The Great Western Savings office building will have approximately 67 , 550 square feet of space in a 3 story structure on an approximately 3 . 1+ acre site. The parking lot will have 230 spaces . The Planning Commission, on a 3 to 1 vote, denied the application because of : 1 . Potential traffic back up on Golden Gate Drive from cars waiting to get past the attendant booth and gate . 2 . Restricted access to required parking would conflict with the Zoning Ordinance requirement that the parking spaces be continuously accessible to any and all visitors to the site. 3 . Potential shift of project-related parking onto the public street (Golden Gate Drive) created by the restricted access to the off-street parking spaces . On September 12, 1985, Mr. Gilbert R. Reyes, Construction Manager for Great Western Savings, appealed the Planning Commission action. On October 7, 1985, Ms . Maria Pracher, legal representative for Great Western Savings, requested that the item be continued for one month to allow her to review the situation. Box 2340 Dublin, California 94568 Re: Great Western Savings PA 85-060 Dear Mr. Tong: I am writing this letter to formally appeal the Decision of the Planning Commission to deny our request for the use of parking control equipment at our new office complex located at the southwest corner of Dublin Boulevard and Golden Gate Drive. We do not agree with the Commission' s findings that the parking controls proposed will detour the use of our facility and create traffic congestion in the public right-of-way, but rather it would encourage the use of our facility by our employees, tenants and clients by assuring them that a parking space would be available for their use. The Commission' s concerns regarding the potential traffic congestion, we believe would be mitigated by the utilization of two (2) access points, as shown on our site plan, into the parking lot_. In addition, we propose to move the parking controls at the Goldeir- Gate driveway further west into the property there by providing more distance between the parking controls and the public right of way. I am available to review our appeal with you and your staff and answer any questions you might have. Tong Planning Director, City of Dublin 6500 Dublin Boulevard, Suite D Dublin, California 94568 Dear Mr. Tong: This letter will confirm our conversation of October 7 , 1985 in which I informed you that we were recently retained by Great Western Savings with regard to its appeal of the Planning Commis- sion denial of a conditional use for the operation of a con- trolled parking lot to be developed for the Great Western Savings office building at the southwest corner of Dublin Boulevard and Golden Gate Drive. In our conversation, I formally requested a one month continuance from the presently scheduled October 14, 1985 hearing date. We are requesting this continuance because we were retained only several days ago and we wish to have adequate time to review this matter and to meet with you to discuss the possibility of developing a mutually acceptable solution to our client' s concerns and the City' s concerns. Moreover, although we have requested a copy of the Dublin Zoning Code and the Parking Ordinance, we have not yet received them. This letter also will confirm our meeting with you at 9 :30 a.m. on Tuesday, October 22 , 1985 to view the site and discuss with you the City' s concerns regarding Great Western' s proposed parking plan. Cm. Mack opened the public hearing and called for the Staff report . Mr . Gailey presented the Staff report indicating the Ordinance ' s involvement in leading to the filing of this joint Conditional Use Permit/Site Development Review modification application. Background of the Site Development Review process for the three- story office complex currently under construction at the site was detailed. Mr . Gailey summarized Staff ' s concerns with the proposed use of an attendant controlled parking lot station; 1) the potential stacking of cars out from behind the gate into the public right-of-way for Golden Gate Drive, and 2 ) the potential adverse effects related to restricting access and its related potential impact on the availability of on-street parking in- the immediate vicinity. Mr . Gailey advised that if the Commission saw merit in the proposal that Staff would request the item be continued to allow Staff to formalize possible site plan modifications to mitigate the stated concerns . .Mr . Gil Reyes, Project Construction Manager made a presentation on behalf of the property owner and emphasizing the following points; 1) it ' s the owner ' s contention that the backup would probably occur with or without use of the attendant controlled security gates; but that the light traffic on Golden Gate Drive would minimize the extent of the problem, 2 ) availability at two entrances to the parking lot means employees, who' d enter the site during peak a .m. hours, would learn to use the second, southerly entrance, 3 ) use of the attendant controlled parking lot would actually serve to encourage community to use the lot, because they' d know an on-site space would be available and 4 ) without use of the proposed attendant controlled security gates, the owners of the building could not satisfactorilv control who used the parking lot . ATTACHMENT ?om Mr . Reyes, in answer to an inquiry by Cm. Petty, advised use of a split level or multi-level garage was considered initially but determined infeasible. Cm. Raley inquired as to the proposed layout of the adjoining commercial center (KB Enterprises) . Mr . Tong provided background input as to the Bart Station designated by the General Plan for the end of Golden Gate Drive . Mr . Robert Hagman, Architect and applicant for the project advised the Commission that security gates have been used by Great Western in Southern California . He stated he felt there would be no major problems associated with their use, especially the back-up problem discussed. He indicated that the possible presence of Bart parking concerns Great Western greatly. On motion by Cm. Raley, seconded by Cm. Barnes, voice vote found 4-0 approval to close the public hearing. Cm. Petty voiced concern that the Commission had not been the body to consider the Site Development Review application for the office complex . He discussed the parking situation and indicated he felt the area to be devoted to parking was excessive. Cm. Raley indicated he felt Bart parking was not a real issue at this time, and that if and when a problem arose, then the request could . be reconsidered. On motion by Cm. Barnes, seconded by Cm. Raley, voice vote found 4-0 in favor of adopting Resolution No. 85 denying the subject Conditional Use Permit/Site Develpment Review modification request . APPLICANT/ REPRESENTATIVE: Robert W. Hagman Hagman Associates 114 Santa Margarita Menlo Park , CA 94025 PROPERTY OWNER: Great Western Savings 9301 Corbin Avenue Northridge, CA 91328 PROPERTY LOCATION: Southwest corner of Dublin Boulevard and Golden Gate Drive, zoned C-2; General Commercial District (APN 941-1500-15-24 ) SURROUNDING LAND USE AND ZONING: North: C-1; Commercial uses on Dublin Blvd. South: C-2 ; Shopping Center - Retail East : C-2 ; Golden Gate Dr . & Auto Dealership West : C-2; Undeveloped & Shopping Center ZONING HISTORY: The Great Western Savings office complex currently under the initial stages of construction was approved under the Site Development Review process on September 14 , 1984 (City File #PA 84-028) . When initially submitted, the project proposal included a request that an attendant-controlled parking lot be considered. Through the review process the proposed use of attendant controlled parking was dropped and the project ultimately conditionally approved such that use of security structures or gates were subject to review and approval by the City Planning Department (Condition #7- Architecture) . During the course of preparing working drawings for submittal of building permits, Great Western requested the City reconsider the inclusion of security parking controls . The City advised that the use of security ----------------------------------------------------------------- ITEM NO. 1#3 ATTACHMENT 5 parking controls was considered inappropriate for the specific use of the subject property and would be in conflict with the regulations outlined within the City Parking Ordinance. Great Western Savings was advised that the use of security parking controls could not be allowed until a Conditional Use Permilt/Site Development Review Modification approval was secured. The building permits for the project were approved with the proposed security parking control improvements "red-lined" off the plans . APPLICABLE REGULATIONS: Section 8-63 . 1 of the Zoning Ordinance states in part that the maintenance of the required parking and loading spaces shall be a continuing obligation of the owner of the property upon which the structure exists for such period of time that the use requiring such parking continues . Section 8-63 . 2 of the Zoning Ordinance states in part that the Ordinance ' s regulations involving on-site parking are intended to assure that off-street parking is provided for the use of tenants of the premises, and for clients, customers, employees and callers . Said parking is required to be kept continuously accessible for these purposes . Development of the subject property is proceeding under the entitlement granted under City file PA 84-028 , a Site Development Review application. Section 8-95 . 8 of the Zoning Ordinance outlines the process to amend plans approved by a Site Development Review process . The proposal to develop and operate an attendant controlled parking lot is not specifically listed as either an allowed use or as a conditional use . in the C-2 ; General Commercial District . Sections 8-91 . 0 and 8-91 . 1' of the Zoning Ordiance outline the procedures used to consider a District classification of a use not listed in any part of the Ordinance. Staff ' s determination . on this matter is that the proposed use most appropriately falls within the conditional use category of uses that may be considered in the C-2 District. Section 8-94 . 0 states that conditional uses must be analyzed to determine: 1 ) whether or not the use- is required by the public need; 2 ) whether or not the use will be properly related to other land uses, transportation and service facilities in the vicinity; 3 ) whether or not the use will materially affect the health or safety of persons residing or working in the vicinity; and 4 ) whether or not the use will be contrary to the specific intent clauses or peformance standards established for the district in which it is located. Section 8-94 . 4 states the approval of a Conditional Use Permit may be valid only for a specified term, and may be made contingent upon the acceptance and observance of specified conditions , including but not limited to the following matters : a) substantial conformity to approved plans and drawings; b) limitations on time of day for the conduct of specified activities; c) time period within which the approval shall be exercised and the proposed use brought into existence, failing which, the approval shall lapse and be void; d) guarantees as to compliance with the terms of the approval, including the posting of bond; -2- e) compliance with requirements of other departments of the : City/County Government. ENVIRONMENTAL REVIEW: Categorically exempt NOTIFICATION: Public Notice of the September 3 , 1985 , hearing I as. published in the Tri-Valley Herald, mailed to adjacent property owners, and posted in public buildings ANALYSIS: The principle concern City Staff has regarding the proposed use of attendant controlled parking revolves around the potential to have entering cars back up behind the attendant booths into the public right-of-way for Golden Gate Drive : Of secondary concern is the apparent conflict between use of controlled parking and stated intent of the City' s parking ordinance .(see "Applicable Regulations) . While use of the attendant controlled parking lot would provide the property owner an extra benefit to pass on to perspective tenants, the potential for adverse impacts being created for surrounding property owners and the general public work jointly to make the request unreasonable. If the Commission sees merit in the proposal, Staff recommends that the matter be continued to allow Staff time to formalize possible site plan layout changes to minimize potential impacts related to use of attendant controlled parking. RECOMMENDATION FORMAT: 1 ) Open public hearing and hear staff presentation 2 ) Take testimony from applicant and the public 3 ) Question staff, applicant and the public 4 ) Close public hearing and deliberate 5 ) Adopt Resolution regarding the Conditional Use Permit/Site Development Review Modification or continue to allow applicant and/or Staff to supply supplemental information-. ACTION: Staff recommends the Planning Commission adopt the attached Resolution ( Exhibit A) denying Conditional Use Permit/Site Devemopment Review Modification Application PA 85-060 . If the Commission Fees merit in the request, Staff recommends the Commission continue the item to the meeting of September 16 , 1985 , and direct Staff to prepare a draft resolution providing for the approval of the request. WHEREAS, Hagman Associates/Great Western Savings request approval of a Conditional Use Permit and Site Development - Review Modification to allow development and operation of attendant controlled parking lot for access to the 230 space parking lot under development in conjunction with the Great Western Savings office complex project (PA 84-028 ) located at the southwest corner of the intersection of Dublin Blvd. and Golden Gate Drive, more specifically identified as APN 941-1500-15-24 ; and WHEREAS, the proposal to develop and operate an attendant controlled parking lot is not specifically listed as either an allowed or as a conditional use in the subject property' s Zoning district classification (C-2 District) ; and WHEREAS, the adopted City of Dublin Zoning Ordinance outlines the procedure used to consider a District classification of a use not listed in any part of the Ordinance ; and WHEREAS, the adopted City of Dublin Zoning Ordinance further outlines the process to allow consideration of amendment of the plans approved by the Site Development Review process ; and WHEREAS, the Planning Commission did hold a public hearing on said application on September 3 , 1985 ; and WHEREAS, proper notice of said public hearing was given in all respects as required by law; and WHEREAS, this application has been reviewed in accordance with the provisions of the California Environmental Quality Act and has been found to be categorically exempt ; and WHEREAS, the Planning Commission finds that the Conditional Use Permit/Site Development Review Modification will not have a significant environmental impact; and WHEREAS, the Staff Report was submitted recommending that the Conditional Use Permit/Site Development Review Modification application be denied; and WHEREAS, the Planning Commission did hear and consider all said reports, recommendations and testimony herein above setforth; and NOW THEREFORE, BE IT RESOLVED THAT THE Planning Commission does hereby find that; 1 ) The use of attendant controlled parking at the Great Western Savings office complex will not be properly related to other adjoining land uses in the vicinity of the subject property due to the potential to shift excess project parking to the public streets ; I U Y i 2 ) The requested use may be detrimental to the public welfare, more specifically stated, the use may be detrimental to the functioning of neighboring commercial uses, and in the long run adversely impact the economic vitality of the community at large, by adversely impacting traffic movement along Golden Gate Drive as a result of traffic back-ups extending behind the attendant controlled , parking booths out into the public , right-of-way for Golden Gate Drive;. 3 ) The requested use will be contrary to the requirements and intent of the City' s Parking Ordinance, more specifically stated, the requested use would be inconsistent with Sections 8-48 .0 , 8- 63 . 1 and 8-63 . 2 of the Zoning Ordinance which establish that the maintenance of on-site parking is an obligation of the property owner to assure that off-street parking be provided for use of tenants of the premises, and for clients, customers, employees and callers , with accessibility being provided for these parties on a continuous basis.
