absorbed and that they would have to disband. Although the Parks and Recreation commission was sympathetic to the concerns of senior clubs, they felt that the city should not subsidize these clubs any further now that the City has a Senior Center. Thus, it was the recommendation of the Parks and Recreation commission that these clubs no longer be exempted from the policy and that they be assessed fees in accordance with the proposed fee schedule. CONCLUSION: The Parks and Recreation commission considered the proposed revisions to the Facility Use policy and Fee Schedule for the Shannon Community center at their regular meeting held on August 11, 1992. The Commission was in favor of the proposed revisions and recommended that the city Council approve the proposed Facility Use Policy and Fee Schedule. . . staff has prepared a resolution Establishing a Facility Use Policy and Fee Schedule For Use of the Shannon Community Center which is attached in Exhibit C. Dublin manages the Shannon Community Center. The Center is the Recreation Department for city sponsored classes and is also available for renta! by community groups and private The Facility Use Policy is designed to ensure that the Center is utilized for recreational, cultural, social and community service functions that meet the needs and interests of the community. In additionl the Facility Use Policy establishes rules, regulations, procedures and fees governing the use of the Center. Any request for exception to the rules, regulations, procedures and fees as stated in the Facility Use Policy, must be submitted in writing to the Director of Recreation no later than one (1) month prior to the date requested. CLASSIFICATIONS OF USERS 1. The following classifications shall apply for the purpose of determining applicable fees and charges as well as priority use: I. city of Dublin Use II. School Districts with whom the city has a reciprocal Facility Use Agreement. III. Community Groups - An organized public group having the following membership qualifications: a) Is non-profit. b) Has officers and a definite organizational structure. c) Activities are recreational or educational in nature. d) At least fifty-one percent (51%) must be residents of the city of Dublin. Organizations claiming status in this classification must demonstrate that they qualify f or such status by submitting a roster of their membership and a copy of their bylaws or constitution at the time that they submit a Facility Use Application. IV. Dublin Chamber of Commerce V. Private Individuals or Groups - Youth or adult groups not open to the public and which are using the facility for private purposes. In this group are lodges, fraternal organizations, political organizations, wedding receptions, but not limited to these groups. VI. Non-resident Individuals or Groups - Individuals or groups with less than fifty-one percent (51%) of their membership residing within the boundaries of the city of Dublin. VII. Commercial use by private groups for the principle purpose of making a profit not pledged to be devoted to pUblic or welfare use. 2. Use of the Center shall not be granted: a) To any individual or group, political or advocates the overthrow of the government of the America or the State of California by force, other unlawful means. When determined by the Director of Recreation, be in the best interest of the city. otherwise, that United States of violence or any b) such use may not RESERVATION PROCEDURE 1. In order to reserve the Shannon community Center, a Facility Use Application must be submitted for approval by the Director of Recreation. Approval takes 3-5 working days; you will be notified by mail as to the status of your application. 2. Once an application has been submitted, a waiting list will be established for applicants requesting use on the same date. If, after the review by the Director of Recreation, the application is rejected, the first apolicant on the waiting list will be notified. -1- August 1990 ~}(l}{J 0 [IDO li" IA . . RESERVATION PROCEDURE (CONTINUED) 3. Applications must be submitted in person at Civic Center, 100 Civic Plaza, Dublin. The applicant must be the "user" of the facility. 4. Applications are accepted between the hours of 9:00a.m. and 4:00p.m., Monday through Friday (holidays excepted). 5. Applications for weekday use of the Center will be accepted up to three (3) months in advance of the desired date. Applications for weekend use (Friday night-sunday) of the Center will be accepted as follows: a) Classifications I-V may submit applications up to one (1) year in advance of the desired date. b) Classification VI may submit applications up to nine (9) months in advance of the desired date. c) Classification VII may submit applications up to six (6) months in advance of the desired date. d) If the submittal date falls on a Saturday, the application may be submitted the preceeding Friday. If the submittal date falls on a Sunday, the application may be submitted on the following Monday. 6. Applications for continuous use of the Center will be accepted as follows: a) Classification I may submit applications up to one (1) year in advance. b) Classifications II-IV may submit applications on a quarterly basis as follows: 1. Summer (June, July, August) - Applications accepted starting May. 2. Fall (September, october, November, December) - Applications accepted starting August 1. 3. Winter (January 1 February, March) - Applications accepted starting December 1. 4. spring (April, May) Applications accepted starting March 1. c) Continuous use is not permitted for Classifications V-VI. 7. Applications submitted less than fifteen (15) working days prior to the day requested will not be accepted. 8. An additional 50% will be charged for use of the Center on designated city holidays. 9. Transfer of security deposits from one date to another is permitted if the request is submitted in writing no late than sixty (60) days prior to the original date requested. (This will only be allowed one time). CANCELLATIONS 1. Cancellations must be made in writing by the person listed as applicant on the Facility Use Application. Refunds will be handled as follows: a) 30 days or more prior to function date - forfeit deposit unless date is rebooked by another user. b) Less than 30 days prior to function date - forfeit deposit and one-half of fees paid. occasionally it may be necessary to reschedule, .relocate or cancel a request previously approved. In this event, the group or individual will be given as much advance notice as possible. PAYMENT SCHEDULE 1. At the time the application is submitted, the security deposit is required (see Fee Schedule) 2. Final payment is due no later than one month (30 days) prior to the scheduled function date. Please call the rental secretary at 833-6645 to schedule an appointment 3. payments not received by this thirty day deadline will result in cancellation of the function and forfeiture of the deposit. 4. Security deposits will be returned by mail within 30 days of your function date providing there are no violations of the Facility Use Policy and/or excessive cleaning or damages to the facility. 5. Payments can be made by check, money order or ash. Checks or money orders must be made payable to the city of Dublin. If paying by check, the check must be drawn on the account of the person listed as applicant on the Facility Use Application. -2- . . HOURS OF USE 1. The Shannon community Center is available for rental sunday through Thursday from 8:00AM to 10:00PM, and Friday and saturday from 9:00AM to 12 Midnight. 2. The minimum reservation accepted will be for two hours. 3. Hours of use must include the amount of time needed for the function, setup and cleanup, including any time needed by your caterer, band, florist, coordinator, etc. 4. Refunds are not given for hours not used. 5. wi thin 30 days of function date, requests for changes in function hours are subject to availability of staff. 6. The Center must be vacated by the time specified on the Facility Use Application. INSURANCE CERTIFICATE Applicants shall provide Insurance Liability information on the City of Dublin's required form evidencing such coverage. Such certificates shall provide Bodily Injury and Property Damage Liability protection at a minimum limit of $500,000 per occurrence. If alcohol is to be sold, liquor liability is required. The Certificate of Insurance shall name the city of Dublin, its officers and employees as the Additional Insured in conformance with the Hold Harmless Aoreement as outlined in the Facilitv Use Application, and must speciJfy that the user groups insurance shall be primary to any insurance carried by the city. The certificate shall be properly executed with an original signature of an authorized agent of the insurance company and is due at the time final payment is made. ALCOHOLIC BEVERAGES 1. Requests to sell alcohol must be submitted in writing to the Dublin polices services, 100 civic Plaza, Dublin, CA 94568. 2. If permission is granted, applicants must obtain the appropriate permits or licenses from the Alcoholic Beverage Control Board, 7677 Oak Park street, suite 1020, Oakland, CA (639-0628). The permit/license must be submitted when final payment is made. GENERAL REGULATIONS AND INFORMATION 1. Groups composed of minors must be supervised by one (1) adult for each twenty (20) minors at all times while they are using the facility. 2. Facility Use Permits cannot be transferred, assigned or sublet. 3. Decorations must be of flame-retardant material. The use of nails, tacks or staples is prohibited. 4. storage is not available either before or after your event. 5. Tables and chairs may not be removed from the facility. 6. Barbecuing and/or use of candles must be approved in advance by the Fire Department (829-2333). 7. Rice, birdseed, confetti, and like materials may not be thrown inside or outside the facility. 8. Tickets may not be sold at the door as an admission charge unless approved in advance by the Director of Recreation. 9. Parking is permitted in painted parking stalls only. parking is not permitted on sidewalks, lawn areas or unmarked blacktop areas. Vehicles parked illegally will be cited. 10. SMOKING IS PROHIBITED within the interior of the center (Resolution No. 143-89). 11. Shannon Center is not air conditioned! - 12. caterers, florists, etc. are not authorized to schedule hours of use. 13. Children in attendance must be supervised at all times. --------------------------------------------------------------------------- SIGN AND SUBMIT WITH APPLICATION The undersigned, hereby agrees to be responsible for any damage to the facility occurring during this use, and agrees to be responsible for the conduct of all persons attending this function. Applicant further agrees to be responsible for any accident or injury occurring to anyone during this use, and agrees that the city of Dublin, its officers and employees, shall not be responsible for any such injury or loss. The Shannon community Center is located at 11600 Shannon Avenue (at San Ramon Road) in Dublin. The Center is utilized by the Recreation Department for city sponsored classes and programs and is also available for rental by the community. Facili ties available include a large social hall, three smaller meeting rooms and a kitchen. The shannon Community Center Facility Use Policy establishes rules, regulations, procedures and fees governing the use of the Center. CLASSIFICATION OF USERS Group 1. city of Dublin Group 2. Public Agencies (agencies serving the city of Dublin including Alameda County, Dublin-San Ramon Services District, Dublin Unified School District, etc.) Group 3. Dublin Chamber of Commerce Group 4. Community Groups (organized non-profit groups whose open to the public and whose primary purpose is community) a) Resident (51% of membership must reside or within the Dublin city Limits) b) Non-Resident membership is to serve the own property Group 5. Private Individuals or Groups (groups whose membership is not open to the pUblic and/or activities such as weddings, receptions, anniversaries, birthday parties, etc.) a) Resident (reside or own property within the Dublin city Limits) b) Non-Resident Group 6. Commercial Groups (companies, groups, or individuals whose events have the primary purpose of generating a profit such as training seminars, trade shows, auctions, etc.) a) Resident (company facility must be located within the Dublin city Limits, or if there is no company facility, person responsible for event must reside or own property within the Dublin City Limits) b) Non-Resident PRIORITY OF USERS Group ~ _ Reservations accepted up to one calendar year in advance of requested dates of use. Requests to sell alcohol must be submitted in writing to Dublin polices Services, 100 civic Plaza, Dublin, CA 94568. 2. If permission is granted, Applicants must obtain the appropriate permits or licenses from the Alcoholic Beverage control Board, (639-0628). Evidence of approval is due at the time final payment is made. GENERAL REGULATIONS AND INFORMATION 1. Groups composed of minors must be supervised by two (2) adults for each twenty (20) minors at all times while they are using the facility. 2. Facility Use Permits cannot be transferred, assigned or sublet. 3. Transfer of security deposits from one date to another is permitted if the request is submitted in writing no later than sixty (60) days prior to the original date requested. (This will only be allowed one time) . 4. Decorations must be of flame-retardant material. The use of nails, tacks or staples is prohibited. 5. storage is not available either before or after the event. 6. Tables and chairs may not be removed from the facility. 7. Barbecuing and/or use of candles must be approved in advance by the Fire Department (829-2333). 8. Rice, birdseed, confetti, and like materials may not be thrown inside or outside the facility. 9. Tickets may not be sold at the door as an admission charge unless approved in advance. 10. parking is permitted in painted parking stalls only. Vehicles parked illegally will be cited. 11. An additional 50% will be charged for use of the Center on designated city holidays pending availability of staff. 12. SMOKING IS PROHIBITED within the interior of the Center (Resolution No. 143-89). 13. Shannon Community Center is not air conditioned. . . The Security Deposit is refundable provided that there are no violations of the Facility Use Policy and/or excessive cleaning or damages to the facility. . . ~ RESOLUTION NO. - 93 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ********************* ESTABLISHING FACILITY USE POLICY AND FEE SCHEDULE FOR USE OF SHANNON COMMUNITY CENTER WHEREAS, the city of Dublin assumed operation of the Shannon Community Center from Services District on July 1, 1984; and WHEREAS, effective July 1, 1988 the title Community Center was transferred from the Dublin San District to the city of Dublin: and the responsibility for the Dublin San Ramon to the Shannon Ramon Services WHEREAS, the Shannon Community Center is available for use by the public during such times that the City is not utilizing the Center for city sponsored activities; and WHEREAS, it is necessary to have established Facility Use Policies and Fee Schedules for use of city facilities; and WHEREAS, the Facility Use POlicy and Fee Schedule for the Shannon Community Center have been updated and revised to reflect changes proposed by Staff and the Parks and Recreation Commission. NOW THEREFORE, BE IT RESOLVED THAT THE city Council of the city of Dublin does hereby adopt the Facility Use Policy and Fee Schedule contained in Exhibit B. BE IT FURTHER RESOLVED that the provisions contained in all previous resolutions relating to the Facility Use Policy and Fee Schedule for the Shannon Community Center are hereby rescinded.
