Estimated cost DESCRIPTION : Mr. Dale Schuett, 7408 Stagecoach Road, delivered a petition signed by residents of Stagecoach Road to the City Offices. Mr. Schuett requested to be placed on the next available City Council agenda. The petition requests that the City close Stagecoach Road at its previous northern termination until the following conditions are met: l) The Dublin Police Department is given clear authority to issue traffic citations on Stagecoach Road. 2) 3) The City of Dublin offers its final acceptance of the original improvements made to Stagecoach Road by Landstock, Inc. The repairs made necessary by construction traffic traveling to and from the Amador Lakes project are completed. 4) The widening and other improvements to be made to Stagecoach Road by Rafanelli & Nahas are completed. 5) Twenty five miles per hour speed limit signs are posted conspicuously along Stagecoach Road. The residents also requested that until the conditions are met, that signs referring to the Amador Lakes project be removed and "not a through street" or "no outlet" signs be posted at the southernmost extension of Stagecoach Road. This petition stems from excessive speeding problems which are being experienced by existing residents along Stagecoach Road. The inability of the City Police Department to enforce traffic regulations on Stagecoach Road stems from the following problems: 1) The public improvements associated with old Stagecoach Road have never been accepted as public improvements. The City has never accepted these improvements because of soil problems and deficiencies which residents of old Stagecoach Road have experienced after the construcvion of their homes. The City Engineer has indicated that the City should not accept these improvements until these soil problems and deficiencies are resolved by the original developer of the homes along Stagecoach Road. 2) The newer portion of Stagecoach Road which is presently under con- struction has not been completed. The City cannot accept the newer portion of Stagecoach Road until all of the public improvements associated with Tract 4719 and Amador~kes are completed. / ITEM NO. COPIES TO' Ron Nahas AGENDA STATEMENT: Page 2 PUBLIC HEARING - Stagecoach Road-Regulation of Vehicular Traffic Since neither portion of Stagecoach Road has been accepted by the City, Stagecoach Road is not a legal public street. Therefore, the Police Department at present does not have the authority to issue traffic citations on either portion of Stagecoach Road. Staff and the Developers, Rafanelli & Nahas agree with the residents that this creates an undesirable situation from a traffic safety standpoint. Staff has met with the Developer to discuss possible solutions to the problems being experienced by the residents along Stagecoach Road. As a result of that meeting, the City Manager, Assistant City Attorney, Police Chief and the Developer agree that the City should pursue Section 21107.5 of the California Vehicle Code which permits traffic enforcement on private roadways when the following specific findings are made: 1) 2) The roadway is generally open for public use. The subject street connects with highways such that it cannot be distinguished from a public road. In order to make these findings, the City must hold a public hearing to receive testimony and determine whether the California Vehicle Code provisions can be applied to Stagecoach Road between Amador Valley Boulevard and the northern City limit. It is the position of Staff that both of the required findings can be met and recommends that the City Council adopt the attached resolution which provides for traffic enforcement on Stagecoach Road. If the City Council adopts this resolution, the Police can enforce a 25 mph prima facie speed limit on the older portion of Stagecoach Road because it is considered as a residential district as defined by the California Vehicle Code. The newer portion of Stagecoach Road would have a speed limit of 55 mph because it cannot be considered a residential district as defined by the California Vehicle Code and therefore, the 25 mph prima facie speed limit could not apply. However, Section 22362 of the California Vehicle Code does provide that the City could enforce a 25 mph speed limit in a construction zone. Since work is still being done with respect to the improvements within Tract ~719 and Amador Lakes, 25 mph construction zone signs could be posted at a distance of ~00' from either end of the construction zone and that speed limit could be enforced by the Police Department. The construction zone cannot consist of the entire project, but only that portion which actual work is being done on public improvements. In both cases, the Police would only be able to enforce the speed limit by pacing vehicles. It is/therefore further recommended that the City Council authorize the City Traffic Engineer to conduct a speed survey on Stagecoach Road in order that radar could be used by the Police in the future. Staff would not recommend that the City close off the newer portion of Stagecoach Road until all the public improvements and repairs within the two projects are completed. As you are aware, a portion of the Amador Lakes condominium development is presently occupied. Closing Stagecoach Road off would create a greater inconvenience to provide emergency services to the Amador Lakes development and would also necessitate Dublin residents within the Amador Lakes projects to travel into San Ramon in order to access shopping, libraries and other services within the City of Dublin. Staff and the Developer will be meeting with the residents of Stagecoach Road in City Offices at 7:30 p.m., Thursday evening, to present these potential solutions to the residents in more detail. S I GNATURE NAME ADDRESS DATE RESOLUTION NO. - 85 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN REGULATING VEHICULAR TRAFFIC ON STAGECOACH ROAD PURSUANT TO SECTION 21107.5 OF THE CALIFORNIA VEHICLE CODE WHEREAS, 10 days written notice was given to the owners of Stagecoach Road north from Amador Valley Boulevard to the Contra Costa County line that a hearing would be held to consider declaring that said portion of Stagecoach Road is generally open to the public and so connects with Amador Valley Boulevard that the public cannot determine that said portion of Stagecoach Road is not a highway; and WHEREAS, on May 13, 1985, the City Council held a public hearing and took testimony from interested persons on said issue. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin hereby finds and declares that Stagecoach Road north from Amador Valley Boulevard to Contra Costa County line, a private road, is generally held open for use of the public for purposes of vehicular travel, and so connects with said Amador Valley Boulevard that the public cannot determine that said portion of Stagecoach Road is not a highway. BE IT FURTHER RESOLVED that the City Council finds that the owner(s) of said portion of Stagecoach Road have not erected any signs on said portion of Stagecoach Road to the effect that the road is privately owned and maintained and that it is not subject to public traffic regulations or control. BE IT FURTHER RESOLVED that this resolution is adopted pursuant to California Vehicle Code Section 21107.5 for the purposes of making the provisions of the California Vehicle Code applicable to such portions of Stagecoach Road. STAGECOACH ROAD - REGULATION OF VEHICULAR TRAFFIC At the regular City Council meeting on Monday, May 13, 1985, the City Council will conduct a public hearing. The' meeting will begin at 7:30 p.m. at the Dublin Library, 7606 Amador Valley Boulevard- The purpose of the public hearing is to receive testimony related to the application of California Vehicle Code, Section 21107.5 to Stagecoach Road in the City of Dublin. The section of roadway considered is Stagecoach Road from ~mador Valley Boulevard to the northern city limit. The public hearing focuses on two issues which must be determined to apply California Vehicle Code requirements to a private roadway: 1) .Whether the roadway is generally open for public use; and 2) Whether the subject street connects with highways such that it cannot be distinguished from a public road. Section 21107.5 allows for the application of the California Vehicle Code to private roadways when specific findings are made.
